    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Mediante el decreto AJT 202013241 de 31 de agosto de 2020, publicado en el Boletín Oficial de las Islas Baleares núm.&amp;nbsp;157, de 10 de septiembre de 2020, se aprobó el decreto que contiene la Instrucción que ordena y regula las actividades de los artistas de calle en zonas de dominio público municipal de este ayuntamiento en las calles del centro de la ciudad y la playa de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;A día de hoy, se ha comprobado la necesidad de realizar una serie de modificaciones para que la redacción de su articulado sea lo más clara posible para la ciudadanía, en cumplimiento de los principios que deben regir la actuación y relaciones de las Administraciones públicas con la ciudadanía y que se prevén en el artículo 3 de la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público.&amp;nbsp;Además, se hace necesaria una modificación en cuanto a cuestiones relativas a las solicitudes para la obtención del carné de artista de calle y en su tramitación, dado que los plazos de presentación se reducen de veinte a quince días con el fin de simplificar y agilizar su procedimiento, en coherencia con lo dispuesto en dicho artículo 3;&amp;nbsp;y también procede adaptar la regulación a las exigencias de la normativa sobre protección de datos establecida por el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos y por el que se deroga la Directiva 95/46/CE (Reglamento general de protección de datos) y por la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Por otra parte, de acuerdo con el artículo 5.3 de la&amp;nbsp;Ley&amp;nbsp;11/2016, de 28 de julio, de igualdad de mujeres y hombres de la&amp;nbsp;CAIB, en el procedimiento de elaboración de la Ordenanza municipal de ocupación de la vía pública se incorporaron las recomendaciones del informe de evaluación de impacto de género emitido por el Instituto Balear de la Mujer en fecha 20 de&amp;nbsp;febrero&amp;nbsp;de 2018, y plasmaron específicamente en la redacción del artículo 62&amp;nbsp;de la citada&amp;nbsp;ley que hace&amp;nbsp;referencia&amp;nbsp;a la publicidad que comporte conductas discriminatorias.&amp;nbsp;Estas&amp;nbsp;recomendaciones&amp;nbsp;no proceden en la regulación del presente decreto, pero cabe citar el artículo 32 de la Ley en relación con la&amp;nbsp;participación&amp;nbsp;en el ámbito cultural, el fomento de las producciones artísticas y culturales que fomenten los valores de igualdad entre mujeres y hombres ni las manifestaciones artísticas que reproduzcan estereotipos y valores sexistas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Con base en lo que se ha expuesto, procede realizar una serie de modificaciones en diversos artículos para mejorar la redacción del articulado de la norma que nos ocupa y que, en consecuencia, sea más clara y más accesible para la ciudadanía, y la tramitación para la obtención del carné de artista en la calle sea más ágil y rápida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;De acuerdo con el Decreto AJT 201912198, de fecha 17/06/2019 (BOIB núm. 85, de 27/06/2019), de aprobación de las áreas municipales del Ayuntamiento de palma y nombramiento de los titulares de dicha área así como el Decreto de Alcaldía núm.&amp;nbsp;AJT 201913026, de 28/06/2019 (BOIB núm. 94&amp;nbsp;de 11/07/2019), de organización de los servicios administrativos del Ayuntamiento de Palma;&amp;nbsp;de acuerdo con la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, y de acuerdo con la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local, se propone que el concejal del Área de Participación Ciudadana y Gobierno interior dicte el siguiente:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;DECRETO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;1º.- MODIFICAR&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;del Decreto&amp;nbsp;AJT 202013241 de 31 de agosto de 2020, publicado en el Boletín Oficial de las Islas Baleares núm.&amp;nbsp;157, de 10 de septiembre de 2020, y por el que se aprobó el decreto que ordena y regula las actividades de los artistas de calle en zonas de dominio público municipal de este ayuntamiento en las calles del centro de la ciudad y la playa de Palma, lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Donde dice:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;«Artículo 5&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Solicitudes y plazos&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;1. Para obtener el carné de artista obligatorio para las zonas autorizadas el artista debe presentar la siguiente documentación en cualquier Oficina de Atención a la Ciudadanía,&amp;nbsp;OAC:&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Solicitud cumplimentada (anexo I)&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Fotocopia del DNI,&amp;nbsp;NIE&amp;nbsp;o Pasaporte.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Certificado de empadronamiento.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Fotografía&amp;nbsp;formato&amp;nbsp;carné.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Currículum: deberá hacerse constar la experiencia relacionada con la actividad y, en su caso, memoria de la actividad realizada en Palma.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Declaración de responsabilidad determinada por su actividad (anexo II)&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Dossier de la propuesta artística.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;En su caso, documento donde se demuestre la pertenencia a entidades de artistas callejeros registradas en el&amp;nbsp;RMEC.&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;2. Los criterios y baremos de puntuación se encuentran detallados en el Anexo III&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;3. Existen dos posibilidades de solicitud, de acuerdo con la duración de la actividad que se quiera realizar:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="decimal lower-alpha" style="list-style-type:lower-alpha"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Solicitud para período anual: las solicitudes se pueden presentar del 1 al 20 de enero.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Solicitud para temporada de verano: las solicitudes pueden presentarse del 1 al 20 de abril.&amp;nbsp;Se considera temporada de verano los meses comprendidos entre mayo y septiembre, ambos inclusive.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;4. El Ayuntamiento resolverá en el plazo de&amp;nbsp;20&amp;nbsp;días hábiles desde que finalice el plazo de presentación de las solicitudes, publicará las listas telemáticamente para que se puedan consultar y abrirá período de alegaciones durante&amp;nbsp;5&amp;nbsp;días hábiles.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;5. Para cualquier carencia de la documentación exigida será requerida su subsanación y si en el plazo de&amp;nbsp;5&amp;nbsp;días hábiles desde la recepción del requerimiento no se presenta, se entenderá desistido en su petición y se archivará sin otro trámite.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;6. El Ayuntamiento dirimirá las alegaciones presentadas en el plazo de&amp;nbsp;5&amp;nbsp;días desde que finalice el período de alegaciones, y publicará la lista de plazas definitivas.&amp;nbsp;Al recoger el carné es imprescindible presentar el resguardo de pago de la tasa correspondiente.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;7. Las solicitudes de licencia de ocupación de vía pública que se hayan presentado fuera del plazo establecido, no serán admitidas a trámite.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;8. El silencio administrativo en materia de ocupación de vía pública tiene carácter negativo.&amp;nbsp;En ningún caso, las solicitudes supondrán la concesión de la licencia automáticamente.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;9. En caso de prórroga de la licencia anual para la realización de actividades artísticas en la calle, se podrá obtener la licencia por declaración responsable de la persona, mientras no varíe la normativa reguladora.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Debe decir:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;«Artículo 5&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Solicitudes, plazos y tramitación&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;1. Para obtener el carné de artista obligatorio para las zonas autorizadas, el artista debe presentar la siguiente documentación en cualquier Oficina de Atención a la Ciudadanía (OAC):&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Solicitud cumplimentada (anexo I)&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Fotocopia del DNI,&amp;nbsp;NIE&amp;nbsp;o pasaporte.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Certificado de empadronamiento.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Fotografía&amp;nbsp;formato&amp;nbsp;carné.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Currículum: deberá hacerse constar la experiencia relacionada con la actividad y, en su caso, memoria de la actividad realizada en Palma.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;En su caso, documento donde se demuestre la pertenencia a entidades de artistas callejeros registradas en el&amp;nbsp;RMEC&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El certificado de empadronamiento lo tendrán que aportar aquellas personas solicitantes que no se encuentren empadronadas en el municipio de Palma.&amp;nbsp;Para las que estén empadronadas en este Municipio, el Ayuntamiento comprobará de oficio este extremo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;2. Existen dos posibilidades de solicitud, de acuerdo con la duración de la actividad que se quiera realizar:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;a)Solicitud para período anual: las solicitudes se pueden presentar del 15 al 30 de noviembre.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;b)&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Solicitud por temporada de verano: las solicitudes pueden presentarse del 15 al 31 de marzo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;Se considera temporada de verano los meses comprendidos entre mayo y septiembre, ambos inclusive&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Las solicitudes de licencia de ocupación de vía pública que se hayan presentado fuera del plazo establecido no serán admitidas a trámite.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;En ningún caso, las solicitudes supondrán la concesión de la licencia automáticamente.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;3. Salvo lo dispuesto en el punto siguiente, se archivarán sin otro trámite las solicitudes que no estén debidamente firmadas por la persona solicitante y las que no vayan acompañadas de los documentos previstos en las letras f) y g) del apartado primero de este artículo, los cuales tendrán carácter de documentación esencial.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;4-Para cualquier carencia respecto al resto de documentación exigida en este artículo, se requerirá su subsanación, y si en el plazo de&amp;nbsp;5&amp;nbsp;días hábiles desde la recepción del requerimiento no se subsana, se entenderá que se desiste de la solicitud y se archivará sin otro trámite.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;También se archivarán sin ningún otro trámite aquellas solicitudes relativas a grupos de artistas que no cumplan con lo dispuesto en el artículo 10.1 de este Decreto.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;5. El Ayuntamiento resolverá en el plazo de&amp;nbsp;20&amp;nbsp;días hábiles desde que finalice el plazo de presentación de las solicitudes, de acuerdo con los criterios y baremo de puntuación previstos en el anexo III; publicará las listas telemáticamente para su consulta y abrirá período de alegaciones durante&amp;nbsp;3&amp;nbsp;días hábiles.&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;6. El silencio administrativo en materia de ocupación de vía pública tiene carácter negativo.&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;7. Se podrá prorrogar la licencia anual para la realización de actividades artísticas en la calle.&amp;nbsp;Para la obtención de esta licencia será suficiente la declaración responsable de la persona y la fotografía en formato carné, mientras no varíe la normativa reguladora.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;2º.- SUPRIMIR&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;del artículo 6 del Decreto de referencia su apartado 3, que dispone:&amp;nbsp;«&lt;em&gt;No hallarse al corriente de sus obligaciones con la hacienda municipal será motivo de denegación.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;3º.- AÑADIR&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;en el Decreto de referencia el Capítulo VII, relativo a la protección de datos, el cual debe disponer:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;«Capítulo VII&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Protección de datos&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Artículo 21&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Protección de datos de los solicitantes&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Los datos personales facilitados en cumplimiento del objeto de este Decreto deben ser tratados de conformidad con el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que se refiere al tratamiento de datos personales y a la libre circulación de estos datos, la Ley orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales, y la legislación vigente en materia de protección de datos. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La finalidad del tratamiento y la base jurídica para este tratamiento es la tramitación de las licencias de artistas de calle, así como, en el caso de las licencias de carácter anual, su prórroga, de acuerdo con lo dispuesto en el presente Decreto.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El responsable del tratamiento de los datos personales recogidos en virtud de este decreto es la Dirección General de Participación Ciudadana y Coordinación Territorial, ante la que los interesados ​​podrán ejercitar los derechos de acceso, rectificación, oposición y supresión de aquellos.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;4º.- SUPRIMIR&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;la disposición transitoria única (Convocatoria extraordinaria) del Decreto de referencia, que dispone:&amp;nbsp;«&lt;em&gt;Se establece un período extraordinario para la solicitud de licencias y otorgamiento hasta el 31 de diciembre de 2020. Este período extraordinario se iniciará en el momento de su publicación durante 20 días naturales, de acuerdo con los criterios establecidos en el artículo 5 del presente decreto.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;5º.- MODIFICAR Y APROBAR&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;el anexo I &lt;em&gt;(Solicitud para la realización de actividades artísticas en la calle)&lt;/em&gt; del Decreto de referencia en el sentido de incluir una cláusula relativa a la protección de datos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
