    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Habiéndose aprobado definitivamente la ordenanza reguladora del precio público por la prestación del servicio de escuela infantil, se publica este para su general conocimiento y en cumplimiento de los artículos 70.2 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local y 103 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ORDENANZA REGULADORA DEL PRECIO PÚBLICO POR LA PRESTACIÓN DEL SERVICIO DE ESCUELA INFANTIL MUNCIPAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 1. Fundamento y objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta Entidad Local, en uso de las facultades contenidas en los artículos 41 a 47 y 127 del Texto Refundido de la Ley Reguladora de las Haciendas Locales aprobado por Real decreto legislativo 2/2004, de 5 de marzo, establece el presente precio público del servicio de escuela infantil pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 2. Hecho imponible&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Constituye el hecho imponible del precio público la prestación del servicio de escolarización, atención, cura y vigilancia de los niños, y otros de complementarios, propios de las escuelas infantiles, cuando estos sean realizados por los servicios municipales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 3. Objeto al pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son sujetos pasivos del precio público, en concepto de contribuyentes, las personas físicas que soliciten o se beneficien de la prestación de servicios o realización de las actividades de enseñanza. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Estarán obligados al pago del precio público:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Los progenitores o quienes ostente la tutoría de los niños que se beneficien de los servicios prestados por las escuelas infantiles públicas u otros servicios educativos de 0 a 3 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) O, si procede, quién pueda estar obligado al pago de los alimentos de estos, conforme al que prevé el Código Civil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 4. Responsables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Son responsables tributarias las personas físicas y jurídicas determinadas como tales a la Ley general tributaria y a la Ordenanza general. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La derivación de responsabilidad requerirá que, previa audiencia de la persona interesada, se dicte acto administrativo, en los términos previstos a la Ley general tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Las obligaciones tributarias pendientes se exigirán a las personas sucesoras de las personas físicas, jurídicas y entidades sin personalidad, en los términos previstos a la Ley general tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo5. Cuantía&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los precios públicos serán los siguientes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 6. Exenciones y bonificaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Previo informe favorable del servicios municipales sociales se puede otorgar la exención de todo o parte del pago, hasta un máximo de tres cuotas, cuando las circunstancias socioeconómicas de la persona solicitante manifiesten una situación no adecuada y que falten en cada momento con un nivel mínimo de subsistencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 7. Devengo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El precio público se reportará en el momento de la formalización del alta del servicio de comedor con independencia de su real prestación, y para los alumnos ocasionales desde la solicitud de prestación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 8. Normas de Gestión&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las personas interesadas en la prestación del servicio a que se refiere este Acuerdo regulador, tendrán que presentar en la escuela infantil municipal o al Ayuntamiento la solicitud de inscripción en los modelos que se faciliten.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las bajas del servicio escolar tendrán que comunicarse quince manantial antes y harán efecto en el mes siguiente de su comunicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En los casos de falta de pago de las reiteradas se seguirá el siguiente procedimiento&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. Por falta de pago durante un mes la adjudicadora del servicio o el órgano que lo gestione por encomienda, se pondrá en contacto con la familia del Niño por la situación detectada&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. Por un retraso en el pago de mes de dos mensualidades significará la baja del centro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En casos excepcionales, debidamente acreditados por parte de los obligados del pago, como puedan ser enfermedad grave, cambio de domicilio, u otros motivos de fuerza mayor, se procederá a la devolución de la cuota mensual del importe correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para mantener la reserva de la plaza a pesar del niño/niña no utilice el servicio durante 1 mes completo, se abonará el 10% del importe de la escolarización, excepto en el caso de cuando la no utilización del servicio sea por causas ajenas a la voluntad de los usuarios, justificadas con el informe o documentación pertinente. La cuota de reserva de plaza será compensada con la primera mensualidad del mes siguiente una vez se realice la inscripción. Se exceptúa el mes de agosto. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuando por causa no imputable al obligado al pago del precio público no se preste el servicio procederá la devolución del importe correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las deudas por los precios públicos aquí regulados podrán exigirse por el procedimiento administrativo de constreñimiento, en conformidad con el artículo 46.3 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el Real decreto legislativo 2/2004, de 5 de marzo y la norma de recaudación que sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 9. Modificación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La modificación de los precios públicos fijados en el presente Acuerdo corresponderá al Pleno de la Corporación, en virtud el artículo 47.1 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el Real decreto legislativo 2/2004, de 5 de marzo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 10. Legislación aplicable&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El en lo referente a infracciones y sanciones tributarías, será de aplicación a la Ley 58/2003 de 17 de diciembre, general Tributaría en concreto en los artículos 181 y segundos así como sus disposiciones de desarrollo, segundos el que dispone el Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por Real Decreto 2/2004, de 5 de marzo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todo lo no previsto en el presente acuerdo estará el que dispone , la Ley 8/1989, de 13 de abril, de Tasas y Precios Públicos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Diposición final&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El presente Acuerdo regulador, entrará en vigor el día siegan de la publicación al Boletin Oficial de la Comunidad Autónoma de las Islas Baleares.&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra el presente Acuerdo se podrá interponer recurso contencioso-administrativo, ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de, en el plazo de dos meses a contar desde el día siguiente en la publicación del presente anuncio, en conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la Jurisdicción Contencioso-Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
