    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La erosión genética es el proceso de pérdida de variedades y razas de las especies domésticas y silvestres de plantas y animales, y es un proceso continuo y generalizado a nivel mundial y nacional. Las causas son: la introducción de especies y variedades foráneas, los procesos de transformación de las prácticas y sistemas agropecuarios tradicionales y las exigencias de los mercados. Todo ello ha contribuido a relegar muchas especies y variedades nativas, por sustitución y competencia, de manera que se han ido imponiendo variedades vegetales comerciales por encima de las variedades autóctonas. Con la pérdida de una especie o de una variedad local se elimina, de manera irreversible, la diversidad genética en ella contenida, que naturalmente incluye gérmenes de adaptación a la zona en que evolucionó, siendo este uno de los principales riesgos de pérdida de biodiversidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los recursos filogenéticos son de vital importancia para garantizar el futuro y la sostenibilidad de la agricultura, ya que suponen una enorme fuente de información y material genético para adaptarnos a los nuevos retos del sector y a las demandas del mercado. En este sentido, la pérdida de variabilidad genética supone una limitación de la capacidad de responder a nuevas necesidades y un incremento de la vulnerabilidad de nuestros cultivos ante cambios ambientales o aparición de nuevas plagas o enfermedades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Como ya se ha demostrado en diferentes ocasiones, los recursos filogenéticos constituyen una garantía para la seguridad alimentaria y son la base para crear nuevas variedades. Además, ayudan a mantener el equilibrio del ecosistema mediante la utilización de especies apropiadas, adaptadas al territorio y seleccionadas durante cientos de años por sus cualidades. Algunas de estas variedades poseen, por ejemplo, características que las hacen más resistentes a la sequía o al calor estival, por lo que pueden contribuir a la mitigación de los efectos del cambio climático en nuestra agricultura. Dentro de los recursos filogenéticos, las variedades localmente adaptadas tienen un especial interés, ya que, además de soportar mejor las condiciones climáticas del entorno, forman parte de una identidad cultural y de una gastronomía singular de cada territorio.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La protección de variedades autóctonas en riesgo de erosión genética es el sistema agrícola de producción de alimentos, de equilibrio del ecosistema con especies adaptadas a nuestro territorio y de producción de productos de alta calidad que tiene como objeto reducir los efectos contaminantes en las aguas y los suelos con el fomento de la adopción de metodologías de producción vegetal que utilicen al máximo los recursos fitogenéticos y los mecanismos de producción naturales y aseguren a largo plazo una agricultura sostenible y la protección de los recursos fitogenéticos que constituyen una garantía para la seguridad alimentaria y son la base para crear nuevas variedades. La producción de variedades autóctonas en riesgo de erosión genética, a diferencia de lo que pasa con la producción ecológica, permite el uso de productos agroquímicos de síntesis, como abono, pesticidas y otros.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El Programa de desarrollo rural de las Illes Balears para el periodo 2014-2020 (PDR) contempla una serie de medidas de ayuda destinadas al sector agrario, según el Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm. 1698/2005 del Consejo, que establece las normas generales que regulan la ayuda de la Unión al desarrollo rural financiada por el Fondo Europeo Agrícola de Desarrollo Rural (FEADER), complementando las disposiciones comunes para los fondos estructurales y de inversión europeos, establecidas en la segunda parte del Reglamento (UE) núm. 1303/2013 del Parlamento Europeo y del Consejo. En concreto, entre otras medidas, se contempla en el PDR la submedida 10.1.3 correspondiente a la protección de variedades autóctonas en riesgo de erosión genética.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El proceso de abandono de la actividad agraria se considera una problemática esencial en las Illes Balears, no tan solo de cara al mantenimiento del tejido socioeconómico de las zonas rurales, sino también desde el punto de vista medioambiental en relación con el mantenimiento de gran parte del territorio del archipiélago (en concreto, un 73% de la superficie total está ocupada por cultivos, así como por pastos con árboles y arbustos). En estas áreas, la agricultura tiene una incidencia crucial en términos de conservación del paisaje, prevención de incendios, calidad del entorno y conservación de hábitats, especies protegidas y mantenimiento de razas autóctonas y variedades locales.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Esta submedida contribuye claramente a los objetivos transversales de mejora del medio ambiente y adaptación y mitigación del cambio climático, ya que supone un fomento de prácticas respetuosas con el medio ambiente adaptadas a los ecosistemas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De acuerdo con lo dispuesto en el punto 5 del artículo 28 del Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), los compromisos en virtud de esta medida se contraerán por un periodo de cinco a siete años, lo que está recogido en el Programa de desarrollo rural, y podrán ser prorrogados para alcanzar o mantener los objetivos medioambientales. No obstante, para los nuevos compromisos que deban asumirse a partir del 2021, los Estados miembros fijarán un periodo de uno a tres años en su programa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El Reglamento (UE) núm. 2220/2020 del Parlamento Europeo y del Consejo, de 23 de diciembre de 2020, por el que se establecen determinadas disposiciones transitorias para la ayuda del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y del Fondo Europeo Agrícola de Garantía (FEAGA) en los años 2021 y 2022, y por el que se modifican los reglamentos (UE) núm. 1305/2013, (UE) núm. 1306/2013 y (UE) núm. 1307/2013, en lo que respecta a sus recursos y a su aplicación en los años 2021 y 2022, y el Reglamento (UE) núm. 1308/2013, en lo que respecta a los recursos y la distribución de esta ayuda en los años 2021 y 2022, prorrogó el periodo de duración de los programas financiados por el FEADER hasta el 31 de diciembre del 2022.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En fecha 26 de febrero del 2015 se publicó en el &lt;/span&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; núm. 29 la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de desarrollo rural de las Illes Balears 2014-2020, que en su artículo 2 señala que serán objeto de ayuda, entre otras actividades, la protección de variedades autóctonas en riesgo de erosión genética.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por otra parte, el Decreto 64/2005, de 10 de junio, de creación del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA), establece en su artículo 2.&lt;/span&gt;&lt;em&gt;a&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; que el FOGAIBA tiene por objeto ejecutar la política de la consejería competente en materia de agricultura y pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero, incluidas las derivadas de la política agrícola común y de los fondos procedentes del Instrumento Financiero de Orientación de la Pesca, de las medidas de desarrollo rural y de otros regímenes de ayudas previstos por la normativa de la Unión Europea.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De acuerdo con lo dispuesto en el artículo 15 del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre, y en el artículo 3 de la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de desarrollo rural de las Illes Balears 2014-2020, corresponde aprobar la convocatoria de estas ayudas mediante una resolución.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por todo ello, en virtud de lo establecido en el artículo 6.1.&lt;/span&gt;&lt;em&gt;g&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; del Decreto 64/2005, de 10 de junio, de creación del Fondo de Garantía Agraria y Pesquera de las Illes Balears, a propuesta del director gerente del FOGAIBA y de conformidad con la autoridad de gestión, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Primero&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Objeto de las ayudas y ámbito de aplicación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Se aprueba la convocatoria, correspondiente al año 2022, de las ayudas destinadas a la protección de variedades autóctonas en riego de erosión genética, de acuerdo con lo establecido en la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de desarrollo rural de las Illes Balears 2014-2020, publicada en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; núm. 29, de 26 de febrero de 2015.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Las ayudas objeto de la presente convocatoria tienen como finalidad dar apoyo a los agricultores que utilicen las variedades vegetales en riesgo de erosión genética de interés en las islas, por el trabajo y esfuerzo que realizan para conservar el material genético y para luchar contra su desnaturalización, así como para preservar la genética de nuestras variedades vegetales autóctonas amenazadas y recuperar unas variedades mucho más adaptadas a nuestras condiciones de cultivo, con una buena rusticidad, más resistentes a las plagas y enfermedades, que compensen la pérdida de rendimiento frente a las variedades comerciales con una mayor producción y calidad, de acuerdo con lo establecido en el Programa de desarrollo rural de las Illes Balears para el periodo 2014-2020 y en el artículo 28 del Reglamento (CE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. El ámbito territorial de aplicación de las ayudas reguladas en esta convocatoria es todo el territorio de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Segundo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Importe máximo de la convocatoria y financiación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Para esta convocatoria se destina un importe máximo de ciento ochenta mil euros (180.000,00&amp;nbsp;€), con posibilidad de ampliar sus créditos, con cargo a los presupuestos del FOGAIBA del año 2022. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Dichas subvencionas se financiarán en un 50% a cargo del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en un 5% a cargo del Ministerio de Agricultura, Pesca y Alimentación (MAPA) y en un 45% a cargo de la Comunidad Autónoma de las Illes Balears (CAIB).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Tercero&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Requisitos de las personas beneficiarias y de las explotaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Requisitos específicos de las personas beneficiarias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Pueden ser beneficiarias de las ayudas previstas en esta convocatoria las personas físicas o jurídicas o agrupaciones sin personalidad jurídica que se acojan al cumplimiento de los compromisos previstos en el apartado noveno de esta resolución y que, antes de dictarse la propuesta de resolución, cumplan los siguientes requisitos: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a&lt;/em&gt;. Que sean agricultores inscritos en el Registro Insular Agrario (RIA) como titulares de una explotación agraria que cumpla los requisitos previstos en el punto 2 del presente apartado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b&lt;/em&gt;. Que estén inscritos en alguna asociación o agrupación de agricultores y/o productores que tenga como objetivo la conservación o el mantenimiento de los cultivos en peligro de erosión genética y cumplan las obligaciones que se deriven de esta inscripción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Cuando se trate de personas físicas o jurídicas sin personalidad jurídica propia, se deben hacer constar expresamente, tanto en la solicitud como en la resolución de concesión, los compromisos de ejecución que asume cada uno de los miembros y también el porcentaje de la subvención que debe aplicarse a cada uno de ellos, los cuales tienen igualmente la consideración de beneficiarios. En cualquier caso, se debe nombrar a un representante o apoderado único de la agrupación, con poder suficiente para cumplir las obligaciones que, como beneficiaria, corresponden a la agrupación. La agrupación no podrá disolverse hasta que hayan transcurrido los plazos de prescripción previstos en el artículo 24 de la Ley 14/2014, de 29 de diciembre, de finanzas de la Comunidad Autónoma de las Illes Balears, y en el artículo 57 del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Requisitos específicos de las explotaciones&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Las explotaciones agrarias para las que se solicite la ayuda objeto de esta convocatoria deberán reunir, antes de dictarse la propuesta de resolución, los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a&lt;/em&gt;. Estar ubicadas en el territorio de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b&lt;/em&gt;. Estar inscritos en el Registro Insular Agrario (RIA).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c&lt;/em&gt;. Cultivar alguna o algunas de las variedades autóctonas en riesgo de erosión genética detalladas en el anexo I.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d&lt;/em&gt;. Disponer de una superficie mínima de 0,3 hectáreas y dedicarla al cultivo en riesgo de erosión genética. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Los requisitos generales y los compromisos establecidos en los puntos anteriores deberán mantenerse durante todo el año 2022.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. La comprobación de la inscripción en el Registro Interinsular Agrario (RIA) se realizará de oficio, excepto manifestación contraria del peticionario, ya que con la presentación de la solicitud se entiende otorgada esta autorización.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. Además, deberán cumplirse los requisitos previstos en el artículo 10 de la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de desarrollo rural de las Illes Balears 2014-2020; así como los establecidos en el Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6. De acuerdo con lo dispuesto en el artículo 10.1.&lt;/span&gt;&lt;em&gt;e&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre, se considerará que los beneficiarios se encuentran al corriente de las obligaciones tributarias y con la Seguridad Social cuando se verifique lo dispuesto en el artículo 38 del Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears, así como en los artículos 18 y 19 del Real decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones. La circunstancia de estar al corriente de las obligaciones tributarias, estatales y autonómicas, y con la Seguridad Social deberá quedar acreditada con anterioridad a dictarse la propuesta de resolución de concesión.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La comprobación del cumplimiento de dicho requisito será realizada por el FOGAIBA y/o la Consejería de Agricultura, Pesca y Alimentación, ya que la presentación de la solicitud de subvención supone la autorización para su comprobación, excepto si existe manifestación expresa contraria. Cuando el solicitante de la ayuda no esté obligado a presentar las declaraciones o documentos a que se refieren las obligaciones anteriores, o cuando la cuantía de la subvención sea igual o inferior a 3.000,00 euros, se acreditará su cumplimiento mediante declaración responsable.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En el caso de que la persona interesada haya presentado declaración responsable, si durante la instrucción del procedimiento resulta que el importe de la subvención es superior a 3.000,00 euros, se le requerirá para que aporte la justificación de este requisito, salvo que se haya autorizado al FOGAIBA para efectuar la comprobación de oficio.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;7. De acuerdo con lo dispuesto en el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres, tampoco podrán ser beneficiarias de las subvenciones previstas en esta resolución las empresas y las entidades solicitantes sancionadas o condenadas, en los últimos tres años, por resolución administrativa o sentencia judicial firmes, por haber ejercido o tolerado prácticas laborales consideradas discriminatorias por razón de sexo o de género.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;8. Para las definiciones aplicables a todo lo previsto en la presente Resolución, será de aplicación la Ley 3/2019, de 31 enero, agraria de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Cuarto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Actividad subvencionable&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Podrán ser objeto de subvención las actuaciones consistentes en el cultivo y la conservación de una superficie y un número limitado de variedades vegetales autóctonas y las Illes Balears, con la finalidad de reducir el riesgo de erosión genética que sufren, durante la campaña 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Quinto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Importe de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. La superficie máxima auxiliable de cada una de las variedades relacionadas en el anexo I de esta Resolución, para el conjunto de todas las solicitudes presentadas y &amp;nbsp;dependiendo del grupo de cultivo al que pertenecen, será la siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Variedades incluidas en el grupo de cultivos herbáceos: 75&amp;nbsp;ha/variedad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Variedades incluidas en el grupo de cultivos hortícolas: 20&amp;nbsp;ha/variedad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Variedades incluidas en el grupo de cultivos frutales: 20&amp;nbsp;ha/variedad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En caso de que la suma de todas las superficies solicitadas de una variedad, superen los máximos anteriores se prorrateará entre los beneficiarios la superficie máxima auxiliable en relación a la superficie solicitada para cada uno de ellos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. El importe de la ayuda, aplicable por grupo de cultivo, se calculará de la siguiente manera:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Herbáceos: 565,00&amp;nbsp;€/ha&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Hortícolas: 600,00&amp;nbsp;€/ha&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Frutales: 800,00&amp;nbsp;€/ha&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="background-color:white; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Estas primas se incrementarán en las cantidades siguientes,&amp;nbsp;en el caso que se sustituya la aportación al suelo de abono nitrogenado por abono foliar en los términos previstos en el punto 3 del apartado noveno, hasta un máximo de 600,00€/ha en cultivos anuales y 900,00€/ha en cultivos permanentes:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="background-color:white; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Herbáceos is&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; 12,48 €/ha.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:normal"&gt;Hortícolas al Aire libre&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; 37,44 €/ha.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:normal"&gt;Frutales&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; 37,44 €/ha.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Sexto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Solicitud de ayuda&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Las solicitudes de ayuda se presentarán junto con la solicitud de las ayudas para el ejercicio 2022, previstas en el Real decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir del 2015 de los pagos directos a la agricultura y a la ganadería y otros regímenes de ayuda, así como sobre la gestión y control de los pagos directos y de los pagos al desarrollo rural, o disposición normativa que lo sustituya. Con la solicitud de ayuda se entiende que también se solicita el pago de la anualidad correspondiente a la campaña 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Estas solicitudes deben presentarse en la forma prevista en la Resolución de la presidenta del FOGAIBA de convocatoria, para el año 2022, de determinadas ayudas comunitarias directas a la agricultura y la ganadería.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La solicitud se debe cumplimentar y presentar mediante la aplicación informática Sistema de Gestión de Ayudas (SGA), que se encuentra a disposición en las oficinas que dependen del FOGAIBA y de las entidades colaboradoras designadas; además, se deben suministrar todos los datos requeridos, así como asumir los compromisos, otorgar las autorizaciones y hacer declaraciones que contiene dicha aplicación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. A estas solicitudes debe adjuntarse la siguiente documentación:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;a&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. En su caso, documento de la representación con la actúa la persona que firma la solicitud. Esta acreditación debe estar vigente en el momento de la solicitud. La representación debe acreditarse en la forma prevista en el artículo 5.4 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;b&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Si el solicitante es persona jurídica, copia del NIF.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;c&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. En caso de agrupaciones sin personalidad jurídica, también habrá que aportar:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Documento en el que quedan reflejadas las normas o la reglamentación de funcionamiento que hayan suscrito todos los miembros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Copia del NIF de la agrupación.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Documento suscrito por todos los miembros de la agrupación en el que queden identificados y se hagan constar expresamente los compromisos que asume cada uno de ellos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Nombramiento de una persona en representación o apoderado único de la agrupación con poder suficiente para cumplir las obligaciones que corresponden a la agrupación como beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Documento suscrito por todos los miembros de la agrupación en el que se haga constar el compromiso de no disolver la agrupación hasta que haya transcurrido el plazo de prescripción previsto en el artículo 24 de la Ley 14/2014, de 29 de diciembre, de finanzas de la Comunidad Autónoma de las Illes Balears, y en el artículo 57 del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;d&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Justificación de la titularidad de la cuenta bancaria en la que se solicita el pago de la ayuda. En el caso de entidades sin personalidad jurídica debe facilitarse el número de cuenta de la entidad.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;e&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Certificado de pertenecer a una asociación o agrupación de agricultores y/o productores que tenga como objetivo la conservación o el mantenimiento de los cultivos en peligro de erosión genética y el cumplimiento de las obligaciones que se deriven de ello.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Según lo establecido en el artículo 13 del Reglamento delegado (UE) núm. 640/2014 de la Comisión, de 11 de marzo de 2014, y en el artículo 95.3 del Real decreto 1075/2014, de 19 de diciembre de 2014, y sin perjuicio del resto de exclusiones y penalizaciones establecidas en la normativa de aplicación, las solicitudes presentadas durante los 25 días naturales siguientes a la finalización del plazo establecido en el punto 1 anterior, a excepción de los casos de fuerza mayor y circunstancias excepcionales, serán aceptadas, pero el importe de la ayuda será reducido en un 1% por cada día hábil de retraso. Esta reducción también se aplicará respecto a la documentación que se deba presentar junto con la solicitud cuando sea un elemento constitutivo de la admisibilidad de la ayuda. Si este retraso es superior a 25 días naturales, la solicitud se considerará inadmisible y no se concederá la ayuda al peticionario.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. La presentación de la solicitud de ayuda supone la aceptación, por parte de la persona interesada, de todo el contenido de esta convocatoria, así como de las bases reguladoras establecidas en la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015 y del resto de normativa de aplicación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. En caso de que con ocasión de la tramitación de otros expedientes en el FOGAIBA ya se haya presentado alguno de los documentos mencionados anteriormente, no será necesario aportarlo de nuevo, siempre que se haga constar la fecha y el órgano o dependencia en que fue presentado o, en su caso, emitido y no hayan transcurrido más de cinco años desde la finalización del procedimiento al que correspondan. Asimismo, no será necesario aportarlo de nuevo si el documento exigido ha sido incorporado a la base documental del FOGAIBA, prevista en el Decreto 53/2006, de 16 de junio, con la comprobación previa de la autenticidad del documento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En los supuestos de imposibilidad material de obtener el documento, el órgano competente podrá requerir al solicitante la presentación o, por defecto, la acreditación por otros medios de los requisitos a los que se refiere el documento, con anterioridad a la formulación de la propuesta de resolución.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6. La comprobación del DNI del beneficiario y de los representantes la realizará de oficio el FOGAIBA. En el caso de que se quiera denegar expresamente la autorización al FOGAIBA y/o a la Consejería de Agricultura, Pesca y Alimentación para la obtención del DNI, de los certificados de estar al corriente de las obligaciones tributarias, estatales y autonómicas, y con la Seguridad Social, deberán aportarse un documento de denegación y los certificados correspondientes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En caso de que no se esté obligado a presentar las declaraciones o documentos a los que se refieren las obligaciones anteriores o cuando la cuantía de la subvención sea igual o inferior a 3.000,00 euros, se acreditará su cumplimiento mediante declaración responsable.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;7. De acuerdo con lo previsto en el artículo 28 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas, no será necesario presentar la documentación o los datos que se puedan obtener por medios telemáticos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Si la solicitud tiene algún defecto o no adjunta toda la documentación mencionada en los puntos anteriores, se requerirá a la persona solicitante mediante una publicación en la página web del FOGAIBA para que, en el plazo de diez días, enmiende el defecto o aporte la documentación, con la indicación de que, si no lo hace, se entenderá desistida su solicitud y, con la resolución previa, se archivará el expediente sin ningún otro trámite.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;8. Cuando en cualquiera de los documentos que sea necesario presentar durante la tramitación del expediente se presenten tachaduras o enmiendas, será considerado no presentado, y se procederá en este caso de acuerdo con lo indicado en el artículo 68 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. Las diferentes notificaciones de enmienda de defectos que se dicten se publicarán en la página web los días 1 y 15 de cada mes, o el día hábil siguiente si estos son festivos, y cada lunes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Séptimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Selección de los beneficiarios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. El procedimiento para la selección de los beneficiarios de las ayudas convocadas mediante esta resolución será el de concurrencia no competitiva&lt;span style="color:black"&gt;; en consecuencia, se seleccionará a todos los beneficiarios solicitantes que cumplan los requisitos de esta convocatoria y adjunten a su solicitud la documentación necesaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. En caso de que el conjunto de las solicitudes con derecho a ayuda supere el importe que se destina a esta convocatoria, se reducirá a cada beneficiario en el mismo porcentaje unitario correspondiente al ajuste presupuestario.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Octavo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Instrucción del procedimiento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. El órgano competente para la instrucción del procedimiento de concesión de las ayudas es el Área de Gestión de Ayudas del FOGAIBA. Este órgano llevará a cabo, de oficio, las actuaciones necesarias para la determinación, el conocimiento y la comprobación de los datos en virtud de los cuales se debe dictar la resolución. En el caso de que sea necesario notificar la propuesta de resolución, esta notificación se hará mediante su publicación en la página web del FOGAIBA cada lunes y los días 1 y 15 de cada mes, o el día hábil siguiente si estos son inhábiles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Se puede prescindir del trámite de notificación de la propuesta de resolución provisional cuando no figuren en el procedimiento ni sean tenidos en cuenta otros hechos, alegaciones y pruebas que los que han aducido las personas interesadas. En este caso, la propuesta de resolución formulada tiene carácter de definitiva.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Cuando la subvención tenga por objeto la financiación de actividades a desarrollar por el solicitante y el importe de la subvención de la propuesta de resolución provisional sea inferior al que figura en la solicitud presentada, se puede instar al beneficiario la reformulación de la solicitud para ajustar los compromisos y las condiciones a la subvención otorgable.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En cualquier caso, la reformulación de solicitudes debe respetar el objeto, las condiciones y la finalidad de la subvención, así como los criterios de valoración establecidos en relación con las solicitudes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Habiendo examinado las alegaciones que han formulado las personas interesadas, en su caso, debe formularse la propuesta de resolución definitiva, la cual debe expresar a la persona solicitante o la lista de personas solicitantes para las que se propone la concesión de la subvención, su cuantía, la financiación por parte de las diferentes administraciones y la medida del programa de que se trate.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. La resolución de los expedientes la dictará el vicepresidente en materia agraria del FOGAIBA, a propuesta del jefe del Servicio de Ayudas al Desarrollo Rural y previo informe de la sección competente del Servicio de Ayudas al Desarrollo Rural del FOGAIBA, en el que se acreditarán, en caso de ser favorable, la legalidad de la ayuda y su importe. En la resolución de concesión de la ayuda se deben hacer constar la financiación por parte de las distintas administraciones y el fondo europeo al que se imputa el gasto.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. El plazo máximo para dictar y notificar la resolución expresa es de seis meses, a contar a partir de la finalización del plazo de presentación de solicitudes, y debe notificarse mediante su publicación en el &lt;/span&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Transcurrido este tiempo sin haberse notificado la resolución expresa, la persona interesada podrá entender desestimada su solicitud.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Excepcionalmente, y de conformidad con lo establecido en el artículo 23 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, podrá acordarse la ampliación del plazo máximo para dictar resolución. En este caso, el acuerdo de ampliación se debe producir antes del vencimiento del plazo y se notificará a las personas interesadas mediante su publicación en el BOIB.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la consejera de Agricultura, Pesca y Alimentación en el plazo de un mes, a partir del día siguiente al de su notificación, de acuerdo con lo establecido en el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y en los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;strong&gt;Noveno&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Obligaciones y compromisos de los beneficiarios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Los beneficiarios se comprometen y se obligan, durante todo el año 2022, a: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;a&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Mantener, sin disminuir, la superficie comprometida en la resolución de concesión de la ayuda, independientemente de que pueda variar la ubicación del cultivo dentro de las parcelas que integran la explotación agraria o de los cambios de las parcelas donde se ubica el cultivo. Este compromiso se considerará cumplido con una tolerancia máxima de disminución de la superficie comprometida de un 10%. El cumplimiento de este compromiso se verificará en control administrativo por comparación con el SIGPAC.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De acuerdo con el artículo 3 del Reglamento (CE) núm. 809/2014 de la Comisión, de 17 de julio de 2014, las solicitudes podrán retirarse parcialmente y la superficie comprometida podrá reducirse respecto a la inicialmente aprobada. En este supuesto, el beneficiario deberá reembolsar, en su caso, la parte recibida por la superficie retirada. Cuando, por parte del FOGAIBA, se haya informado al beneficiario de la existencia de irregularidades en la solicitud o se haya avisado de la intención de efectuar un control de campo o cuando este control de campo haya puesto de manifiesto irregularidades, no se permitirá retirar las partes de la solicitud de ayuda afectada por estas irregularidades.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;b&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Actualizar el cuaderno de explotación que incluya la parte I del anexo III y los elementos indicados en el punto 3 del artículo 16 del Real decreto 1311/2012, de 14 de septiembre, por el que se establece el marco de actuación para conseguir un uso sostenible de los productos fitosanitarios. En el cuaderno de explotación se inscribirán las operaciones de cultivo y actuaciones realizadas (abono, fitosanitarios, cultivo, etc.) en cada una de las parcelas (o grupo de parcelas, en caso de ser del mismo cultivo), con indicación de la fecha de realización y de las incidencias, si las hay.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;c&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Participar, durante el periodo de compromiso, en actividades de formación relacionadas con la medida agroambiental. Por eso, deberá justificar la asistencia a algún curso o actividad de formación técnica, relacionados con la materia, de un mínimo de 10 horas a lo largo de todo el periodo de compromiso. Este compromiso podrá sustituirse por una titulación mínima en formación agrícola reglada de nivel de formación profesional superior. Se comprobará en control administrativo.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;d&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Reservar el 5% del material vegetal de reproducción obtenido en el caso de cultivos anuales. Se comprobará en control de campo.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;e&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Someterse a las actuaciones de comprobación y de control que sean procedentes por parte de las administraciones autonómica, estatal y comunitaria, la Sindicatura de Cuentas u otros órganos de control externo, necesarias para comprobar la correcta concesión de la ayuda y el posterior mantenimiento de los compromisos y aportar toda la documentación que sea requerida en el ejercicio de estas actuaciones.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;f&lt;/span&gt;&lt;/em&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. &lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Ejercer la agricultura sostenible en toda la explotación agraria, de acuerdo con los requisitos y los compromisos de condicionalidad definidos en el Reglamento (CE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013; en el Reglamento (CE) núm. 809/2014 de la Comisión, de 17 de julio de 2014; en el Real decreto 1078/2014, de 19 de diciembre, por el que se establecen las normas de la condicionalidad que deben cumplir los beneficiarios que reciban pagos directos, determinadas primas anuales de desarrollo rural o pagos en virtud de determinados programas de apoyo al sector vitivinícola, y la Orden de la consejera de Agricultura y Pesca de 22 de noviembre de 2005, por la que se establecen los requisitos legales de gestión y las condiciones agrarias y medioambientales, parcialmente modificada por la Orden de la consejera de Agricultura y Pesca de 11 de enero de 2007 y la Orden del consejero de Economía, Agricultura, Comercio e Industria de 3 de enero de 2000, de aprobación del Código de buenas prácticas agrícolas de las Illes Balears. La verificación del cumplimiento del compromiso tiene su propio plan de controles de condicionalidad.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Asimismo, los beneficiarios se comprometen y se obligan, durante el periodo de la campaña de la solicitud, a contar desde la fecha de la presentación de la solicitud de ayuda, a estar inscritos en alguna asociación o agrupación de agricultores y/o productores, que tenga como objetivo la conservación o el mantenimiento de los cultivos en peligro de erosión genética y a cumplir las obligaciones que se deriven de esta inscripción. Esta inscripción podrá hacerse efectiva hasta el momento de antes de dictarse la propuesta de resolución.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Adicionalmente y de forma voluntaria los beneficiarios podrán asumir el compromiso de sustituir la aportación al suelo del abono nitrogenado por abono foliar. Dicho compromiso se comprobara con la aportación por parte del beneficiario, a requerimiento del órgano gestor del FOGAIBA, de las facturas de compra y justificantes de pago de abono foliar por los equivalentes a las siguientes cantidades de aportación de abono al suelo:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;strong&gt;&lt;span style="background-color:white; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;GRUPO DE CULTIVO&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;UFN/HA Y AÑO&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Herbáceos&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; 75&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Hortícolas&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;&amp;nbsp; 200&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Frutales&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; 130&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. Los compromisos que componen la línea de base y que las personas beneficiarias deben asumir son los siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;a&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Disponer de asesoramiento, tal y como lo define el Real decreto 1311/2012 citados.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;b&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Disponer de carné de usuario profesional en las condiciones y casos que define dicho Real decreto 1311/2012.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;c&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Cumplir las normas de almacenaje y rechazo de los productos fitosanitarios, de acuerdo con lo establecido en los reales decretos 1311/2012 citado y 285/2021, de 20 de abril.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;d&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. En los tratamientos en los que se tengan que aplicar productos químicos, solo podrán utilizarse las materias activas autorizadas para cada cultivo y plaga/efecto, de acuerdo con criterios de toxicidad, efectos sobre la fauna auxiliar y menor impacto ambiental, entre otros, criterios que se revisan periódicamente.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;e&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Disponer del cuaderno de explotación que incluya la parte I del anexo III y los elementos indicados en el punto 3 del artículo 16 del Real decreto 1311/2012, de 14 de septiembre, por el que se establece el marco de actuación para conseguir un uso sostenible de los productos fitosanitarios. En el cuaderno de explotación se inscribirán las operaciones de cultivo y actuaciones realizadas (abono, fitosanitarios, cultivo, etc.) en cada una de las parcelas (o grupo de parcelas, en caso de ser del mismo cultivo), con indicación de la fecha de realización y de las incidencias, si las hay.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. En caso de que se modifiquen las normas o los requisitos obligatorios establecidos en el artículo 28.3 del Reglamento (CE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, en los artículos 93 y 94 del Reglamento (CE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, y en su anexo II, así como los requisitos mínimos establecidos en la legislación autonómica o nacional, y cuando esta modificación implique unos compromisos más rigurosos que los suscritos por la persona beneficiaria, esta deberá asumir los nuevos compromisos impuestos por la modificación. En caso de que la adaptación a los nuevos compromisos no sea aceptada por el beneficiario, el compromiso se entenderá finalizado sin que se exija ningún reembolso por el periodo de compromiso efectivo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6. Estas obligaciones se entenderán sin perjuicio de la obligación de cumplir lo previsto en el artículo 11 del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre, y el artículo 11 de la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se aprueban las bases reguladoras para la concesión de subvenciones en el marco del Programa de desarrollo rural de las Illes Balears 2014-2020, así como el resto de la normativa estatal y comunitaria de aplicación.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;7. El régimen jurídico aplicable por el incumplimiento de estas obligaciones, sin perjuicio de lo establecido en el apartado duodécimo de la presente resolución, es el previsto en el Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones, y comprende desde el reintegro de la ayuda y el pago del interés de demora hasta la imposición de las sanciones correspondientes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Décimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Cesión y traspaso de la explotación &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Si, después de presentarse una solicitud de ayuda y antes de que se hayan cumplido todas las condiciones para su concesión, una explotación es cedida por un beneficiario a otro en su totalidad, no se concederá al cedente ninguna ayuda en relación con la explotación cedida. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La ayuda solicitada por el cedente se concederá al cesionario de acuerdo con lo dispuesto en el artículo 8 del Reglamento (CE) núm. 809/2014 de la Comisión, de 17 de julio de 2014, siempre y cuando el nuevo titular:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a. Informe al FOGAIBA de la cesión y solicite el pago de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b. Presente la documentación mencionada en el apartado sexto de esta resolución. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c. Cumpla todas las condiciones exigidas para la concesión de la ayuda respecto de la explotación cedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Si, durante el periodo de ejecución de un compromiso contraído como condición para la concesión de la ayuda, la persona beneficiaria transfiere total o parcialmente su explotación a otra persona, el compromiso o la parte del compromiso que corresponda a la tierra transferida podrán ser asumidos por el nuevo titular durante el periodo que queda por cumplir o caducar, de acuerdo con lo dispuesto en el artículo 47 del Reglamento (CE) núm. 1305/2013 del Parlamento y del Consejo, de 17 de diciembre de 2013, sin que se exija ningún reembolso por el periodo durante el cual el compromiso fue efectivo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. En caso de que el nuevo titular quiera solicitar el pago de la ayuda o asumir el compromiso, respectivamente, deberá presentar una instancia en el plazo de dos meses desde la cesión o traspaso, mediante la aplicación informática Sistema General de Ayudas (SGA) que se encuentra a disposición en las oficinas que dependen del FOGAIBA y de las entidades colaboradoras designadas, que deberá estar firmada por las partes interesadas; deberá adjuntarse la documentación indicada en el apartado sexto, punto 5, de la presente resolución, junto con el documento acreditativo de la cesión o traspaso de la explotación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Se deberán suministrar todos los datos que se indican en la citada aplicación, así como asumir los compromisos, otorgar las autorizaciones y hacer las declaraciones que contiene la misma.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. La comprobación de la inscripción en el Registro Interinsular Agrario (RIA) se realizará de oficio, excepto manifestación contraria del peticionario, ya que con la presentación de la solicitud de subrogación de la ayuda se entiende otorgada la autorización para su comprobación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Igualmente, la comprobación del cumplimiento de estar al corriente de las obligaciones tributarias, estatales y autonómicas, y con la Seguridad Social, se realizará en los términos previstos en el punto 6 del apartado tercero de esta convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Undécimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Incumplimientos y renuncias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. En cuanto al régimen de reducciones y exclusiones, será de aplicación lo dispuesto en la siguiente normativa de aplicación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Por sobredeclaración de superficies: se aplica lo dispuesto en el artículo 19 del Reglamento (UE) núm. 640/2014 de la Comisión, de 11 de marzo de 2014, de acuerdo con el anexo II de esta resolución.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Por incumplimiento de criterios de admisibilidad: las reducciones y exclusiones por incumplimiento de los compromisos vinculados a la concesión de la ayuda, excepto los relativos a la medida de la superficie declarada, tendrán como base el artículo 35 del Reglamento (UE) núm. 640/2014 de la Comisión, de 11 de marzo de 2014, y se aplicarán de acuerdo con lo que indica el anexo II de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Por incumplimiento de la condicionalidad: serán de aplicación las reducciones o exclusiones previstas a artículo 99 del Reglamento (CE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En caso de acumulación de reducciones, estas se aplicarán de conformidad con lo dispuesto en el artículo 41 del Reglamento (UE) núm. 640/2014 de la Comisión, de 11 de marzo de 2014.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. En caso de que el beneficiario no pueda seguir asumiendo los compromisos suscritos porque su explotación es objeto de una operación de concentración parcelaria o de otras intervenciones de ordenación territorial públicas aprobadas por las autoridades competentes, se adoptarán las medidas necesarias para adaptar los compromisos a la nueva situación de la explotación. Si esta adaptación resulta imposible, el compromiso se entenderá terminado sin que se exija ningún reembolso por el periodo de compromiso efectivo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Duodécimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Justificación y pago de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. La solicitud de pago se entenderá presentada junto con la solicitud de ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. El importe de la ayuda concedida se abonará a la persona beneficiaria mediante transferencia bancaria y con la autorización previa del director gerente del FOGAIBA, una vez efectuados los controles y verificaciones correspondientes y cuando se haya justificado el cumplimiento de la finalidad para la que fue concedida.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. En cualquier caso deberán tenerse en cuenta las reducciones y las exclusiones previstas en el Reglamento de ejecución (UE) núm. 809/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, en lo que se refiere al sistema integrado de gestión y control, las medidas de desarrollo rural y la condicionalidad.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Decimotercero&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Ayudas no reintegrables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. De conformidad con lo establecido en el artículo 27 de la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015 y en el artículo 2.2 del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, no se procederá al reintegro de las ayudas recibidas cuando el incumplimiento de alguno de los requisitos, obligaciones o compromisos exigidos a la persona beneficiaria sea a causa de alguno de los siguientes casos de fuerza mayor o circunstancias excepcionales:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a&lt;/em&gt;. Muerte del beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b&lt;/em&gt;. Larga incapacidad profesional del beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c&lt;/em&gt;. Expropiación de la totalidad o de una parte importante de la explotación, si esta expropiación no era previsible el día en que se presentó la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d&lt;/em&gt;. Catástrofe natural grave que haya afectado gravemente a la explotación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;e&lt;/em&gt;. Destrucción accidental de los edificios ganaderos de la explotación. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;f&lt;/em&gt;. Epizootia o enfermedad vegetal que haya afectado a una parte o a la totalidad del ganado o de los cultivos, respectivamente, de la persona beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;No obstante, todo ello quedará condicionado al cumplimiento por parte de la persona beneficiaria de la obligación de notificar al órgano gestor los casos de fuerza mayor o las circunstancias excepcionales, adjuntando las pruebas pertinentes a satisfacción de este órgano, en el plazo de los quince días hábiles siguientes a la fecha en que la persona beneficiaria o su derechohabiente esté en condiciones de hacerlo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Igualmente, no procederá el reintegro de las ayudas recibidas en los demás casos previstos en el artículo 47 del Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Decimocuarto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Compatibilidades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Las actuaciones agroambientales objeto de las ayudas previstas en esta resolución solo pueden combinarse con otros compromisos agroambientales, cuando estos no sean incompatibles, es decir, cuando sean complementarios y compatibles entre sí, según lo establecido en el artículo 11 del Reglamento (UE) núm. 808/2014 de la Comisión, de 17 de julio de 2014.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Decimoquinto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Control de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Los perceptores de las ayudas reguladas en la presente resolución quedan sujetos a las disposiciones comunitarias de control establecidas en el Reglamento de ejecución (UE) núm. 809/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, en lo que se refiere al sistema integrado de gestión y control, las medidas de desarrollo rural y la condicionalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Los controles tienen como finalidad dar cumplimiento a lo establecido en el título III del Reglamento de ejecución (UE) núm. 809/2014 de la Comisión, de 17 de julio de 2014.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. De conformidad con lo dispuesto en el artículo 40 bis del Reglamento de ejecución (UE) núm. 809/2014 de la Comisión, de 17 de julio de 2014, así como en el artículo 99 del Real decreto 1075/2014, se efectuarán controles mediante monitorización sobre todos los expedientes de ayuda. En caso de detectarse incidencias, se notificarán al beneficiario afectado los resultados provisionales de los controles y este puede:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Aportar fotografías georreferenciades de cada recinto (panorámicas y de detalle) mediante la aplicación SGAFot que justifiquen la validez de su declaración, o&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Adaptar la solicitud única para adecuarla a la realidad del terreno, en el periodo permitido de modificación de la solicitud única que se fija en el artículo 96 del Real decreto 1075/2014, de 19 de diciembre. Esta adaptación debe respetar los compromisos aprobados en la resolución de concesión, para no tener penalización.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En caso de que el titular no aporte fotografías ni adapte la solicitud única en el plazo establecido, se penalizará al titular según corresponda.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Para cultivos protegidos (invernaderos, en túnel, etc.) es necesario que el titular realice fotografías preventivas cuando el cultivo ya esté desarrollado, ya que la monitorización no puede obtener datos de los cultivos protegidos. En caso de realizar diferentes cultivos (cultivo principal, cultivo secundario), deberán realizarse fotografías de cada uno de los cultivos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. Cualquier persona que tenga conocimiento de hechos que puedan ser constitutivos de fraude o irregularidad en relación con proyectos u operaciones financiados total o parcialmente con cargo a fondos procedentes de la Unión Europea en el marco de la presente convocatoria puede poner estos hechos en conocimiento del Servicio Nacional de Coordinación Antifraude de la Intervención General de la Administración del Estado, por medios electrónicos a través del canal habilitado a tal efecto por dicho servicio en la dirección web http://igaepre.central.sepg.minhac.age/sitios/igae/es-ES/Paginas/Denan.aspx, en los términos establecidos en la Comunicación 1/2017, de 3 de abril, del servicio mencionado.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Decimosexto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Régimen jurídico&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Para todo lo previsto en esta convocatoria, serán de aplicación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm. 1698/2005 del Consejo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, sobre la financiación, gestión y seguimiento de la política agrícola común, por el que se derogan los reglamentos (CE) núm. 352/78, (CE) núm. 165/94, (CE) núm. 2799/98, (CE) núm. 814/2000, (CE) núm. 1290/2005 y (CE) núm. 485/2008 del Consejo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El Reglamento de ejecución (UE) núm. 808/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El Reglamento de ejecución (UE) núm. 809/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, en lo que se refiere al sistema integrado de gestión y control, las medidas de desarrollo rural y la condicionalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El Reglamento (UE) 2020/2020 del Parlamento Europeo y del Consejo, de 23 de diciembre de 2020, por el que se establecen determinadas disposiciones transitorias para la ayuda del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y del Fondo Europeo Agrícola de Garantía (FEAGA) en los años 2021 y 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El Real decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir del 2015 de los pagos directos a la agricultura y a la ganadería (en el que se regula la condición de agricultor activo).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El Real decreto 1078/2014, de 19 de diciembre, por el que se establecen las normas de condicionalidad que deben cumplir los beneficiarios que reciban pagos directos o determinadas primas anuales de desarrollo rural, o pagos en virtud de los programas de apoyo a la reestructuración y reconversión o de apoyo a la cosecha en verde del viñedo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- La Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de desarrollo rural de las Illes Balears 2014-2020.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- La Ley 3/2019, de 31 de enero, agraria de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El resto de la normativa de desarrollo y aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Decimoséptimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Eficacia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La efectividad de esta resolución queda condicionada a la aprobación definitiva por parte de la Comisión Europea de la modificación del Programa de desarrollo rural de las Illes Balears para el periodo 2014-2020, así como a la aprobación de los nuevos criterios de selección por parte del Comité de Seguimiento del PDR, en los términos previstos en esta resolución. En caso contrario, se modificará con la finalidad de adaptarla al programa y a los criterios aprobados. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La sobredeclaración se calcula por grupo de cultivo como el resultado de la diferencia entre la superficie declarada en la solicitud y la determinada como resultado de los controles, dividida entre la superficie determinada y multiplicada por 100, es decir:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Las reducciones y exclusiones por sobredeclaración de superficies se calcularán de conformidad con lo dispuesto en el artículo 19 del Reglamento (UE) núm. 640/2014 de la Comisión, de 11 de marzo de 2014, según se indica a continuación:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Porcentaje de sobredeclaración de hasta el 3%: se concederá la ayuda por la superficie determinada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Porcentaje de sobredeclaración superior al 3% o a 2 hectáreas pero inferior o igual al 20%&amp;nbsp;de la superficie determinada: la ayuda correspondiente a la superficie determinada se reducirá en el doble de la diferencia en exceso por grupo de cultivo, excepto en los casos previstos en el Reglamento 640/2014.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Porcentaje de sobredeclaración superior al 20%: no se concederá ninguna ayuda por superficie para el grupo de cultivo en cuestión.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Porcentaje de sobredeclaración superior al 50%: no se concederá ninguna ayuda por superficie para el grupo de cultivo en cuestión. Además, la persona beneficiaria estará sujeta a una sanción adicional igual al importe de la ayuda correspondiente a la diferencia entre la superficie declarada y la superficie determinada según lo establecido en el artículo 18 del Reglamento (UE) 640/2014.&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;2. Reducciones en el caso de incumplimiento de criterios de admisibilidad, así como de compromisos y otras obligaciones&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Se entienden por criterios de admisibilidad aquellos compromisos vinculados a la concesión de la ayuda, excepto los relativos a la medida de la superficie, y se tipifican como excluyentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Las reducciones y exclusiones por incumplimiento de los criterios de admisibilidad tendrán como base el artículo 35 del Reglamento (UE) núm. 640/2014.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Dentro de los criterios de admisibilidad y compromisos se pueden diferenciar los siguientes tipos:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Compromisos excluyentes (CE): compromisos cuyo incumplimiento no respeta los criterios y/o requisitos establecidos en la concesión y que deben mantenerse a lo largo de toda la duración de la ayuda. Su incumplimiento tiene asociada una sanción del 100% de la ayuda, su exclusión y, cuando proceda, se solicitará el reintegro de los importes de los años anteriores. En caso de compensación con pagos futuros, si estos importes no se pueden recuperar íntegramente en los tres años naturales posteriores a aquel en que se ha descubierto el incumplimiento, se cancelará el saldo pendiente. En caso de incumplimiento grave, falsedad, intencionalidad y negligencia, el beneficiario quedará excluido de la medida durante el año natural de que se trate y el siguiente.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Compromisos evaluables (CV) en función de la gravedad, el alcance y la persistencia del incumplimiento observado. Estos compromisos evaluables se clasifican como:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;. Compromiso básico (CB): aquel compromiso cuyo incumplimiento implica consecuencias relevantes para los objetivos perseguidos por la medida en cuestión y estas repercusiones duran más de un año o es difícil ponerles fin con medios aceptables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;. Compromiso principal (CP): aquel compromiso cuyo incumplimiento implica consecuencias importantes para los objetivos perseguidos por la medida en cuestión y estas repercusiones duran menos de un año o es posible ponerles fin con medios aceptables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;. Compromiso secundario (CS): aquel que no se ajusta a las definiciones anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Los compromisos de la línea de ayuda de protección de variedades en riesgo de erosión genética están tipificados de la siguiente manera:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Mantener, sin disminuir, la superficie comprometida a nivel de grupo de cultivo en la resolución de concesión de la ayuda, independientemente de que pueda variar la ubicación del cultivo dentro de las parcelas que integran la explotación agraria o de los cambios de las parcelas donde se ubica el cultivo. Este compromiso se considerará cumplido con una tolerancia máxima de disminución de la superficie comprometida de un 10%. CS&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Actualizar el cuaderno de explotación en el que se inscribirán las operaciones de cultivo y actuaciones realizadas (abono, fitosanitarios, cultivo, etc.) en cada una de las parcelas (o grupo de parcelas, en caso de ser del mismo cultivo), con indicación de la fecha de realización y las incidencias, si las hay.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Disponer de cuaderno de explotación sin actualizar o con incorrecciones en un periodo anterior a los últimos tres: &lt;strong&gt;CP&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Disponer de cuaderno de explotación sin actualizar o con incorrecciones en los últimos tres: &lt;strong&gt;CS&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Participar, durante el periodo de compromiso, en actividades de formación relacionadas con la medida agroambiental. Por eso, deberá justificar la asistencia a algún curso o actividad de formación técnica, relacionados con la materia, de un mínimo de 10 horas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;No participar en actividades de formación o participar en actividades de formación de una duración inferior a 5 horas. &lt;strong&gt;CB&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Participar en actividades de formación de una duración igual o superior a 5 horas e inferior a 10 horas. &lt;strong&gt;CP&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Reservar el 5% del material vegetal de reproducción obtenido. &lt;/span&gt;&lt;strong&gt;CB&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Estar inscritos en alguna asociación o agrupación de agricultores y/o productores que tenga como objetivo la conservación o el mantenimiento de los cultivos tradicionales y/o en peligro de erosión genética y cumplir las obligaciones que se deriven de esta inscripción. &lt;/span&gt;&lt;strong&gt;CB&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Someterse a las actuaciones de comprobación y de control que sean procedentes por parte de las administraciones autonómica, estatal y comunitaria, la Sindicatura de Cuentas u otros órganos de control externo, necesarias para comprobar la correcta concesión de la ayuda y el posterior mantenimiento de los compromisos, y aportar toda la documentación que sea requerida en el ejercicio de estas actuaciones. &lt;/span&gt;&lt;strong&gt;CB&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;- Elementos que componen la línea de base. &lt;/span&gt;&lt;strong&gt;CB&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Las sanciones y exclusiones por incumplimientos de compromisos evaluables son las siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;1. COMPROMISOS BÁSICOS&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;100% de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;2. COMPROMISOS PRINCIPALES&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1 compromiso incumplido: 20% de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2 o más compromisos incumplidos: 40% de la ayuda. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;3. COMPROMISOS SECUNDARIOS&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1 compromiso incumplido: 5% de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2 o más compromisos incumplidos: 10% de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;4. EXCLUSIÓN&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Solo en casos de incumplimiento grave, falsedad, intencionalidad y negligencia, se solicitará el reintegro de los importes de años anteriores. En caso de compensación con pagos futuros, si estos importes no se pueden recuperar íntegramente en los tres años naturales posteriores a aquel en que se ha descubierto el incumplimiento, se cancelará el saldo pendiente. Además, el beneficiario quedará excluido de la misma medida durante el año natural en que se ha detectado el incumplimiento y el año natural siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Cuando los beneficiarios no hayan podido cumplir sus compromisos por motivos de fuerza mayor o circunstancias excepcionales, conservarán el derecho a la ayuda en el momento en que se haya producido el caso de fuerza mayor o la circunstancia excepcional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En cualquier caso, será de aplicación lo dispuesto en las circulares de coordinación que se dicten por parte de la autoridad de coordinación. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;5. INCUMPLIMIENTOS INTENCIONADOS&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De conformidad con lo dispuesto en el artículo 60 del Reglamento (UE) núm. 1306/2013, no se concederá ninguna ayuda a los beneficiarios que hayan creado artificialmente las condiciones exigidas para obtenerla.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De acuerdo con lo previsto en el artículo 101 del Real decreto 1075/2014, de 19 de diciembre, se podrán considerar situaciones de creación de condiciones artificiales todas aquellas operaciones detalladas en el anexo XV de dicho Real decreto.&lt;/span&gt;&lt;/p&gt;
