    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13&amp;nbsp;de diciembre de 2019, por la cual se convocan, para el año 2019, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="color:#212121"&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#212121"&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 30/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 3&amp;nbsp;de&amp;nbsp;enero&lt;/span&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;de 2022&lt;/span&gt;&lt;span style="color:#212121"&gt;, firmó la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.El &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;mayo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1, el vicepresidente del FOGAIBA dictó una Resolución de concesión de ayudas para inversiones en la prevención de los daños causados a los bosques por incendios forestales, desastres naturales y catástrofes (R1), que se publicó en el Boletín Oficial de las Islas Baleares número 6&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, del 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;mayo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1, en la que figuraba una concesión a favor de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;MARIA MARÍ TORRES&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, con NIF ***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;4099&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;**, con un importe de ayuda de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;12.240&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,00 € y un plazo de 12 meses,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;desde el día siguiente de la fecha de notificación, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con número de expediente PIFO 2018_1/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;076.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3.El &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;22&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;diciembre&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 202&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, con registro de entrada núm. L95E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;623089&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, la persona indicada en el apartado anterior presentó &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;su renuncia a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;la ayuda, lo que supone llevar a cabo la revocaci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ón total de la ayuda concedida.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;4.El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece la obligación de la Administración a dictar resolución expresa y a notificarla. En su párrafo segundo especifica que «En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con la indicación de los hechos producidos y las normas aplicables ».&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;5.El&amp;nbsp;artículo&amp;nbsp;43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente».&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;6.Por&amp;nbsp;todo ello, se propone hacer la revocación total debido a la renuncia de la ayuda concedida por el beneficiario que se indica en el anexo de esta resolución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares desde 2014 hasta 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3.
