2021-11-25 ![CDATA[Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática por la cual se acepta la renuncia de una subvención y se declara concluido el procedimiento]] CAIB 300 47969 es 568657 ![CDATA[<p><span style="line-height:115%"><strong>Hechos</strong></span></p> <p><span style="line-height:115%">1. El día 31 de diciembre de 2020 se publicó en el <span style="background-color:white">BOIB </span>la Resolución del vicepresidente y consejero de Transición Energética y Sectores Productivos de 23 de diciembre de 2020 por la cual se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2021 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a particulares, entidades sin ánimo de lucro, pequeñas y medianas empresas y asociaciones empresariales.</span></p> <p><span style="line-height:115%">2. Los expedientes listados al anexo presentaron a la consellería de Transición Energética y Sectores Productivos una solicitud de subvención para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a particulares, entidades sin ánimo de lucro, pequeñas y medianas empresas y asociaciones empresariales.</span></p> <p><span style="line-height:115%">3. El consejero de Transición Energética, Sectores Productivos y Memoria Democrática dictó Resolución de concesión de subvención para llevar a cabo un proyecto de instalación fotovoltaica por autoconsumo, por los importes que aparecen al anexo.</span></p> <p><span style="line-height:115%">4. Los titulares de los expedientes que aparecen al anexo han presentado un escrito en el que indica que renuncia a la mencionada subvención.</span></p> <p><strong>Consideraciones jurídicas</strong></p> <p><span style="line-height:115%">1. El consejero de Transición Energética, Sectores Productivos y Memoria Democrática es el órgano competente para resolver este procedimiento atendida la estructura orgánica del Gobierno de las Islas Baleares y de acuerdo con la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la cual se establecen las bases reguladoras para la concesión de subvenciones en materia de energía.</span></p> <p><span style="line-height:115%">2. El Decreto legislativo 2/2005, de 28 de diciembre, por cual se aprueba el texto refundido de la Ley de subvenciones.&nbsp; </span></p> <p><span style="line-height:115%">3. El artículo 94, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, prevé que la Administración, en el supuesto de renuncia de la persona interesada a sus derechos, aceptará la renuncia completamente y resolverá el procedimiento declarando esta circunstancia, con indicación de los hechos producidos y las normas aplicables.</span></p> <p><span style="line-height:115%">Por todo lo anterior, dicto la siguiente,</span></p> <p style="text-align:center"><span style="line-height:115%"><strong>Resolución</strong></span></p> <p><span style="line-height:115%">1. Aceptar la renuncia a la subvención presentada por los beneficiarios de los expedientes que aparecen en el anexo.</span></p> <p><span style="line-height:115%">2. Desvincular el remanente del documento contable que aparecen al anexo.</span></p> <p><span style="line-height:115%">3. Declarar concluido el procedimiento y por tanto, archivar el expediente.</span></p> <p><span style="line-height:115%">4. Notificar esta Resolución a las personas interesadas.</span></p> <p><strong>Interposición de recursos</strong></p> <p><span style="line-height:115%">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática, en el plazo de 1 mes contador desde el día siguiente de haber recibido la notificación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común y de las administraciones públicas y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares.</span></p> <p><span style="line-height:115%">También se puede interponer directamente un recurso contencioso-administrativo ante la Sala Contenciosa del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses contadores desde el día siguiente de haber recibido la notificación de la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.</span></p> <p> </p> <p style="text-align:center"><span style="line-height:115%"><span style="line-height:115%">Palma, 22 de noviembre de 2021</span></span></p> <p style="margin-bottom:0px;
