CAIB CAIB 2022-01-25 2022-01-24 es CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Mediante el Acuerdo de Consejo de Gobierno de 23 de diciembre de 2021 (BOIB número 176, de 25 de diciembre), se aprobó la oferta pública de empleo para el año 2021 correspondiente al personal funcionario y al personal laboral al servicio de la Comunidad Autónoma de las Illes Balears en el ámbito de los servicios generales.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En este Acuerdo se ha detectado un error en el número de plazas incluidas en el anexo 2, en el sentido de solo incluir una parte de la totalidad de las 44 plazas correspondientes a la promoción interna de la oferta ordinaria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, establece que estas pueden rectificar en cualquier momento, de oficio o a instancia de parte, los errores materiales, de hecho o aritméticos existentes en sus actos.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Por otra parte, el artículo 56 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, dispone que la rectificación de los errores materiales, aritméticos y de hecho en actos y disposiciones administrativas corresponde al órgano que haya dictado el acto o la disposición.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Visto que corresponde al Consejo de Gobierno aprobar las ofertas públicas de empleo, es necesario que el citado órgano apruebe este Acuerdo con el fin de que las rectificaciones sean válidas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Por todo ello, y de acuerdo con el artículo 5.2 <em>k</em> de la Ley 3/2007, de 27 de marzo, de la Función Pública de la Comunidad Autónoma de las Illes Balears, a propuesta de la consejera de Presidencia, Función Pública e Igualdad, en la sesión del dia 24 de enero de 2022 adoptó, entre otros, el Acuerdo siguiente:</span></span></p> <p style="margin-bottom:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Primero.</strong> Rectificar el <strong>anexo 2</strong> del Acuerdo del Consejo de Gobierno de 23 de diciembre de 2021 mediante el cual se aprobó la oferta pública de empleo para el año 2021 correspondiente al personal funcionario y al personal laboral al servicio de la Comunidad Autónoma de las Illes Balears en el ámbito de los servicios generales, en los términos establecidos en este Acuerdo.</span></span></p> <p style="margin-bottom:0px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Segundo.</strong> Publicar este acuerdo en el <em>Boletín Oficial de las Illes Balears</em>.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Contra este acuerdo, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el Consejo de Gobierno en el plazo de un mes a contar desde el día siguiente al de su publicación, de acuerdo con el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y el artículo 123 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">También cabe interponer un recurso contencioso-administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente al de su publicación, de acuerdo con los artículos 8.2, 10.1 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa, sin perjuicio de que la persona interesada pueda interponer cualquier otro que considere procedente.</span></span></p> <p> </p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif;
