    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En sesión extraordinaria celebrada día 18 de noviembre de 2021, el Pleno del Ayuntamiento de Alcudia ha aprobado las bases reguladoras del concurso de mostradores para la campaña comercial de Navidad 2021. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con el artículo 9.3 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, por medio del presente edicto se publican las bases referidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Alcudia, a la fecha de la firma&lt;em&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;(18 de noviembre de 2021)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="color:null"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La alcaldesa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“&lt;strong&gt;BASES DEL CONCURSO DE ESCAPARATES POR LA CAMPAÑA COMERCIAL DE NAVIDAD 2021&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. &lt;strong&gt;Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El objeto de estas bases es establecer las normas que tienen que regir el concurso de escaparates enmarcado dentro de la Campaña comercial de Navidad 2021, a partir del cual se concederán unos premios económicos destinados a galardonar las mejores decoraciones de escaparates de los comercios del municipio de Alcúdia con el objetivo de dinamizar y poner en valor el comercio de proximidad y promover la participación ciudadana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. &lt;strong&gt;Premios y dotación económica&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El concurso de escaparates constará de dos categorías: la profesional, en la cual se otorgarán dos premios, y la popular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los premios de la categoría profesional serán otorgados por un jurado profesional, compuesto por tres miembros denominados por la alcaldía del Ayuntamiento de Alcúdia y que tengan relación con el mundo del arte, el comercio o el diseño.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El premio de la categoría popular será otorgado al escaparate que obtenga más votos por parte de la ciudadanía, con uno “me gusta” en la publicación que compartirá el Ayuntamiento de Alcúdia a su perfil de Facebook.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los premios su los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.º Premio profesional, con una dotación económica de 700€.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.º Premio profesional, con una dotación económica de 500€.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Premio popular, con una dotación económica de 300€.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. &lt;strong&gt;Requisitos de participación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Podrán participar las personas físicas o jurídicas legalmente constituidas, que sean titulares de un establecimiento comercial físico y abierto al público con escaparate en el municipio de Alcúdia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. &lt;strong&gt;Inscripciones, plazos y documentación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para participar se tendrá que presentar el modelo de solicitud (Anexo I), donde se indicarán los datos identificativos y se declarará responsablemente que no se incurre en ninguno de las prohibiciones establecidas en el artículo 13, apartado 2 de la Ley 38/2003, General de Subvenciones y que encuentran al corriente de pago de las obligaciones con la Seguridad Social y la Agencia Tributaria. También se autoriza en el Ayuntamiento de Alcúdia a consultar los datos para comprobar que se está al corriente en el cumplimiento de las obligaciones de pago con el Ayuntamiento de Alcúdia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las solicitudes se presentarán a partir del trámite telemático creado a tal efecto en la sede electrónica del ayuntamiento de Alcúdia, según el que determina el artículo 14.2 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Únicamente las personas físicas podrán presentar su solicitud de manera presencial en el registro de entrada del Ayuntamiento de Alcúdia, o de cualquier forma establecida en el artículo 16.4 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuando una persona física sea titular de más de un establecimiento, podrá presentar una solicitud para cada uno de ellos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El plazo de presentación de las solicitudes se indicará a la convocatoria, aprobada por la alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. &lt;strong&gt;Procedimiento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vez finalizado el plazo de presentación de solicitudes, el área de Comercio del Ayuntamiento de Alcúdia se pondrá en contacto con los establecimientos participantes y facilitará un dorsal con un número, el cual tendrán que ubicar a un lugar visible del escaparate.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los comercios participantes tendrán que exhibir los escaparates durante los días que se determinarán en la convocatoria. Durante estos días el área de Comercio y los miembros del jurado profesional visitarán todos los establecimientos participantes y realizarán las fotografías que se publicarán en el Facebook del Ayuntamiento para la votación popular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. &lt;strong&gt;Instrucción y resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El órgano competente para la ordenación y la instrucción del procedimiento de concesión de la ayuda es el área de Comercio del Ayuntamiento de Alcúdia. A la vista de la decisión del jurado, el instructor formulará la propuesta de resolución que elevará a la alcaldía del Ayuntamiento de Alcúdia. Se prescindirá del trámite de audiencia, de acuerdo con el artículo 82.4 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El órgano competente para resolver es la alcaldía del Ayuntamiento de Alcúdia. La resolución se notificará a los interesados mediante un anuncio publicitado en la página web del Ayuntamiento de Alcúdia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. &lt;strong&gt;Jurado&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El jurado del concurso de escaparates estará compuesto por dos modalidades: el jurado popular y el jurado profesional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Jurado Profesional: estará formado por tres personas nombradas por la alcaldía del Ayuntamiento de Alcúdia y que tengan relación con el mundo del arte, el comercio o el diseño. Este será el encargado de dar el primero y el segundo premio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Su composición se hará pública en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Jurado Popular: La ciudadanía votará en la red social Facebook dando uno me gusta a las fotografías publicadas al perfil de Facebook del Ayuntamiento de Alcúdia. El escaparate votado con más “me gusta” obtendrá el tercer premio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de que el escaparate más votado por el jurado popular coincida con el profesional, se dará el premio al siguiente escaparate más votado por el público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El jurado actuará con libertad y discrecionalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El veredicto del jurado profesional y popular se publicará en la página web del Ayuntamiento de Alcúdia. Su veredicto será inapelable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. &lt;strong&gt;Criterios de valoración&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La temática del concurso será la navideña.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para decidir los premiados, el jurado profesional valorará las siguientes características de los escaparates presentados, hasta un máximo de 10 puntos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Originalidad, hasta 2 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Grado de vinculación entre la temática y la presentación del propio producto, hasta 2 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Calidad artística y diseño, hasta 2 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Iluminación, hasta 2 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Utilización de materiales reciclados o reciclables, hasta 2 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cuanto al jurado popular valorará con uno “me gusta” el escaparate que considere tenga que ser el ganador del concurso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. &lt;strong&gt;Consignación presupuestaria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se destina la cantidad de 1500€, con cargo a la aplicación presupuestaria CO4312 479002 del presupuesto municipal del Ayuntamiento de Alcúdia para la anualidad 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. &lt;strong&gt;Pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No se podrá realizar el pago a los participantes premiados si éstos no se encuentran al corriente de pago de sus obligaciones con la Seguridad Social, con la Agencia Tributaria y con el Ayuntamiento de Alcúdia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para poder realizar el pago, solo los participantes premiados, tendrán que presentar el certificado de titularidad bancaria (Anexo II), junto con el certificado que acredite que se encuentran al corriente de pago de sus obligaciones con la Seguridad Social y con la Agencia Tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todos los beneficiarios se verán sometidos en el momento de pago a la correspondiente retención tributaria según el régimen jurídico del IRPF o Impuesto sobre sociedades, según cada caso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. &lt;strong&gt;Régimen Jurídico&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En todo el que no regulan estas bases será de aplicación, la Ley 38/2003, de 17 de noviembre, General de Subvenciones, y el Reglamento General de Subvenciones 887/2006 aprobado el 21 de julio, el texto refundido de la Ley de subvenciones, aprobado mediante el Decreto Legislativo 2/2005, de 28 de diciembre, la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, el Reglamento de servicios de las Corporaciones Locales de 17 de junio de 1955, el Real decreto legislativo 2/2004 por el que se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local, La ordenanza general reguladora de la concesión de Subvenciones del Ayuntamiento de Alcúdia publicada al BOIB n.º 176 de día 1 de diciembre de 2017, las Bases de ejecución del Presupuesto Municipal del año en curso y el resto de normativa para la concesión de subvenciones públicas que sea de aplicación&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12.&lt;strong&gt; Derechos de imagen y de autor&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los establecimientos y personas participantes ceden al ayuntamiento los derechos de imagen, reproducción y difusión pública relacionados con el concurso. Las fotografías realizadas por el concurso serán de propiedad exclusiva del Ayuntamiento por su uso, exhibición, reproducción, difusión pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con la Ley Orgánica 3/2018, de 5 de diciembre, de protección de datos de carácter personal, los datos facilitados por los participantes se incorporan a ficheros propiedad del Ayuntamiento de Alcúdia. El órgano administrativo ante el cual se pueden ejercer los derechos de acceso, rectificación, cancelación, oposición y otros que reconozca la dicha Ley es la concejalía de Comercio y Promoción Económica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;13.&lt;strong&gt; Aceptación de las bases&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La participación en el concurso comporta el pleno conocimiento y la aceptación de estas bases y del resultado de las votaciones del jurado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
