    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;Dado que al punto 4t del acuerdo del Consejo Ejecutivo del Consejo de Mallorca, relativa a la cesión de tramos de las vías Ma-3440A, Ma-3511, Vías de servicios A, B y C por parte del Consejo de Mallorca y cesión del tramo de Camí des Dau por parte del Ayuntamiento de Llubí, se ordena la publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt; a los efectos de su general conocimiento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Con el fin de dar cumplimiento a esta previsión, visto que día 3 de marzo de 2022 se formalizó el convenio mediante la firma del consejero ejecutivo del Departamento de Movilidad e Infraestructuras del Consejo de Mallorca y de la alcaldesa-presidenta del Ayuntamiento de Llubí, se procede a su publicación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;“CONVENIO DE COLABORACIÓN EN MATERIA DE CARRETERAS ENTRE EL AYUNTAMIENTO DE LLUBÍ Y EL CONSEJO DE MALLORCA EN RELACIÓN A LA CESIÓN DE TRAMOS DE LAS VÍAS MA-3440A, MA-3511, VÍAS DE SERVICIOS A, B I C POR PARTE DEL CONSEJO DE MALLORCA Y CESIÓN DEL TRAMO DE CAMINO DESDE DADO POR PARTE DEL AYUNTAMIENTO DE LLUBÍ&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

Sr. Iván Sevillano Miguel, consejero ejecutivo de Movilidad e Infraestructuras, de acuerdo con el vigente Decreto de organización del Consejo Insular de Mallorca de 9 de diciembre de 2019, modificado por los decretos de día 6 de marzo de 2020, de día 22 de mayo de 2020, 9 de julio de 2020 y 26 de enero de 2021 (BOIB nº. 167, de día 12 de diciembre de 2019, BOIB nº. 29, de día 7 de marzo de 2020, BOIB nº. 95, de día 28 de mayo de 2020, BOIB nº. 131de 25 de julio de 2020 y BOIB nº. 12, de 28 de enero de 2021 respectivamente)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Magdalena Perelló Frontera, batlesa-presidenta del Ayuntamiento de Llubí, con NIF. &lt;/span&gt;&lt;span style="background-color:white; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;P0703000J, &lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;por acuerdo de Lleno de 15 de junio de 2019, en virtud de las facultades que le atribuye el artículo 21 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local, con domicilio en la calle de Sant Feliu nº. 13, CP 07430 de Llubí&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Las partes nos reconocemos mutuamente la capacidad legal necesaria para formalizar este convenio y exponemos los siguientes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;ANTECEDENTES&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;I.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; En fecha 16 de agosto de 2021, número 32897 del registro general del Consejo de Mallorca, el Ayuntamiento de Llubí dirigió escrito a esta administración insular mediante el cual exponía que estaba interesado en suscribir un convenio en materia de carreteras con respecto a la cesión de varios tramos de vías del Consejo de Mallorca y la permuta de un tramo del Camino Desde Dado de titularidad municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;II.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Es voluntad del Consejo de Mallorca y del Departamento de Movilidad e Infraestructuras, de llevar a cabo un refuerzo del firme de la calzada y en relación a la superficie objeto de cesión de la vía Ma-3440A.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;III. &lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por otra parte, en la actualidad el Ayuntamiento de Llubí ha iniciado las obras consistentes en la implantación de una red de pluviales en la vía Ma-3440A con el correspondiente restablecimiento y refuerzo del firme de la calzada, dada la urgente necesidad de estas obras y a los efectos de una mayor eficiencia en el gasto público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;IV.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; En fecha 19 de noviembre de 2021el servicio de Explotación y Conservación de la Dirección Insular de Infraestructuras del Consejo de Mallorca emitió informe técnico en relación en el convenio interesado, cuyo tenor literal es el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;em&gt;​​​​​​​&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;em&gt;"INFORME TÉCNICO&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;em&gt;En fecha 16 de agosto de 2021 (riego. de entrada 32897/2021) el ayuntamiento de Llubí solicita asumir la carretera Ma-3440A y los viales de servicio de la variante. No obstante, creo oportuno que en el convenio de cesión se incluya la permuta de titularidad del tramo de la Ma-3511, entre los pk 5,365 y 5,900 (actualmente del Consejo de Mallorca) con el tramo del camino desde Dau grafiat en color verde en el plano adjunto. El motivo de esta propuesta responde en que desde la ejecución de la variante la conexión vial entre Sineu y Llubí es a través del camino desde Dau (de titularidad municipal).&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;em&gt;Los tramos objeto de cesión a la corporación municipal de Llubí atraviesan suelo urbano o soportan un tráfico eminentemente local. En consecuencia, entendemos más eficaz la gestión municipal de las vías, a fin de que se simplificará la tramitación de los expedientes vinculados a autorizaciones de obras de los vecindarios y a la explotación de las vías. La única vía que pierde la conectividad es la Ma-3440A, no obstante no es de aplicación el artículo 5.1 de la ley 5/1990 de Carreteres a fin de que la vía no forma parte de la red principal.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;em&gt;Tramos objeto de cesión en el Ayuntamiento:&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;El coste estimado de las obras de refuerzo del firme de la Ma-3440A solicitado por el Ayuntamiento de Llubí es de 164.252,47 € (IVA incluido)&lt;strong&gt;&lt;em&gt; “&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;V.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; El contenido del presente convenio fue aprobado por acuerdo de día 23 de febrero de 2022 del Consejo Ejecutivo del Consejo de Mallorca y por acuerdo de día 17 de enero de 2022 del Pleno del Ayuntamiento de Llubí.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por lo tanto, en este convenio se tienen que contemplar los compromisos entre las partes y establecer las contraprestaciones correspondientes a las siguientes,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;CLÁUSULAS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;PRIMERA. OBJETO DEL CONVENIO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;El objeto del convenio es articular la colaboración entre el Consejo de Mallorca y el Ayuntamiento de Llubí, por la cual las Administraciones intervinientes cederán los tramos de las vías Ma-3440A, Ma-3511, Vía de servicio A, Vía de servicio B y Vía de servicio C y el tramo del Camino desde Dado, respectivamente, en la configuración que se detalla en la cláusula tercera. Asimismo establecer el compromiso del Consejo en relación al refuerzo de firme de la Ma-3440A y por lo que hace la superficie objeto de cesión y, en este sentido, determinar de común acuerdo los ajustes precisos para compensar su financiación que, por las circunstancias expresades al antecedente tercero, llevará a cabo el propio ayuntamiento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;SEGUNDA. ÁMBITO DE ACTUACIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;El ámbito de actuación son las infraestructuras con la configuración y detalle que se relacionan en el antecedente cuarto de este documento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;TERCERA. DESARROLLO DE LOS OBJETIVOS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Las partes mediante el presente convenio acuerdan, los derechos y las obligaciones que cada una de ellas asumen.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Por parte del Consejo de Mallorca&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;El Consejo de Mallorca cede al Ayuntamiento de Llubí, la titularidad de los siguientes tramos de las vías que a continuación se detallan y que pasarán a integrarse en la red local a todos los efectos, con todas las competencias y deberes que comporta.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Finalizar las obras relativas a la red de pluviales que se están ejecutando en la vía Ma-3440A, licitar y adjudicar el contrato de obra relativa al refuerzo de firme de la calzada de esta vía desde el pk inicial 7,645 en el pk final 9,462, con cargo a los presupuestos municipales, así como comunicar al Consejo de Mallorca, el importe final de adjudicación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Se anexan planos del tramos objeto de las cesiones y que forman parte de este convenio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;CUARTA. COMPROMISO DEL CONSEJO DE MALLORCA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;El Consejo de Mallorca, se compromete, en el plazo de vigencia de este convenio, a incluir en el respectivo presupuesto general de la entidad una subvención nominativa de las previstas en el arte. 17.3 de la Ordenanza general de subvenciones del Consejo de Mallorca, a favor del Ayuntamiento de Llubí, a efectos de compensar los gastos que haya llevado a cabo directamente el ayuntamiento con respecto al refuerzo de firme de la vía Ma-3440A, entre el pk inicial 7,645 y pk final 9,462.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;En este sentido, dada la actual volatilidad de los precios, tanto de la construcción en general como de la obra pública, el importe de la subvención habrá de comtemplar, partiendo de la valoración estimada por el Servicio de Explotación y Conservación por un importe de 164.252,47 €, el importe final de adjudicación del contrato de obra.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Esta subvención se regirá por el convenio que la regule, por Ordenanza general de subvenciones del Consejo de Mallorca (aprobada por Acuerdo de Pleno de 23 de diciembre de 2016, BOIB nº. 21, de 18 de febrero de 2017), modificada por Acuerdo de Pleno de 14 de junio de 2018 (BOIB nº. 96, de 4 de agosto de 2018); la Ley 38/2003, de 17 de noviembre, general de subvenciones; el Real decreto 887/2006, de 21 de julio, que aprueba el Reglamento de la Ley 38/2003 general de subvenciones; la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas; la Ley 40/2015, de 1 de octubre, del régimen jurídico del sector público; la Ley 8/2000, de 27 de octubre, de consejos insulares; el Reglamento Orgánico de la Corporación (aprobado por Acuerdo del Pleno de 12 de abril de 2018. BOIB nº. 89, de 19 de julio); el vigente Decreto de organización del Consejo Insular de Mallorca de 9 de diciembre de 2019, modificado por los decretos de día 6 de marzo de 2020, de día 22 de mayo de 2020, 9 de julio de 2020 y 26 de enero de 2021 (BOIB nº. 167, de día 12 de diciembre de 2019, BOIB nº. 29, de día 7 de marzo de 2020, BOIB nº. 95, de día 28 de mayo de 2020, BOIB nº. 131de 25 de julio de 2020 y BOIB nº. 12, de 28 de enero de 2021 respectivamente); la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres (BOE nº. 202, de 22.08.2016); y el resto de la normativa que sea de aplicación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;QUINTA. GESTIÓN DEL CONVENIO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Con la finalidad de tratar todas las aquellas cuestiones que se puedan derivar del presente convenio y proponer, si procede, el caso y las medidas a adoptar en los órganos competentes, se podrá constituir una comisión de seguimiento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;SEXTA. APROBACIÓN Y ENTRADA EN VIGOR DEL CONVENIO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Una vez firmado por ambas partes y se publique en el &lt;em&gt;Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;SÉPTIMA. VIGENCIA Y DURACIÓN DEL CONVENIO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;El convenio tendrá una duración máxima de dos (2) años, de acuerdo en el artículo 49 h) de la LRJSP 40/2015.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;La duración se contabilizará a partir de la entrada en vigor del Convenio.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;En cuanto a posibles ampliaciones o prórrogas del Convenio que se puedan acordar, estará en todo caso al procedimiento dispuesto al artículo 49 apartado h) de la LRJSP 40/2015.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;OCTAVA. MODIFICACIONES DEL CONVENIO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;La modificación del Convenio se atenderá al procedimiento y requisitos establecidos para la LRJSP 40/2015.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Las modificaciones se tratarán previamente entre las partes o en la Comisión de Seguimiento, en su caso, la cual elevará la propuesta a las partes para su aprobación si procede.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Las modificaciones tendrán que ser acordadas de forma unánime por las partes intervinientes en el Convenio, atendiendo en el artículo 49 g) de la LRJSP 40/2015, y para su tramitación se habrá incluir el contenido mínimo que establece el artículo 49.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;NOVENA. EXTINCIÓN Y RESOLUCIÓN DEL CONVENIO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;El convenio se resolverá una vez finalizado su plazo de vigencia o, en su caso, a la finalización de las eventuales ampliaciones o prórrogas que se puedan acordar.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Serán causas de resolución las contempladas en el artículo 51.2 de la Ley 40/2015 (LRJSP); es decir, el incumplimiento de las obligaciones y compromisos por alguna de las partes, el acuerdo unánime entre estas, la decisión judicial que declare nulo el convenio o por cualquier otra causa prevista en el convenio o a las leyes correspondientes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;En cuanto a los efectos de una resolución anticipada, se tendrá que tener en cuenta el indicado al artículo 52 de la Ley 40/2015 LRJSP y proceder a la correspondiente liquidación de la aportación de ambas partes en función de las tareas y funciones que se hayan desarrollado. En este supuesto será imprescindible la propuesta, con su informe adjunto, de la Comisión de Seguimiento, en su caso, definida a la cláusula quinta.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;DECENA. NATURALEZA JURÍDICA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;El presente convenio tiene la naturaleza administrativa prevista en el artículo 47.2 a de la LRJSP, dentro del Capítulo VI de su Título Preliminar, que contempla el régimen jurídico completo de los convenios y recoge definición, tipo, contenido, etc... y cuántos elementos se consideran necesarios para su aprobación, suscripción y validez&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;En caso de litigio entre las partes, las cuestiones en controversia serán sometidas a la jurisdicción contenciosa administrativa, de conformidad con lo que se prevé en el artículo 44 de la Ley 29/1998, de 13 de julio, de la Jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;No obstante el anterior, las controversias que puedan plantearse sobre la interpretación, ejecución o desarrollo de este convenio se dirimirán, con carácter previo, a la Comisión de Seguimiento, en su caso.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Y para dejar constancia, se extiende el presente documento en dos ejemplares en el lugar y fecha indicados al encabezamiento del presente documento.”&lt;/span&gt;&lt;/p&gt;
