&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Mediante Resolución del consejero de Modelo Económico, Turismo y Trabajo, y presidente del SOIB, de 29 de septiembre de 2020, (BOIB núm. 175, de 13 de octubre) se aprobó la convocatoria SOIB Joven Becas de Éxito para el estudio, del programa de segunda oportunidad para personas desocupadas de más de 18 y menos de 30 años, que estén matriculados en los cursos de segundo, tercero y cuarto de educación secundaria de personas adultas (ESPA) o en ciclos de formación profesional presencial de grado medio o de grado superior sostenidos con fondos públicos de la CAIB, para el periodo 2020-2021 cofinanciada por el Fondo Social Europeo a través del Programa Operativo de Ocupación Juvenil, para el periodo 2014-2020, y de la Iniciativa de Ocupación Juvenil, para el periodo 2020-2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. De acuerdo con el punto primero del anexo de la Resolución de la convocatoria mencionada, estas becas están dirigidas a personas desocupadas mayores de 30 años que cursen entre otros, ciclos de formación profesional presencial de grado medio o superior sostenidos con fondos públicos de la CAIB durante el curso académico 2020-2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. De acuerdo con el apartado 10 del anexo de la resolución de la convocatoria mencionada, el SOIB tiene que tramitar el pago una vez finalizado el curso escolar y comprobar de oficio que cumple con los requisitos que establece esta convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Se ha comprobado que los alumnos que constan en el anexo de esta resolución están al corriente con el cumplimiento de sus obligaciones tributarias con la Hacienda de la Comunidad Autónoma de las Illes Balears, la Seguridad Social y las obligaciones tributarias con la administración del Estado, y cumplen las obligaciones que constan en el punto 5.1 del anexo de la Resolución de convocatoria y en el resto de normativa aplicable.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Hay crédito adecuado y suficiente en la partida presupuestaria 76101 322D11 48000 00 19114 de los presupuestos de la Comunidad Autónoma de las Illes Balears para el año en curso.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Resolución del consejero de Modelo Económico, Turismo y Trabajo, y presidente del SOIB, de 29 de septiembre de 2020, (BOIB núm. 175 de 13 de octubre) por la cual se aprueba la convocatoria SOIB Joven Becas de Éxtio para conceder becas para el estudio, del programa de segunda oportunidad para personas desocupadas de més de 18 y menos de 30 años inscritas en el Sistema Nacional de Garantía Juvenil, cofinanciada por el Fondo Social Europeo a través del Programa Operativo de Ocupación Juvenil, para el periodo 2014-2020, y de la Iniciativa de Ocupación Juvenil, 20-21. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El artículo 2.2 del Decreto 22/2020, de 24 de julio, de aprobación del Texto Consolidado del Decreto de aprobación de los Estatutos del Servicio de Ocupación de las Islas Baleares (BOIB núm. 131, de 25 de julio) establece que el SOIB, para cumplir sus fines, puede llevar a cabo, entre otros, las funciones necesarias para gestionar las políticas activas de empleo; gestionar el conjunto de programas y medidas de orientación, empleo, formación y formación con alternancia con el empleo, que tienen por objeto mejorar las posibilidades de acceso a la colocación de las personas, desocupadas en el mercado de trabajo, por cuenta propia o de otros; la adaptación de la formación y recalificación para el empleo de los trabajadores, así como las otras acciones destinadas a fomentar el espíritu empresarial, la economía social y a mejorar las condiciones de los trabajadores.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. De acuerdo con los apartados g) y i) del artículo 9.4 del anexo del Decreto 22/2020, de 24 de julio, de aprobación del Texto consolidado del Decreto de aprobación de los Estatutos del Servicio de Ocupación de las Illes Balears (BOIB núm. 131, de 25 de julio), es función del presidente del SOIB autorizar gastos, contraer obligaciones y proponer pagos del servicio, así como conceder ayudas y subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La Ley 38/2003, de 17 de noviembre, general de subvenciones, tiene por objeto la regulación del régimen jurídico general de las subvenciones otorgadas por las administraciones públicas (BOE nº 276, de 18 de noviembre).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones (BOIB num. 196, de 31 de diciembre) tiene por objeto determinar el régimen jurídico de las subvenciones, cuya gestión corresponde a la Administración de la Comunidad Autónoma de las Illes Balears o a las entidades públicas que de ella dependen.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. De acuerdo con el artículo 39.7 del Decreto Legislativo 2/2005, de 28 de diciembre, las subvenciones que se conceden en consideración a la concurrencia de una determinada situación en el perceptor, no requieren ninguna otra justificación que la acreditación por cualquier medio admisible en derecho de la situación mencionada previamente a la concesión, sin perjuicio de los controles que se puedan establecer para verificar su existencia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Orden de la consejera de Educación, Cultura y Universidades, de 10 de octubre de 2013, por la cual se establecen las bases reguladoras de las subvenciones en materia de políticas activas de ocupación gestionadas por el Servicio de Empleo de las Illes Balears (BOIB núm. 146, de 24 de octubre).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. De acuerdo con el artículo 7.3 de la Orden de la consejera de Educación, Cultura y Universidades, de 10 de octubre de 2013, la selección de los beneficiarios se puede llevar a cabo por procedimientos que no son de concurso cuando no sean necesarias la comparación y la prelación, en un único procedimiento, de todas las solicitudes entre sí (de acuerdo con el artículo 17.2 del Decreto legislativo 2/2005, de 28 de diciembre)&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. La Ley 13/2014, de 29 de diciembre, de presupuestos generales de la Comunidad Autónoma de las Illes Balears para el año 2015, en la disposición final séptima modifica el artículo 1 de la Ley 7/2000, de 15 de junio, de creación del Servicio de Ocupación de las Illes Balears, y lo define como un organismo autónomo dotado de personalidad jurídica propia y plena capacidad de obrar, adscrito a la consejería competente en materia de trabajo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. De acuerdo con el Decreto 11/2021, de 15 de febrero, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 21, de 15 de febrero de 2021), el SOIB está adscrito Consejería de Modelo Económico, Turismo y Trabajo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. El artículo de la Ley 30/2015 de procedimiento administrativo común que establece que se podrá prescindir del trámite de audiencia cuando no figuren en el procedimiento ni deben ser tenidos en cuenta en la resolución otros hechos ni otras alegaciones y pruebas que las aducidas por el interesado&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Conclusiones&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, informo favorablemente sobre la 2ª concesión de subvenciones en concepto de becas dirigidas a personas jóvenes desocupadas entre 18 y 29 años inscritas en el Sistema Nacional de Garantía Juvenil que han promocionado de primero a segundo o titulado en un ciclo de formación profesional presencial de grado medio o superior sostenido con fondos públicos de la CAIB durante el curso académico 2020-2021, de los alumnos que constan en el anexo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Conceder una subvención por un importe global de 34.506,00 € en concepto de beca para asistencia a las persones beneficiarias que consten en el anexo I de esta Resolución.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El importe total de la beca que corresponde a cada alumno se ha de calcular de acuerdo con el que establece el apartado 7 del anexo de la Resolución del consejero de Modelo Económico, Turismo y Trabajo, y presidente del SOIB, de 29 de septiembre de 2020 (BOIB núm. 175, de 13 de octubre) (568 euros por ámbito de conocimiento cursado en cualquiera de los dos cursos académicos).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Autorizar y disponer el gasto por un importe global de 34.506,00 € a favor de los beneficiarios que consten en el anexo de esta Resolución, a cargo de la partida presupuestaria 76101 322D11 48000 00 19114 de los presupuestos de la Comunidad Autónoma de las Illes Balears pera el año 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Reconocer la obligación y proponer el pago por un importe global de 34.506,00 € a favor de les persones beneficiarias que constan en el anexo de esta Resolución, con cargo a la partida presupuestaria 76101 322D11 48000 00 19114 de los presupuestos de la Comunidad Autónoma de las Illes Balears pera el año 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Publicar esta Resolución en el Boletín Oficial de las Illes Balears y a la página web del Servicio de Empleo de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Consejero de Modelo Económico, Turismo y Trabajo y presidente del SOIB en el plazo de un mes a contar desde el día siguiente de la publicación, acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears También se puede interponer directamente un recurso contencioso administrativo ante el Juzgado Contencioso Administrativo en el plazo de dos meses contados desde el día siguiente de la publicación,de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso administrativa. &lt;/span&gt;&lt;/p&gt;
