    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El apartado 9.3 de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015, por la que se convocan subvenciones para inversiones en las explotaciones agrarias, correspondientes a los años 2015 hasta 2019 , especifica que la resolución expresa se notificará a los interesados mediante la publicación en el Boletín Oficial de las Islas Baleares, de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas .&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias. La citada Resolución se modificó en fecha 17 de diciembre de 2015 (BOIB núm. 185), en fecha 22 de junio de 2016 (BOIB núm. 81) y en fecha 26 de junio de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;2.Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de Pere Joan Munar Fotirroig, entre otros, que figuran en el anexo de la Resolución de concesión, R20 de fecha 11 de septiembre de 2019, (BOIB núm. 146, de 26 de octubre de 2019) con los datos y los importes correspondientes&amp;nbsp;(con un importe concedido de 25.115,70 €).&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;3.Dada la Resolución de concesión de la mencionada ayuda, y de acuerdo con lo que establece el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido ya justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en el modo y plazos determinados en la convocatoria.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;4.Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago así como la documentación exigida, pero, una vez examinada ésta, se comprueba que:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&amp;nbsp;- la sembradora SNE 350-3-28 Solano Horizonte chasis n. 14021, comprobado en el Registro de maquinaria agrícola de las Islas Baleares (ROMA) no figura inscrita.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&amp;nbsp;- los pagos del tractor Lamborghini y la pala delantera Stoll, están pagados y justificados fuera de plazo, la fecha para justificar y pagar las inversiones es hasta 26 de abril de 2020. Solo el pago de fecha 21 de enero de 2019 de un importe 4.879,58 euros, está dentro de plazo, pero en la orden de transferencia figura el BNP PARIBAS como el beneficiario de la transferencia, cuando el proveedor de la factura es Agromontuiri, SL, así mismo en la orden de transferencia tampoco figura en el concepto el número de factura para poder identificar que este importe es una parte de la factura A/490 de un importe de 32.500,00 euros.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;5. Dado que la sembradora SNE 350-3-28 Solano Horizonte chasis n. 14021de la factura núm. M03193 no está inscrita en el Roma incumple el apartado décimo punto 2 de obligaciones de los beneficiarios de la Resolución y RD 1013/2009, de 19 de junio, sobre la caracterización y registro de la maquinaria agrícola, y por tanto se trate de una factura no auxiliable. Los pagos de la factura núm. A/490 de fecha 19 de diciembre de 2017 están fuera de plazo establecido, según el punto 2 del apartado duodécimo, la actuación subvencionada deberá estar realizada y pagada por el beneficiario en el período comprendido entre la fecha de comienzo del período de elegibilidad previsto en el apartado cuarto de la Resolución, que en el punto 3 establece que de conformidad con lo que dispone la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014-2020, sólo serán subvencionables los gastos realizados después de la presentación de la solicitud de ayuda y el plazo, en este caso de inversión mueble, de seis meses a contar desde el día siguiente a la fecha de notificación de la Resolución de concesión de la ayuda. Asimismo no están reflejados los datos necesarios para justificar los pagos efectuados, según el punto 3 del apartado duodécimo de la Resolución, y por tanto se trate de una factura no auxiliable. Referente a la prolongación del plazo por el estado de alarma, la notificación de la concesión se publicó en el R20 de fecha 11 de septiembre de 2019, (BOIB núm. 146, de 26 de octubre de 2019), la fecha límite de la actuación subvencionada de estar realizada y pagada hasta 26 de abril de 2020. La suspensión de los plazos administrativos comenzó el 14 de marzo de 2020 con la declaración de estado de alarma para la gestión de la situación de crisis sanitaria y reanudó según la resolución de fecha 1 de abril de 2020 de la presidenta del Fogaiba. No está dentro de este plazo, no procede la suspensión, ni prolongación de los plazos.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;6. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre, dispone que “Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="line-height:120%"&gt;&lt;em&gt;cantidades indebidamente percibidas”.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;7. Con fecha 17 de mayo de 2021 se notifica a la persona interesada, mediante la publicación en la web, el Informe/Propuesta provisional de resolución de revocación parcial de 5 de agosto de 2020 por el incumplimiento de la obligación de haber realizado, pagado y justificado las inversiones concedidas dentro del plazo establecido, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;8. El 24 de mayo de 2021 (RGE núm. 200700), don Pere Juan Munar Fontirroig presentó alegaciones y la documentación correspondiente al expediente INEA2017_1/308.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;9. Una vez revisadas las alegaciones, en fecha 6 de septiembre de 2021 se notifica mediante la publicación en la web deficiencias de documentación para aportar y aclaraciones, informando de que si no se hace así, será considerada desistida su solicitud.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;10. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece la obligación de la Administración a dictar resolución expresa y notificarla. En su párrafo segundo especifica que “En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con indicación de los hechos producidos y normas aplicables».&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;11. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas».&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;12. Considerando todo ello, se propone declarar por desistida la ayuda concedida al beneficiario que se indica en el anexo de esta resolución y ello comporta su revocación total.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del presidente del Fons de Garantia Agraria i Pesquera de les Illes Balears &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;(FOGAIBA)&lt;/em&gt;&amp;nbsp;&lt;em&gt;de 10 de julio de 2015 (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Propuesta de resolución &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Por todo ello, se informa favorablemente sobre la declaración de desistimento &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;y&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&amp;nbsp;revocación total y&amp;nbsp;se propone al vicepresidente en materia agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;1.Dar &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;por desistida &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;l&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;a ayuda concedida a &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Pere Joan Munar Fontirroig&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;, por la Resolución del vicepresidente del FOGAIBA de 11 de octubre de 2019; (R20), expediente núm. INEA2017_1/308.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;2.Revocar totalmente &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;la ayuda concedida en la resolución del vicepresidente del FOGAIBA de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;11&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;octu&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;bre de 2019 (R&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;), correspondiente al expediente INEA2017_1/3&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;08&amp;nbsp;y por el importe indicado en el anexo de esta resolución.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;3.Declarar concluido el procedimiento y archivo del expediente&amp;nbsp;INEA2017_1/308.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;4.Publicar esta Resolución en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y los&amp;nbsp;artículo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;120 y 121&amp;nbsp;de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
