es 655258 2021-11-16 2021-11-16 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:0.46cm">El director general de Movilidad y Transporte Terrestre ha formulado la propuesta de resolución siguiente: </span></span></p> <p><strong><strong>Hechos</strong></strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. El día 3 de agosto de 2021 se publicó en el BOIB n.º 103 la Orden del consejero de Movilidad y Vivienda de 29 de julio de 2021, por la cual se aprueban las bases reguladoras de las subvenciones en materia de transporte público por carretera de viajeros y mercancías. Estas bases prevén que las convocatorias que se dicten a su amparo se tienen que aprobar con una resolución del consejero de Movilidad y Vivienda y se tienen que publicar en el BOIB.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. El 22 de octubre de 2021 el consejero de Movilidad y Vivienda dictó una resolución por la cual se aprueba la convocatoria de ayudas para el sector del transporte público por carretera de viajeros y mercancías para paliar los efectos económicos y sociales de carácter negativo que se han producido por la alerta sanitaria derivada de la COVID-19, con el objetivo de mantener su actividad. Esta resolución de convocatoria se publicó en el BOIB n.º 146 de 26 de octubre de 2021.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En concreto, se trata de conceder ayudas económicas a las personas físicas o jurídicas que sean titulares de autorización de transporte público de viajeros o de mercancías residenciadas en las Illes Balears, para paliar el impacto económico ocasionado en el sector a consecuencia de la alerta sanitaria derivada de la COVID-19, con el objetivo de mantener su actividad de transporte.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. En cumplimiento del pu</span><span style="background-color:#ffffff; font-family:&quot;Times New Roman&quot;,Times,serif">nto octavo de la convocatoria, la jefa del Servicio de Ordenación del Transporte en fecha 10 de noviembre de 2021 ha emitido el informe previo favorable a la primera concesión de ayudas, que por lo que aquí interesa indica:</span></p> <p style="margin-left:40px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">«9. A día de hoy, se han analizado las 50 primeras solicitudes presentadas dentro de plazo y que han tenido entrada al Servicio que instruye el procedimiento, del que resulta que en la modalidad de transporte discrecional de viajeros de la clase VD y VTC y en la modalidad de de transporte de mercancías (MDL y MDP) se han presentado un total de 14 solicitudes, de las cuales 13 no presentan ninguna deficiencia y 1 presenta deficiencias.</span></p> <p style="margin-left:40px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En cuanto a la modalidad de transporte discrecional de viajeros VT, hasta la fecha de finalización del plazo para presentar las solicitudes no se pueden analizar estas, puesto que para determinar el importe individual de las ayudas es necesario conocer el número total de autorizaciones por las cuales se ha solicitado la subvención.</span></p> <p style="margin-left:40px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">10. Se han comprobado los siguientes puntos:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">- Que los beneficiarios, de acuerdo con el punto décimo de la convocatoria, han presentado correctamente la solicitud y la declaración responsable, con lo cual se considera justificado el objeto de la subvención.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">- Que los beneficiarios disponen de la autorización de transporte correspondiente a la modalidad de ayuda solicitada.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">- Que los beneficiarios se encuentran al corriente de pago con la Agencia Tributaria estatal y con la Tesorería General de la Seguridad Social, que no tienen deudas pendientes de pago con la *CAIB y que no tienen sanciones pendientes de pago.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">- Que hay crédito adecuado y suficiente a la partida presupuestaria 25201/413G01/47000/00 del presupuesto de la Comunidad Autónoma de las Illes Balears para el año 2021.</span></p> <p style="margin-left:40px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">11. De las 50 solicitudes analizadas en las cuales la cuantía de la ayuda que corresponde a cada solicitante no supera los 30.000 euros, y en consecuencia no es necesaria la fiscalización previa de la Intervención General de la CAIB, procede la concesión de ayudas por un importe total de 86.200 euros, de los cual 45.800 euros corresponden a la modalidad VD y VTC y 40.400 euros a la modalidad MDL y MDP, a los beneficiarios que se relacionan en el anexo y por el importe individual indicado.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-left:40px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Conclusión</span></p> <p style="margin-left:40px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Se informa favorablemente conceder las ayudas para el sector del transporte público por carretera de viajeros y mercancías para paliar los efectos económicos y sociales de carácter negativo que se han producido por el alerta sanitaria derivada de la COVID-19, con el objetivo de mantener su actividad, por un gasto global de 86.200 euros, de los cual 45.800 euros corresponden a la modalidad VD y VTC y 40.400 euros a la modalidad MDL y MDP, a favor de los beneficiarios que figuran al anexo y por el importe individual indicado.»</span></p> <p><strong><strong>Fundamentos de derecho</strong></strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1.
