    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Pleno del Ayuntamiento en sesión celebrada el día 18 de octubre de 2021 acordó aprobar provisionalmente la modificación de la ordenanza fiscal 05TOD reguladora de la Tasa por por los documentos que expidan o entiendan la administración o las autoridades municipales en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Aprobar inicialmente la modificación de los artículos 4 y 5 de la Ordenanza fiscal 05T.OD reguladora de la tasa por los documentos que expidan o entiendan la administración o las autoridades municipales, que quedarán redactados cómo se dirá a continuación.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. Solicitar al “Institut Balear de la Dona” de conformidad con el artículo 7.g de la Ley 12/2006, de 20 de septiembre, de la mujer, y el art. 5 de la ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres, el informe de evaluación de impacto de género respeto la mencionada normativa, incorporándose las sugerencias que se formulen sobre el texto de la normativa con carácter previo a la aprobación definitiva.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Exponer por un plazo de 30 días hábiles el acuerdo de aprobación provisional de la modificación de la Ordenanza fiscal, mediante su publicación en el Boletín Oficial de las Islas Baleares, en uno de los diarios de los de mayor difusión de la Comunidad Autónoma de las Islas Baleares y en el tablón de anuncios de la sede electrónica de este ayuntamiento a los efectos que los interesados puedan examinar el expediente y presentar las reclamaciones oportunas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;En el caso de que no se presenten reclamaciones en el plazo mencionado se entenderá definitivamente aprobado el acuerdo provisional adoptado, de forma automática y sin necesidad de un nuevo acuerdo expreso. Si se presentan reclamaciones serán resueltas por el pleno.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La entrada en vigor queda prevista para el día siguiente de la publicación en el Boletín Oficial de la Comunidad Autónoma de las Islas Baleares del acuerdo de aprobación definitiva o de la provisional elevado automáticamente a tal categoría.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Las modificaciones del acuerdo primero son las siguientes:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Los documentos que hayan de iniciar un expediente se presentarán a las Oficinas Municipales o en las formas y registros señalados en el artículo 16.4 de la Ley 39/2015.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. Las tasas por la expedición de documentos, se exigirán en régimen de autoliquidación y se abonarán en las Oficinas Municipales, o bien a través del Portal Web de la Agencia Tributaria de las Islas Baleares (ATIB- Tributos Locales- Autoliquidación de Tasas y Precios Públicos Locales).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. El pago de la tasa es requisito obligatorio para la presentación y/o tramitación de la solicitud.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4. El pago de la tasa no condiciona el contenido de la certificación ni presupone el sentido favorable o desfavorable de la misma para los intereses de la persona solicitante.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5. Los documentos recibidos a través de las Oficinas señaladas en el artículo 16.4 de la Ley 39/2015, serán admitidos provisionalmente, pero no se les podrá dar trámite sin el previo pago de los derechos, por lo que se requerirá a la persona interesada para que en el plazo de diez días abone las cuotas correspondientes, con la advertencia de que, transcurrido ese plazo sin efectuar el abono, se tendrán los escritos por no presentados y se procederá a su archivo.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. Los derechos por cada petición de búsqueda de antecedentes se devengarán aunque sea negativo su resultado".&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Dicho acuerdo fue publicado en el Tablón de anuncios de la Sede Electrónica en fecha 26 de octubre de 2021, en uno de los diarios de mayor difusión de la provincia en fecha 27 de octubre de 2021 y y en el BOIB n.º 146 de fecha 26 de octubre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Transcurrido el plazo de exposición pública sin que se hayan interpuesto reclamaciones, el referido acuerdo se eleva a definitivo, de conformidad con el artículo 17.3 del RDL 2/2004, de 5 de marzo, por el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales y con el artículo 49 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De conformidad con el informe de la técnica de Gestión Tributaria, de 16 de diciembre de 2021, el texto de la modificación puede ser elevado a definitivo sin más trámite, dado que las recomendaciones contenidas al informe sobre el impacto de género emitido por el “Institut Balear de la Dona” de fecha 3 de noviembre de 2021 no suponen ninguna alteración del contenido del texto aprobado provisionalmente puesto que son simples sugerencias de redacción y se han incorporado al texto definitivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las modificaciones de las ordenanzas entrarán en vigor al día siguiente de la publicación en el Boletín Oficial de las Islas Baleares del acuerdo de aprobación provisional elevado automáticamente a definitivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De conformidad con el artículo 20 del RD Legislativo 2/2004, se establece una Tasa por los documentos que expidan o entiendan la administración o las autoridades municipales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;ARTÍCULO 2&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;HECHO IMPONIBLE&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Hecho Imponible. Constituye el hecho imponible de esta tasa la actividad municipal de preparación, estudio, redacción, revisión y cualquier otra que resulte necesaria para la expedición o emisión, a instancia de parte, de documentos administrativos, tengan o no carácter oficial. Así mismo, constituye el hecho imponible de esta tasa la reproducción de documentos y la edición y entrega del CD o del catálogo de promoción turística editados por la Delegación de Turismo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Obligación de contribuir. Se devenga la tasa y surge la obligación de contribuir en el momento de presentación de la solicitud que inicie la tramitación del expediente cuando este se tenga que solicitar por escrito, o en el momento en que se realice la petición, cuando esta se haga de manera verbal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;ARTÍCULO 3&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;SUJETOS PASIVOS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Sujeto pasivo. Serán sujetos pasivos de esta tasa las personas físicas o jurídicas que soliciten, provoquen o en el interés de las cuales redunde la tramitación del expediente, siempre que esta tramitación tenga como objetivo la expedición o emisión, a instancia de parte, de documentos administrativos, tengan o no carácter oficial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Responsables. Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas y jurídicas a las cuales se refiere el artículo 42 de la Ley General Tributaria. Serán responsables subsidiarios las personas responsables o titulares de las Administraciones de las sociedades y Sindicaturas, interventores/interventoras o liquidadores/liquidadoras de quiebras, concursos, sociedades y entidades en general, en los supuestos y con la extensión que señala el artículo 43 de la Ley General Tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;DEVENGO Y GESTIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Los documentos que hayan de iniciar un expediente se presentarán a las Oficinas Municipales o en las formas y registros señalados en el artículo 16.4 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Las tasas por la expedición de documentos, se exigirán en régimen de autoliquidación y se abonarán en las Oficinas Municipales, o bien a través del Portal Web de la Agencia Tributaria de las Islas Baleares (ATIB- Tributos Locales- Autoliquidación de Tasas y Precios Públicos Locales).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. El pago de la tasa es requisito obligatorio para la presentación y/o tramitación de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. El pago de la tasa no condiciona el contenido de la certificación ni presupone el sentido favorable o desfavorable de la misma para los intereses de la persona solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. Los documentos recibidos a través de las Oficinas señaladas en el artículo 16.4 de la Ley 39/2015, serán admitidos provisionalmente, pero no se les podrá dar trámite sin el previo pago de los derechos, por lo que se requerirá a la persona interesada para que en el plazo de diez días abone las cuotas correspondientes, con la advertencia de que, transcurrido ese plazo sin efectuar el abono, se tendrán los escritos por no presentados y se procederá a su archivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6. Los derechos por cada petición de búsqueda de antecedentes se devengarán aunque sea negativo su resultado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;DISPOSICIÓN FINAL&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La presente ordenanza fue modificada y aprobada provisionalmente por acuerdo del Pleno de fecha 19 de octubre de 2021, entendiéndose definitivamente aprobada por haber transcurrido el plazo de exposición pública sin que se presentasen reclamaciones. Entrará en vigor a partir del día siguiente a la publicación en el BOIB del acuerdo provisional elevado a definitivo, de conformidad con el art. 17.4 del RDL 2/2004, que aprueba el TRLRHL y continuando su vigencia hasta su derogación o modificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
