&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1, El 29 de Julio de 2021 la empresa Redexis GAS SA registró en la Dirección General de Política Industrial (DGPI), la solicitud de revisión de tarifas de derechos de alta y otros servicios relacionados con el suministro de gas por canalización. En esta solicitud se adjuntó un estudio justificativo de los incrementos propuestos. Los parámetros que se utilizaron para el estudio, además de la variación del IPC, fueron la evolución de costes salariales, combustibles e incrementos en los costes de acreditaciones técnicas de los técnicos. Asimismo la propuesta registrada suponía un incremento de 17,45% para las tareas de inspección inicial y Altas, y un incremento de 17,24% en las tareas de las inspecciones periódicas domiciliarias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2, El 3 de Septiembre de 2021 el Servicio de Seguridad Industrial de la DGPI emitió un oficio requiriendo a la empresa solicitante que justificara las nuevas tarifas de acuerdo con los IPC anuales y mensuales del periodo de revisión. El periodo de incrementos empezó en abril 2008 (fecha de entrada en vigor del Decreto 45/2008), hasta Julio de 2021, fecha de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3, El 29 de Septiembre de 2021 la empresa Redexis GAS SA registró en la DGPI una nueva propuesta de tarifas sobre la base de los índices propuestos por el Servicio de Seguridad Industrial, el cual contemplaba tener en cuenta como parámetro único de incremento, el IPC correspondiente a la base oficial del INE. Para Islas Baleares y para el período de revisión establecido, el incremento propuesto por Redexis GAS SA, fue de 16,3%.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4, En el Decreto 45/2008 de 11 de Abril, por el que se regula el régimen económico de los derechos de alta y otros servicios relacionados con el suministro de gas por canalización (BOIB nº 56 de 2008), en concreto en su Disposición adicional única (actualización de importes), se establece lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;«Se faculta a la Consejera de Comercio, Industria y Energía para modificar, mediante una resolución que se publicará en el Boletín Oficial de las Islas Baleares, los anteriores precios máximos, o bien a solicitud de las empresas suministradoras, debidamente justificada, o de oficio, cuando se considere que se ha producido una variación sustancial de los costes derivados de la contratación y de la inspección previa de las instalaciones receptoras de la persona abonada, prevista en la reglamentación vigente».&lt;/span&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5, En los datos publicados por el Instituto Nacional de Estadística el IPC en las Islas Baleares desde Abril de 2008 hasta Julio, el incremento ha sido del 16,3%.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6, El 8 de Octubre de 2021 el Servicio de Seguridad Industrial emitió un informe favorable sobre la propuesta registrada por Redexis GAS SA el 29 de Septiembre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1, Decreto 45/2008 de 11 de abril, por el que se regula el régimen económico de los derechos de alta y otros servicios relacionados con el suministro de gas por canalización (BOIB núm 56 de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2, Datos del Instituto Nacional de Estadística.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3, Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:black"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1, Aprobar la propuesta que en fecha de 29 de septiembre la empresa Redex GAS SA presentó a la DGPI. En ella el incremento de precios para el periodo comprendido entre abril de 2008 y julio de 2021 corresponde al IPC para Islas Baleares. Dado lo anterior, los importes máximos establecidos en el artículo 3 del Decreto 45/2008 quedarían incrementados en la proporción de 16,3%, y por tanto con las siguientes cuantías:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;&lt;strong&gt;Tarifa 1.&lt;/strong&gt; Las personas usuarias con un consumo inferior o igual a 5.000 kWh / año&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;a) Para nuevas instalaciones y ampliaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;- Derechos de alta (que incluyen los servicios de enganche y de verificación):&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;93,70 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;b) A petición de los usuarios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;c) Inspección periódica: 50,01 €, importe en el que queda incluida la parte proporcional del coste de la inspección de la parte común.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;&lt;strong&gt;Tarifa 2&lt;/strong&gt;. Las personas usuarias con un consumo superior a 5.000 kWh / año e inferior o igual a 50.000 kWh /año&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;a) Para nuevas instalaciones y ampliaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;- Derechos de alta (que incluyen los servicios de enganche y de verificación):&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;99,06 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;b) A petición de los usuarios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;a) Para nuevas instalaciones y ampliaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;a) Para nuevas instalaciones y ampliaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;c) Inspección periódica: 132,58 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;&lt;strong&gt;Tarifa 5. &lt;/strong&gt;Para el resto de tarifas, en función del consumo energético diario contratado (Cmaxd) por kWh / día&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;a) Para nuevas instalaciones y ampliaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;- Derechos de alta (que incluyen los servicios de enganche y de verificación):&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;126,49 € + (Cmaxd x 0,09992) €, con un máximo de 770,97 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2, Publicar esta resolución en el Boletín Oficial de las Islas Baleares .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:black"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes a partir del día siguiente de la notificación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de Octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de Marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:black"&gt;También se puede interponer directamente un recurso contencioso administrativo ante el Juzgado Contencioso Administrativo en el plazo de dos meses a contar desde al día siguiente de la notificación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de Julio, reguladora de la jurisdicción contencioso administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
