&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de julio de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para Inversiones en las explotaciones agrarias, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;Boletín Oficial de las&amp;nbsp;Islas Baleares&amp;nbsp;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1 de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de &amp;nbsp;1 de octubre, y&amp;nbsp;del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 16&amp;nbsp;de diciembre&amp;nbsp;de 2021, firmó la siguiente resolución,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;"RESOLUCIÓN DE ACEPTACIÓN DE CAMBIO DE TITULAR&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 106, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, modificada mediante las resoluciones de 17 de diciembre de 2015 (BOIB núm. 185), 22 de junio de 2016 (BOIB núm. 81) y 26 de junio de 2018 (BOIB núm. 80). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.De conformidad con el apartado sexto de la citada Resolución, el plazo para presentar las solicitudes finalizó el día 31 de diciembre de 2015. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.En fecha 18 de julio de 2017 se dictó la Resolución de concesión (R13), que se publicó en el BOIB número 100, de día 15 de agosto de 2017. Esta remesa incluye el expediente núm. 107 a nombre de ANTONIO SALAS GALMÉS, con NIF ***1674**, con un importe de ayuda concedido de 6.728,11 € (seis mil setecientos veintiocho euros con 11 céntimos euros), correspondiendo el 41% en el FEADER por un importe de 2.758,53€, el 10,91% en el MAGRAMA por un importe de 734,04 € y el 48,09% en la CAIB por un importe de 3.235,54€. Esta cofinanciación fue modificada por Resolución de 28 de marzo de 2018, publicada en el BOIB número 45, de día 12 de abril de 2018, pasando a ser del 53% FEADER con un importe de 3.565,90 €, el 14,10% AGE con un importe de 948,66€ y el 32,90% CAIB con un importe de 2.213,55€. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Con fecha 23 de abril de 2018 se dictó Resolución de pago, en la que se incluye el expediente núm. 107 a nombre de ANTONIO SALAS GALMÉS, con NIF ***1674**, con un pago total de 3.433,68€ (1.819,85€ FEADER, 484,15€ AGE y 1.129,68€ CAIB) y una revocación de 3.294,43€ por no justificación de la totalidad de las inversiones aprobadas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. Con fecha 16 de noviembre de 2021, ANTONIO SALAS GALMÉS, con NIF ***1674**V, presentó en la delegación del FOGAIBA de Manacor, con registro de entrada L95E553363, un escrito por el que solicita la subrogación en los derechos de la ayuda concedida y un cambio de titularidad de la explotación a MARIA ANTÒNIA BARCELÓ GARCÍA con NIF ***2441**, que se compromete a mantener las condiciones que debía cumplir el anterior titular, aceptando todas las obligaciones y compromisos detallados en la concesión, de acuerdo con la Resolución de la convocatoria. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. Conforme a lo dispuesto en el artículo 47.2 del Reglamento (UE) núm. 1305/2013 relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm. 1698/2005 del Consejo, cuando durante el período de ejecución de un compromiso contraído como condición para la concesión de una ayuda, se transfiera total o parcialmente la explotación afectada a otra persona, el compromiso, o la parte del mismo que corresponda a la tierra transferida podrá ser asumido por esta persona durante la parte restante de este período o caducar, sin que se exija reembolso alguno por el período durante el cual el compromiso fuese efectivo. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. Ante todo esto, se propone la aceptación del cambio de titularidad, con el compromiso de mantener las obligaciones y compromisos restantes respecto del expediente de ayuda Inversiones en las explotaciones agrarias, INEA2015_2/107.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Orden del consejero de agricultura, Medio ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020 . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Reglamento (UE) núm. 1305/2013 relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm. 1698/2005 del Consejo. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Propuesta de resolución de cambio de titular&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente &amp;nbsp;y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ceptar&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;el cambio del titular&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con el compromiso de mantener las obligaciones y compromisos restantes, respecto del expediente de ayuda Inversiones en las explotaciones agrarias, INEA2015_2/107 pasando a ser el nuevo titular MARIA ANTÒNIA BARCELÓ GARCÍA con NIF ***2441**.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Notificar esta resolución a la persona interesada&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el consellera de Agricultura, Pesca y alimentación, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y los artículos 121 y 122, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
