<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">El Acuerdo del Consejo de Gobierno de 25 de octubre de 2021 aprobó el Plan de Medidas de Prevención, Contención y Coordinación Frente a la COVID-19 y el Plan Específico de Medidas de Prevención y Contención de la COVID-19 en los Servicios Sociales, y estableció los niveles de alerta sanitaria a </span><span style="color:#000000">aplicar temporalmente en cada una de las islas, </span><span style="color:#000000">unos </span><span style="color:#000000">niveles que fueron revisados los días 8 y 23 de noviembre; 3, 13 y 23 de diciembre de 2021, </span><span style="color:#000000">y 10 </span><span style="color:#000000">y 31 </span><span style="color:#000000">de enero de 2022.</span></span></span></p>
<p><span style="color:#000000; font-family:"Times New Roman",Times,serif">El Plan de Medidas de Prevención, Contención y Coordinación Frente a la COVID-19 establece unas medidas básicas de seguridad y prevención de carácter y aplicación general cualquiera que sea el nivel de alerta sanitaria declarado para cada isla, así como una serie de medidas aplicables a determinados sectores de actividad de mayor riesgo en función del nivel de alerta sanitaria declarado para cada isla.</span></p>
<p><span style="color:#000000; font-family:"Times New Roman",Times,serif">Así pues, las determinaciones del nivel de alerta sanitaria que periódicamente se realizan</span><span style="color:#000000; font-family:"Times New Roman",Times,serif"> son las que determinan cuál es el conjunto efectivo de medidas de prevención y protección frente a la transmisión de la COVID-19 establecidas en </span><span style="color:#000000; font-family:"Times New Roman",Times,serif">dicho </span><span style="color:#000000; font-family:"Times New Roman",Times,serif">Plan que son </span><span style="color:#000000; font-family:"Times New Roman",Times,serif">de aplicación en cada momento en cada isla.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">El pasado día 31</span><span style="color:#000000"> de enero, el Conse</span><span style="color:#000000">jo de</span><span style="color:#000000"> Gobierno adoptó el A</span><span style="color:#000000">cuerdo</span><span style="color:#000000"> </span><span style="color:#000000">por el </span><span style="color:#000000">que</span><span style="color:#000000"> </span><span style="color:#000000">se establ</span><span style="color:#000000">ecían</span><span style="color:#000000"> los niveles de alerta sanitaria </span><span style="color:#000000">a</span><span style="color:#000000"> aplicar en cada una de las islas </span><span style="color:#000000">y se modific</span><span style="color:#000000">a</span><span style="color:#000000">b</span><span style="color:#000000">a</span><span style="color:#000000"> puntualmente </span><span style="color:#000000">el Plan de Medidas de Prevención, Contención y Coordinación Frente a la COVID-19, </span><span style="color:#000000">aprobado por </span><span style="color:#000000">Acuerdo del Consejo de Gobierno de 25 de octubre de 2021.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Con este Acuerdo y una vez puestos de manifiesto</span><span style="color:#000000"> los datos relativos a los factores de riesgo epidemiológico y asistencial que </span><span style="color:#000000">concurrían</span><span style="color:#000000"> </span><span style="color:#000000">en aquel momento, el Consejo de Gobierno declaró que </span><span style="color:#000000">Mallorca, Eivissa </span><span style="color:#000000">y Formentera</span><span style="color:#000000"> se encontraban en nivel de alerta sanitaria </span><span style="color:#000000">4</span><span style="color:#000000">, mientras que </span><span style="color:#000000">Menorca </span><span style="color:#000000">se encontraba en nivel de alerta </span><span style="color:#000000">3</span><span style="color:#000000">. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Así pues, la situación epidemiológica y asistencial en las islas </span><span style="color:#000000">globalmente</span><span style="color:#000000">, </span><span style="color:#000000">según </span><span style="color:#000000">el informe del Comité Autonómico de Gestión de Enfermedades Infecciosas de 11 de febrero </span><span style="color:#000000">de 2022</span><span style="color:#000000">, basado en datos </span><span style="color:#000000">consolidados a día </span><span style="color:#000000">8 </span><span style="color:#000000">del mismo mes de la Dirección </span><span style="color:#000000">G</span><span style="color:#000000">eneral de Salud Pública y Participación y datos</span><span style="color:#000000"> ofrecidos por el Servicio de Salud de las I</span><span style="color:#000000">lles Balears</span><span style="color:#000000"> de día </span><span style="color:#000000">9</span><span style="color:#000000"> de febrero</span><span style="color:#000000">, </span><span style="color:#000000">la comunidad autónoma presenta una incidencia acumulada a 14 días (IA14) por 100.000 habitantes en la población general de 1.665,5 casos, lo </span><span style="color:#000000">que</span><span style="color:#000000"> supone </span><span style="color:#000000">todavía </span><span style="color:#000000">un nivel de riesgo </span><span style="color:#000000">muy </span><span style="color:#000000">alto</span><span style="color:#000000">. Por otro lado, en la población > 65 años </span><span style="color:#000000">la</span><span style="color:#000000"> IA14 se encuentra en </span><span style="color:#000000">1.044,6</span><span style="color:#000000"> </span><span style="color:#000000">casos (riesgo </span><span style="color:#000000">muy</span><span style="color:#000000"> </span><span style="color:#000000">alto</span><span style="color:#000000">).</span><span style="color:#000000"> </span><span style="color:#000000">La tasa de positiv</span><span style="color:#000000">i</span><span style="color:#000000">d</span><span style="color:#000000">a</span><span style="color:#000000">d</span><span style="color:#000000"> a 7 días es </span><span style="color:#000000">del</span><span style="color:#000000"> </span><span style="color:#000000">20,29</span><span style="color:#000000"> </span><span style="color:#000000">%. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Por islas, Mallorca presenta una IA14 de 1.592,4 casos</span><span style="color:#000000">, </span><span style="color:#000000">Menorca de 2.260,5, </span><span style="color:#000000">Eivissa presenta una IA14 de 1.789,5 </span><span style="color:#000000">casos </span><span style="color:#000000">y Formentera presenta una IA14 de 907,3.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Por otro lado, la situación asistencial </span><span style="color:#000000">empieza a presentar muchas mejoras.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Por islas, Mallorca presenta una</span><span style="color:#000000"> ocupación de camas de planta </span><span style="color:#000000">con una ocupación de</span><span style="color:#000000">l 9,72</span><span style="color:#000000"> </span><span style="color:#000000">%;</span><span style="color:#000000"> </span><span style="color:#000000">Menorc</span><span style="color:#000000">a se</span><span style="color:#000000"> </span><span style="color:#000000">encuentra </span><span style="color:#000000">respecto </span><span style="color:#000000">a la ocupación de camas de planta e</span><span style="color:#000000">n </span><span style="color:#000000">un </span><span style="color:#000000">7,88 </span><span style="color:#000000">%, </span><span style="color:#000000">mientras que Eivissa (que incluye los ingresos procedentes de Formentera) </span><span style="color:#000000">presenta una ocupación del </span><span style="color:#000000">21,82 %. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En cuanto a las ocupaciones de camas de cuidados crítico</span><span style="color:#000000">s, Mallorca </span><span style="color:#000000">se encuentra en </span><span style="color:#000000">un 18,58 </span><span style="color:#000000">%, </span><span style="color:#000000">Menorca </span><span style="color:#000000">en un</span><span style="color:#000000"> </span><span style="color:#000000">18,52</span><span style="color:#000000"> </span><span style="color:#000000">% </span><span style="color:#000000">y Eivissa </span><span style="color:#000000">y Formentera </span><span style="color:#000000">se encuentran en </span><span style="color:#000000">unos porcentajes de ocupación del 14,75<span style="color:#000000"> </span>%.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En definitiva, la evolución de la pandemia de COVID-19 </span><span style="color:#000000">en </span><span style="color:#000000">las Illes Balears</span><span style="color:#000000"> </span><span style="color:#000000">en cuanto a esta sexta ola sigue un camino de franca mejora, </span><span style="color:#000000">de modo</span><span style="color:#000000"> que prácticamente todos los indicadores epidemiológicos </span><span style="color:#000000">presentan importantes mejoras </span><span style="color:#000000">en comparación con datos de hace dos semanas.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Así pues, ha continuado la evolución que ya empieza a </span><span style="color:#000000">ser</span><span style="color:#000000"> clásica en la pandemia </span><span style="color:#000000">de forma que,</span><span style="color:#000000"> </span><span style="color:#000000">transcurridas </span><span style="color:#000000">dos semanas aproximad</span><span style="color:#000000">ament</span><span style="color:#000000">e</span><span style="color:#000000"> desde el </span><span style="color:#000000">cambio de tendencia en la curva de contagios y de incidencias, </span><span style="color:#000000">en el caso de Mallorca empiezan </span><span style="color:#000000">a reflejarse</span><span style="color:#000000"> </span><span style="color:#000000">también </span><span style="color:#000000">de </span><span style="color:#000000">una </span><span style="color:#000000">forma </span><span style="color:#000000">evidente </span><span style="color:#000000">estos cambios </span><span style="color:#000000">en la situación asistencial. Desgraciadamente, en el caso de Menorca y de Eivissa, donde la inversión de la tendencia en la evolución de los contagios se ha </span><span style="color:#000000">manifestado</span><span style="color:#000000"> con mayor retraso, no puede hacer</span><span style="color:#000000">se</span><span style="color:#000000"> todavía esta afirmación y </span><span style="color:#000000">habrá que estar a la expectativa d</span><span style="color:#000000">e la eventual evolución local de esta ola. En cualquier caso, </span><span style="color:#000000">cabe d</span><span style="color:#000000">ecir que Menorca parte, eso s</span><span style="color:#000000">í</span><span style="color:#000000">, de una situación asistencial más favorable que </span><span style="color:#000000">el resto</span><span style="color:#000000"> de islas para </span><span style="color:#000000">a</span><span style="color:#000000">fr</span><span style="color:#000000">o</span><span style="color:#000000">ntar </span><span style="color:#000000">lo que esperamos que sea el último embate de esta ola de la pandemia. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Así pues, los</span><span style="color:#000000"> cuadro</span><span style="color:#000000">s</span><span style="color:#000000"> de la evolución de la sexta ola de la pandemia </span><span style="color:#000000">en</span><span style="color:#000000"> las islas presenta</span><span style="color:#000000">n</span><span style="color:#000000"> este estado </span><span style="color:#000000">en fechas</span><span style="color:#000000"> 26 de enero y a 9 de febrero de 2022.</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En consecuencia<span style="color:#000000"> </span>y </span><span style="color:#000000">de conformidad con</span><span style="color:#000000"> </span><span style="color:#000000">el cuadro de </span><span style="color:#000000">i</span><span style="color:#000000">ndicadores para la valoración de riesgo y niveles de </span><span style="color:#000000">a</span><span style="color:#000000">lerta de transmisión de COVID-19, </span><span style="color:#000000">del </span><span style="color:#000000">documento </span><span style="color:#000000">«</span><span style="color:#000000">Actuaciones de respuesta coordinada para el control de la transmisión de COVID-19</span><span style="color:#000000">»</span><span style="color:#000000">, </span><span style="color:#000000">aprobado</span><span style="color:#000000"> por la Comisión Interterritorial del </span><span style="color:#000000">Sistema</span><span style="color:#000000"> Nacional de Salud (CISNS) </span><span style="color:#000000">en la sesión de 24 de noviembre de 2021, </span><span style="color:#000000">hay que</span><span style="color:#000000"> </span><span style="color:#000000">revisar los niveles de alerta sanitaria que son </span><span style="color:#000000">de aplicación</span><span style="color:#000000"> </span><span style="color:#000000">en</span><span style="color:#000000"> cada una de las islas, </span><span style="color:#000000">lo </span><span style="color:#000000">que</span><span style="color:#000000"> </span><span style="color:#000000">determinará el contenido de las medidas de prevención y contención de la COVID-19 que </span><span style="color:#000000">serán<span style="color:#000000"> </span>aplicables.</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En este sentido, el informe del Comité Autonómico de Enfermedades Infecciosas</span><span style="color:#000000"> </span><span style="color:#000000">d</span><span style="color:#000000">e </span><span style="color:#000000">11</span><span style="color:#000000"> </span><span style="color:#000000">d</span><span style="color:#000000">e </span><span style="color:#000000">febrero </span><span style="color:#000000">d</span><span style="color:#000000">e 202</span><span style="color:#000000">2</span><span style="color:#000000"> </span><span style="color:#000000">se ha emitido </span><span style="color:#000000">conforme a</span><span style="color:#000000">l documento </span><span style="color:#000000">«</span><span style="color:#000000">Actuaciones de respuesta coordinada para el control de la transmisión de COVID-19</span><span style="color:#000000">»</span><span style="color:#000000">, aprobado por la Comisión Interterritorial del Servicio Nacional de Salud (CISNS), que establece que tiene que posicionar</span><span style="color:#000000">se</span><span style="color:#000000"> un territorio en un nivel de alerta que se corresponde con su nivel de riesgo </span><span style="color:#000000">según</span><span style="color:#000000"> el análisis de indicadores </span><span style="color:#000000">de riesgo, </span><span style="color:#000000">de </span><span style="color:#000000">modo</span><span style="color:#000000"> que </span><span style="color:#000000">se</span><span style="color:#000000"> clasific</span><span style="color:#000000">a un</span><span style="color:#000000"> territorio en el máximo nivel de alerta en </span><span style="color:#000000">el que se cumplan las siguientes condiciones:</span></span></span></p>
<ul>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Al menos dos indicadores del bloque I se encuentran en aquel nivel de riesgo o superior. </span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Al menos uno de los indicadores del bloque II se encuentra en aquel nivel de riesgo o uno superior.</span></span></span></li>
</ul>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">El bloque II está integrado por dos indicadores de hospitalización general y por dos indicadores de UCI, debiendo tenerse en cuenta para la determinación del nivel el indicador que presente el máximo de entre los dos indicadores de hospitalización general y de entre los dos de UCI. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Además, el nivel resultante no puede ser inferior en más de un nivel del riesgo marcado por el indicador de ocupación de UCI, ni </span><span style="color:#000000">en </span><span style="color:#000000">más de dos niveles por debajo del marcado por el bloque I en su conjunto. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">También dispone el citado documento que e</span><span style="color:#000000">n situaciones con un riesgo de transmisión elevado, en las </span><span style="color:#000000">que</span><span style="color:#000000"> se detecte un empeoramiento brusco de la situación epidemiológica (ej. un aumento rápido de la tasa de incidencia en una semana) podrá establecer</span><span style="color:#000000">se</span><span style="color:#000000"> el nivel de alerta valorando únicamente los indicadores de uno de los bloques, teniéndose en cuenta el valor más alto de cualquier</span><span style="color:#000000">a</span><span style="color:#000000"> de ellos, valorando además la tendencia de la situación epidemiológica. As</span><span style="color:#000000">i</span><span style="color:#000000">mismo, ante situaciones especiales en las </span><span style="color:#000000">que</span><span style="color:#000000"> se detecte un riesgo específico, las CA podrán tomar la decisión de elevar de forma rápida el nivel de alerta para un determinado territorio. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Examinados todos estos</span><span style="color:#000000"> factores, el informe </span><span style="color:#000000">del Comité Autonómico de Gestión de Enfermedades Infecciosas de 1</span><span style="color:#000000">1</span><span style="color:#000000"> </span><span style="color:#000000">de febrero </span><span style="color:#000000">de 2022 concluye:</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- « Las Illes Balears lograron el pico de la sexta oleada a nivel de incidencia de casos el día 22 de enero de 2022 (IA14 de 4148,4 casos por 100.000 habitantes) momento desde el que se ha podido evidenciar una notable mejora de la situación epidemiológica, con una incidencia actual de 1665,5 casos por 100.000 habitantes y en evolución rápidamente descendente. Así, la incidencia se ha reducido en la mitad en los últimos 14 días (IA14 de 3249 casos por 100.000 habitantes el 27 de enero). </span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- La situación hospitalaria ha evolucionado también de forma favorable durante las últimas dos semanas, en particular a nivel de ocupación de UCI, con una disminución del 32% de la ocupación de forma global en las Baleares y un 40% en Mallorca. </span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- Los indicadores de riesgo sitúan, de forma global, en la comunidad autónoma en nivel de alerta 3 (comparado con la situación a nivel de alerta 4 hace dos semanas). Mallorca y Menorca se encuentran en nivel de alerta sanitaria 3 e Eivissa y Formentera en nivel de alerta sanitaria 4. </span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- La cobertura de vacunación de la población supera ya el 88% de la población mayor de 5 años con una dosis y casi el 85% con pauta completa. Por otra banda, la cobertura de dosis de refuerzo a población vulnerable es muy elevada, con coberturas superiores al 80% en las personas mayores de 70 años y de casi el 75% en personas de entre 60 a 69 años.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- La incidencia de ingresos a UCI es 25 veces superior en la población mayor de 60 años no vacunada frente en la población vacunada, y 50 veces superior en comparación con la población que ha recibido la dosis de refuerzo.</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- Se pronostica que, como consecuencia de la oleada *Òmicron, de forma conjunta con el efecto de una muy elevada cobertura vacunal, especialmente en los grupos vulnerables, el volumen de población susceptible a infección durante los próximos meses sea mucho más reducido en relación a momentos anteriores de la pandemia, hecho que disminuye de forma significativa el riesgo de sufrir una nueva oleada epidémica con efectos importantes a nivel asistencial en los próximos meses (siempre y cuando no aparezca una nueva variante con características diferentes que impliquen una evasión importante frente a la protección inmunológica lograda a nivel poblacional); esto, pues, podría dar lugar en un periodo de relativa baja transmisión. [...]»</span></span></span></p>
<p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>II</strong></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Por otro lado, la reciente aprobación </span><span style="color:#000000">del </span><span style="color:#000000">Real </span><span style="color:#000000">D</span><span style="color:#000000">ecreto 115/2022, de 8 de febrero, por el </span><span style="color:#000000">que</span><span style="color:#000000"> se modifica la obligatoriedad del uso de m</span><span style="color:#000000">a</span><span style="color:#000000">scar</span><span style="color:#000000">ill</span><span style="color:#000000">as durante la situación de crisis sanitaria ocasionada por </span><span style="color:#000000">la</span><span style="color:#000000"> COVID-19, </span><span style="color:#000000">obliga a </span><span style="color:#000000">realizar</span><span style="color:#000000"> </span><span style="color:#000000">algunas</span><span style="color:#000000"> adaptaciones del </span><span style="color:#000000">Plan de Medidas de Prevención, Contención y Coordinación Frente a la COVID-19</span><span style="color:#000000">,</span><span style="color:#000000"> </span><span style="color:#000000">aprobado </span><span style="color:#000000">por </span><span style="color:#000000">Acuerdo<span style="color:#000000"> </span>del Consejo de Gobierno de 25 de octubre de 2021.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Asi</span><span style="color:#000000">mismo parece adecuado dar un</span><span style="color:#000000">os</span><span style="color:#000000"> términos más genéricos a las medidas qu</span><span style="color:#000000">e</span><span style="color:#000000">, en relación </span><span style="color:#000000">con la organización de fiestas populares, se contienen en este Plan, hasta ahora demasiado centradas en festividades concretas.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En este sentido se pronuncia el informe del Comité Autonómico de Gestión de Enfermedades Infecciosas de 11 de febrero de 2022, cuando entre sus conclusiones, manifiesta:</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">«[...] De forma coherente con la disminución del nivel de riesgo evaluado en la Comunidad Autónoma, consecuencia de la mejora de la situación epidemiológica y de las predicciones de inicio de un periodo de relativa baja transmisión, junto con la existencia de coberturas vacunales muy elevadas, especialmente en el grupo de personas más vulnerables, se considera adecuado y proporcionado proceder a relajar algunas de las medidas no farmacológicas en vigor. En concreto, se propone relajar algunas de las medidas relacionadas con actividades que, por el hecho de darse al aire libre, llevan asociadas un menor peligro específico de transmisión del SARS-CoV-2, como pueden ser el uso obligatorio de mascarillas en espacios al aire libre y en los que no se dan aglomeraciones, así como la flexibilización de medidas relacionadas con la celebración de acontecimientos populares al aire libre.»</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Finalmente, </span><span style="color:#000000">a</span><span style="color:#000000"> la luz de la experiencia adquirida en la prevención del contag</span><span style="color:#000000">io</span><span style="color:#000000"> de la </span><span style="color:#000000">COVID-</span><span style="color:#000000">19</span><span style="color:#000000"> en el ámbito de los servicios sociales </span><span style="color:#000000">y de </span><span style="color:#000000">lo</span><span style="color:#000000"> que resulta de los </span><span style="color:#000000">A</span><span style="color:#000000">utos de la Sala de lo </span><span style="color:#000000">C</span><span style="color:#000000">ontencioso </span><span style="color:#000000">A</span><span style="color:#000000">dministrativo del Tribunal Superior de Justicia de las Illes Balears en relación a medidas aplicadas en este ámbito que requieren de la aprobación de </span><span style="color:#000000">dicho</span><span style="color:#000000"> órgano, </span><span style="color:#000000">se aprueba un nuevo </span><span style="color:#000000">Plan Específico de Medidas de Prevención y Contención de la COVID-19 en los Servicios Sociales </span><span style="color:#000000">que sustituye al qu</span><span style="color:#000000">e</span><span style="color:#000000"> se aprobó también </span><span style="color:#000000">por medio de </span><span style="color:#000000">Acuerdo<span style="color:#000000"> </span>del Consejo de Gobierno de 25 de octubre de 2021. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En consecuencia, el Consejo de Gobierno, como responsable máximo de la política sanitaria en las Illes Balears, a propuesta de la consejera de Salud y Consumo, en la sesión del día 14 de febrero de 2022 adopta, entre otros, el Acuerdo siguiente</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Primero. </strong>Disponer que desde</span><span style="color:#000000"> la publicación </span><span style="color:#000000">de este Acuerdo hasta las 24.00 horas del día </span><span style="color:#000000">2</span><span style="color:#000000">8</span><span style="color:#000000"> de febrero de 202</span><span style="color:#000000">2</span><span style="color:#000000">, salvo que se revisen antes, son </span><span style="color:#000000">de aplicación</span><span style="color:#000000"> en las Illes Balears los siguientes niveles de alerta sanitaria:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- En la isla de Mallorca, el nivel de alerta sanitaria 3.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- En la isla de Menorca, el nivel de alerta sanitaria 3.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- En la isla de Eivissa, el nivel de alerta sanitaria 4.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">- En la isla de Formentera, el nivel de alerta sanitaria 4.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Segundo. </strong></span><span style="color:#000000">Modificar el texto del segundo y tercer párrafo del punto 2 del apartado</span><span style="color:#000000"><strong> </strong></span><span style="color:#000000">I</span><span style="color:#000000"> del</span><span style="color:#000000"> a</span><span style="color:#000000">nexo</span><span style="color:#000000"> </span><span style="color:#000000">1 del</span><span style="color:#000000"> A</span><span style="color:#000000">cuerdo</span><span style="color:#000000"> </span><span style="color:#000000">del Consejo de Gobierno de 25 de octubre de 2021 </span><span style="color:#000000">por el </span><span style="color:#000000">que</span><span style="color:#000000"> </span><span style="color:#000000">se establecen los niveles de alerta sanitaria </span><span style="color:#000000">a</span><span style="color:#000000"> aplicar en cada una de las islas </span><span style="color:#000000">y se modifica puntualmente</span><span style="color:#000000"> el Plan de Medidas de Prevención, Contención y Coordinación Frente a la COVID-19, </span><span style="color:#000000">con </span><span style="color:#000000">la siguiente redacción:</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>- Las personas de más de seis años tendrán que llevar mascar</em></span><span style="color:#000000"><em>illa</em></span><span style="color:#000000"><em> en todo momento en espacios cerrados de </em></span><span style="color:#000000"><em>uso</em></span><span style="color:#000000"><em> público o </em></span><span style="color:#000000"><em>en</em></span><span style="color:#000000"><em> las zonas de atención al públic</em></span><span style="color:#000000"><em>o</em></span><span style="color:#000000"><em> de edificios, tanto de titularidad p</em></span><span style="color:#000000"><em>ública</em></span><span style="color:#000000"><em> c</em></span><span style="color:#000000"><em>o</em></span><span style="color:#000000"><em>mo privada, cuando pueda concurrir</em></span><span style="color:#000000"><em>se</em></span><span style="color:#000000"><em> en el mismo espacio con otras personas no conviv</em></span><span style="color:#000000"><em>i</em></span><span style="color:#000000"><em>ent</em></span><span style="color:#000000"><em>e</em></span><span style="color:#000000"><em>s, con las excepciones </em></span><span style="color:#000000"><em>señaladas</em></span><span style="color:#000000"><em> en los </em></span><span style="color:#000000"><em>siguientes </em></span><span style="color:#000000"><em>párrafos, a</em></span><span style="color:#000000"><em>sí como en los supuestos<span style="color:#000000"><em> </em></span>previstos en el artículo 6.2 de la Ley 2/2021, de 29 de marzo, de medidas urgentes de prevención, contención y coordinación para hacer frente a la crisis sanitaria ocasionada por la COVID-19.</em></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>- A los efectos de lo indicado en el párrafo anterior, se entiende que no es posible garantizar el mantenimiento de la distancia de seguridad interpersonal de al menos 1,5 metros en los eventos</em></span><span style="color:#000000"><em> multitudinarios </em></span><span style="color:#000000"><em>que se realicen con los asistentes </em></span><span style="color:#000000"><em>de pie</em></span><span style="color:#000000"><em>, </em></span><span style="color:#000000"><em>incluyendo los que se </em></span><span style="color:#000000"><em>realizan a</em></span><span style="color:#000000"><em>l aire libre, y, por lo tanto, es obligatorio el uso de la mascar</em></span><span style="color:#000000"><em>illa</em></span><span style="color:#000000"><em> en estas situaciones. Esta obligatoriedad se aplica también a los espacios de realización de ferias, mercados al aire libre y fiestas populares. </em></span><span style="color:#000000"><em>Si los asistentes están sentados, será obligatorio el uso de la mascar</em></span><span style="color:#000000"><em>illa</em></span><span style="color:#000000"><em> cuando no pueda mantener</em></span><span style="color:#000000"><em>se</em></span><span style="color:#000000"><em> una distancia de seguridad de al menos 1,5 metros entre personas, excepto grupos de conviv</em></span><span style="color:#000000"><em>ientes.</em></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Tercero. </strong>Modificar </span><span style="color:#000000">el texto del </span><span style="color:#000000">punto </span><span style="color:#000000">14</span><span style="color:#000000"> </span><span style="color:#000000">del</span><span style="color:#000000"> apartado III del</span><span style="color:#000000"> a</span><span style="color:#000000">nexo</span><span style="color:#000000"> </span><span style="color:#000000">1 del</span><span style="color:#000000"> A</span><span style="color:#000000">cuerdo</span><span style="color:#000000"> </span><span style="color:#000000">del Consejo de Gobierno de 25 de octubre de 2021 </span><span style="color:#000000">por el </span><span style="color:#000000">que</span><span style="color:#000000"> </span><span style="color:#000000">se establecen los niveles de alerta sanitaria </span><span style="color:#000000">a</span><span style="color:#000000"> aplicar en cada una de las islas </span><span style="color:#000000">y se modifica puntualmente</span><span style="color:#000000"> el Plan de Medidas de Prevención, Contención y Coordinación Frente a la COVID-19, </span><span style="color:#000000">con </span><span style="color:#000000">la </span><span style="color:#000000">siguiente redacción:</span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em><strong>14. Medidas aplicables en fiestas populares en territorios en nivel de alerta sanitaria 3 o superior</strong> </em></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>Se observarán las siguientes medidas: </em></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a) Bailes populares </em></span></span></span></p>
<p style="margin-left:80px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>- Las actividades de baile (bailes populares) que puedan realizarse en cualquier evento se desarrollarán con uso obligatorio de mascarilla y en espacios delimitados.</em></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b) Celebraciones religiosas</em></span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>-Las celebraciones religiosas respetarán en todo momento el aforo máximo de los lugares de culto.</em></span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>-Los participantes permanecerán sentados y usando mascarilla.</em></span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>- La entrada y salida del lugar de culto se realizarán de forma ordenada y evitando hacerlo por el mismo acceso o salida.</em></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>c) Pasacalles, desfiles</em></span></span></span></p>
<p style="margin-left:80px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>Se procurará que el público asistente a estas actividades —se participa de modo estático— lo haga manteniendo la distancia de seguridad. Por eso, se aplicarán medidas que hagan posible un mayor esponjamiento del espacio donde se realizan. Se recomienda ampliar los recorridos y/o ampliar las zonas donde se desarrollan estas actividades para evitar aglomeraciones de personas.</em></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>d) Eventos multitudinarios populares</em></span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>- Se procurará la distancia máxima posible entre los asistentes al evento.</em></span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>- Será obligatorio el uso de mascarilla, aunque el evento se realice al aire libre.</em></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Cuarto.</strong></span><span style="color:#000000"> </span><span style="color:#000000">Aprobar el </span><span style="color:#000000">t</span><span style="color:#000000">exto consolidado, </span><span style="color:#000000">que figura como anexo al presente </span><span style="color:#000000">Acuerdo, del </span><span style="color:#000000">Plan de Medidas de Prevención, Contención y Coordinación </span><span style="color:#000000">F</span><span style="color:#000000">rente a la COVID-19, </span><span style="color:#000000">aprobado </span><span style="color:#000000">mediante el anexo </span><span style="color:#000000">1</span><span style="color:#000000"> del Acuerdo del Consejo de Gobierno de 25 de octubre de 2021 </span><span style="color:#000000">por el </span><span style="color:#000000">que</span><span style="color:#000000"> se aprueb</span><span style="color:#000000">a</span><span style="color:#000000">n</span><span style="color:#000000"> </span><span style="color:#000000">el Plan de Medidas de Prevención, Contención y Coordinación Frente a la COVID-19 y el </span><span style="color:#000000">Plan Específico de Medidas de Prevención y Contención de la COVID-19 en los Servicios Sociales,</span><span style="color:#000000"> y se</span><span style="color:#000000"> establecen los niveles de alerta sanitaria </span><span style="color:#000000">a aplicar en cada una de las islas.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Quinto. </strong>Aprobar</span><span style="color:#000000">, en los términos que resultan del anexo </span><span style="color:#000000">2</span><span style="color:#000000"> </span><span style="color:#000000">de</span><span style="color:#000000"> este Acuerdo, </span><span style="color:#000000">el </span><span style="color:#000000">texto del </span><span style="color:#000000">nuevo </span><span style="color:#000000">Plan Específico de Medidas de Prevención y Contención de la COVID-19 en los Servicios Sociales, </span><span style="color:#000000">que se aprobó </span><span style="color:#000000">como </span><span style="color:#000000">ane</span><span style="color:#000000">xo 2 </span><span style="color:#000000">del Acuerdo del Consejo de Gobierno de 25 de octubre de 2021 </span><span style="color:#000000">por el </span><span style="color:#000000">que</span><span style="color:#000000"> se aprueb</span><span style="color:#000000">a</span><span style="color:#000000">n</span><span style="color:#000000"> </span><span style="color:#000000">el Plan de Medidas de Prevención, Contención y Coordinación Frente a la COVID-19 y el </span><span style="color:#000000">Plan Específico de Medidas de Prevención y Contención de la COVID-19 en los Servicios Sociales,</span><span style="color:#000000"> y se</span><span style="color:#000000"> establecen los niveles de alerta sanitaria </span><span style="color:#000000">a aplicar en cada una de las islas. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Sexto. </strong>N</span><span style="color:#000000">otificar </span><span style="color:#000000">este Acuerdo </span><span style="color:#000000">a la Delegación del Gobierno en las Illes Balears y a la dirección operativa del Plan Territorial de Protección Civil de la Comuni</span><span style="color:#000000">d</span><span style="color:#000000">a</span><span style="color:#000000">d Autónoma de las Illes Balears (PLATERBAL) para la transición hacia una nueva normalidad derivada de la situación de emergencia de salud pública ocasionada por la COVID-19. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Séptimo. </strong>Hacer constar que corresponderá a la Administración de la Comunidad Autónoma de las Illes Balears y a los ayuntamientos, en el ámbito de sus competencias, las funciones de vigilancia, inspección y control del correcto cumplimiento de las obligaciones previstas en este Acuerdo, para garantizar su efectividad. A tal efecto, las citadas administraciones podrán solicitar la colaboración de los cuerpos y fuerzas de seguridad del Estado. El incumplimiento de las medidas podrá ser sancionado de conformidad con la normativa aplicable en materia de salud pública.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Octavo.</strong> Comunicar a la Dirección de la Abogacía este Acuerdo con el objeto de que, de considerarlo oportuno, lo presente ante el órgano judicial competente al efecto establecido en el artículo 10.8 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Noveno. </strong></span><span style="color:#000000">Publicar </span><span style="color:#000000">el presente</span><span style="color:#000000"> Acuerdo en </span><span style="color:#000000">el <em>Boletín Oficial de las Illes Balears.</em></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Décimo</strong></span><span style="color:#000000"><strong>. </strong>Contra este Acuerdo, que pone fin a la vía administrativa, cabrá interponer recurso potestativo de reposición ante el mismo órgano dictante, en el plazo de un mes a contar desde su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, o, alternativamente, recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears, en el plazo de dos meses a contar desde su publicación, conforme a los artículos 10.1 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa. </span></span></span></p>
