&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.&lt;/strong&gt; Mediante Resolución nº. 11452 de 4 de agosto de 2021, el Presidente del&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Instituto&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Mallorquín&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;e As&lt;/span&gt;&lt;span style="color:#000000"&gt;untos&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Sociales&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;(IMAS)&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;aprobó&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;l &lt;/span&gt;&lt;span style="color:#000000"&gt;expediente&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;convocatoria de &lt;/span&gt;&lt;span style="color:#000000"&gt;la concertación social de urgencia del servicio &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;ocupacional para personas con discapacidad intelectual y/o del desarrollo&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;(BOIB nº. 105, de 7 de agosto de 2021). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt; Con esta resolución se autorizó un gasto dimanando de este expediente por importe total máximo de &lt;/span&gt;&lt;span style="color:#000000"&gt;14.593.174,20&lt;/span&gt;&lt;span style="color:#000000"&gt; euros (IVA exento)&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;con cargo a la partida presupuestaria 40.23128.22709 del presupuesto de gasto del IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. &lt;/strong&gt;La Jefa del Servicio de Personas con Discapacidad e Innovación Social con el visto bueno del Director Insular de Personas con Discapacidad e Innovación Social ha emitido informe técnico, de fecha 11 de agosto de 2021, en el que propone el cambio de partida presupuestaria, para&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:none"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt; la introducción de una partida complementaria, y en consecuencia la modificación de la mencionada Resolución nº. 11452 de 4 de agosto de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.&lt;/strong&gt; El mencionado informe técnico ha sido objeto de aclaración por parte de la Jefa del Servicio de Personas con Discapacidad e Innovación Social, mediante informe técnico de fecha 28 de octubre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos&lt;span style="display:none"&gt;&amp;lt;A[Fundamentos|Cimientos]&amp;gt;&lt;/span&gt; de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Con respecto a la competencia,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. &lt;/strong&gt;Decreto de la Presidencia del Consejo de Mallorca por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el que se nombran los miembros del Consejo Ejecutivo (BOIB nº. 92, de 9 de julio de 2019), siendo nombrado el señor Javier de Juan Martín Consejero&lt;span style="display:none"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt; Ejecutivo de Derechos Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;El órgano competente para aprobar esta resolución es la Presidencia del IMAS, de acuerdo con el artículo 7.2.28 de los Estatutos del IMAS (BOIB nº. 67, de 18 de mayo de 2019). No obstante, y de acuerdo con el artículo 8.2.1 las Vicepresidencias del IMAS suplirán a la Presidencia y asumirán sus atribuciones en caso de vacante, ausencia, enfermedad, imposibilidad física o una otro causa legal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Con respecto al fondo y al procedimiento&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. &lt;/strong&gt;La autorización de un gasto es el acto mediante el cual se acuerda, después del cumplimiento&lt;span style="display:none"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt; de los trámites legales establecidos, la realización de gasto por un importe exactamente determinado. La realización de este acto tiene relevancia jurídica enfrente de terceros y vincula la Administración a la realización de un gasto concreto, determinante tanto con respecto a la cuantía como las condiciones de ejecución. Para que se pueda cancelar o modificar este acto tiene que quedar acreditado que estas condiciones de ejecución no se podrán cumplir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. &lt;/strong&gt;La Aprobación definitiva del expediente nº. 4/2021 de modificación de créditos en el presupuesto propio de la Corporación del ejercicio 2021 por crédito extraordinario (CE01/2021 SUP.01/2021) (BOIB nº. 55, de 27 de abril de 2021) modificado por Acuerdo del Pleno de Consejo de Mallorca de 8 de julio de 2021 (BOIB nº. 101, de 29 de julio de 2021). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.&lt;/strong&gt; La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (BOE nº. 236, de 2 de octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;En virtud de la competencia atribuida legalmente,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESUELVO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero&lt;/strong&gt;. CAMBIAR la partida presupuestaria a cargo de la que se autorizó el gasto de la concertación social por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el procedimiento de urgencia del servicio ocupacional para personas con discapacidad intelectual &lt;span style="background-color:#ffffff"&gt;y/o del desarrollo, según la distribución siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
