    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13&amp;nbsp;de diciembre de 2019, por la cual se convocan, para el año 2019, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="color:#212121"&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#212121"&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 30/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 14&lt;/span&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;de enero&amp;nbsp;de 2022&lt;/span&gt;&lt;span style="color:#212121"&gt;, firmó la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

JOSEP ESCANDELL MARTINEZ &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con NIF &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;3901&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;**&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, en nombre y representación de la entidad FROZA SL con CIF B07459480 presentó en el registro del FOGAIBA una solicitud de ayuda para poder acogerse a la línea de ayudas por inversiones en la prevención de los daños causados a los bosques por incendios forestales, desastres naturales y catastróficos al amparo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para el año 2018, este tipo de subvenci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ón.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.Con fecha 15 de marzo de 2021 se publicó en la página web del FOGAIBA la propuesta provisional de concesión/denegación PIFO 2019 de día 11 de marzo de 2021. En sus ANEXOS no se encontraba incluida la entidad FROZA SL.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 3 de mayo de 2021 el vicepresidente en materia agraria del FOGAIBA dictó Resolución de concesión/denegación a los beneficiarios de las ayudas, R1 de fecha 3 de mayo de 2021 donde la entidad FROZA SL no formaba parte de ningún Anexo y por tanto, no se había ni denegado ni concedido la subvención a la sociedad.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;4.Con fecha 9 de junio de 2021, ASAJA BALEARS con CIF G57050098, en nombre y representación de la entidad FROZA SL interpuso recurso de alzada contra la Resolución de concesión/denegación a los beneficiarios de las ayudas, R1 de fecha 3 de mayo de 2021, alegando los siguientes puntos: que se estime el recurso de alzada y que se resuelva de forma favorable la ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;La documentación adjunta al recurso es la siguiente: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;5.Con fecha 6 de septiembre de 2021 se publicó en la página web del FOGAIBA la notificación de deficiencias donde se requería a la entidad FROZA SL en el plazo de 10 días a contar desde el día siguiente de la publicación de la notificación p&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ara presentar la siguiente documentación: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;En caso de personas jurídicas, fotocopia del NIF y de los estatutos sociales: Falta copia del NIF del representante y documento de representación en formato «apud acta».&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;6.Con fecha 9 de septiembre de 2021, SR. MANUEL ROSSIÑOL FUSTER, en nombre y representación de la entidad FROZA SL, presentó en el registro del FOGAIBA la siguiente documentación &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;o &amp;nbsp;para subsanar las deficiencias: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Fotocopia del NIF del sr. MANUEL FUSTER ROSSINYOL. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Elevación al público de acuerdo social donde consta que el sr. MANUEL ROSSIÑOL FUSTER actúa en nombre y representación de la entidad FROZA SL.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;7.Con fecha 14 de septiembre de 2021, SR. MANUEL ROSSIÑOL FUSTER, en nombre y representación de la entidad FROZA SL, presentó en el registro del FOGAIBA la siguiente documentación para subsanar las deficiencias: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Documento apud acta donde el sr. MANUEL ROSSIÑOL FUSTER, representante de FROZA SL, otorga la representación de la entidad a SR. JOSEP ESCANDELL MARTINEZ pa&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;r&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&amp;nbsp;los trámites relacionados con el expediente PIFO2019_2/001 hasta que finalice el procedimiento. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Fotocopia del NIF del sr. JOSEP MARTÍNEZ ESCANDELL y del sr. MANUEL ROSSIÑOL FUSTER.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;8.Con fecha 27 de septiembre de 2021, el jefe del Servicio de Ayudas al Desarrollo Rural emitió un informe técnico relativo al expediente de referencia en relación con el recurso de alzada interpuesto por el señor Josep Escandell Martínez contra la resolución de concesión a los beneficiarios de las ayudas del vicepresidente del FOGAIBA de 3 de mayo de 2021.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;9.Con fecha 22 de noviembre de 2021, la consellera de Agricultura, Pesca y Alimentación resolvió estimar el recurso de alzada interpuesto por ASAJA BALEARS, en nombre y representación de FROZA SL con NIF B07459480, contra la resolución de concesión a los beneficiarios de las ayudas del vicepresidente del FOGAIBA de 3 de mayo de 2021.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), p&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;or &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;la que se convocan, para &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;el año 2019, subvenciones para inversiones en la prevención de los daños causados a los bosques por incendios forestales, desastres naturales y catástrofes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares desde 2014 hasta 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015 de 1 de octubre de régimen jurídico de las administraciones públicas&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Propuesta de resolución &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente en materia agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Conceder al expediente PIFO 2019_2/0001, a nombre de FROZA SL con NIF B07459480, una subvención de 25.500,00 euros, relativa a la línea de ayuda “&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;nversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes para el año 2019 con cargo al presupuesto 100% CAIB y&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;a la anualidad de 2019.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.Determinar que, de acuerdo con lo que establece la convocatoria de referencia, las obligaciones de los beneficiarios serán las indicadas en el Anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. Notificar esta resolución al interesado mediante su publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, se puede interponer recurso de alzada ante e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l conseller de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Medio Ambiente, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Agricultura&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesca&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&amp;nbsp;en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 121 y 122, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Poner en marcha el plan empresarial como máximo durante los nueve meses siguientes a la fecha de concesión de la ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Ejercer la actividad agraria en la explotación durante al menos cinco años desde el momento del inicio de la actividad hasta cinco años después de la concesión de la ayuda. En el caso de las SRM (Sociedad rural menorquina), el joven agricultor incorporado podrá cambiar de SRM siempre que se cumplan los mismos requisitos y previa comunicación al FOGAIBA.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Mantener los requisitos y condiciones exigibles con respecto a las condiciones de la explotación durante este período. En el caso de la viabilidad económica de la explotación deberá mantenerse durante un mínimo de tres años a partir de que ésta sea alcanzada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Tener la consideración de agricultor activo, de acuerdo con lo dispuesto en el Capítulo I, Título II del Real Decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir de 2015 de los pagos directos a la agricultura ya la ganadería y otros regímenes de ayuda, así como sobre la gestión y control de los pagos directos y de los pagos al desarrollo rural, durante los dieciocho meses siguientes a la fecha de instalación. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Someterse a los controles que lleve a cabo la Administración, necesarios para comprobar la correcta concesión de la ayuda y posterior mantenimiento de los compromisos. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Cumplir, en su explotación, los requisitos legales de gestión, así como las buenas condiciones agrarias y medioambientales establecidas en los artículos 91, 92, 93, 94 y 95 del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Cumplir con las normas de información y publicidad previstas en el anexo III del Reglamento de ejecución (UE) núm. 808/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1305/2013, del Parlamento Europeo y del Consejo, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Cumplir con los compromisos adquiridos para la concesión de la ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Cumplir con las normas mínimas en materia de medio ambiente, higiene y bienestar de los animales, de conformidad con la normativa comunitaria y nacional, en un plazo máximo de 24 meses desde la instalación del joven. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Se informa a los beneficiarios de que sus expedientes se encuentran a su disposición y consulta en el Servicio de Ayudas al Desarrollo Rural del FOGAIBA (calle Reina Constança, nº 4 de Palma).&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
