    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 14&amp;nbsp;de noviembre de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para las Inversiones&amp;nbsp;en la Transformación y la comercialización de productos agrícolas, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 23&amp;nbsp;de marzo&amp;nbsp;de 2022, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Analizada toda la documentación presentada, con&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;02/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, el vicepresidente del FOGAIBA dictó Resolución de concesión de la ayuda, a cargo de la anualidad 20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1, a favor del interesado por un importe de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;52&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;739,20€, cofinanciados en un 53,00% por el FEADER, 14,1% la AGE, y 32,9% la CAIB, distribuidos de la siguiente manera:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;·&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;27&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;951&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;78€ con cargo a la línea FEADER núm. 050460010441104&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;·&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;17.351,19&amp;nbsp;€ con cargo a la CAIB&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;·&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7.436,23€ con cargo a la AGE&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Dada la mencionada&amp;nbsp;Resolución de concesión de la ayuda, y de acuerdo con lo establecido en el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otras, a realizar las actuaciones auxiliadas dentro del plazo establecido ya justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y los plazos determinados en la convocatoria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. El plazo para presentar la solicitud de pago terminaba el &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;05/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/202&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. Con fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;01/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/202&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&amp;nbsp;se le requiere al interesado que presente la solicitud de pago con la documentación exigida y se le da un plazo de 15 días hábiles.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. A día de hoy no ha presentado ninguna documentación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13 de noviembre de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en la transformación y la comercialización de productos agrícolas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Reial Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014 a 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. Ley 39/2015, de régimen jurídico de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Conclusión &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo lo expuesto anteriormente, se considera que la no ejecución del proyecto con los términos y en los plazos establecidos en la normativa, implica la posibilidad de revocar la ayuda otorgada a HIJOS DE ESTEBAN MONTIEL SL, mediante la Resolución de concesión de la subvención de fecha 02/09/2020, por incumplimiento de los compromisos adquiridos y por tanto el no reconocimiento de la liquidación y la tramitación del pago o el reintegro de la ayuda ya recibida en su caso. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;En virtud de lo que precede, dado el Decreto 64/2005, de 10 de junio, de creación del FOGAIBA; en virtud de la Orden de la consell&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;era de Agricultura y Pesca de 23 de diciembre de 2005 donde se dispone que el FOGAIBA asume la ejecución de la política de la Conse&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;llería de Agricultura y Pesca en lo referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero a partir de 1 de enero de 2006. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se concluye que no se puede tramitar el pago de la ayuda puesto que el interesado ha incumplido la normativa de aplicación por no justificar correctamente el pago de la inversión aprobada de acuerdo con los términos y plazos establecidos en la convocatoria; por este motivo procede REVOCAR la ayuda concedida en la Resolución de día 02/09/2020 &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y proposo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Proceder a la revocación total de la resolución de ayuda concedida a HIJOS DE ESTEBAN MONTIEL SL con NIF: B07916927, mediante Resolución de concesión del vicepresidente del FOGAIBA de día 02/09/2020, la cual concedía al interesado una ayuda por importe de 52.739,2 €. El motivo de la revocación es por no haber justificado el pago de la inversión aprobada de acuerdo con los términos y plazos establecidos en la convocatoria. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.El importe de la ayuda a revocar está cofinanciado por el FEADER en un 53,00% por el FEADER, 14,1% la AGE, y 32,9% la CAIB, distribuidos de la siguiente manera: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;·&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;27.951,78 € con cargo a la línea FEADER núm. 050460010441104 &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;·&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;17.351,19 € con cargo a la CAIB &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;·&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;7.436,23 € con cargo a la AGE &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.En consecuencia, dejar sin efecto la mencionada resolución de concesión de la ayuda y proceder al archivo de las actuaciones del expediente ITC 2019/022.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;​​​​​​​&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;​​​​​​​&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Contra esta Resolución se podrá interponer recurso de alzada ante el conseller de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con lo establece en el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y los artículos 121 y 122, de la Ley 39/2015 del procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
