Aprobar laconvocatoria de subvencionesen los ayuntamientos de Mallorca hasta 50.000 habitantes para dar a la juventud en el año 2022. </span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Autorizar un gasto de 300.000,00 €, con cargo a la aplicación presupuestaria 65.33410.46200, del año 2022,RCcon nº. de operación 220219000784 de 240.000 € (Línea 1) y otraRCcon nº. de operación 220219000785 de 60.000 € (Línea 2) </span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Cañameras Bernaldo</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">El Consejo Ejecutivo del Consejo Insular de Mallorca, a través de la Dirección Insular de Participación y Juventud, por acuerdo de dia 22 de diciembre de 2022 y de acuerdo con los objetivos fijados en el Plan Estratégico de Subvenciones del año 2022 aprobó una convocatoria pública de acuerdo con la Ordenanza general de subvenciones del Consejo Insular de Mallorca, aprobada por acuerdo del Pleno de 23 de diciembre de 2016 (BOIB nº. 21, de 18 de febrero de 2017), modificada por acuerdo del Pleno de 14 de junio de 2018 (BOIB 96, de 4 de agosto de 2018).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong>1. Objeto de la convocatoria</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">El objeto de la presente convocatoria es dar apoyo a las entidades locales para que puedan desarrollar políticas activas de juventud, desde diferentes ámbitos, y promover así el beneficio sociocomunitario que supone la implicación de las personas jóvenes en su realidad inmediata desde una vertiente institucional y recogen los objetivos siguientes:&nbsp; </span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Facilitar el ejercicio de la ciudadanía activa de la población joven en acciones sociales, culturales y educativas no regladas a través de las iniciativas propuestas en el ámbito local. </span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Fomentar modelos de hábitos saludables, de inclusión social y de bienestar emocional para la juventud. </span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Desarrollar acciones socioeducativas que favorezcan la equidad de género y la igualdad de oportunidades.</span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong>2. Beneficiarios</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">2.1. Ayuntamientos de Mallorca, con una población hasta 50.000 habitantes, dividida en dos líneas: </span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Línea 1 (<span style="color:purple">L1</span>): Ayuntamientos de Mallorca, con una población igual o inferior a 20.000 habitantes y la entidad local menor de Palmanyola. </span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Línea 2 (L2): Ayuntamientos de Mallorca, con una población superior a 20.000 habitantes e inferior a 50.000 habitantes. </span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Los datos referentes a la población que se tendrán en cuenta son los que constan en el Instituto de Estadística de las Islas Baleares (IBESTAT) a 1 de enero de 2020. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">2.2. No pueden acogerse a la ayuda económica las entidades en las cuales concurra alguna de las prohibiciones establecidas en el artículo 8 de la Ordenanza general de subvenciones (BOIB nº. 21, de 18 de febrero de 2017).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong>3. Naturaleza de las subvenciones</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">3.1. Las subvenciones de esta convocatoria son de carácter voluntario y eventual, anulables, revocables y reintegrables en todo momento por las causas previstas en la Ordenanza general de subvenciones. Además, no generan ningún derecho a obtener otras subvenciones en años posteriores y no se pueden alegar como precedente. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong>4. Régimen de compatibilidad con otras ayudas o subvenciones</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">De acuerdo con el que se prevé en el artículo 16 de la Ordenanza general de subvenciones del Consejo Insular de Mallorca, la subvención otorgada es compatible con otras subvenciones, ayudas, ingresos o recursos para la misma finalidad, procedentes de cualquier otra administración o entes públicos o privados, nacionales, de la Unión Europea o de organismos internacionales, siempre que el importe no sea, en ningún caso, de una cuantía que, aisladamente o conjuntamente con las otras subvenciones, supere el coste de la actividad que la persona beneficiaria tiene que llevar a cabo o el valor de la situación objeto de financiación, y sin perjuicio de lo que se establezca en la normativa por la cual se regulan estas otras subvenciones concurrentes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5. Régimen de concurrencia</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.1.&nbsp; Estas subvenciones se conceden de acuerdo con los principios indicados en el artículo 5.4 de la Ordenanza general de subvenciones del Consejo Insular de Mallorca.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El procedimiento para seleccionar las entidades beneficiarias es la concurrencia no competitiva por cuantía fija, por<span style="color:green"><span style="display:none">&lt;A[por|para]&gt;</span></span> lo cual, no se fija un orden de prelación si las solicitudes reúnen los requisitos y si hay crédito suficiente. En caso contrario, la prelación de la concesión vendrá dada por<span style="display:none">&lt;A[por|para]&gt;</span> la orden de entrada de la solicitud en el registro, siempre que el expediente sea correcto y aporte los documentos preceptivos, hasta que se agote el total del crédito asignado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.2. Las solicitudes presentadas pueden perder el número de orden de entrada si se les ha hecho algún requerimiento para enmendar la documentación. En este caso, la entidad beneficiaria pasará a tener el número de orden de entrada obtenido en el momento de presentar la documentación enmendada en el Registro General. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6. Actuaciones y gastos subvencionables </strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dentro el objetivos de la convocatoria se han concretado en dos líneas de actuación, segundo la entidad local que las lleve a cabo.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.1. Actuaciones subvencionables línea 1 (<span style="color:purple">L1</span>)</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.1. a) Nóminas y Seguridad Social del personal fijo o eventual del Servicio de Juventud del ayuntamiento o por contrato con otra entidad a través de facturas que desarrollen programas, campañas o proyectos de dinamización juvenil organizadas por el ayuntamiento.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.1. b) Programas, campañas y/o proyectos de dinamización juvenil y/o información juvenil que se desarrollen desde las áreas de juventud. (Mirar glosario, apartado 6.4.)</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.1. c) Actividades de formación de reciclaje y perfeccionamiento dirigidas al personal de dinamización juvenil que contribuyan a una mejora del servicio de juventud. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para que<span style="display:none">&lt;A[Porque|Para que]&gt;</span> una actividad pueda ser subvencionable no puede haber sido subvencionada en ninguna otra convocatoria de subvenciones del Consejo de Mallorca dentro del mismo periodo de ejecución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.2. Actuaciones subvencionables línea 2 (L2): </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.2. a) Hasta el 50% de las nóminas y Seguridad Social del personal fijo o eventual del Servicio de Juventud del ayuntamiento o por contrato con otra entidad a través de facturas que desarrollen programas, campañas o proyectos de dinamización juvenil organizadas por el ayuntamiento.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.2. b) Programas, campañas y/o proyectos dirigidos a las siguientes temáticas: información afectiva-sexual, salud mental, movilidad, emancipación, trabajo y/o sobre la puesta en marcha de servicios o procesos participativos. (Mirar glosario, apartado 6.4.)</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.2. c) Desarrollo de un Plan<span style="display:none">&lt;A[Plan|Plano]&gt;</span> local de Juventud participado y dirigido a la población (de 16 a 30 años). Con las siguientes fases:</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Publicidad e información previa a agentes implicados.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Análisis de la realidad y evaluación del anterior plan<span style="display:none">&lt;A[plan|plano]&gt;</span>, si hay.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Proceso de recogida de propuestas. </span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Tratamiento de la información obtenido al punto <span style="color:red">b</span> y c.&nbsp; </span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Preparación de las primeras líneas de elaboración.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Retorno a los jóvenes y redacción del plan<span style="display:none">&lt;A[plan|plano]&gt;</span>.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">g)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Aprobación del plan<span style="display:none">&lt;A[plan|plano]&gt;</span> por<span style="display:none">&lt;A[por|para]&gt;</span> Pleno y difusión.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.3. Cualquiera de las actuaciones subvencionadas tienen que ir destinadas únicamente a jóvenes de entre 12 y 30 años, a excepción del apartado 6.2.c). </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.4. Glosario de términos</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El presente glosario contiene la definición de términos de la Convocatoria de subvenciones para los ayuntamientos de Mallorca de menos de 50.000 habitantes para dar apoyo a la juventud en el año 2022, con el fin de poder interpretar y aclarar conceptos: </span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Plan<span style="display:none">&lt;A[Plan|Plano]&gt;</span>: </strong>Se trata de un guion sistemático que se elabora antes de realizar una acción. </span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Programa: </strong>Conjunto de proyectos relacionados, que se pueden ejecutar a la hora o secuencialmente, con los mismos objetivos.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Campaña:</strong> Conjunto de actuaciones con un mismo hilo conductor que se llevan a cabo con la intención de difundir una idea concreta.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Proyecto: </strong>Conjunto de acciones interrelacionadas, integradas en una misma planificación, que se ejecutan coordinadamente, con el objetivo de conseguir una meta concreta, durante un periodo de tiempo determinado. El proyecto puede formar parte de un programa o plan<span style="display:none">&lt;A[plan|plano]&gt;</span> más amplio.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Actividad: </strong>Acción puntual que se desarrolla en el marco de un proyecto o campaña.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Acontecimiento:</strong><strong> </strong>Hecho o suceso puntual de relevante importancia que se encuentra programado en el marco de un proyecto o una campaña. </span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.5. Se consideran subvencionables los gastos que, de manera indudable, responden a la naturaleza de la actuación subvencionada, resultan estrictamente necesarios y se efectúan en el periodo de elegibilidad de los gastos establecido en el apartado 6.6. de esta convocatoria. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En ningún caso, el coste de adquisición de los gastos subvencionables puede ser superior al valor de mercado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los gastos subvencionables de esta convocatoria son los siguientes:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Costes laborales del personal vinculado a la concejalía de juventud y/o al servicio de dinamización y/o de información juvenil, aunque sea de manera proporcional, excepto los que se mencionan en el punto 7 de estas bases.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Gastos corrientes derivados de la actuación subvencionable: arrendamiento de instalaciones, de equipamientos, de vehículos o de maquinaria que expresamente se hayan contratado para llevar a cabo la actividad subvencionada.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Materiales divulgativos, informativos. En este apartado, se incluyen, entre otros, todo tipo de publicaciones o materiales que informen de la actuación subvencionable o lo promocionen, como un programa de actividades de la actuación subvencionable, un reportaje informativo sobre algún aspecto de la actividad subvencionada, cartelería, planos<span style="display:none">&lt;A[planes|planos]&gt;</span>, trípticos.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Bienes consumibles en general. Se incluyen los bienes fungibles directamente relacionados con la actuación subvencionable, como material de papelería, ferretería, etc.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Seguros de accidentes y de responsabilidad civil directamente relacionadas con la acción concreta objeto de la subvención.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Transporte, montaje y desmontaje de instalaciones temporales.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Servicios de limpieza, vigilancia, ambulancia y otros servicios personales directamente relacionados con la actividad subvencionada.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.6. El periodo de elegibilidad de los gastos subvencionables es el comprendido entre el 1 de enero de 2022 y el 31 de diciembre de 2022, inclusive. La fecha de emisión de las facturas o de los justificantes de gasto tiene que ser dentro de este periodo.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>7. Actuaciones y gastos no subvencionables</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.1. Son actuaciones no subvencionables a los efectos de esta convocatoria:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quedan excluidas de esta subvención todas las actividades y/o acciones que no respeten los objetivos y valores en que se prevén en el punto 1 de esta convocatoria. </span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quedan excluidos de esta subvención las actividades, proyectos, campañas y/o acciones que no tengan a las personas jóvenes como destinatarias.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quedan excluidas de esta subvención las actividades, proyectos y/o acciones con carácter lucrativo, comercial, mercantil o similar, y las actividades vinculadas a partidos políticos u organizaciones sindicales.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quedan excluidas de esta subvención las actividades, proyectos y/o acciones de materias curriculares y académicas, de alfabetización cultural o lingüística, las actividades docentes (complementarias y de ampliación) y las relacionadas con el aprendizaje de idiomas o el refuerzo y apoyo<span style="display:none">&lt;A[apoyo|soporte]&gt;</span> educativo o escolar. </span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quedan excluidas de esta subvención las actividades, proyectos y/o acciones turísticas, viajes individuales, viajes de estudios o de grupos escolares.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quedan excluidas de esta subvención las salidas lúdicas sin ningún objetivo socioeducativo.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quedan excluidas de esta subvención las actividades, proyectos y/o acciones de cualquier asociación (federaciones, clubs, redes, asociaciones menores...) que únicamente haga acciones deportivas.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quedan excluidas de esta subvención las actividades regladas de música.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quedan excluidas de esta subvención todas las actividades que en el artículo 38 del Decreto 23/2018, de 6 de julio, por<span style="display:none">&lt;A[por|para]&gt;</span> el cual se despliega parcialmente la Ley 10/2006, de 26 de julio, integral de la juventud, se delimitan como excluidas de actividades de tiempo libre infantil y juvenil.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Quedan excluidas los proyectos de ocio infantil y juvenil definidos en el artículo 37 del Decreto 23/2018, de 6 de julio, por<span style="display:none">&lt;A[por|para]&gt;</span> el cual se despliega parcialmente la Ley 10/2006, de 26 de julio, integral de la juventud en periodo de vacaciones escolares.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.2. A los efectos de esta convocatoria, se consideran bienes muebles inventariables: maquinaria, herramientas, mobiliario y equipos de oficina, ordenadores, calefactores, equipos para la docencia y la investigación, aparatos portátiles de aire acondicionado, elementos de transporte, aplicaciones informáticas... que reúnan las características siguientes:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Que no sean bienes fungibles.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Que el periodo de vida útil sea superior a un año.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Que produzcan un incremento del patrimonio.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Que el precio de adquisición sea superior a 150 €, IVA incluido.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>8. Financiación e importe máximo</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.1. De acuerdo con el Plan Estratégico de Subvenciones del Consejo Insular de Mallorca para el año 2022, se destina un importe de trescientos mil euros (300.000,00 €) con cargo a la partida presupuestaria correspondiente del presupuesto de 2022. RC de futuro con nº. de operación 220219000784 de 240.000 € (Línea 1) y otra RC de futuro con nº. de operación 220219000785 de 60.000 € (Línea 2). Por<span style="display:none">&lt;A[Por|Para]&gt;</span> conceder subvenciones a ayuntamientos de Mallorca de hasta 50.000 habitantes para dar apoyo a la juventud.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Teniendo en cuenta que la aprobación del expediente se ha tramitado como<span style="display:none">&lt;A[como|cómo]&gt;</span> anticipado de gasto la cuantía prevista para la convocatoria, tiene carácter estimado, por<span style="display:none">&lt;A[por|para]&gt;</span> lo cual la concesión de las subvenciones queda condicionada a la existencia de crédito adecuado y suficiente en el momento de la resolución de concesión.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.2. Cada entidad solicitando puede pedir hasta un máximo del importe que le corresponde según el tanto por ciento de la población juvenil de acuerdo con el criterio establecido en el punto anterior.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de que la entidad solicite más importe de lo que le corresponde en función de lo que se establece en el punto 8.2., sólo se admitirá<span style="display:none">&lt;A[admitirá|concederá]&gt;</span> el máximo que le corresponda.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstante, cuando la cuantía del crédito de la convocatoria no sea suficiente para cubrir el 100% del presupuesto de la convocatoria, la última persona beneficiaria según el orden de entrada derivado del registro recibirá como máximo el importe remanente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.4 Si no se conceden las cuantías inicialmente previstas para las diferentes líneas, por falta de solicitudes o para no acreditar la condición de beneficiario, se puede traspasar indistintamente el crédito remanente de una línea a la otra, si, de acuerdo con las solicitudes presentadas, es conveniente incrementar la dotación presupuestaria para atender todas las solicitudes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las subvenciones que se otorguen se adjudicarán hasta agotar el límite del crédito presupuestario inicial, siempre que se cumplan los requisitos legales de esta convocatoria y del resto de normas aplicables.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>9. Formalización de la solicitud y acreditación de los requisitos</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las solicitudes se tienen que formalizar mediante el modelo y los anexos que facilita el Consejo Insular de Mallorca, que se pueden descargar directamente de la web de la institución, a través de la dirección<span style="color:null"> https://seu.conselldemallorca.net/</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Llenar la documentación de manera incompleta o con errores, de manera que no se pueda apreciar la concurrencia de los requisitos necesarios para otorgar la subvención, o no presentar el proyecto subvencionable o la documentación complementaria necesaria, es motivo suficiente de exclusión. Si procede<span style="display:none">&lt;A[pega|ocurre]&gt;</span>, se tiene que comunicar la deficiencia a la entidad solicitante para que lo enmiende en un plazo de diez días hábiles contadores desde la recepción del requerimiento. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9.1. Las solicitudes se tienen que presentar con la documentación siguiente:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Modelo de solicitud, firmado por el alcalde o la alcaldesa de la entidad local. (Anexo IV)</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Modelo de convenio aprobado por el órgano competente (anexo VIII)</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9.2. De acuerdo con lo que se establece en el artículo 10.2 de la Ordenanza general de subvenciones, la entidad solicitante no necesita aportar documentación acreditativa de las obligaciones tributarias con el Consejo Insular de Mallorca y los organismos autónomos que dependen. El órgano instructor de esta convocatoria pedirá directamente los certificados correspondientes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9.3. Para todo lo que no se prevé en esta convocatoria, se tiene que aplicar con carácter supletorio lo que dispone el artículo 10 de la Ordenanza general mencionada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>10. Plazo y lugar<span style="display:none">&lt;A[lugar|sitio]&gt;</span> de presentación de la solicitud</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10.1. El plazo para presentar las solicitudes y toda la documentación es de treinta (30) días hábiles, contadores a partir del día siguiente de publicarse el extracto de esta convocatoria en el <em>Boletín Oficial de las Islas Baleares </em>(BOIB). Si el último día es inhábil, el plazo se alarga hasta el día hábil siguiente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10.2. Los ayuntamientos tienen que dirigir la solicitud, la justificación, los anexos y toda la documentación a la Dirección Insular de Participación y Juventud del Departamento de Promoción Económica y Desarrollo Local, identificado con el código DIR LA0015208, a través del Registro Electrónico del Consejo de Mallorca.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los documentos se tienen que aportar con firma válida, de acuerdo con el artículo 10.2. de la Ley 39/2015, de procedimiento administrativo común de las administraciones públicas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10.3. Si la solicitud o la documentación presentada no reúne los requisitos exigidos o no la acompañan los documentos preceptivos, no se puede valorar. En este caso, el órgano instructor tiene que requerir a las personas interesadas que enmienden la falta o aporten los documentos preceptivos en el plazo de 10 días hábiles, a partir del día siguiente de haber recibido el requerimiento correspondiente. Si enmiendan la documentación, se tiene que aplicar lo que se dispone en el punto 5.2. de esta convocatoria, si no lo hacen, se considerará que han desistido.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>11. Procedimiento, órganos de instrucción, fiscalización y resolución</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.1. La tramitación y gestión de esta convocatoria se sujeta a los principios de publicidad, transparencia, concurrencia, objetividad, igualdad, no discriminación, eficacia y eficiencia establecidos en el artículo 5.4 de la Ordenanza general mencionada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.2. El procedimiento de selección de las entidades beneficiarias se lleva a cabo mediante concurrencia no competitiva, según riguroso orden de entrada en el Registro General del Consejo de Mallorca, siempre que las personas interesadas reúnan los requisitos y hasta que se agote el crédito presupuestario establecido en este convocatoria y con los límites que se recogen en el punto 8 de esta convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.3. El órgano instructor puede requerir a la persona interesada los informes o las aclaraciones que considere convenientes. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.4. Presentar la solicitud equivale a aceptar la subvención, si se concede. La entidad beneficiaria puede renunciar en cualquier momento del proceso.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.5. De acuerdo con el artículo 18 de la Ordenanza general mencionada, la Jefa del Servicio de Juventud o quien la sustituya tiene que instruir el expediente administrativo de concesión de las subvenciones y tiene que velar para que se cumplan los requisitos de la convocatoria, además de ejercer las facultades que se prevén en el artículo 18.2.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.6. El Consejo Ejecutivo es el órgano competente para aprobar y resolver esta convocatoria de conformidad con el artículo 36, letra <span style="color:red">f</span>), del vigente Reglamento orgánico del Consejo de Mallorca, en relación con la base 23.4 de las de ejecución del presupuesto de 2021. Al Consejero<span style="display:none">&lt;A[consejero|conseller]&gt;</span> ejecutivo de Promoción Económica y Desarrollo Local le corresponde reconocer las obligaciones económicas, en concepto de subvención.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.7. La Intervención delegada de la Misericordia del Consejo de Mallorca se encarga de llevar a cabo la fiscalización previa limitada a la convocatoria y los actos que derivan: aprobación de la convocatoria, concesión, justificación de las subvenciones y reconocimiento de obligaciones. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.8. El Consejo de Mallorca, en cumplimiento de lo que se prevé en los artículos 14 y 19.2 de la Ordenanza general mencionada, tiene que enviar a la Base de Datos nacional de subvenciones información sobre la aprobación de esta convocatoria y de la concesión que deriven.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sin embargo, esta convocatoria se tiene que publicar en el BOIB y en la Sede Electrónica del Consejo Insular de Mallorca <span style="color:null">(https://seu.conselldemallorca.net/).</span> </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.9. Cuando<span style="display:none">&lt;A[Cuando|Cuándo]&gt;</span> se apruebe el acuerdo de concesión de las subvenciones, las personas beneficiarias tienen que firmar un convenio (anexo VIII) con el Departamento de Promoción Económica y Desarrollo Local, firmado por<span style="display:none">&lt;A[para|por]&gt;</span> el Consejero<span style="display:none">&lt;A[consejero|conseller]&gt;</span> Ejecutivo del departamento de acuerdo con el artículo 1 del Decreto de la Presidencia del Consejo de Mallorca por<span style="display:none">&lt;A[por|para]&gt;</span> el cual se determina la organización del Consejo Insular de Mallorca.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Antes de firmar este convenio, el órgano de gobierno competente de cada ayuntamiento tiene que haber aprobado el modelo de convenio y lo tiene que notificar al Consejo de Mallorca con la presentación de la solicitud de subvención.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Asimismo, teniendo en cuenta lo que se establece en el artículo 36.d del Reglamento orgánico del Consejo de Mallorca, aprobado por acuerdo del Pleno de 12 de abril de 2018 (BOIB nº. 89, de 19 de julio de 2018), corresponde al Consejo Ejecutivo aprobar los convenios independientemente de la cuantía. Por lo tanto con el acuerdo de aprobación de la convocatoria, igualmente, se aprobará el mencionado convenio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.10. El plazo máximo de resolución es de seis (6) meses, contadores desde la fecha de publicación de la convocatoria correspondiente. Si no se ha dictado la resolución transcurridos estos seis meses, se tiene que entender desestimada la solicitud, aunque la Administración tiene que dictar la resolución expresa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.11. El acuerdo de concesión de esta convocatoria se tiene que notificar oficialmente a las entidades interesadas con la publicación en el BOIB y en la Sede Electrónica del Consejo Insular de Mallorca </span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px">(https://seu.conselldemallorca.net/).</span><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"> Cualquier otra notificación que se tenga que hacer durante la tramitación de esta subvención a las entidades interesadas, se hará de manera electrónica al correo designado a este efecto con la solicitud de subvención.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>12. Obligaciones de las entidades beneficiarias</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las entidades beneficiarias de las subvenciones tienen que cumplir las obligaciones establecidas en estas bases y las que se disponen en los artículos 9 y 15 de la Ordenanza general de subvenciones del Consejo Insular de Mallorca sobre las obligaciones de las personas beneficiarias y sobre la difusión de la subvención concedida, además del resto de normativa aplicable.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Hay que remarcar que la persona beneficiaria tiene que comunicar en el órgano instructor de la presente convocatoria cualquier anulación que se haga de reconocimiento de obligaciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Teniendo en cuenta que el periodo subvencionable es, en gran parte, posterior a la publicación de la convocatoria de la subvención, en cada una de las actividades que las entidades beneficiarias lleven a cabo (posteriores a la publicación de la convocatoria), en el marco de la presente subvención, tienen que hacer constar que la actividad se desarrolla con el apoyo del Consejo de Mallorca, con los logotipos correspondientes, de la misma medida<span style="display:none">&lt;A[medida|tamaño]&gt;</span> de los del ayuntamiento y al lado de estos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de que, a la hora de justificar, no se demuestre el uso de los logotipos del Consejo Insular de Mallorca y el del Servicio insular de Juventud según lo que se establece en el párrafo anterior, puede ser causa de pérdida total o parcial de la subvención concedida.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>13. Pago de la subvención</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.1. La subvención se otorgará por un importe cierto, de acuerdo con el orden de prelación de las solicitudes y en aplicación del artículo 24.2 de la Ordenanza general de subvenciones. Los proyectos se subvencionan por un importe cierto equivalente a la cuantía solicitada, hasta al máximo correspondiente. Por lo tanto, no se aplica el ajuste a la baja del importe de la subvención en razón del grado de ejecución de la actividad subvencionada, siempre que eso no implique superar el coste total de la actividad, proyecto o programa seleccionado, una vez deducidos los ingresos ajenos u otras subvenciones de que lo han financiado. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.2. El pago de la cuantía concedida se hará con un pago anticipado del cien por cien sin que haya que presentar ninguna garantía, según el artículo 50 y siguientes de la Ordenanza general de subvenciones del Consejo de Mallorca, que permite que las convocatorias de subvenciones tramitadas por este organismo prevean pagos anticipados cuando así se considere justificado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.3. Según lo que se establece en el artículo 48.4. de la Ordenanza general de subvenciones del Consejo Insular de Mallorca, para poder hacerse el pago de la subvención, la persona beneficiaria tiene que estar al corriente del cumplimiento<span style="display:none">&lt;A[cumplimiento|cumplido]&gt;</span> de las obligaciones tributarias y de la Seguridad Social ante la Administración del Estado, así como de las obligaciones tributarias ante el Consejo Insular de Mallorca y los organismos autónomos que dependen, impuestas por las disposiciones vigentes. Asimismo, la persona beneficiaria tiene que acreditar que no es deudora por resolución de procedencia de reintegro. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.4. El Consejo Insular de Mallorca puede inspeccionar las actividades subvencionadas, sin perjuicio de las competencias que puedan corresponder, por normativa legal o reglamentaria, a otros organismos o instituciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>14. Justificación de la subvención</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.1. Una vez finalizada el periodo subvencionable, periodo de elegibilidad de los gastos, indicada en el punto de esta convocatoria, la entidad beneficiaria tiene la obligación de justificar, de acuerdo con el artículo 35 de la Ordenanza general de subvenciones del Consejo de Mallorca, la aplicación de los fondos percibidos y el cumplimiento<span style="display:none">&lt;A[cumplimiento|cumplido]&gt;</span> del resto de condiciones impuestas a la finalidad que ha servido de fundamento<span style="display:none">&lt;A[fundamento|cimiento]&gt;</span> a la concesión de la subvención. Los documentos justificativos se enumeran en el punto 15 de esta convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.2. Las corporaciones locales beneficiarias de las subvenciones convocadas tienen hasta el 31 de enero de 2023 para enviar al Consejo de Mallorca la justificación de las actuaciones subvencionables.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de que la concesión de las subvenciones sea<span style="display:none">&lt;A[sea|esté]&gt;</span> en una fecha posterior a la indicada en el párrafo anterior, el plazo para presentar la justificación será de diez (10) días, contadores desde el día siguiente de la notificación de la concesión de las subvenciones objeto de la presente convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.3. Si no se presenta la justificación delante del órgano administrativo competente en el plazo establecido, se tiene que requerir a la persona beneficiaria que la presente en el plazo improrrogable de quince (15) días hábiles, contadores desde el día siguiente de recibir la notificación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.4. Si la documentación que se presenta como justificación es incompleta o incorrecta, se tiene que requerir a la entidad beneficiaria que la rectifique o aporte los documentos necesarios en el plazo de diez (10) días hábiles improrrogables, de acuerdo con lo que se establece en el artículo 68 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. No hacerlo supone perder el derecho a cobrar la subvención. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>15. Contenido de la cuenta justificativa</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">15.1. De acuerdo con la disposición adicional segunda de la Ordenanza general de subvenciones del Consejo Insular de Mallorca, en los convenios de colaboración que regulen las ayudas que el Consejo Insular de Mallorca y los organismos autónomos y consorcios que dependen otorguen a otras administraciones públicas, la subvención se puede justificar a través de un certificado emitido por<span style="display:none">&lt;A[para|por]&gt;</span> la persona titular del órgano que la ha percibido, por el cual se acredite que la actividad se ha llevado a cabo y que se ha cumplido la finalidad de la subvención, junto con el informe emitido por la intervención o el órgano de control financiero equivalente de la entidad beneficiaria, por<span style="display:none">&lt;A[por|para]&gt;</span> el cual se acredita la veracidad y la regularidad de la documentación justificativa de la subvención. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para esta convocatoria, los documentos que se tienen que presentar para justificar la subvención son:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Memoria técnica de las actuaciones hechas objeto de la subvención firmada por un técnico o técnica responsable en la materia, con el visto bueno del alcalde o la alcaldesa. Se tiene que adjuntar documentación (fotografías, carteles...) que demuestre la realización de los programas, campañas y/o proyectos, la edad de los participantes, la fecha y el apoyo<span style="color:green"><span style="display:none">&lt;A[apoyo|soporte]&gt;</span></span> del Consejo de Mallorca a través del logotipo. (Anexo V)</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Un informe emitido por el interventor o interventora de la entidad beneficiaria con el visto bueno del alcalde o alcaldesa que acredite la veracidad y la regularidad de la documentación justificativa de la subvención. (Anexo VI)</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Un certificado emitido por el secretario o secretaria de la entidad local, con el visto bueno del alcalde o alcaldesa que acredite que el programa/s, campaña/s o proyecto/s se ha llevado a término y que se ha cumplido la finalidad de la subvención. (Anexo VII)</span></span></p> </li> </ul> <p>&nbsp;<span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>16. Infracciones, sanciones y pérdida de derecho al cobro</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">16.1. El régimen de infracciones y de sanciones administrativas aplicables es el que se establece en el título IV de la Ley 38/2003, de 17 de noviembre, general de subvenciones (BOE nº. 276, de 18 de noviembre de 2003), y en el resto de la normativa aplicable y, en concreto, en los artículos 63 y 64 de la Ordenanza general de subvenciones del Consejo Insular de Mallorca.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">16.2. El artículo 58 de la Ordenanza antes mencionada regula la pérdida del derecho a cobrar la subvención.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">16.3. Con independencia del criterio de otorgamiento de la subvención aplicado, cuando la persona beneficiaria presente una justificación definitiva por un importe inferior al concedido, el centro gestor podrá cancelar de oficio el remanente de la concesión con la aceptación previa de la persona beneficiaria. A los efectos indicados, la persona beneficiaria podrá renunciar al importe remanente no justificado si así lo indica en el apartado 7 del Anexo VI.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">16.4. De conformidad con los principios de eficacia y eficiencia en la asignación y utilización de los recursos públicos regulados en el artículo 5 de la Ordenanza general de subvenciones del Consejo Insular de Mallorca, en caso de que el importe de la pérdida del derecho al cobro de la subvención sea igual o inferior a 100,00 € y siempre que este importe no supere el 1% de la subvención concedida, el centro gestor anulará de oficio la diferencia entre el importe de la subvención concedida y el importe de la subvención reconocida, sin necesidad de iniciar el procedimiento y la declaración posterior de la pérdida del derecho al cobro de una parte de la subvención, y sin que la persona beneficiaria presente la renuncia a cobrar esta cantidad.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>17. Publicidad</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">17.1. El Consejo Insular de Mallorca, en cumplimiento de lo que se prevé en los artículos 17, 18 y 20 de la Ley 38/2003 mencionada y de acuerdo con los artículos 19.2 y 14 de la Ordenanza general de subvenciones mencionada, tiene que enviar la información de esta convocatoria y de las resoluciones de concesiones a la Base de Datos nacional de subvenciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">17.2. El extracto de la convocatoria de subvenciones y la resolución se tienen que publicar en el <em>Boletín Oficial de las Islas Baleares</em>, así como en la Sede Electrónica del Consejo Insular de Mallorca (https://seu.conselldemallorca.net/). </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>18. Ineficacia sobrevenida de la convocatoria</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si, por<span style="display:none">&lt;A[por|para]&gt;</span> circunstancias sobrevenidas de interés público y general, el Consejo de Mallorca no puede llevar adelante la tramitación de esta convocatoria, el órgano que la aprobó lo tiene que dejar sin efectos con un informe justificativo previo de la secretaría técnica del centro gestor.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>19. Normativa de aplicación</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las subvenciones de esta convocatoria se rigen por el contenido de estas bases; para<span style="display:none">&lt;A[para|por]&gt;</span> la Ley 38/2003, de 17 de noviembre, general de subvenciones; por<span style="display:none">&lt;A[por|para]&gt;</span> el Real decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003, general de subvenciones (BOE nº. 176, de 25 de julio de 2006); por<span style="display:none">&lt;A[para|por]&gt;</span> la Ordenanza general de subvenciones del Consejo Insular de Mallorca, aprobada por acuerdo del Pleno de 23 de diciembre de 2016 (BOIB nº. 21, de 18 de febrero de 2017), modificada por acuerdo del Pleno de 14 de junio de 2018 (BOIB nº. 96, de 4 de agosto de 2018), y el resto de la normativa que sea aplicable. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>20. Recursos </strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con el artículo 44 y 46.6 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa, contra esta resolución no se puede interponer ningún recurso en vía administrativa, si bien se puede formular potestativamente un requerimiento para la anulación o revocación en el plazo de dos meses contadores desde el día que se recibe la notificación con carácter previo a la interposición de un recurso contencioso administrativo.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El requerimiento se entenderá desestimado si, en el plazo de un mes desde la presentación, no se notifica ninguna resolución expresa.
