41644 ![CDATA[Resolución del consejero de Fondos Europeos, Universidad y Cultura, a propuesta del director general de Política Universitaria e Investigación, por la que se declara el desistimiento de solicitudes de ayudas de movilidad para cursar parte de los estudios universitarios en cualquier país de la Unión Europea (UE-27) durante el año académico 2020-2021]] CAIB 2021-10-16 2021-10-16 250 479444 es CAIB CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En fecha 11 de octubre de 2021 el director general de Política Universitaria e Investigación ha formulado la siguiente propuesta de resolución:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El 6 de mayo de 2021 se publicó en el BOIB número 59 la Resolución del consejero de Fondos Europeos, Universidad y Cultura de 22 de abril de 2021 por la que se convocan ayudas complementarias para alumnos de las Illes Balears que participan en programas institucionales de movilidad para cursar parte de los estudios universitarios en cualquier país de la Unión Europea (UE-27) durante el año académico 2020-2021</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El día 30 de julio de 2021 finalizó el plazo de presentación de solicitudes para la petición de estas ayudas de acuerdo con lo dispuesto en el punto 7.6 de la convocatoria.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con el punto 12 del anexo de la mencionada convocatoria, entre los días 6 y 10 de septiembre de 2021 se tiene que hacer público el informe mediante el que se notifican los posibles defectos de las solicitudes o la carencia de documentación. El día 10 de agosto de 2021, ya revisados todos los expedientes, se publicó el mencionado informe. Los solicitantes podían aportar la documentación para subsanar la solicitud hasta el 24 de septiembre de 2021.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Comisión Evaluadora, reunida el 7 de octubre de 2021, ha motivado la evaluación y la calificación de las solicitudes previstas en el apartado 11 de la convocatoria, de acuerdo con los requisitos y los criterios de preferencia establecidos en la misma convocatoria. De esta reunión existe un acta que consta en el expediente, en la que, de acuerdo con el artículo 68.1 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, se consideran desistidas en su solicitud las personas interesadas como consecuencia de no haber subsanado en plazo, o haber subsanado parcialmente o de forma incorrecta.</span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Orden de la consejera de Educación y Cultura de 1 de julio de 2009 por la que se establecen las bases reguladoras de las subvenciones en materia de educación y cultura (BOIB n.º 100, de 11 de julio).</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Resolución del consejero de Fondos Europeos, Universidad y Cultura de 22 de abril de 2021 por la que se convocan ayudas complementarias para alumnos de las Illes Balears que participan en programas institucionales de movilidad para cursar parte de los estudios universitarios en cualquier país de la Unión Europea (UE-27) durante el año académico 2020-2021 (BOIB n.º 59, de 6 de mayo).</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Propuesta de resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propongo al consejero de Fondos Europeos, Universidad y Cultura que dicte una resolución en los siguientes términos:</span></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Declarar el desistimiento de las solicitudes de ayudas complementarias para alumnos de las Illes Balears que participan en programas institucionales de movilidad para cursar parte de los estudios universitarios en cualquier país de la Unión Europea (UE-27) durante el año académico 2020-2021 a las personas que figuran en el anexo como consecuencia de no haber subsanado en plazo, o haber subsanado parcialmente o de forma incorrecta, de acuerdo con el artículo 68.1 de la Ley 39/2015.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Disponer que esta Resolución se publique en el <em>Boletín Oficial de las Illes Balears</em> y en la página web de la Dirección General de Política Universitaria e Investigación (<em>http://dguni.caib.es</em>).</span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Fondos Europeos, Universidad y Cultura, en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación de la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción contencioso-administrativa.</span></p> <p><span style="font-family:Times New Roman,Times,serif;
