    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Pleno del Ayuntamiento de Santa Margalida en sesión ordinaria celebrada día 30 de setiembre de 2021, adoptó el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;«Antecedentes de hecho&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. En fecha 23 de noviembre de 2020, se adoptó el acuerdo del Consejo de Gobierno por el que se declararon como inversiones de interés autonómico, las intervenciones previstas para los nuevos centros de salud, unidades básicas de salud y servicio de urgencia de atención primaria (SUAP) en Mallorca; entre ellas consta al construcción de una nueva unidad básica en el municipio de Santa Margalida, situado en el solar con referencia catastral 9250708ED0995S0001US:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;«Primero. De conformidad con el artículo 7 del Decreto Ley 1/2018, en relación con el artículo 5 de la Ley 4/2010, de 16 de junio, declaró Inversión de interés autonómico las intervenciones previstas siguientes:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. La construcción de una nueva unidad básica de salud en el municipio de Santa Margarita, situado en el solar con referencia catastral 9250708ED0995S0001US »&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. En el BOIB núm. 199 de fecha 24 de noviembre de 2020, se publicó el mencionado acuerdo.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;PRIMERO-.&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; Ceder gratuitamente y de forma definitiva en el Servicio de Salud de las Islas Baleares, Consejería de Salud y Consumo, el terreno bien patrimonial de titularidad municipal con referencia catastral 9250708ED0995S0001US; para que se destine al uso de construcción de la nueva unidad básica de salud en Santa Margalida.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;SEGUNDO.-&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; Determinar la reversión automática al patrimonio de este Ayuntamiento del bien cedido gratuitamente, si no es destinado al uso previsto en el término máximo de cinco años, y deja de serlo en todo caso posteriormente en el transcurso de los treinta años próximos.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;TERCERO.-&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; Anotar la cesión gratuita en el Inventario Municipal de Bienes al efecto de actualizarlo.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;CUARTO.- &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Facultar al Alcalde para que suscriba todas las actuaciones que se deriven del expediente, entre ellas la firma de la Escritura pública de cesión del bien.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;QUINTO.-&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; Notificar el presente Acuerdo a la Entidad beneficiaria, que deberá comparecer en el momento que sea emplazado para proceder a elevar a Escritura pública la cesión referida.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;SEXTO.- &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Remitir la documentación necesaria en el Registro de la Propiedad para que efectúen los oportunos asientos registrales según la Legislación hipotecaria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;SÉPTIMO.-&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; Remitir certificado del acuerdo de cesión gratuita a la autoridad competente de la Comunidad Autónoma (Dirección General de Función Pública) a efectos de la toma de conocimiento de la cesión del bien patrimonial de acuerdo con el artículo 109.2 RBEL.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Lo que se publica para su conocimiento y efectos oportunos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
