    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El punto 3 del apartado Octavo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 28&amp;nbsp;de enero de 2021, por la cual se convocan ayudas destinadas al pago compensatorio en zonas de montaña para el año 2021, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el Boletín Oficial de las Islas Baleares, y se hará de acuerdo a los términos que prevé el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#212121"&gt;El vicepresidente&amp;nbsp;en Materia Agraria&amp;nbsp;del FOGAIBA, con&amp;nbsp;fecha 16&amp;nbsp;de&lt;/span&gt;&amp;nbsp;&lt;span style="color:#212121"&gt;febrero&amp;nbsp;de 2022, firmó la siguiente resolución: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Hechos&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 26 de febrero de 2015, se publicó en el BOIB nº. 29 la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014- 2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Con fecha de 30 de enero de 2021 se publicó, en el BOIB nº. 13, la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 28 de enero de 2021, por la que se aprueba la convocatoria para el año 2021 de las ayudas destinadas al pago compensatorio por en zonas de montaña en las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.De conformidad con el apartado sexto de la citada Resolución, y la Orden APA 407/2021, de 25 de abril, por la que se modifican, para el año 2021, varios plazos establecidos en el Real Decreto 1075/2014, de 19 de diciembre, dictado por la aplicación en España de la Política Agrícola Común, el plazo de presentación de solicitudes de la convocatoria finalizó el día 15/6/2021. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.El &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;r. JOAN MARC FIOL SASTRE, con DNI ***0532**, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 31/5/2021 registr&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de entrada la solicitud única, GOIBE214801/2021, a la que se le asigna el número de expediente 04005430, incluyendo l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;ayuda al pago compensatorio en zonas de montaña. Del examen de la documentación aportada&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&amp;nbsp;el titular cumple con los requisitos para ser beneficiario de la ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.El 25/6/2021 desde el Servicio de Ayudas Directas de la PAC se envía una notificación sobre los controles preliminares de las duplicidades de los recintos al &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;r. JOAN MARC FIOL SASTRE, con DNI ***0532**. El 21/10/21 &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;El Sr.&amp;nbsp;Fiol Sastre hace una alegación a la solicitud única en respuesta a esta notificación, número de registro de entrada 498052/21. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;La superficie penalizable resultante de las duplicidades es de 8,57 ha, la superficie determinada resultante de los controles preliminares es de 9,51 ha. Estos datos suponen una sobredeclaración del 90,12%.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. Dado el artículo 19.2. del Reglamento Delegado (UE) 640/2014 de la Comisión de 11 de marzo de 2014, si la superficie declarada a efectos de los regímenes de ayuda o medidas de ayuda por superficie sobrepasa la superficie determinada en un 50% no se concederá ninguna ayuda por superficie para el grupo de cultivo en cuestión. Además, el beneficiario estará sujeto a una sanción adicional igual al importe de la ayuda correspondiente a la diferencia entre la superficie declarada y la superficie determinada dado el artículo 18.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
