    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Dado que al punto 4t del acuerdo del Consejo Ejecutivo del Consejo de Mallorca, relativo a la cesión por parte del Consejo de Mallorca al Ayuntamiento de Palma del vial servicio Ma-19 Salida 12 de la red de carreteras del Consejo de Mallorca a esta entidad local, se ordena la publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt; a los efectos de su general conocimiento.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Con el fin de dar cumplimiento a esta previsión, visto que día 23 de febrero de 2022 se formalizó el convenio mediante la firma del consejero ejecutivo del Departamento de Movilidad e Infraestructuras del Consejo de Mallorca y del alcalde-presidente del Ayuntamiento de Palma del convenio, se procede a su publicación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;CONVENIO POR EL CUAL SE LLEVAR a cabo LA CESIÓN DE LA TITULARIDAD EN RELACIÓN EN EL VIAL DE SERVICIO DE LA SALIDA 12 DE LA Ma-19, SENTIDO PALMA, DE LA RED DE CARRETERAS DEL CONSEJO DE MALLORCA AL AYUNTAMIENTO DE PALMA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Palma, a&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;REUNIDOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Por una parte, el honorable. Señor Iván Sevillano Miguel, consejero ejecutivo de Movilidad e Infraestructuras, de acuerdo con el &lt;span style="background-color:#fdfdfc"&gt;Decreto de la presidenta del Consejo Insular de Mallorca, de 9 de diciembre de 2019, por el cual se determina la organización del Consejo Insular de Mallorca (BOIB nº. 167, de 12 de diciembre de 2019), modificado por los decretos de día 6 de marzo, 22 de mayo, 9 de julio y 10 de noviembre, todos de 2020 (BOIB núms. 29, 95, 131 y 196, de días 7 de marzo, 28 de mayo, 25 de julio y 17 de noviembre, respectivamente), decreto de 26 de enero de 2021 (BOIB nº. 12 de 28 de enero de 2021), decreto de día 13 de mayo de 2021 (BOIB nº. 67, de 22 de mayo de 2021) y decreto de día 28 de diciembre de 2021 (BOIB nº. 180, de 30 de diciembre de 2021).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Y por la otra, el Excmo. Sr. José Hila Vargas, alcalde de Palma, por el acuerdo del Pleno adoptado en la sesión extraordinaria de 13 de junio de 2019, en virtud de las facultades que le atribuye el artículo 21 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Las partes se reconocen por la representación con que actúan, la capacidad suficiente para formalizar este convenio, por lo cual,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;EXPONEN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.&lt;/strong&gt; El Consejo de Mallorca es el titular del vial de servicio de la salida 12 de la Ma-19, sentido Palma, según consta en el Inventario General de Bienes de esta institución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt; Fecha 31 de agosto de 2021, con nº. 346239 del registro general del Consejo de Mallorca, tendió entrada escrito del Departamento de Infraestructuras del Ayuntamiento de Palma, dando traslado en el Consejo de Mallorca del acuerdo adoptado día 25 de agosto de 2021 &lt;span style="display:none"&gt;por&lt;/span&gt; la Junta de Gobierno de este ente local, cuyo punto primero se expresa en el siguiente sentido:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;em&gt;“ &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;1r. Aprobar la petición en el Consejo de Mallorca de la cesión en este Ayuntamiento del vial de servicio de la Ma-19 que &lt;span style="display:none"&gt;discurre&lt;/span&gt; paralelo en este vial, por la parte norte, entre la rotonda de enlace de la Ma-19 con la Ma-6011 (Carretera Militar) y el final del vial dirección Llucmajor, con la condición de previa reparación del pavimento asfáltico en aquellos puntos donde sea necesario, previa a la dotación de una capa de rodadura en toda su superficie del vial, y la dotación y/o reparación del sistema de drenaje superficial en los laterales del vial, o, en su caso, dada la urgencia de ejecutar las obras propuestas &lt;span style="display:none"&gt;por&lt;/span&gt; la Junta de Compensación UE 82/01 Bellavista-c/ Trovadores, compromiso firme por parte del Consejo de Mallorca de que se ejecutarán las obras requeridas una vez formalizada la &lt;strong&gt;cesión en este ayuntamiento “&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.&lt;/strong&gt; El día 19 de octubre de de 2021, la Dirección Insular de Infraestructuras, emitió informe relativo a la cesión, por parte del Consejo de Mallorca, de la titularidad en el Ayuntamiento de Palma del vial de servicio de la salida 12 de la Ma-19, sentido Palma, con una longitud de 1.445 m (1.380 m. + 65 m.), un ancho medio de 7 m., en definitiva, con una superficie &lt;span style="display:none"&gt;estimada&lt;/span&gt; de 10.115 m2. (1.445 m x 7 m.) y una valoración patrimonial estimada de 252.875 €., adjuntando en relación a las diferentes infraestructuras objeto de este convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.&lt;/strong&gt; Que esta cesión de la titularidad supondrá una mejora y una gestión más eficaz de las respectivas redes viales de ambas administraciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6.&lt;/strong&gt; En el tramo de la cesión en el Ayuntamiento de Palma, no le es exigible la conectividad que impone la norma balear sobre las carreteras de la Red Primaria. No obstante lo anterior, esta conectividad se mantendrá.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. &lt;/strong&gt;Por acuerdo de día 27 de octubre de 2021, el Consejo Ejecutivo del Consejo de Mallorca, aprobó el presente convenio en materia de carreteras con el Ayuntamiento de Palma, modificado por acuerdo de día 9 de febrero de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Por todo eso, acuerdan suscribir este convenio, que se revuelve por las siguientes,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;CLÁUSULAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;PRIMERA. Objeto del convenio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;El objeto de este convenio es la cesión por parte del Consejo de Mallorca al Ayuntamiento de Palma de la titularidad de la vía que a continuación se describe y la adopción del compromiso de esta administración insular de llevar a cabo las obras mencionadas al acuerdo de la Junta de Gobierno del Ayuntamiento de Palma, de fecha 25 de agosto de 2021, descrito al punto segundo de los antecedentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;u&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/u&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Vía de servicio&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;longitud= 1.380 m + 65 m= 1.445 m &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;superficie &lt;span style="display:none"&gt;estimada&lt;/span&gt; = 1.445 x 7 m = 10.115 m2 &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Valoración patrimonial estimada:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;superfície= 10.115 m2 &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;precio unitario= 25 €/ m2 &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;valoración= 252.875 € &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;SEGUNDA. Vigencia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;La vigencia de este convenio no es otro que el tiempo establecido para realizar el objeto del convenio, iniciándose a partir de la fecha de firma de este documento y, en consecuencia, obligante en las partes desde aquel momento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;TERCERA. Obligaciones de las partes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Por parte del Consejo de Mallorca&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;El Consejo de Mallorca cederá la titularidad al Ayuntamiento de Palma el vial de servicio de la salida 12 de la Ma-19, sentido Palma que se describe en la cláusula primera y, en consecuencia, pasarán a integrarse en la red local del Ayuntamiento de Palma desde el momento en que se formalice la recepción, mediante la firma, &lt;span style="display:none"&gt;por&lt;/span&gt; ambas Administraciones públicas, de la correspondiente “Acta de Entrega”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;El Consejo de Mallorca llevará a cabo las obras de reparación del pavimento asfáltico en aquellos puntos donde sea necesario, previa a la dotación de una capa de rodadura en toda su superficie del vial, y la dotación y/o reparación del sistema de drenaje superficial en los laterales del vial, en el plazo de un año, contador desde la firma &lt;span style="display:none"&gt;por&lt;/span&gt; ambas administraciones del acta de entrega.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Por parte del Ayuntamiento de Palma&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;El Ayuntamiento de Palma acepta la titularidad de la vía objeto de la cesión y, en consecuencia, asumirá la conservación y mantenimiento, así como todas las competencias y deberes que comporta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Asimismo, se hará cargo de las indemnizaciones a tercero por responsabilidades patrimoniales que afecten al mantenimiento y los elementos que forman parte de los tramos objeto de cesión desde el momento de la firma de este convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;CUARTA. Gestión del Convenio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Con la finalidad de tratar todas aquellas cuestiones que se puedan derivar del presente convenio y proponer, si procede, el caso en los órganos competentes las medidas a adoptar, se podrá constituir una comisión de seguimiento, bilateral y paritaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;QUINTA. Extinción&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;El convenio quedará extinguido una vez transcurrido el periodo de vigencia mencionado en la cláusula segundo, o por la concurrencia de cualquiera de las siguientes circunstancias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a. Por mutuo acuerdo entre las partes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:normal"&gt;b. Por incumplimiento de sus obligaciones por cualquiera de las partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;SEXTA. Resolución de conflictos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:normal"&gt;Las partes acuerdan resolver de mutuo acuerdo las cuestiones que suban surgir de la interpretación y el cumplimiento de este convenio o plantearlas, en su caso, ante la comisión de gestión del convenio que se cree.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:normal"&gt;Como prueba de conformidad con el contenido de este convenio, las partes lo firman por duplicado y a un solo efecto, en el lugar y fecha indicados al encabezamiento, de manera que queda una copia en poder de cada parte que interviene.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
