font-size:12px"><span style="line-height:114%">El apartado&nbsp;9.3. de la Resolución del&nbsp;Presidente del Fondo de&nbsp;Garantía Agraria&nbsp;y Pesquera de&nbsp;las&nbsp;Islas Baleares&nbsp;(FOGAIBA) de 10 de setiembre de 2015 por la&nbsp;que se convocan, subvenciones&nbsp;para la Creación de empresas de Jóvenes agricultores, correspondientes a los años 2015-2019, &nbsp;especifica&nbsp;que la resolución&nbsp;expresa&nbsp;se notificará&nbsp;a&nbsp;los interesados mediante&nbsp;su publicación en el&nbsp;<em><em>Boletín Oficial de las</em></em><em>&nbsp;</em><em><em>Islas Baleares</em></em><em>&nbsp;</em>de acuerdo con los&nbsp;términos&nbsp;previstos en el artículo&nbsp;45.2&nbsp;de la Ley&nbsp;39/2015, de 1&nbsp;de octubre, del&nbsp;procedimiento administrativo común de&nbsp;las&nbsp;administraciones públicas. </span></span></p> <p style="margin-bottom:0,0000pt; font-size:12px"><span style="line-height:114%"><em><em>1.El 15 de septiembre de 2015 se publicó en el Boletín Oficial de las Islas Baleares núm. 136 la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores . La Resolución mencionada se modificó en fecha 26 de abril de 2016 (BOIB núm. 54, de 30 de abril de 2016), modificada por la Resolución del Presidente del FOGAIBA de 26 de junio de 2018 (BOIB núm. 80, de 28 de junio de 2018).</em></em></span></span></p> <p style="margin-top:3,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>2.</em>&nbsp;<em>El 21 de enero de 2019 (con registro de entrada núm. 957), MATEUS MANRESA SCHUEROFF presentó la solicitud de ayuda correspondiente al expediente núm. CEJA2019_1 / 006. En el Plan Empresarial que adjunta manifiesta que el inicio de la actividad es la instalación como joven agricultor de una explotación agraria no prioritaria.</em></em></span></span></p> <p style="margin-top:3,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>3. El 15 de diciembre de 2020, el vicepresidente en materia agraria del FOGAIBA dictó la Resolución de concesión de ayudas para la creación de empresas de jóvenes agricultores (R1), publicada en el BOIB núm. 215, de 29 de diciembre de 2020, en la que se incluye una concesión a favor de MATEUS MANRESA SCHUEROFF, con NIF ***3591**, con un importe de ayuda por concurrencia de 27.500,00 €, con núm. de expediente CEJA2019_1/006.</em></em></span></span></p> <p style="margin-top:3,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>4. El expediente mencionado ha sido objeto de una revisión sistemática por parte de un superior, de acuerdo con lo establecido en el artículo 3.2 de la Circular de Coordinación 18/2019, para la campaña 2019, se ha detectado que en la concesión se produjo el error siguiente:</em></em></span></span></p> <p style="margin-top:3,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>- Se concedieron 2.500,00 € en concepto para incorporación a una explotación dedicada a la agricultura ecológica, pero como explica el hecho 2 de esta resolución, el interesado no lo manifestaba en el Plan Empresarial.</em></em></span></span></p> <p style="margin-top:3,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>5. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".</em></em></span></span></p> <p style="margin-top:3,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>6. Con fecha 3 de mayo de 2021 se notifica al interesado, mediante la publicación en la web, el Informe/Propuesta provisional de resolución de la revocación parcial de día 29 de abril de 2021 por incorporación a una explotación dedicada a la agricultura ecológica, pero como explica el hecho 2 de esta resolución, el interesado no lo manifestaba en el Plan Empresarial, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones. Una vez transcurridos los 10 días hábiles, el interesado no ha presentado ninguna alegación.</em></em></span></span></p> <p style="margin-top:3,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>7.
