![CDATA[Ordenanza reguladora de los precios públicos por la prestación de servicios deportivos municipales]] 2022-01-28 41520 text/html ![CDATA[<p><strong><span style="color:black">Artículo 1º. Fundamento legal.</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">De conformidad con lo que prevé el artículo 127 en relación con el artículo 41 ambos del RD Legislativo 2/2004, de 5 de marzo, texto refundido de la ley reguladora de las haciendas locales, el Ayuntamiento de Inca sigue exigiendo el precio público para la prestación de servicios deportivos municipales que se regularán mediante la presente ordenanza.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Artículo 2º. Hecho imponible.</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">El hecho imponible del precio público se genera con la solicitud por la que se solicita cualquiera de los servicios o actividades especificados en el artículo 4. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Artículo 3º. Sujeto pasivo</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">b. 1.</span> <span style="color:black">Están obligados al pago del precio público, regulados en esta ordenanza, quienes se beneficien por la prestación de servicios deportivos municipales.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">c. 2. También estarán obligados al pago las personas físicas o jurídicas que soliciten para ellas o para terceras personas cualquiera de los servicios, prestaciones o actividades señalados en el artículo 3er. de esta ordenanza.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Artículo 4º. Bonificaciones y exenciones.</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. </span>Los casos derivados de los Servicios Sociales Municipales, y previo informe técnico, el Ayuntamiento podrá otorgar la exención de todo pago o la fijación de unas cuotas no previstas dentro del artículo anterior, cuando las circunstancias socioeconómicas de la persona solicitante manifiesten una situación no adecuada a las normas o uso que marquen en cada momento un nivel mínimo de subsistencia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstante, siempre que se produzcan modificaciones de la situación socioeconómica y familiar, el departamento de Servicios Sociales informará al Departamento de Deportes para que lleve a cabo la correspondiente revisión de cuotas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. Las familias numerosas gozarán de una bonificación de un 25% del precio público en las tarifas descritas en el artículo 4 cuando los sujetos pasivos de acuerdo con la normativa vigente tengan la condición de familia numerosa de conformidad con los requisitos regulados en la Ley 40/2003, de protección a las familias numerosas, debiéndose presentar la siguiente documentación: </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">a) Título oficial de familia numerosa emitido por el CIM, vigente a 1 de enero del ejercicio por el que se solicita la bonificación.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Certificado de convivencia, de que todos los miembros que figuran en el título oficial de familia numerosa conviven en el mismo domicilio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las familias monoparentales (constituida por un solo progenitor con el que conviva el hijo consanguíneo o adoptado y que constituya su sustentador único) gozarán de una bonificación de un 25% del precio público en las tarifas descritas en el artículo 4 , debiéndose acreditar mediante documentación que acredite que se trata de una familia monoparental y certificado de convivencia. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Las víctimas de un delito de violencia de género, así como los y las menores que estén bajo su patria potestad o guarda y custodia, gozarán de una bonificación de un 25% del precio público en las tarifas descritas en el artículo 4. La acreditación se hará mediante la presentación de la sentencia firme que acredite que ha sido víctima de un delito de violencia de género y el certificado de convivencia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Las personas discapacitadas que tenga la consideración legal en grado igual o superior al 33% gozarán de una bonificación del 25% del precio público de las tarifas descritas en el artículo 4, debiendo acreditar la condición de la discapacidad mediante la presentación del certificado expedido por el órgano competente. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;6. Las personas de 65 años o más, personas jubiladas y los pensionistas, gozarán de una bonificación del 25% del precio público de las tarifas descritas en el artículo 4, debiendo acreditar su condición mediante la presentación de la documentación adecuado.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Los titulares de carné joven, gozarán de una bonificación del 15% del precio público de las tarifas descritas en el artículo 4, debiendo acreditarlo mediante la presentación de la documentación que les acredite que son titulares del carné joven.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Únicamente en la actividad ordinaria por las tarifas del programa de Actividades físico-deportivas de Vacaciones Escolares (Campus Deportivo, de Navidad Deportiva y de Pascua Deportiva), y en caso de asistencia de un segundo hermano o hermana la tarifa establecida, se reducirá en un 25% por este segundo hermano o hermana, debiendo acreditarlo mediante la presentación del Libro de Familia y certificado de convivencia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. Los que únicamente hagan uso de las tarifas del programa de Actividades físico-deportivas de Verano y Vacaciones Escolares estarán exentos del pago de la cantidad de 10 € de inscripción/matrícula.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">10. Las bonificaciones de los puntos 2, 3, 4, 5, 6, 7 y 8 no se podrán simultanear y, por tanto, se aplicará la que más beneficie a la unidad familiar.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">11. Todas las bonificaciones anteriormente mencionadas deben aprobarse por acuerdo de la Junta de Gobierno, debiendo realizar en todos los casos, la petición/solicitud de exención al Ayuntamiento de Inca. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Fuera de los supuestos reconocidos en este artículo, no se reconocerá exención, reducción o bonificación en el pago de ese precio público.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">En relación con la aplicación de las reducciones vigentes en el sistema tributario municipal se entiende por unidad familiar el conjunto de las personas que conviven en un mismo inmueble, estén o no incluidas en el mismo libro de familia, todo con referencia al primer día natural de cada ejercicio.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Los referidos datos se acreditarán con el certificado de convivencia municipal. La referida acreditación no surtirá efectos si se observa que en el histórico de personas que conviven en el domicilio de empadronamiento objeto de la reducción consta la baja de cualquier persona en el cuarto trimestre del ejercicio y el alta de la misma persona a partir del segundo día natural del ejercicio.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Artículo 6º. Normas de gestión.</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. La obligación de pago de la inscripción del precio público regulado en esta ordenanza nace desde que se solicita cualquiera de los servicios o actividades especificados en el artículo 4.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. El pago de la inscripción y seguro se hará efectivo anualmente mediante la correspondiente liquidación emitida por el Departamento de Deportes del Ayuntamiento antes de formalizar la correspondiente matriculación y será irreductible, y se realizará el pago mediante las entidades bancarias colaboradoras.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">3. La recaudación del precio público se realizará, mediante domiciliación de recibos,</span> o <span style="color:black">mediante la correspondiente liquidación emitida por el Departamento de Deportes del Ayuntamiento, y se realizará el pago mediante las entidades bancarias colaboradoras, o mediante </span>tarjeta de crédito.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el supuesto de que se proceda a devolver los recibos que hayan sido domiciliados, los gastos que se generen serán debidamente asumidos por el usuario del servicio, informándose al usuario de la deuda pendiente, el cual deberá liquidarse antes de la finalización de la fecha de emisión del recibo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de que no se haga el ingreso dentro del plazo establecido se aplicará un recargo de un 5%, iniciándose el procedimiento de apremio correspondiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Una vez transcurrido el plazo de un mes contado a partir de la fecha de emisión de los recibos no abonados se procederá en el mes siguiente a dar de baja al usuario del servicio, perdiendo los derechos que le corresponderían sobre esta plaza, iniciando el procedimiento de apremio correspondiente. de las cantidades pendientes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La asistencia a las actividades deportivas infantiles, actividades físicas dirigidas a las Personas Mayores y actividades acuáticas de bebés, niños y jóvenes del programa de invierno y de verano, durante el período de octubre (año en curso) a enero (año siguiente) y de junio a septiembre, en la cuarta falta no justificada, se dará de baja el cursillista y perderá la plaza. Si existen reservas en el curso con la plaza vacante, el Servicio Municipal de Deportes se pondrá en contacto con quien corresponda.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. En caso de que la prestación del servicio no se realice por causas imputables a la Administración, los usuarios podrán solicitar la devolución del importe de la matrícula o la cuota pertinente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Si por motivos ajenos al Ayuntamiento de Inca, el usuario inscrito quisiera darse de baja, no tendrá derecho a la devolución de la tarifa abonada, salvo que la renuncia a la prestación del servicio (baja) haya sido notificada cinco días antes del inicio de la actividad.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Las devoluciones se tramitarán de la forma habitual, previa solicitud de la persona interesada </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Artículo 7º. Infracciones y sanciones tributarias</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Por lo que respecta a las infracciones y sanciones tributarias que, en relación al precio público regulado en esta Ordenanza, resulten procedentes, se aplicará lo que dispone la Ley General Tributaria, el Reglamento General de Recaudación, y la ordenanza general de gestión, recaudación , inspección de tributos y otros ingresos de derecho público locales o norma que las derogue o sustituya.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Disposición final.
