    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado 9.3. de la Convocatoria de ayudas para el desarrollo rural de la isla de Menorca, relacionados directa o indirectamente con los ámbitos agrario y / o ambiental, dentro de la Estrategia de Desarrollo Local Participativo de Mallorca, de fecha 13&amp;nbsp;de noviembre&amp;nbsp;de 2020&amp;nbsp;especifica que la resolución se publicará con carácter informativo a los interesados mediante su publicación en el Boletín Oficial de las Islas Baleares de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente en Materia Agraria del FOGAIBA con fecha 21&amp;nbsp;de octubre&amp;nbsp;de 2021, firmó la siguiente resolución,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 19 de noviembre de 2020 se publicó, en el BOIB nº. 197, el anuncio de la publicación del Acuerdo de la Junta Directiva de la Asociación Mallorca Rural Grupo de Acción Local de Mallorca aprobando la Convocatoria, para el año 2020, de ayudas al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes terminó el días 21 de diciembre de 2020, y tuvieron entrada en el Registro del Grupo de Acción Local, Asociación Mallorca Rural un total de 71 solicitudes de ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. Todos los expedientes relacionados en el Anexo I cuentan con su respectivo informe de subvencionabilidad positivo y han sido aprobados por el Órgano decisorio del Grupo de Acción Local Mallorca Rural. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Los interesados señalados en el Anexo I adjunto han presentado, en tiempo y forma, toda la documentación necesaria prevista en la convocatoria, y se ha comprobado que cumplen con los requisitos exigidos para poder ser beneficiarios de esta ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Las actuaciones solicitadas por los interesados cumplen con los requisitos establecidos en la convocatoria para poder ser subvencionables. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. Teniendo en cuenta que el crédito existente cubre la totalidad de las peticiones de esta convocatoria no existe impedimento alguno para resolver estos expedientes sin afectar a lo dispuesto en los apartados séptimo y octavo de la convocatoria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fund&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ament&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;o&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s de derecho&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;I.Acuerdo por el que se aprueban las Bases de la convocatoria, para el año 2020, de ayudas al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;II.Convenio de colaboración entre el Fondo de Garantía Agraria y Pesquera de las Islas Baleares como Organismo Pagador, el adjunto a la Gerencia del FOGAIBA como Autoridad de Gestión y el Grupo de Acción Local Asociación Mallorca Rural por lo que se establecen las condiciones para la aplicación de la medida 19 del Programa de Desarrollo Rural de las Islas Baleares 2014-2020 de 20 de abril de 2018. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;III.Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm. 1698/2005 del Consejo. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;VIII.Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;IX.Ley 12/2014, de 16 de diciembre, agraria de las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;X.Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de Garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;XI. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución&lt;/em&gt;&amp;nbsp;&lt;em&gt;de Concesión&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y proposo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Conceder la ayuda solicitada a los beneficiarios por los importes y con los plazos detallados en el Anexo I, que son un total de 3 expedientes y que comienza con S. COOP. AGRICOLA RAMADERA S. SALVADOR y termina con AGROPECUARIA AUCADENA SL , que suma un importe total de 54.000,19 euros, relativo a la línea de ayuda « Apoyo a la implementación en las operaciones incluidas los EDL No Programados MALLORCA » Convocatoria, para el año 2020, de ayudas al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca. EDLNP32020_1. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Autorizar y disponer el gasto señalado a cada uno de los beneficiarios con cargo a los presupuestos y porcentajes de cofinanciación detallados en el Anexo I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Determinar que, de acuerdo con lo que establece la convocatoria de referencia, las obligaciones de los beneficiarios serán las indicadas en el Anexo II. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Notificar la resolución a cada uno de los beneficiarios del Anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Son obligaciones de las personas beneficiarias las siguientes: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Realizar las inversiones o actividades auxiliables durante el plazo establecido.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en los términos y plazos determinados en la presente convocatoria. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Mantener las inversiones realizadas durante al menos cinco años, contados desde la fecha de pago de la ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Cumplir las normas comunitarias aplicables a la inversión y en especial las relativas a la durabilidad de las operaciones previstas en el artículo 71 del Reglamento (UE) núm. 1303/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Someterse a los controles que lleve a cabo la administración, necesarios para comprobar la correcta concesión de la ayuda y el posterior mantenimiento de compromisos. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Atender los requerimientos del Grupo de Acción Local Asociación Mallorca Rural relacionados con el seguimiento y la evaluación del proyecto y de la Estrategia de Desarrollo Local Participativo. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Cumplir los compromisos adquiridos para la concesión de la ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Además, se tendrán que cumplir las normas de información y publicidad previstas en el anexo III del Reglamento de ejecución (UE) núm. 808/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Estas obligaciones se entenderán sin perjuicio de la obligación de cumplir con el resto que se establecen en el artículo 11 del texto refundido de la Ley de subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, y en el artículo 11 de la Orden de bases reguladoras de la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014-2020, aprobado mediante la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, así como el resto que se deriven de la normativa estatal y comunitaria de aplicación. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;El régimen jurídico aplicable por el incumplimiento de estas obligaciones es el que prevé el Texto refundido de la Ley de subvenciones, aprobado por Decreto legislativo 2/2005, de 28 de diciembre, y comprende desde el reintegro de la ayuda y el pago del interés de demora hasta la imposición de las correspondientes sanciones. En caso de incumplimiento de las obligaciones anteriores se aplicarán las reducciones previstas en la convocatoria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
