    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de setiembre de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para la Creación de empresas de Jóvenes agricultores, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 17 de diciembre&amp;nbsp;de 2021, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;"INFORME PROPUESTA DE RESOLUCIÓN /RESOLUCIÓN DE ACEPTACIÓN DE RENUNCIA &lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 15 de septiembre de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 136, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores, modificada mediante las resoluciones de 26 de abril de 2016 y 26 de junio de 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.El 15 de diciembre de 2020, el vicepresidente en materia agraria del FOGAIBA dictó una Resolución de concesión de ayudas para creación de empresas de jóvenes agricultores, que se publicó en el Boletín Oficial de las Islas Baleares número 215, del 29 de diciembre de 2020, en la que figuraban&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;entre otros, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;FRANCISCA FERRER ROIG&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, con NIF ***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;5895&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;**, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;el número de orden 76 de la lista de concurrencia y BERNARDO RAMÓN TORRES con NIF ***5868**, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con&amp;nbsp;el número de orden 77 de la lista de concurrencia, ambos con una concesión de 0 euros por la aplicación del proceso de concurrencia.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 11 de noviembre de 2021, FRANCISCA FERRER ROIG, ha presentado una solicitud de desistimiento de la ayuda, lo que supone ser eliminado de la lista de concurrencia. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Con fecha 11 de noviembre de 2021, BERNARDO RAMÓN TORRES, ha presentado una solicitud de desistimiento de la ayuda, lo que supone ser eliminado de la lista de concurrencia. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece la obligación de la Administración a dictar resolución expresa y notificarla. En su párrafo segundo especifica que “En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con indicación de los hechos producidos y normas aplicables». &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas». &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.Considerando todo ello, se propone realizar la revocación total debido a la renuncia de la ayuda concedida por el beneficiario que se indica en el anexo I de esta resolución.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Orden del Consell&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;r &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesi&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ón de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares desde 2014 hasta 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, del&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;1 de octubre, de&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l procedimiento administrativo &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de las administraciones p&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;úblicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente en materia agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Aceptar la&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;renuncia&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;FRANCISCA FERRER ROIG y de BERNARDO RAMÓN TORRES, de&amp;nbsp;la Resolución del vicepresidente en materia agraria del FOGAIBA de día 15 de diciembre de 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Eliminar de la lista de concurrencia de la resolución del vicepresidente en materia agraria del FOGAIBA de día 15 de diciembre de 2020, a los interesados FRANCISCA FERRER ROIG y BERNARDO RAMÓN TORRES.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Declarar concluido el procedimiento y archivar&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;os&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expediente&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. Notificar esta resolución mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
