&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El Consejo Ejecutivo del Consejo de Mallorca, en sesión que ha tenido lugar el día 16 de marzo de 2022, ha aprobado el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&amp;lt;&amp;lt;&lt;strong&gt;Primero.&lt;/strong&gt; Aprobar la convocatoria que se adjunta de subvenciones 2022-2023 para llevar a cabo acciones incluidas en el Plan de Acción para la energía Sostenible y el Clima (PAESC) para alcanzar los objetivos 2030 previstos por el Pacto de Alcaldías de Mallorca.&lt;/span&gt;&lt;span style="line-height:1"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Autorizar un gasto por un importe total de siete millones de euros (7.000.000,00 €), tres millones quinientos mil euros (3.500.000,00 €) con cargo al presupuesto de 2022 y otros tres millones quinientos mil euros (3.500.000,00 €) con cargo al presupuesto de 2023. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Del gasto total de 2022, dos millones ochocientos mil euros (2.800.000,00 €) con cargo a la aplicación presupuestaria 65.94310.76205, RC nº. operación 220220000413, quinientos mil euros (500.000,00 €) con cargo a la aplicación presupuestaria 65.94310.46202, RC nº. operación 220220000414, cien mil euros (100.000,00 €) con cargo a la aplicación presupuestaria 65.94310.76211, RC nº. operación 220220000415 y otros cien mil euros (100.000,00 €) con cargo a la aplicación presupuestaria 65.94310.76212, RC nº. operación 220220000416 del presupuesto de gastos del Consejo de Mallorca para el ejercicio 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Del gasto total de 2023, tres millones de euros (3.000.000,00 €) con cargo a la aplicación presupuestaria 65.94310.76205, RC nº. operación 220229000034, y quinientos mil euros (500.000,00 €) con cargo a la aplicación presupuestaria 65.94310.46202, RC nº. operación 220229000033, del presupuesto de gastos del Consejo de Mallorca para el eejercicio 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;No obstante lo anterior, al tratarse de una convocatoria de gasto plurianual, el gasto correspondiente al ejercicio 2023 queda sometido a la existencia de crédito adecuado y suficiente para su financiación. &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Tercero. &lt;/strong&gt;Autorizar al consejero de Promoción Económica y Desarrollo Local a firmar los convenios, de acuerdo con el modelo que figura como Anexo 0 de la convocatoria, con todos y cada uno de los ayuntamientos beneficiarios de las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Cuarto.&lt;/strong&gt; Aprobar los modelos normalizados siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Modelo de convenio a suscribirse con cada entidad local beneficiaria de las subvenciones (Anexo 0).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Solicitud de la subvención (Anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Declaración responsable de no incurrir en prohibiciones para ser beneficiario de subvenciones (Anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Declaración responsable de encontrarse al corriente en el cumplimiento&lt;span style="display:none"&gt; de las &lt;/span&gt;obligaciones tributarias con el Estado y el Consejo de Mallorca y con la Seguridad Social (Anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Declaración responsable de no encontrarse en la situación prevista en el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres (Anexo IV).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Certificado del secretario/a en fase de justificación de gastos (Anexo V).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Informe del interventor/a en fase de justificación de gastos (Anexo VI). &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Quinto. &lt;/strong&gt;Publicar esta convocatoria en el Boletín Oficial de las Islas Baleares (BOIB) y a la Base de Datos Nacional de Subvenciones (BDNS).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;De conformidad con el artículo 44 en relación con el 46.6 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contenciosa Administrativa, contra este acuerdo no se podrá interponer recurso en vía administrativa, si bien se podrá formular potestativamente REQUERIMIENTO para su anulación o revocación en el plazo de dos meses contadores desde el día que se publique en el Boletín Oficial de las Islas Baleares con carácter previo a la interposición de recurso contencioso administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El requerimiento se entenderá desestimado si en el plazo de un mes desde su presentación no se notifica resolución expresa. El plazo para interponer el recurso contencioso administrativo será de dos meses contadores desde el día siguiente en aquel en el cual se reciba comunicación de la resolución expresa sobre el requerimiento previo o este se entienda desestimado de forma presunta. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Si no se formula requerimiento previo, se podrá interponer directamente recurso contencioso administrativo en el plazo de dos meses contadores desde el día de la publicación del acuerdo en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;No obstante lo anterior, se puede interponer, si es el caso, cualquier otro recurso que se estime pertinente.&amp;gt;&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Convocatoria de subvenciones 2022-2023 para llevar a cabo acciones incluidas en el Plan de Acción para la Energía Sostenible y el Clima (PAESC) para alcanzar los objetivos 2030 previstos para el Pacto de las Alcaldías.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;1. Objeto y finalidad &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Esta convocatoria se hace en el marco de la Ordenanza general de subvenciones del Consejo de Mallorca (BOIB nº. 21, de 18 de febrero de 2017, y nº. 96, de 4 de agosto de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La finalidad de esta convocatoria es otorgar subvenciones a los ayuntamientos de Mallorca para llevar a cabo actuaciones relativas al Pacto de las Alcaldías para el Clima y la Energía de Mallorca. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;2. Beneficiarios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2.1. Pueden ser beneficiarios de esta convocatoria de subvenciones todos los ayuntamientos de Mallorca que cumplan los requisitos siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Estar adherido formalmente en el Pacto de las Alcaldías para el Clima y la Energía/Pacto de las Alcaldías para el Clima y la Energía (2030), aprobado por la Comisión Europea el 15 de octubre de 2015, antes de la solicitud de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Tener nombrado un gestor energético municipal. El gestor energético puede pertenecer a la mancomunidad del territorio del municipio. Las funciones mínimas del gestor energético municipal están definidas en el punto 7 de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Disponer, a la fecha de solicitud de la subvención, del PASC (Plan de Acción para la Energía Sostenible y el Clima) aprobado por el Pleno de la corporación municipal, registrado y enviado a la Oficina del Pacto de la Unión Europea en el sitio web &lt;em&gt;www.pactodelasalcaldias.eu&lt;/em&gt;, según los procedimientos establecidos por esta oficina, o estar en proceso de redacción del PAESC. En este último caso, en el momento de la justificación de la subvención, se tiene que acreditar la aprobación del PAESC por el Pleno de la corporación municipal y el envío de esta aprobación en la Oficina del Pacto de la Unión Europea en el sitio web &lt;em&gt;www.pactodelasalcaldias.eu&lt;/em&gt;, según los procedimientos establecidos por esta oficina.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2.2. No pueden acogerse a esta convocatoria los ayuntamientos de Mallorca en los cuales concurra alguna de las prohibiciones establecidas en el artículo 8 de la Ordenanza general de subvenciones del Consejo de Mallorca (BOIB nº. 21, de 18 de febrero de 2017, y nº. 96, de 4 de agosto de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;3. Acciones subvencionables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las acciones que se pueden financiar con las subvenciones de esta convocatoria son las necesarias para alcanzar los objetivos 2030 establecidos por el Pacto de las Batlies:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Reducción de un 40% de las emisiones de CO&lt;sub&gt;2&lt;/sub&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Implantación del 27% de energías renovables. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Mejora del 27% de la eficiencia energética.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Acciones de adaptación al cambio climático.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Estas acciones se pueden clasificar como acciones genéricas (tipo A) y acciones de inversión (tipo B).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las acciones genéricas (tipo A) subvencionables son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;I. Honorarios de redacción de proyectos, memorias o estudios, a cuyo objeto ayude a conseguir los objetivos marcados hasta un máximo, subvencionable de 4.000,00 € por actuación y hasta un máximo subvencionable de 12.000,00 € por ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;II. Plan de residuos, contra incendios, de la calidad del aire, etc. hasta un máximo subvencionable de 4.000,00 € por plan y un máximo subvencionable de 12.000,00 € por ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;III. Plan de movilidad urbana sostenible (PMUS) hasta un máximo subvencionable de 5.886,79 € por ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;IV. Campañas de sensibilización hasta un máximo subvencionable de 1.000,00 € más 2,00 €/habitante por campaña y hasta un máximo subvencionable de 12.000,00 € por ayuntamiento. El número de habitantes del municipio según los datos de la población publicados por el Instituto Nacional de Estadística a 1 de enero de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;V. Sistema de gestión y contabilidad energética hasta un máximo subvencionable de 50,00 €/CUP y año.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;VI. Auditorías energéticas hasta un máximo subvencionable de 2.000,00 € por auditoría y hasta un máximo subvencionable de 6.000,00 € por ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;VII. Informe de seguimiento de acciones del PAESC, hasta un máximo subvencionable de 1.500,00 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;VIII. Informe de seguimiento del inventario de emisiones de referencia (IRE) del PAESC, hasta un máximo subvencionable de 1.500,00 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las acciones de inversión (tipo B) subvencionables son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;I. Mejora de la eficiencia energética del alumbrado:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;1. Alumbrado público o de la iluminación exterior (iluminación de fuentes, fachadas de edificios, monumentos, etc.) hasta un máximo subvencionable de 30,00 €/W instalado. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las actuaciones propuestas han de:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:80px"&gt;
	&lt;li&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="line-height:1"&gt;Tener una calificación mínima de eficiencia energética B y cumplir las prescripciones del Real decreto 1890/2008, de 14 de noviembre, por el cual se aprueba el Reglamento de eficiencia energética en instalaciones de alumbrado exterior y sus instrucciones técnicas complementarias EA-01 en EA-07.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Reducir las emisiones de CO&lt;sub&gt;2&lt;/sub&gt; en, al menos, un 30% con respecto a la situación actual. El porcentaje destinado a obra civil no puede superar el 50% de la actuación.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;No son subvencionables las actuaciones para la renovación de equipos de iluminación exterior para vigilancia y seguridad nocturna, señales y anuncios luminosos e iluminación festiva, así como cualquier otra que tenga carácter temporal. Ni las actuaciones consistentes en la sustitución directa de luces por sistemas LED &lt;em&gt;Retrofit&lt;/em&gt; que mantengan la luminaria original.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Alumbrado interior de edificios o instalaciones municipales hasta un máximo subvencionable de 20,00 €/W instalado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las actuaciones propuestas tienen que reducir las emisiones de CO&lt;sub&gt;2&lt;/sub&gt; en, al menos, un 30% con respecto a la situación actual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;II. Instalaciones fotovoltaicas de autoconsumo de uso municipal:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1" style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Valor de inversión máxima subvencionable admisible de la instalación fotovoltaica de autoconsumo, hasta un máximo de 100 kWp instalados: 1,50 €/Wp instalado. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;III. Mejora de la eficiencia energética en instalaciones de generación de ACS y/o calefacción/refrigeración que supongan, como mínimo, un ahorro de consumo energético de un 30%:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1" style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Bomba de calor o plantas enfriadoras con clasificación energética B, como mínimo, y hasta un máximo subvencionable de 600,00 €/kWt, teniendo en cuenta la potencia nominal térmica.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&amp;nbsp;Calderas de biomasa hasta un máximo subvencionable de 600,00 €/kWt.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;IV. Mejora del envolvente térmico de edificios municipales con el objetivo de reducir la demanda energética en calefacción y climatización de un edificio existente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;V. Instalación de puntos dobles de carga de vehículos eléctricos, hasta un máximo subvencionable de 7.000,00 €/punto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;VI. Sustitución de vehículos municipales de más de 10 años por un vehículo 100% eléctrico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;VII. Mejora de la eficiencia energética en los sistemas de abastecimiento de agua potable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;VIII. Otras acciones de inversión de mitigación o adaptación al cambio climático incluidas en el PAESC. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Los Ayuntamientos que estén interesados en llevar a cabo alguna acción diferente de las descritas en los puntos anteriores, siempre y cuando contribuya a la consecución de los objetivos 2030 del Pacto de las Alcaldías, podrán solicitarla justificando su necesidad, la reducción de emisiones de CO2, los ahorros energéticos previstos y/o otros efectos beneficiosos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Se tienen que presentar por separado cada una de las acciones genéricas o de inversión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Estas acciones tienen que estar bien definidas en la ficha correspondiente dentro del Plan de Acción para la Energía Sostenible y el Clima (PAESC), tener definidos los indicadores de seguimiento, con un objetivo y un presupuesto concreto, no genérico o querido. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En caso de que la acción no esté bien definida en una ficha del PAESC o en caso de no tener el PAESC aprobado, hay que hacer la ficha correspondiente en el momento de la solicitud y se tiene que incluir en las futuras revisiones y/o aprobaciones del PAESC.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;4. Compromisos de los beneficiarios de las acciones subvencionadas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En toda la documentación y actuaciones que se hagan relacionadas con las acciones subvencionadas, se tiene que hacer constar que están financiadas por el Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca y tienen que incluir el logotipo del Consejo de Mallorca y el del Pacto de las Alcaldías de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;5. Gastos subvencionables &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las subvenciones de esta convocatoria se pueden destinar a sufragar gastos comprendidos desde el 1 de enero de 2022 al 31 de diciembre de 2023. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En ningún caso el importe del gasto subvencionable puede ser superior al valor de mercado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;6. Crédito presupuestario&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;A las subvenciones objeto de esta convocatoria se destina la cantidad total de siete millones euros (7.000.000,00 €), tres millones quinientos mil euros (3.500.000,00 €) con cargo al presupuesto de 2022 y tres millones quinientos mil euros (3.500.000,00 €) con cargo al presupuesto de 2023. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Del gasto total de 2022, dos millones ochocientos mil euros (2.800.000,00 €) con cargo a la aplicación presupuestaria 65.94310.76205, RC nº. operación 220220000413, quinientos mil euros (500.000,00 €) con cargo a la aplicación presupuestaria 65.94310.46202, RC nº. operación 220220000414, cien mil euros (100.000,00 €) con cargo a la aplicación presupuestaria 65.94310.76211, RC nº. operación 220220000415 y otros cien mil euros (100.000,00 €) con cargo a la aplicación presupuestaria 65.94310.76212, RC nº. operación 220220000416 del presupuesto de gastos del Consejo de Mallorca para el ejercicio 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Del gasto total de 2023, tres millones de euros (3.000.000,00 €) con cargo a la aplicación presupuestaria&lt;strong&gt; &lt;/strong&gt;65.94310.76205, RC nº. operación 220229000034, y quinientos mil euros (500.000,00 €) con cargo a la aplicación presupuestaria 65.94310.46202, RC nº. operación 220229000033, del presupuesto de gastos del Consejo de Mallorca para el ejercicio 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;7. Funciones mínimas del gestor energético municipal&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las funciones mínimas del gestor energético municipal son:&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Ser el encargado e impulsor principal responsable en su municipio del Pacto de las Alcaldías de Mallorca, y relacionarse con la Oficina del Pacto en Bruselas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Coordinar los departamentos y las áreas relacionadas con el gasto energético y colaborar.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Recoger datos (inventario de potencias y tecnología, centro en centro, consumos mes a mes, aspectos relacionados con el cambio climático...).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Responsabilizarse de la gestión y contabilidad energética municipal. Controlar que los consumos y gastos energéticos sean los correctos y previstos para cada instalación.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Diseñar, junto con otro personal técnico y personal municipal o externo, estrategias de mejora constante, es decir, proponer líneas de actuación para conseguir mejorar la eficiencia de las instalaciones. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Sensibilizar las personas usuarias que hacen uso de las instalaciones y la ciudadanía en general del que se está haciendo y de los objetivos a conseguir.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Hacer el seguimiento, medida y control de las mejoras implantadas, así como de los ahorros.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Hacer el seguimiento y el control de los contratos con empresas de servicios energéticos. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Encargarse de que las empresas que gestionan diferentes instalaciones proporcionen información de los consumos y gastos energéticos. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El gestor energético puede prestar los servicios desde la mancomunidad del territorio al cual pertenece el ayuntamiento. Tiene que ser nombrado por cada uno de los ayuntamientos beneficiarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;s&gt;8&lt;/s&gt;. Naturaleza de la subvención y límites&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;1. Las subvenciones de esta convocatoria son de carácter voluntario y eventual, y anulables, revocables y reintegrables en todo momento por las causas previstas en la Ordenanza general de subvenciones. Además, no generan ningún derecho a obtener otras subvenciones en años posteriores y no se pueden alegar como precedente. Asimismo, son compatibles con otras ayudas y subvenciones que pueda recibir el beneficiario para el mismo proyecto subvencionado, siempre que el cómputo total de las ayudas o subvenciones recibidas no supere el coste de la actividad que la entidad beneficiaria tiene que desarrollar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2. La cuantía de la subvención no puede superar el 100% del importe solicitado subvencionable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;9. Régimen de concesión&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;De acuerdo con el artículo 17 de la Ordenanza general de subvenciones, el régimen de concesión se lleva a cabo mediante el procedimiento de concurrencia no competitiva y, por lo tanto, no es necesario fijar un orden de prelación entre las solicitudes, ya que es suficiente cumplir los requisitos que se establecen en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La determinación de las ayudas entre los ayuntamientos se hace de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En función de la población (según datos del Instituto Nacional de Estadística a 1 de enero de 2021), se establece una subvención máxima por ayuntamiento, además de los límites establecidos para la realización de cada una de las acciones previstas en el punto 3 de esta convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En el caso de solicitar PMUS se incrementará el importe correspondiente por acciones genéricas con 1.886,79 €.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En el caso de solicitar acciones de mejora de eficiencia energética de un edificio de uso municipal se incrementará el importe correspondiente por acciones de inversión con 1.886,79 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La suma de las cantidades que corresponden a los ayuntamientos por acciones genéricas y por acciones de inversión es la subvención total.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El pago de la subvención se hará mediante un anticipo del 100% de la subvención en los años 2022 y 2023 una vez concedida y firmado el convenio de colaboración descrito en el punto 13.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las actuaciones se subvencionan según el orden de preferencia señalado por el presidente o la presidenta de la corporación local en la solicitud de subvención que figura como anexo I de la convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Si la actuación o la suma de todas las actuaciones solicitadas es de importe inferior a la subvención global que resulta para cada ayuntamiento de los criterios determinados en este punto, esta subvención global se reducirá automáticamente al importe de las actuaciones presentadas. En caso de que las actuaciones presentadas sean de importe superior a la subvención que corresponde a cada ayuntamiento según los criterios de este punto, la diferencia irá a cargo del ayuntamiento. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;10. Presentación de solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El plazo para presentar las solicitudes junto con la documentación prevista en el punto siguiente es de dos meses a partir del día siguiente de publicarse el extracto de esta convocatoria en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las instancias se tienen que dirigir a la Presidencia del Consejo de Mallorca, y se tienen que presentar telemáticamente en el registro electrónico general del Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Si la solicitud no reúne los datos de identificación, tanto de la subvención solicitada como de la persona solicitando, o algunos de los requisitos previstos en la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, se requerirá la entidad solicitante, de acuerdo con lo que establece el artículo 73.2 de la ley antes mencionada, &lt;span style="display:none"&gt;para que&lt;/span&gt; en un plazo de diez días hábiles, enmiende la falta o acompañe los documentos preceptivos con indicación que, si no lo hace así, se considerará que desiste de la petición, con una resolución expresa previa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;11. Formalización de solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;1. Las solicitudes se tienen que formalizar mediante el modelo oficial (anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2. A las solicitudes se tiene que adjuntar la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2.1 En caso de modificación del gestor energético municipal, se tiene que aportar la resolución o el acuerdo de nombramiento del nuevo gestor energético.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2.2 Para cada actuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;a) Memoria descriptiva de la acción, firmada por el gestor energético municipal con el visto bueno del alcalde o alcaldesa. Esta memoria descriptiva tiene que incluir, como mínimo, la información siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Copia de la ficha de la acción incluida dentro del PAESC o PAES.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Descripción detallada de la acción a implantar, concretando características como ubicación, alcance, planos, % ahorro de emisiones y de consumos previstos, etc. no especificadas en la ficha de la acción.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Plazo de ejecución de la acción.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Indicación de si la acción es una acción genérica (tipo A) o una acción de inversión (tipo B).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;b) En caso de que la acción requiera un proyecto técnico redactado por personal técnico competente, este se tiene que aportar junto con la memoria descriptiva y se puede presentar en formato digital. En caso de que el técnico redactor o técnica redactora no sea personal técnico municipal, el proyecto técnico tiene que estar visado por el colegio profesional correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;c) Presupuesto detallado de la acción a llevar a cabo, con el IVA desglosado. El presupuesto tiene que estar firmado por el gestor energético municipal con el visto bueno del alcalde o alcaldesa. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2.3 Declaración responsable de no incurrir en prohibiciones para ser beneficiario de subvenciones (anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2.4 Declaración responsable de encontrarse al corriente en el cumplimiento de obligaciones tributarias con el Estado y el Consejo de Mallorca y con la Seguridad Social (anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2.5 Declaración responsable de no encontrarse en la situación prevista en el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres (anexo IV).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;12. Órgano instructor y procedimiento de concesión de las subvenciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El órgano instructor es la secretaría técnica del Departamento de Promoción Económica y Desarrollo Local, que tiene que llevar a cabo las actuaciones establecidas en la Ordenanza general de subvenciones y formular la propuesta de resolución. El órgano instructor puede requerir a las entidades solicitantes los informes o las aclaraciones que considere convenientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El Departamento de Promoción Económica y Desarrollo Local es el centro gestor responsable del seguimiento de las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El plazo máximo para resolver y notificar la resolución del procedimiento es de 6 meses. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El vencimiento del plazo máximo sin haberse notificado la resolución, legitima a los interesados para entender desestimada por silencio administrativo la solicitud de concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El Consejo Ejecutivo es el órgano competente para aprobar y resolver esta convocatoria de conformidad con el artículo 36, letra f), del vigente Reglamento orgánico del Consejo de Mallorca, en relación con la base 23.4 de las de ejecución del presupuesto de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;De conformidad con el artículo 44 en relación con el 46.6 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contenciosa Administrativa, contra el acuerdo de concesión de las subvenciones no se podrá interponer recurso en vía administrativa, si bien se podrá formular potestativamente REQUERIMIENTO para su anulación o revocación en el plazo de dos meses contadores desde el día que se publique en el Boletín Oficial de las Islas Baleares con carácter previo a la interposición de recurso contencioso administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El requerimiento se entenderá desestimado si en el plazo de un mes desde su presentación no se notifica resolución expresa. El plazo para interponer el recurso contencioso administrativo será de dos meses contadores desde el día siguiente en aquel en el cual se reciba comunicación de la resolución expresa sobre el requerimiento previo o este se entienda desestimado de forma presunta. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Si no se formula requerimiento previo, se podrá interponer directamente recurso contencioso administrativo en el plazo de dos meses contadores desde el día de la publicación del acuerdo en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;No obstante lo anterior, se puede interponer, si es el caso, cualquier otro recurso que se estime pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;13. Convenio de colaboración&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;De acuerdo con lo que dispone la disposición adicional segunda de la vigente Ordenanza general de subvenciones del Consejo de Mallorca para la justificación de los gastos, se tiene que firmar un convenio entre el Consejo de Mallorca y cada entidad local beneficiaria de las subvenciones. Cada entidad local tiene que aprobar a este modelo de convenio, que figura como anexo 0 de esta convocatoria, y lo tiene que remitir al Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca una vez aprobado en el plazo de un mes contador desde la fecha en qué se publica en el BOIB la concesión de la subvención. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El convenio arriba mencionado tiene que regular las obligaciones de ambas partes derivadas de la concesión de las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;14. Obligaciones de las entidades beneficiarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Los ayuntamientos a los cuales se han concedido las subvenciones tienen las obligaciones siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;14.1. Remitir al Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca, en el plazo de un mes contador desde la fecha en que se publica en el BOIB la concesión de la subvención, un certificado de la secretaría municipal que acredite que el ayuntamiento ha aprobado el convenio a suscribir con el Consejo de Mallorca según el modelo normalizado que figura como anexo 0 de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El convenio arriba mencionado se tiene que firmar entre el Consejo de Mallorca y cada una de las entidades beneficiarias de las subvenciones una vez concedidas estas. El convenio regulará las obligaciones de ambas partes derivadas de la concesión de las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;14.2. Adjudicar las actuaciones subvencionadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;14.3. Llevar a cabo las acciones subvencionadas desde el 1 de enero de 2022 hasta el 31 de diciembre de 2023 y presentar la justificación de los gastos al Consejo de Mallorca hasta el 30 de enero de 2024. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Para justificar las actuaciones subvencionadas, de acuerdo con la disposición adicional segunda de la Ordenanza general de subvenciones vigente del Consejo de Mallorca, la entidad beneficiaria tiene que presentar al Consejo de Mallorca la siguiente documentación: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;a) Un certificado &lt;span style="display:none"&gt;para &lt;/span&gt;las acciones genéricas (tipo A) del secretario o secretaria de la entidad local con el visto bueno del alcalde o alcaldesa que acredite que las acciones genéricas subvencionadas se han llevado a cabo, que se ha cumplido la finalidad de la subvención y que se aporta la documentación justificativa que establece la convocatoria (anexo V).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;b) Un certificado &lt;span style="display:none"&gt;para&lt;/span&gt; las acciones de inversión (tipo B) del secretario o secretaria de la entidad local con el visto bueno del alcalde o alcaldesa que acredite que las acciones de inversión subvencionadas se han llevado a cabo, que se ha cumplido la finalidad de la subvención y que se aporta la documentación justificativa que establece la convocatoria (anexo V).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;c) Para cada acción subvencionada se tiene que aportar: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-roman" start="1" style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Una memoria técnica de la acción ejecutada con indicación de los ahorros conseguidos o impactos climáticos sobre los cuales se ha actuado, con referencia a los indicadores de la acción antes y después de la implantación de esta, firmada por el gestor energético municipal y en concordancia con la ficha de la acción que conste en LO DIGIERO. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Se tiene que adjuntar a la memoria técnica toda aquella documentación generada a raíz de la acción subvencionada (documentos informativos, certificados, trípticos, etc.) que justifiquen que la acción se ha hecho (en formato digital preferiblemente).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En los casos que la acción subvencionada implique la redacción de un proyecto, este se tiene que enviar visado y en formato digital. El proyecto puede sustituir la memoria técnica. En este caso, se tiene que incluir la indicación de los ahorros conseguidos o impactos climáticos sobre los cuales se ha actuado con referencia a los indicadores de la acción antes y después de la implantación de esta. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;​​​​​​​&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las facturas y justificantes de pago de la acción llevada a cabo, con el IVA desglosado. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;d) Un informe (anexo VI) emitido por el interventor o interventora de la entidad local beneficiaria de la subvención en virtud del cual se haga constar:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La veracidad y la regularidad de la documentación justificativa de la subvención que se encuentra al poder de la entidad local en los términos establecidos en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Una relación de las facturas de la actuación subvencionada con los datos identificativos de cada factura: número, fecha, acreedor e importe. Y que el pago de las facturas se ha realizado antes de la finalización del plazo de justificación.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Una relación certificada de las obligaciones reconocidas de la actuación subvencionada de acuerdo con lo que prevé el artículo 48.1, apartado segundo, de la Ordenanza general de subvenciones vigente del Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Además, este informe para la justificación de las acciones subvencionadas tiene que hacer constar:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Que el ayuntamiento no ha obtenido ninguna otra subvención de otras instituciones públicas o privadas por la actividad objeto de la subvención (o, si es el caso, relación de las concedidas, con indicación de los importes y la procedencia).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Que los trabajos realizados y facturados objeto de la subvención se ajustan a los precios de mercado. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Que los gastos corresponden sin lugar a dudas a la actividad objeto de subvención. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Que el ayuntamiento no recupera ni compensa o recupera y compensa el impuesto sobre el valor añadido (IVA). &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Que, si sucede, con respecto a las facturas de honorarios de personas físicas el Ayuntamiento ha ingresado las retenciones de IRPF en la Agencia Tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Finalizada la actividad objeto de la subvención, el servicio responsable del Departamento emitirá un informe de evaluación y de comprobación relativo a si la subvención concedida cumple los requisitos y se ajusta a la finalidad de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;14.4. Autorizar al Consejo de Mallorca a tratar los datos obtenidos a raíz de la implantación de las acciones subvencionadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;14.5. En el caso de ejecución de acciones de inversión, hacer constar el patrocinio del Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca en las actuaciones. En especial, colocar en un lugar visible una placa con la leyenda y medidas que indique el Consejo de Mallorca, incluyendo el logotipo del Departamento y el del Pacto de las Alcaldías de Mallorca. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="background-color:white"&gt;Para la actuación de adquisición de vehículos tiene que figurar en un lugar visible del vehículo que la adquisición ha sido subvencionada por el Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca, con el anagrama, la leyenda y las medidas que indique el Consejo de Mallorca, incluyendo el logotipo del Departamento y el del Pacto de las Alcaldías de Mallorca.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En el caso de las acciones genéricas, hacer constar en toda la documentación y actuaciones que están financiadas por el Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca y tienen que incluir el logotipo del Departamento y el del Pacto de las Alcaldías de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;14.6. Comunicar al Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca, en cualquier momento, la obtención de subvenciones o ayudas para la misma finalidad y no consignadas en la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;14.7. Cumplir el resto de obligaciones que se prevén en el artículo 9 de la Ordenanza general de subvenciones vigente del Consejo de Mallorca aprobado por acuerdo del Pleno de 23 de diciembre de 2016 (BOIB nº. 21, de 18 de febrero de 2017).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;1&lt;s&gt;5&lt;/s&gt;. Importe de la subvención y reintegro&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La subvención se otorga por un importe cierto. En caso de que la cuantía justificada sea inferior a la concedida, el importe a subvencionar se tiene que ajustar con el importe justificado finalmente. Dado que está prevista la aprobación de un &lt;span style="display:none"&gt;anticipo&lt;/span&gt; del 100% de las subvenciones concedidas, en el caso que el importe justificado subvencionable sea inferior al importe subvencionado, el ayuntamiento interesado tiene que hacer, una vez presentada la justificación de los gastos de cada actuación, a requerimiento del Consejo de Mallorca, un reintegro de la diferencia entre la cantidad subvencionada y abonada mediante &lt;span style="display:none"&gt;anticipo &lt;/span&gt;y la cantidad finalmente justificada, además de los intereses de demora correspondientes desde el momento del pago del &lt;span style="display:none"&gt;anticipo&lt;/span&gt; de la subvención en el ayuntamiento interesado hasta la fecha en que se acuerde la procedencia del reintegro por parte del Consejo de Mallorca de cada actuación.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;16. Ampliaciones de plazos &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las ampliaciones de los plazos establecidos en esta convocatoria se rigen por lo que dispone el artículo 32 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas. En todo caso, las solicitudes de ampliación de plazos tienen que tener entrada oficial en el Consejo de Mallorca con una antelación mínima de treinta (30) días naturales a la fecha de finalización. Se autoriza el consejero ejecutivo competente en la materia para resolver las peticiones de ampliaciones de plazos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las entidades locales beneficiarias de la subvención pueden solicitar en el órgano que la concede, antes de que concluya el plazo para llevar a cabo la actividad subvencionada, modificaciones del acuerdo de concesión, reducción del importe concedido, modificación de la actuación objeto de la subvención, que se autorizan cuando tienen la causa en circunstancias imprevistas o son necesarias para el buen final de la actuación, siempre que no se altere el objeto o la finalidad de la subvención y no se dañe el derecho de terceros. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;17. Criterios objetivos que tienen que regir el otorgamiento y la cuantía de las subvenciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La concesión de las subvenciones de esta convocatoria se rige por los principios de publicidad, objetividad, igualdad y no discriminación, y se tiene que resolver según estos criterios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El procedimiento de concesión de las subvenciones se hace siguiendo los criterios fijados en el punto 9 de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;18. Revocación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las subvenciones son de concesión voluntaria, revocables y reducibles por las causas previstas en las leyes y en la Ordenanza general de subvenciones vigente del Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;19. Normativa supletoria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Para todo lo que no se haya previsto en esta convocatoria son aplicables la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local; el Real decreto legislativo 781/1986, de 18 de abril, por el cual se aprueba el texto refundido de las disposiciones legales vigentes en materia de régimen local; la Ley orgánica 2/2012, de 27 de abril, de estabilidad presupuestaria y sostenibilidad financiera; el Real decreto legislativo 2/2004, de 5 de marzo, por el cual se aprueba el texto refundido de la Ley reguladora de las haciendas locales; la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas; la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público; la Ley 9/2017, de 8 de noviembre, de contratos del sector público; la Ley 38/2003, de 17 de noviembre, general de subvenciones; la Ley 8/2000, de 27 de octubre, de consejos insulares; el Real decreto 887/2006, por el cual se aprueba el Reglamento de la Ley general de subvenciones; el Reglamento orgánico del Consejo de Mallorca aprobado por el Pleno el 12 de abril de 2018; el Decreto de organización del Consejo de Mallorca de 9 de diciembre de 2019 (BOIB nº. 167, de 12 de diciembre de 2019); la Ordenanza vigente de procedimiento administrativo del Consejo de Mallorca, aprobada por acuerdo del Pleno del Consejo de Mallorca de 2 de mayo de 1995 (BOIB nº. 100, de 10 de agosto de 1995); la Ordenanza general de subvenciones aprobada por acuerdo del Pleno de 23 de diciembre de 2016 (BOIB nº. 21, de 18 de febrero de 2017), y el resto de la normativa que sea aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;20. Recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;De conformidad con el artículo 44 en relación con el 46.6 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa, contra el acuerdo de aprobación de la convocatoria de subvenciones no se puede interponer ningún recurso en vía administrativa, si bien se puede formular potestativamente un requerimiento para anularlo o revocarlo en el plazo de dos meses contadores desde el día siguiente de publicarse en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt; (BOIB), con carácter previo a la interposición de un recurso contencioso administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El requerimiento se tiene que entender desestimado si, en el plazo de un mes desde la presentación, no se notifica una resolución expresa. El plazo para interponer el recurso contencioso administrativo es de dos meses contadores desde el día siguiente de recibir la comunicación de la resolución expresa sobre el requerimiento previo o del día que el recurso se entiende desestimado de forma presunta. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Si no se formula un requerimiento previo, se puede interponer directamente un recurso contencioso administrativo en el plazo de dos meses contadores desde el día siguiente de publicarse el acuerdo de aprobación de la convocatoria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;No obstante lo anterior, se puede interponer, si procede, cualquier otro recurso que se estime oportuno.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;21. Publicación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;El Consejo de Mallorca, en cumplimiento de lo que prevén los artículos 17, 18 y 20 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, remitirá en la Base de Datos nacional de subvenciones información sobre la resolución de aprobación de la convocatoria de las subvenciones y de las resoluciones de concesión que se deriven y se publicará en el BOIB por conducto de esta base de datos, además de publicarse en la Sede Electrónica del Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;5. La disposición adicional segunda de la Ordenanza general de subvenciones del Consejo de Mallorca aprobada por acuerdo del Pleno de 23 de diciembre de 2016 (BOIB nº. 21, de 18 de febrero de 2017) establece que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;«En los convenios de colaboración que regulen las ayudas que el Consejo Insular de Mallorca y los organismos autónomos y consorcios que dependen otorguen a otras administraciones públicas, la subvención se puede justificar a través de un certificado emitido &lt;span style="display:none"&gt;por&lt;/span&gt; el titular del órgano que la ha percibido, por el cual se acredite la realización de la actividad y el cumplimiento de la finalidad de la subvención, y también a través del informe emitido por la Intervención, u órgano de control financiero equivalente, de la entidad beneficiaria por el cual acredita la veracidad y la regularidad de la documentación justificativa de la subvención.»&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;6. En el marco de lo que prevé esta disposición adicional segunda, el objeto de este convenio es regular las obligaciones, el desarrollo de las acciones y la justificación de los gastos derivados de la subvención antes mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Ambas partes nos reconocemos mutuamente la capacidad legal necesaria para formalizar este convenio, de acuerdo con las siguientes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Cláusulas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;1. Este convenio tiene por objeto regular las obligaciones, el desarrollo de las acciones y la justificación de los gastos derivados de la subvención concedida &lt;span style="display:none"&gt;por&lt;/span&gt; el Consejo de Mallorca al Ayuntamiento d ........................ para llevar a cabo acciones incluidas en el Plan de Acción para la Energía Sostenible y el Clima (PAESC) para alcanzar los objetivos 2030 previstos por el Pacto de las Alcaldías en el marco de la convocatoria de subvenciones 2022-2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;2. El Ayuntamiento cumple los requisitos para acogerse a la convocatoria de subvenciones .................. y ha recibido la subvención para llevar a cabo las acciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;................................................................................................................................................&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;3. El Ayuntamiento d ...................., como beneficiario de la subvención, se compromete a cumplir todas y cada una de las obligaciones previstas en la convocatoria de subvenciones, tanto las de tipo administrativo como las de tipo técnico, muy especialmente a llevar a cabo las actuaciones subvencionadas hasta el 31 de diciembre de 2023 y presentar la justificación de los gastos al Consejo de Mallorca hasta el 30 de enero de 2024. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;4. La justificación de las acciones subvencionadas en el Ayuntamiento de ......................., de acuerdo con la disposición adicional segunda de la Ordenanza general de subvenciones vigente del Consejo de Mallorca, se hará por medio de la presentación en el Consejo de Mallorca por parte de la entidad beneficiaria de la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;a) Un certificado por las acciones genéricas (tipo A) del secretario o secretaria de la entidad local con el visto bueno del alcalde o alcaldesa que acredite que las acciones genéricas subvencionadas se han llevado a término, que se ha cumplido la finalidad de la subvención y que se aporta la documentación justificativa que establece la convocatoria (anexo V).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;b) Un certificado por las acciones de inversión (tipo B) del secretario o secretaria de la entidad local con el visto bueno del alcalde o alcaldesa que acredite que las acciones de inversión subvencionadas se han llevado a término, que se ha cumplido la finalidad de la subvención y que se aporta la documentación justificativa que establece la convocatoria (anexo V).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;c) Para cada acción subvencionada se tiene que aportar: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-roman" start="1"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Una memoria técnica de la acción ejecutada con indicación de los ahorros conseguidos o impactos climáticos sobre los cuales se ha actuado, con referencia a los indicadores de la acción antes y después de la implantación de esta, firmada por el gestor energético municipal y en concordancia con la ficha de la acción que conste en el PAESC. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Se tiene que adjuntar a la memoria técnica toda aquella documentación generada a raíz de la acción subvencionada (documentos informativos, certificados, trípticos, etc.) que justifiquen que la acción se ha hecho (en formato digital preferiblemente).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En los casos que la acción subvencionada implique la redacción de un proyecto, este se tiene que enviar visado y en formato digital. El proyecto puede sustituir la memoria técnica. En este caso, se tiene que incluir la indicación de los ahorros conseguidos o impactos climáticos sobre los cuales se ha actuado con referencia a los indicadores de la acción antes y después de la implantación de esta. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Las facturas y justificantes de pago de la acción llevada a cabo, con el IVA desglosado.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;d) Un informe (anexo VI) emitido por el interventor o interventora de la entidad local beneficiaria de la subvención en virtud del cual se haga constar:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La veracidad y la regularidad de la documentación justificativa de la subvención que se encuentra al poder de la entidad local en los términos establecidos en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Una relación de las facturas de la actuación subvencionada con los datos identificativos de cada factura: número, fecha, acreedor e importe. Y que el pago de las facturas se ha realizado antes de la finalización del plazo de justificación.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Una relación certificada de las obligaciones reconocidas de la actuación subvencionada de acuerdo con lo que prevé el artículo 48.1, apartado segundo, de la Ordenanza general de subvenciones vigente del Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Además, este informe para la justificación de las acciones subvencionadas tiene que hacer constar:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Que el ayuntamiento no ha obtenido ninguna otra subvención de otras instituciones públicas o privadas por la actividad objeto de la subvención (o, si es el caso, relación de las concedidas, con indicación de los importes y la procedencia).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Que los trabajos realizados y facturados objeto de la subvención se ajustan a los precios de mercado. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Que los gastos corresponden sin lugar a dudas a la actividad objeto de subvención. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Que el ayuntamiento no recupera ni compensa o recupera y compensa el impuesto sobre el valor añadido (IVA). &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Que, si ocurre, con respecto a las facturas de honorarios de personas físicas el Ayuntamiento ha ingresado las retenciones de IRPF en la Agencia Tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;5. Este convenio finalizará al acabar las acciones subvencionadas y una vez justificadas las actuaciones en los términos de este convenio y realizados, si procede, los reintegros de la subvención por parte del Ayuntamiento d .................................................&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Que el Ayuntamiento se compromete a comunicar al Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca, en cualquier momento, la obtención de subvenciones o ayudas para la misma finalidad y no consignadas en la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
