&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Junta de Gobierno Local de esta Corporación municipal en sesión ordinaria celebrada día 3 de diciembre de 2021, ha aprobado las bases que regularán la convocatoria para el Concurso de &lt;span style="background-color:white"&gt;Belenes&lt;/span&gt; para particulares 2021-22 que se transcriben literalmente a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“&lt;strong&gt;&lt;em&gt;BASES GENERALES DEL CONCURSO MUNICIPAL DE BELENES PARA PARTICULARES&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. &lt;strong&gt;&lt;em&gt;OBJECTO Y FINALIDAD.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El objeto de esta convocatoria, por parte del Ayuntamiento de Andratx, tiene como finalidad la recuperación de las tradiciones y fomentar la participación ciudadana en las fiestas de Navidad.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Por todo esto, se convoca un Concurso de Belenes de particulares; invitando a toda la gente a participar.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. &lt;strong&gt;&lt;em&gt;DESTINATARIOS.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Podrán participar en el concurso todas las personas residentes en el término municipal de Andratx que cumplan con los requisitos establecidos en el artículo 13 de la Ley 38/2003, de 17 de noviembre, Ley general de subvenciones. Destacando encontrarse al corriente en el cumplimiento de las obligaciones tributarias, ante la Seguridad Social, la Administración pública de la Comunidad Autónoma, la Agencia Estatal de Administración Tributaria (AEAT) y el Ayuntamiento de Andratx.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La Tesorería Municipal del Ayuntamiento de Andratx expedirá de oficio certificación acreditativa de si los peticionarios están al corriente de sus obligaciones fiscales con este Ayuntamiento y de si son o no deudores del mismo por cualquier otro concepto no tributario.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. &lt;strong&gt;&lt;em&gt;BASES REGULADORAS.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Para todos los casos no previstos en esta convocatoria será aplicable:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Ley 38/2003, de 17 de noviembre, general de subvenciones (BOIB 276, de 18 de noviembre de 2003).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Real Decreto 887/2006, por el que se aprueba el reglamento que desarrolla la Ley general de subvenciones (BOIB 176, de 25 de julio de 2006).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas (BOE 236, de 2 de octubre de 2015).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Ordenanza general de subvenciones de Andratx 2017 (BOIB núm 47, de 20 de abril de 2017).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El resto de normativa que resulte de aplicación.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. &lt;strong&gt;&lt;em&gt;CRÉDITO PRESUPUESTARIO.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Durante el ejercicio presupuestario 2021, se destina la cantidad de 1.050,00 euros al concurso de belenes objeto de esta convocatoria, con cargo a la aplicación presupuestaria 2021.4310.48100.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. &lt;strong&gt;&lt;em&gt;REQUISITOS Y CONDICIONES.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Se priorizará que la ubicación de los Belenes sea visible desde la calle (principalmente ventanas, portales, etc.). Así mismo, podrá localizarse en el interior de las viviendas. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Los belenes que se presenten guardarán el debido respeto al hecho que representan. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Los belenes permanecerán montados durante el periodo mínimo comprendido entre el día 20 de diciembre de 2021 y el 6 de enero de 2022, ambos incluidos.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. &lt;strong&gt;&lt;em&gt;CATEGORÍAS.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las categorías o modalidades a concurso serán las siguientes: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;em&gt;Belén tradicional. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;em&gt;Belén infantil.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;em&gt;Belén innovador.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. &lt;strong&gt;&lt;em&gt;CRITERIOS DE VALORACIÓN.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Los criterios de valoración para cada una de las modalidades de Belenes serán las siguientes: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.1. &lt;strong&gt;&lt;em&gt;Belén tradicional&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. &lt;em&gt;Originalidad de las figuras y de la composición&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;em&gt;Perspectiva del Belén&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. &lt;em&gt;Relación entre la medida y la calidad de la composición&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. &lt;em&gt;Valor artístico, detalles y buen gusto&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.2. &lt;strong&gt;&lt;em&gt;Belén infantil&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. &lt;em&gt;Trabajo manual realizado y la laboriosidad en la ejecución de los elementos, así como los elementos usados (barro, corcho, papel, materiales reciclados.…)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;em&gt;Originalidad en la composición&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. &lt;em&gt;Originalidad de las figuras&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. &lt;em&gt;Esfuerzo y participación en la realización por parte de los más pequeño casa.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.3. &lt;strong&gt;&lt;em&gt;Belén innovador&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. &lt;em&gt;Trabajo manual realizado y la laboriosidad en la ejecución de los elementos, así como los elementos usados (barro, corcho, papel, materiales reciclados....)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. &lt;em&gt;Originalidad de las figuras&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. &lt;em&gt;Creatividad e innovación en el conjunto del Belén&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. &lt;strong&gt;&lt;em&gt;PLAZO, LUGAR DE PRESENTACIÓN Y CONTENIDO DE LAS SOLICITUDES.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.1. &lt;strong&gt;&lt;em&gt;Presentación de las solicitudes&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las solicitudes de participación en el concurso (anexo 1) y el resto de documentación obligatoria se podrán presentar a partir del día siguiente de la publicación en el Boletín Oficial de las Islas Baleares (BOIB) de esta convocatoria hasta el 20 de diciembre de 2021 (incluido).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La inscripción en este concurso es totalmente gratuita.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las solicitudes se podrán presentar, de acuerdo con lo que establecen los artículos 14.2, 14.3, 16.4 y 66, de la Ley 39/2015, del 1 de octubre, del procedimiento administrativo común de las administraciones públicas, de las siguientes formas:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Presencialmente: ante el Servicio de Atención Ciudadana (SAC) del Ayuntamiento de Andratx obligatoriamente con cita previa (de 08:30 a 13:30 de lunes a viernes) o cualquiera de las oficinas de registro de la Administración autonómica, de la Administración General del Estado, del resto de comunidades autónomas o de las entidades que integran la Administración local. También se podrá presentar ante las oficinas de Correos, dentro de un sobre abierto, a fin de que el personal de la oficina pueda indicar, mediante el sello oficial, el lugar, fecha y hora exacta en que se ha efectuado el registro.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Telemáticamente: a través de la sede electrónica del Ayuntamiento de Andratx mediante el trámite específico (En todo caso, sujetos obligados a relacionarse a través de medios electrónicos con las administraciones públicas, y opcionalmente personas físicas no obligadas). Es necesario disponer de uno de los métodos de identificación permitidos (certificado electrónico, DNI electrónico o Cl@ve pin). &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Si la solicitud no cumple los requisitos establecidos en la convocatoria, el órgano gestor debe requerir a la persona interesada para que lo subsane en el plazo máximo de 10 días hábiles, con la indicación de que, si no lo hace, se considerará que ha desistido de la solicitud, previa resolución que debe ser dictada en los términos previstos en el artículo 68 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.2. &lt;strong&gt;&lt;em&gt;Contenido&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;em&gt;Las solicitudes de participación en el concurso se deben presentar mediante las instancias y los anexos que facilita el Ayuntamiento de Andratx y que se pueden encontrar en la sede electrónica del Ayuntamiento de Andratx:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La solicitud constará de la siguiente documentación:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. &lt;em&gt;Anexo 1. Modelo de solicitud y declaraciones responsables&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;em&gt;Fotocopia NIF&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. &lt;em&gt;Poder/Autorización de representación (si procede)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Los participantes autorizarán expresamente la captación, la reproducción y la publicación de las imágenes generales y a detalle del belén facilitadas (Anexo I). Estas podrán ser difundidas en los varios medios y canales del Ayuntamiento (web municipal, redes sociales, material promocional, publicaciones externas, revistas, trípticos y otros medios propios).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La fotografía del belén con su creador y/o participante no será objeto de ser difundida a los varios medios y canales del Ayuntamiento (web municipal, redes sociales, material promocional, publicaciones externas, revistas, trípticos y otros medios propios) sin el consentimiento expreso del participante (Anexo I). &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Una vez presentada la solicitud (anexo I) en el Registro de entrada del Ayuntamiento o en cualquiera de las formas previstas en el artículo 16.4 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas, cada participante, enviará la documentación gráfica (fotografías) del belén al correo electrónico patrimoni@andratx.cat. El plazo máximo para enviar las fotografías será el 21 de diciembre de 2021.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;e. &lt;em&gt;Solicitud de transferencia bancaria para pagos (Modelo SEPA)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f. &lt;em&gt;Acreditación de estar al corriente en el cumplimiento de las obligaciones tributarias, ante la Seguridad Social, la Administración pública de la Comunidad Autónoma y la Agencia Estatal de Administración Tributaria (AEAT).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El pago de estos premios, serán abonados con cargo a la partida correspondiente, una vez llevada a cabo la tramitación legalmente establecida. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. &lt;strong&gt;&lt;em&gt;ÓRGANOS COMPETENTES PARA INSTRUIR Y RESOLVER EL PROCEDIMIENTO.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La tramitación y gestión de esta convocatoria se sujetará a los principios enumerados en el artículo 8.3 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La Junta de Gobierno Local será el órgano encargado de aprobar las bases y la convocatoria y de resolverla, de acuerdo con el Decreto número 1945/2021, de 31 de mayo de 2021, por el que el señor alcalde del Ayuntamiento de Andratx, delega un conjunto de competencias a la Junta de Gobierno Local, entre las que se encuentra la de concesión de ayudas, subvenciones y becas económicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Recibido el informe por el órgano instructor que gestiona las solicitudes para participar en el concurso de belenes y comprobado que los solicitantes cumplen con los requisitos exigidos, se dictará la propuesta de resolución correspondiente. Y posteriormente, la Junta de Gobierno Local resolverá la convocatoria, con indicación de los extremos contenidos en la propuesta de resolución definitiva.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. &lt;strong&gt;&lt;em&gt;CRITERIOS PARA LA VOTACIÓN.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11.1. &lt;strong&gt;&lt;em&gt;Votación de los Belenes participantes:&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Desde el área de Patrimonio se publicarán las fotografías de los belenes en las redes sociales y se abrirá el período de votación comprendido desde la publicación del álbum de fotografías en la página de Facebook del Ayuntamiento de Andratx hasta el 10 de enero de 2022 incluido, hasta las 12:00 h del mediodía.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las fotografías se publicarán en un álbum fotográfico en la página del Facebook del Ayuntamiento de Andratx, que servirá como sistema de votación a través de las interacciones. Se realizará un álbum por cada belén presentado. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Cada perfil personal de Facebook podrá votar los álbumes que desee. La persona ganadora será la titular del álbum que más interacciones haya tenido en la página del Facebook del Ayuntamiento de Andratx. Se contabilizarán los ‘me gusta' del álbum, no de las imágenes adjuntas dentro del mismo. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Se entenderá como interacción los «&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;img alt=""  height="28" data-eboib-alt-url="https://intranet.caib.es/eboibback/preVisualizarImagen/1101846/656001/image1639046046059.png" src="https://intranet.caib.es/eboibback/preVisualizarImagen/1101846/656001/image1639046046059.png" width="65" /&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;» exclusivamente. No se tendrán en cuenta como interacción/votación cualquier otra reacción, comentario o contenido compartido en otras páginas o perfiles.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Cuando existan dudas derivadas del origen de las fotografías, el Ayuntamiento de Andratx podrá solicitar al interesado, de forma motivada y aplicando todas las medidas de seguridad, la comparecencia por parte del técnico de patrimonio con el fin de comprobar que el Belén es el correspondiente a la documentación presentada.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12. &lt;strong&gt;&lt;em&gt;PROCEDIMIENTO Y NOTIFICACIÓN DE LOS PREMIOS.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La convocatoria, con las bases que la rigen, se publicarán en el Boletín Oficial de la Comunidad Autónoma correspondiente, en la página Web y en el tablón de anuncios del Ayuntamiento de Andratx.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las resoluciones de concesión de los premios del concurso de belenes se publicarán en la citada página web y en el tablón de anuncios del Ayuntamiento de Andratx; en los términos de la disposición adicional séptima de la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El plazo máximo para resolver el procedimiento y notificarlo es de seis meses desde la fecha de publicación del extracto de la convocatoria en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Y si no se resolviera en plazo el procedimiento de concesión de los premios, debemos señalar que, según lo fijado en el artículo 25.4 y 5 LGS, transcurrido el plazo de seis meses desde la iniciación sin resolver y notificar resolución, los interesados podrán entender desestimada su solicitud. A partir de ese momento podrán interponer el recurso potestativo de reposición (en un mes desde que se producen los efectos de silencio administrativo) o, directamente, el contencioso-administrativo ante el Juzgado Contencioso. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;13. &lt;strong&gt;&lt;em&gt;ABONO DE LOS PREMIOS.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;em&gt;El abono del total del importe premiado se hará mediante transferencia bancaria a la cuenta corriente designada por el beneficiario del premio (solicitud de transferencia bancaria para los pagos (Modelo SEPA)) una vez se haya comprobado que el solicitante cumple los requisitos para ser beneficiario del premio y se dicte la correspondiente resolución de concesión de la subvención.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;14. &lt;strong&gt;&lt;em&gt;OBLIGACIONES DE LAS PERSONAS BENEFICIARIAS.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las personas beneficiarias deben cumplir con las obligaciones establecidas en el artículo 8 de la Ordenanza Municipal de Subvenciones de Andratx y con el artículo 14 de la Ley 38/2003 General de Subvenciones.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;15. &lt;strong&gt;&lt;em&gt;REINTEGRO Y PÉRDIDA DEL DERECHO A COBRO DE LA SUBVENCIÓN.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Para la aplicación del reintegro se ajustará a las causas y procedimientos establecidos en la presente convocatoria (destacando el artículo 13 de ésta), en los artículos 36 y siguientes de la Ley 38/2003 General de Subvenciones, 96 y siguientes del Reglamento General de Subvenciones, y 49 y siguientes de la Ordenanza reguladora de Subvenciones de Andratx. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;16. &lt;strong&gt;&lt;em&gt;ACEPTACIÓN DE LES BASES, DERECHOS Y OBLIGACIONES.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La presentación al concurso supone la aceptación de las bases y de los derechos y obligaciones que se derivan.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;17. &lt;strong&gt;&lt;em&gt;RENUNCIA&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;En cualquier momento del procedimiento, los interesados podrán desistir de su solicitud o renunciar al derecho de percibir los premios concedidos en conformidad con aquello que dispone el artículo 94 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La renuncia se tendrá que presentar mediante instancia general de acuerdo con los artículos 14.2, 14.3 y 16.4, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;18. &lt;strong&gt;&lt;em&gt;INFRACCIONES Y SANCIONES.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El incumplimiento de los requisitos establecidos en estas bases o en la normativa de aplicación podrá dar lugar a la aplicación del régimen de sanciones establecido en al LGS.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;19. &lt;strong&gt;&lt;em&gt;PRESENTACIÓN DE RECURSOS&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Contra la resolución por la que se aprueban las presentes bases y de conformidad con lo dispuesto en los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, y 8, 45 y 46 de la Ley 29/1998, de 13 de julio, se podrá interponer uno de los siguientes recursos: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) Con carácter potestativo, recurso de reposición ante el mismo órgano que dictó el acto recurrido (salvo que se trate de un acto dictado por delegación en cuyo caso corresponderá la resolución al órgano delegante), en el plazo de un mes, a contar desde el día siguiente de la publicación de la convocatoria de las presentes bases.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La interposición del recurso, excepto en los casos en que una disposición establezca lo contrario, no suspenderá la ejecución del acto impugnado, de conformidad con lo dispuesto en el artículo 117 de la Ley 39/2015, de 1 de octubre. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Si transcurriese un mes desde el día siguiente al de la interposición del recurso de reposición sin que éste haya sido resuelto, podrá entender que ha sido desestimado e interponer recurso contencioso-administrativo ante el Juzgado de lo Contencioso Administrativo de Palma, en el plazo de seis meses, a contar desde el día siguiente al de la desestimación presunta. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) Recurso contencioso-administrativo ante el Juzgado de lo Contencioso Administrativo de Palma, dentro del plazo de dos meses contados desde el día siguiente de la publicación de la convocatoria de las presentes bases.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;En caso de optar por el recurso potestativo de reposición no se podrá interponer el recurso contencioso-administrativo hasta que aquél sea resuelto expresamente o se haya producido su desestimación por silencio administrativo.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Todo ello sin perjuicio de cualquier otro recurso o acción que estime procedente.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
