![CDATA[Bases específicas de la convocatoria del proceso selectivo para cubrir 2 plazas vacantes de policía local del ayuntamiento de Sa Pobla ]] ![CDATA[<p style="text-align:center"><strong>BASES ESPECÍFICAS DE LA CONVOCATORIA DEL PROCESO SELECTIVO PARA CUBRIR COMO PERSONAL FUNCIONARIO DE CARRERA 2 PLAZAS VACANTES DE LA CATEGORÍA DE POLICÍA LOCAL DEL AYUNTAMIENTO DE SA POBLA MEDIANTE EL PROCEDIMIENTO ORDINARIO.</strong></p> <p><strong>PRIMERA. Objeto de la convocatoria, procedimiento de selección y normativa</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La presente convocatoria tiene por objeto regular el proceso selectivo para proveer, como funcionarios de carrera, 2 plazas de la categoría de policía local, vacantes y dotadas presupuestariamente, correspondientes a la Oferta de Empleo Público del año 2020, por el sistema de acceso de turno libre y procedimiento de selección de oposición. Estas plazas corresponden a la escala de Administración Especial, subescala de Servicios Especiales, clase policía local, Grupo de clasificación C1, del Ayuntamiento de sa Pobla.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Se aplicarán a estas pruebas selectivas las presentes bases; la Ley 4/2013, de 17 de julio, de coordinación de las policías locales de las Islas Baleares, con la modificación efectuada por la Ley 11/2017, de 20 de diciembre; el Decreto 40/2019, de 24 de mayo, por el que se aprueba el Reglamento marco de coordinación de las policías locales de las Islas Baleares y se modifica el Decreto 55/2017, de 15 de diciembre, del Fondo de Seguridad Pública de las Islas Baleares; Decreto 11/2017, de 24 de marzo, de exigencia del conocimiento de la lengua catalana en los procedimientos selectivos de acceso a la función pública y para ocupar puestos de trabajo de la Administración de la Comunidad Autónoma de las Islas Baleares, el Real Decreto Legislativo 5/2015, de 30 de octubre, por el que se aprueba el Texto refundido de la Ley del Estatuto básico del empleado público, y la Ley 3/2007, de 27 de marzo, de la función pública de la Comunidad Autónoma de las Islas Baleares, así como el resto de disposiciones legales aplicables a la policía local.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>SEGUNDA. Requisitos de los aspirantes</strong>.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Para ser admitidas en estas pruebas selectivas, los interesados ​​deben cumplir, en la fecha de finalización del plazo de presentación de solicitudes y durante todo el proceso selectivo, los requisitos siguientes:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><em>a)</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Tener la nacionalidad española.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>b) </em>Tener dieciocho años cumplidos.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>c</em>) Estar en posesión del título de bachiller, técnico o equivalente, o estar en condiciones de obtenerlo en la fecha en que finalice el plazo de presentación de solicitudes. En el caso de titulaciones expedidas en el extranjero, deberá aportar la correspondiente homologación del Ministerio de Educación, Cultura y Deporte.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>d)</em> No padecer enfermedad o defecto físico o psicofísico que impida o disminuya el desarrollo correcto de las funciones, en relación con el cuadro de las exclusiones que se determinan en el anexo 5 del Decreto 40/2019, de 30 de abril.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>e)</em> No haber sido separado del servicio de la Administración local, autonómica o estatal, ni estar inhabilitado para el ejercicio de la función pública.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>f)</em> No tener antecedentes penales por delitos dolosos.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>g)</em> Poseer los permisos de conducción de las clases A2 y B en vigor.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>h)</em> Comprometerse a llevar armas y, en su caso, a utilizarlas, mediante una declaración jurada.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>e)</em> Estar en posesión del nivel B2 (nivel avanzado) del conocimiento de la lengua catalana. Los certificados serán los expedidos por la Escuela Balear de Administración Pública, o los expedidos u homologados por la conselleria competente en materia de política lingüística, o los reconocidos según la Orden del consejero de Educación, Cultura y Universidades de 21 de febrero de 2013. </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>j)</em> Haber abonado la tasa por derechos de examen que asciende a 26 € BOIB 167 (12/12/2019).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>TERCERA. Presentación de solicitudes</strong>.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. Las solicitudes para tomar parte en el proceso selectivo se ajustarán al modelo normalizado de solicitud (anexo 1) deberán dirigirse a la Alcaldía y se presentarán en el Registro del Ayuntamiento o en cualquier otra de las formas que establece el artículo 16.4 de la Ley 39/2015.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">El modelo normalizado de solicitudes se encontrará a disposición de los interesados, en el Registro General de este Ayuntamiento y en la página web http://www.sapobla.cat/ a partir de la apertura del plazo para su presentación.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. El plazo general de presentación de solicitudes es de veinte días hábiles a partir del día siguiente a aquel en que se publique la convocatoria en el Boletín Oficial del Estado. Cuando el último día del plazo sea inhábil, se entenderá prorrogado al primer día hábil siguiente.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. Junto con la solicitud rellenada adecuadamente, las personas aspirantes deben adjuntar:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">a) Una declaración responsable de que el aspirante cumple los requisitos exigidos en las bases, con referencia siempre a la fecha de expiración del plazo señalado para presentar las solicitudes.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">b) Acreditación de haber abonado la tasa por derechos de examen o bien, acreditación de las bonificaciones y / o exenciones de las que puedan ser objeto, previstas en el Título VI de la mencionada Ordenanza Fiscal y justificante de pago de la cuantía resultante, si corresponde, al siguiente número de IBAN: ES59 2100 0096 9402 00004982. La falta de justificación del pago de la tasa indicada determina la exclusión del aspirante. Este pago no sustituye, en ningún caso, el trámite de presentar la solicitud en el plazo y en la forma prevista.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">c) Declaración, en su caso, de tener el certificado de superación de las pruebas de aptitud física de la EBAP en los términos que se establecen en el artículo 165.3 del Decreto 40/2019 a efectos de quedar exentas de hacer las pruebas físicas del proceso selectivo.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La Administración puede requerir del solicitante la aportación formal de la documentación sustituida por la declaración responsable en cualquier fase del procedimiento selectivo.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4. Con la formalización y presentación de la solicitud, el aspirante da su consentimiento al tratamiento de los datos de carácter personal que son necesarios para tomar parte en la convocatoria y para el resto de la tramitación del proceso selectivo, de acuerdo con la normativa vigente en materia de protección de Datos de Carácter Personal.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">5. Los aspirantes quedarán vinculados a los datos que se hagan constar en su solicitud. El domicilio y teléfono que figuren en la misma se considerarán válidos a efectos de notificaciones, siendo responsabilidad exclusiva de los candidatos tanto los errores descriptivos, como la no comunicación durante el proceso de selección de cualquier cambio en los datos de la solicitud.</span></p> <p><strong><span style="color:black">CUARTA. Admisión y exclusión de las personas aspirantes</span></strong><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. Finalizado el plazo de presentación de solicitudes, en el plazo máximo de 10 días hábiles, se publicará en el tablón de anuncios del Ayuntamiento y en la página web https://sapobla.eadministracio.cat/board/ una resolución por la que se aprueba la lista provisional de admitidos y excluidos, con indicación de la causa de exclusión. En la resolución en que se publique la lista provisional de admitidos y excluidos de las pruebas selectivas, deberá constar la fecha, la designación en su caso del Tribunal Calificador, la hora y el lugar en que se llevarán a cabo los ejercicios de la fase de oposición con indicación de si se deben llevar a cabo en una o más sesiones, y con el intervalo mínimo entre ejercicio y ejercicio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En todo caso, con el fin de evitar errores y, si se producen, posibilitar su subsanación en tiempo y en forma, las personas interesadas tienen que comprobar no solo que no figuran en la relación de personas excluidas sino que, además, sus nombres constan en la relación pertinente de personas admitidas.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. Los aspirantes excluidos u omitidos dispondrán de un plazo de diez días hábiles, a contar desde el día siguiente de la publicación, para corregir el defecto o adjuntar el documento que sea preceptivo. En caso de que no se subsanen, dentro de este plazo, las deficiencias que hayan motivado su exclusión, la solicitud se considerará</span><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif"> no presentada.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. Una vez finalizado el plazo a que se refiere el párrafo anterior y subsanadas, en su caso, las solicitudes, el Alcalde dictará resolución, en el plazo máximo de diez días hábiles, de aprobación de la lista definitiva de personas admitidas y excluidas. Esta resolución se hará pública en los mismos lugares indicados para la resolución provisional.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">El hecho de figurar en la relación de personas admitidas no prejuzgará que se les reconozca a las personas aspirantes la posesión de los requisitos exigidos para participar en el proceso selectivo. Si de la documentación que deben presentar al superarlo se desprenga que no poseen alguno de los requisitos, perderán todos los derechos que pudieran derivarse de su participación</span></p> <p><strong>QUINTA. El tribunal calificador</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. El órgano de selección es colegiado y la composición se ajustará a los principios de imparcialidad y profesionalidad de sus miembros y se debe respetar el principio de representación equilibrada de mujeres y hombres, salvo por razones fundadas y objetivamente motivadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La composición de los Tribunales debe ser predominantemente técnica; todos los miembros deben tener titulación igual o superior a las exigidas para el acceso a las plazas convocadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El personal de elección o de libre designación política, el personal funcionario interino y el personal eventual no podrán formar parte de los órganos de selección. Tampoco pueden formar parte los representantes de los empleados públicos, sin perjuicio de las funciones de vigilancia del buen desarrollo del procedimiento selectivo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las personas representantes sindicales que participen en el procedimiento selectivo, con estas funciones de vigilancia y vela, deben pertenecer a organizaciones sindicales que tengan la consideración de más representativas y que cuenten con más del 10% de representantes en el ámbito del municipio de la convocatoria, con un máximo de un representante por cada sindicato con el límite de cuatro miembros por cada procedimiento selectivo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La pertenencia a los órganos de selección será siempre a título individual; no se puede ejercer esta representación por cuenta ajena.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El Tribunal Calificador estará constituido por cinco miembros y el mismo número de suplentes, su composición efectiva será objeto de resolución con carácter previo a la realización de la primera prueba y publicado en el BOIB.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">El tribunal no puede constituirse ni actuar sin la asistencia de más de la mitad de sus miembros, titulares o suplentes indistintamente, sin presidencia ni secretario. Las decisiones se adoptarán por mayoría.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">6.El tribunal podrá acordar la incorporación en las tareas de personal asesor o especialistas en todas o alguna de las pruebas, que pueden actuar con voz pero sin voto.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">7. Los miembros del Tribunal y los asesores deben abstenerse de intervenir cuando concurran las circunstancias previstas en el artículo 23 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público. Asimismo, deberán notificar esta circunstancia a la autoridad que los nombró.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">La abstención y la recusación de los miembros del tribunal se regulará por los artículos 23 y 24 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, y los artículos 22 y 23 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">8. Las decisiones adoptadas por el tribunal se pueden recurrir en las condiciones que establece el artículo 121 de la Ley 39/2015.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>SEXTA. Fases del sistema de selección</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El procedimiento de selección es el de oposición que consiste en la realización de las pruebas previstas en la convocatoria a fin de determinar la capacidad y la aptitud de los aspirantes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Pruebas de la oposición:</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Todas las pruebas de la oposición son de carácter obligatorio y eliminatorio. Es necesario superar la prueba anterior para poder pasar a la siguiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El orden de actuación de los aspirantes será de manera alfabética del primer apellido de los aspirantes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las mujeres embarazadas con previsión de parte, o en periodo de posparto, coincidente con las fechas de realización de cualquiera de los exámenes o pruebas previstas en el proceso selectivo, podrán poner en conocimiento del Tribunal esta situación, adjuntando el correspondiente informe médico oficial por el que se certifica esta circunstancia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La comunicación debe realizarse con el tiempo suficiente y el Tribunal determinará en base a la información si procede o no atender la solicitud, aplazar la prueba o pruebas o realizarla en un lugar alternativo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En ningún caso las pruebas de reconocimiento médico deben estimarse como circunstancia negativa a los efectos del proceso selectivo cualquier derivada de la situación de embarazo o lactancia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las pruebas a realizar son las siguientes:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Prueba de aptitud física.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Prueba de conocimientos tipo test.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Prueba de desarrollo.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-&nbsp; Prueba de aptitud psicotécnica y de personalidad.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las pruebas se realizarán en el orden anteriormente establecido. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Prueba de aptitud física</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tiene por objeto comprobar, entre otros aspectos, las condiciones de fuerza, agilidad y resistencia de las personas aspirantes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta prueba consiste en la superación de las pruebas parciales que determina el anexo 3 del Decreto 40/2019, de 24 de mayo, por el que se aprueba el Reglamento marco de coordinación de las policías locales de las Islas Baleares y se modifica el Decreto 55/2017, de 15 de diciembre, del Fondo de Seguridad Pública de las Islas Baleares. Anexo 3 de la presente convocatoria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las pruebas físicas se deben superar globalmente, de acuerdo con el baremo y los méritos que señala dicho anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El resultado global de esta prueba se otorgará siempre que el aspirante haya superado un mínimo de tres de las cuatro pruebas parciales con una nota mínima de 5 o superior y que, en la otra prueba parcial, la nota sea igual o superior a 3. La nota media de apto se otorgará siempre que el resultado sea igual o superior a 5; si es inferior a 5, será de no apto.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las aspirantes que estén embarazadas o en periodo de posparto en la fecha de realización de las pruebas físicas, lo que impide o dificulta la realización de esta prueba, y siempre que lo acrediten mediante certificado médico, deben ponerlo en conocimiento del Tribunal Calificador, con carácter previo a la realización de la prueba o el ejercicio. En este caso llevarán a cabo el resto de las pruebas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si se superan estas, la calificación de la fase de oposición queda condicionada a la superación de las pruebas de aptitud física en la fecha que el Tribunal determine, una vez desaparecidas las causas que motivaron el aplazamiento. El Tribunal puede establecer de oficio de forma motivada y con audiencia a la aspirante afectada, una fecha apropiada para realizar las pruebas físicas aplazadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En todo caso, se debe declarar superado el proceso selectivo a los aspirantes con una puntuación final que no puedan superar las aspirantes que se hayan acogido a este derecho.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Prueba de conocimientos tipo test</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La prueba de conocimientos tipo test consta de dos ejercicios que se pueden realizar en una sola sesión.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1º ejercicio: Consiste en responder por escrito las preguntas de un cuestionario de 50 preguntas, con cuatro respuestas alternativas, de las cuales sólo una es correcta, propuesto por el Tribunal calificador, designadas por sorteo público entre 3 alternativas diferentes, que están relacionadas con el programa de temas que figuren en la convocatoria como anexo 2<span style="color:red">.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La valoración de esta prueba es de 0 a 20 puntos y hay que obtener un mínimo de 10 puntos para superarla.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las preguntas no resueltas no se valorarán. La elección de estos se hará por sorteo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La valoración de esta prueba es de 0 a 20 puntos y hay que obtener un mínimo de 10 para superarla.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tiempo: (120 minutos)</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Prueba de aptitud psicológica y de personalidad</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta prueba consiste en la exploración psicotécnica para acreditar niveles mínimos de aptitudes intelectuales y también en la exploración de la personalidad y las actitudes de los aspirantes con el fin de determinar el conjunto de competencias correspondientes a las funciones de la categoría de policía, y descartar la existencia de síntomas o indicadores compatibles con alteraciones psicopatológicas y / o de la personalidad. Las pruebas serán efectuadas por (uno o varios profesionales de la psicología) que actuara / año como asesor / es del tribunal.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta prueba consta de dos partes:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) La primera consiste en responder un test de aptitud intelectual. La valoración de esta prueba es de 0 a 10 puntos y hay que obtener un mínimo de 5 para superarla. El resultado será de APTO o no apto, quedarán eliminados los aspirantes que no obtengan una valoración de apto.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) La segunda consiste en responder (la prueba o pruebas) para evaluar el conjunto de competencias correspondientes según las funciones de la categoría de policía (que pueden consistir en uno o varios tests y, en su caso, en una entrevista personal para completar el estudio). Su valoración es apto o no apto. Quedarán eliminados los aspirantes que no obtengan la valoración de APTO.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>SÉPTIMA. Calificaciones de los ejercicios y lista provisional de aprobados</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La calificaciones de los ejercicios deberá hacerse pública el día que se acuerden y deberán publicarse en el tablón de anuncios del Ayuntamiento</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">https://sapobla.eadministracio.cat/board/. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los aspirantes podrán presentar por escrito, en el registro del Ayuntamiento en el plazo de 5 días hábiles a contar desde el día siguiente a la publicación del resultado de cada ejercicio, las observaciones o alegaciones que consideren oportunas, que deberán ser resueltas de forma motivada por el Tribunal en todo caso antes de las 48 horas previas al inicio del ejercicio siguiente. A los efectos señalados, se facilitará la vista de los ejercicios de los opositores.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Finalizados todos los ejercicios de la fase de oposición, el tribunal hará pública en el tablón de anuncios del Ayuntamiento (https://sapobla.eadministracio.cat/board/) la lista provisional de personas que la hayan superado, con indicación del DNI y de la puntuación obtenida.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La relación de personas que han superado la fase de oposición será determinada por la superación de todos los ejercicios eliminatorios. La calificación final de la oposición debe ser la media aritmética de las puntuaciones otorgadas en las pruebas evaluables mediante puntuación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de que dos o más aspirantes obtuvieran la misma calificación total, se deshará el empate sucesivamente, con los siguientes criterios:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El desempate se tendrá que resolver atendiendo a la mayor puntuación otorgada en la prueba a desarrollar, de persistir el empate el que haya obtenido la mayor puntuación en la prueba tipo test, y si todavía persiste el empate el Tribunal decidirá por sorteo. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los aspirantes dispondrán de un plazo de diez días hábiles, a contar desde la publicación de las listas provisionales, para hacer reclamaciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Terminado este plazo, el Tribunal dispondrá de 5 días hábiles para resolver las reclamaciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>OCTAVA. Lista definitiva de personas aprobadas en la fase de oposición</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Resueltas las reclamaciones, el Tribunal publicará en el tablón de anuncios del Ayuntamiento y en la página web http://www.sapobla.cat/ la relación de aprobados por orden de puntuación y elevará al órgano convocante la propuesta de los aspirantes para su aprobación. La aprobación de la relación de aspirantes que han superado el proceso selectivo y que serán nombrados como funcionarios en prácticas será publicada en el BOIB,<em> en la página web del ayuntamiento http://www.sapobla.cat/ y en el tablón de anuncios https://sapobla.eadministracio.cat/board/</em>.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En ningún caso puede ser un número de aspirantes superior al de plazas convocadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>NOVENA. Presentación de documentación y nombramiento funcionarios en prácticas</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las personas aspirantes disponen de un plazo de veinte días hábiles, desde la fecha de publicación de la resolución de aprobación de la relación de aspirantes que han superado el proceso selectivo y que serán nombrados funcionarios en prácticas, para presentar los documentos que acrediten que cumplen los requisitos que exige la convocatoria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No requieren presentación aquellos documentos que se encuentren en poder del Ayuntamiento de sa Pobla o se pueda comprobar la información por técnicas telemáticas según se regula en el artículo 28 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. En este último caso el interesado debe indicar en qué momento y ante qué órgano administrativo presentó los documentos mencionados, y las administraciones públicas deben solicitar electrónicamente a través de sus redes corporativas o de una consulta a las plataformas de intermediación de datos u otros sistemas electrónicos habilitados al efecto.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El incumplimiento de este plazo o si del examen de la documentación presentada se deduce que los aspirantes no cumplen los requisitos que se exigen en la convocatoria, supondrá la pérdida del derecho a ser nombrados funcionarios en prácticas y quedarán sin efecto todas las actuaciones anteriores relativas a su nombramiento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las personas aspirantes que superen la fase de oposición y acrediten que cumplen los requisitos que exige la convocatoria serán nombradas funcionarias en prácticas por el alcalde al inicio de este periodo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El nombramiento tendrá efectos desde la fecha de comienzo del curso de capacitación o en los supuestos en que la normativa de aplicación excepcione la realización de este curso, desde la fecha de comienzo de las prácticas en el municipio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En ningún caso se puede nombrar personal funcionario en prácticas un número de aspirantes superior al de plazas convocadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta situación se mantendrá hasta que sean nombrados funcionarios de carrera, en su caso, o calificados como no aptos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DÉCIMA. Personal funcionario en prácticas</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La fase de oposición se completa con la superación de un período de prácticas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Este periodo está integrado por la superación tanto del curso de capacitación correspondiente a la categoría de policía como de la fase de prácticas en el municipio, relacionadas con las funciones propias de esta categoría.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los aspirantes que no superen el período de prácticas de acuerdo con el procedimiento de calificación previsto perderán el derecho a su nombramiento como funcionarios de carrera, mediante resolución motivada del alcalde a propuesta del órgano responsable de la evaluación del período de prácticas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si algún aspirante es calificado como no apto en la fase de prácticas, o bien si abandona las prácticas antes de su calificación o es expulsado, en la misma resolución se puede requerir a las personas aspirantes que hayan aprobado todas las pruebas, por orden de puntuación obtenida en las pruebas de la oposición para ser nombrados funcionarios en prácticas. La incorporación de estas personas aspirantes en ningún caso se puede realizar en un curso ya iniciado y se ha de aplazar el inicio del curso de capacitación inmediatamente posterior.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dicha resolución, que agota la vía administrativa, se puede recurrir en los términos que establece la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>UNDÉCIMA. Contenido y retribuciones de las prácticas</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Curso de capacitación</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los aspirantes nombrados funcionarios en prácticas deberá realizar y superar el curso de capacitación, impartido u homologado por la Escuela Balear de Administración Pública, a que se refiere el artículo 34 de la Ley 4/2013, de 17 de julio, de Coordinación de las Policías Locales de las Islas Baleares, excepto en los supuestos en que la normativa de aplicación excepcione la realización de este curso.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las personas que acrediten haber superado el curso de capacitación de la categoría de policía o superior antes de la entrada en vigor de la Ley 11/2017 y lo tengan debidamente actualizado, quedan exentas de realizar esta fase de las prácticas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El incumplimiento de las normas de régimen interno establecidas en la resolución correspondiente de la persona titular de la Consejería de Hacienda y Administraciones Públicas a la que hace referencia el artículo 178.2 del Decreto 40/2019, de 24 de mayo, por el que se aprueba el Reglamento marco de coordinación de los policías locales de los Islas Baleares y es modifica el Decreto 55/2017, de 15 de diciembre, del Fondo de Seguridad Pública de les Illes Balears, puede dar lugar a la no superación del curso de capacitación en las condiciones establecidas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las faltas de asistencia no justificadas durante la realización del curso de capacitación conllevará la disminución proporcional de los derechos económicos, sin perjuicio de la incidencia sobre la evaluación del mismo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los aspirantes que no superen el curso de capacitación no podrán realizar el periodo de prácticas en el municipio y perderán todos los derechos a su nombramiento como funcionario / a de carrera, declarándose así mediante resolución motivada del órgano municipal correspondiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Prácticas en el municipio</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Este periodo de prácticas para la categoría de policía se realiza una vez superado el curso de capacitación excepto que la incompatibilidad de fechas aconseje repartirlo en dos etapas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En todo caso, es necesario haber completado al menos una quinta parte del curso de capacitación para poder ejecutar la primera etapa de prácticas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La fase de prácticas en el municipio con el contenido que determine el Ayuntamiento, tendrá una duración de 6 meses, conforme el art. 34.3 Ley 4/2013).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La fase de prácticas en el municipio con el contenido que determine el Ayuntamiento, tendrá una duración de 6 meses conforme el art. 34.3 Ley 4/2013. La metodología de ejecución y la supervisión se ajustará a lo establecido en la Resolución de la consejera de Administraciones Públicas y Modernización de 23 de octubre de 2020 por la que se determina la metodología de ejecución, supervisión y evaluación de las prácticas en el municipio para las distintas categorías de policía local (BOIB nº 188 de 31 de octubre de 2020).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La evaluación de las prácticas se llevará a cabo según lo establecido en los artículos del 180 al 182 del Decreto 40/2019 y la Resolución de la Consejera de Administraciones Públicas y Modernización de 23 de octubre de 2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Retribución de las prácticas</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Durante el periodo de prácticas se reciben las retribuciones según lo establecido en el artículo 34 bis de la Ley 4/2013.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DUODÉCIMA. Finalización del proceso selectivo</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El tribunal calificador elevará al alcalde la lista definitiva de las personas aspirantes declarados aptos o no aptos, quien resolverá y ordenará su publicación en el plazo de 15 días hábiles en el Boletín Oficial de las Islas Baleares. Prueba de aptitud física</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Tiene como finalidad comprobar, entre otras condiciones, la fuerza, la agilidad, la rapidez y la resistencia de la persona aspirante. Consiste en superar, con una nota de 5 o superior, las pruebas físicas que se indican, de acuerdo con los baremos y los criterios que se establecen por edad y sexo. Las pruebas físicas se deben superar globalmente, de acuerdo con el baremo y los méritos que se señalen. El resultado global de esta prueba se otorgará siempre que el aspirante haya superado un mínimo de 3 de las pruebas parciales con una nota mínima de 5 o superior y que, en la otra prueba parcial, la nota sea 3 o superior. Los brazos deben estar completamente estirados y el aspirante debe estar en suspensión total sin tocar el suelo <span style="color:black">con los pies.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Al oír la señal, el aspirante tiene que hacer el número máximo posible de flexiones de brazos, sin límite de tiempo, a menos que el juez le indique que tiene que abandonar la prueba. Se contabiliza una flexión de brazos siempre que el aspirante haya hecho el recorrido completo, es decir, desde la suspensión total con los brazos estirados hasta la flexión total de brazos de manera que la barbilla del aspirante supere en altura la barra de sujeción sin tocarla.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">La prueba se considera terminada cuando el aspirante cometa alguna infracción a juicio del juez, o cuando soltando la barra y toque en el suelo con los pies.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:black">b) </span>Posición inicial y ejecución <span style="color:black">(Mujeres)</span></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El aspirante debe situarse en posición de suspensión, con los brazos flexionados, agarrada a la barra horizontal sin tocar el suelo. font-size:12px"><em><span style="color:black">Objetivo de la prueba</span></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Desarrollo global del individuo dentro del medio acuático. Se mide la capacidad aeróbica con el desplazamiento o traslación corporal en el medio acuático, la fuerza explosiva (salida), la fuerza rápida (en los giros), la velocidad de reacción (salida), la velocidad cíclica (que es la capacidad de hacer movimientos cíclicos, iguales y repetitivos) a la máxima velocidad contra poca resistencia, velocidad gestual en la salida y los giros.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:black">a) Posición inicial</span></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El aspirante debe situarse en el trampolín o plataforma individual de salto en posición de salida, y se ha de lanzar al agua de cabeza.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Después del lanzamiento, no se permite desplazarse por debajo del agua más allá de la zona delimitada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>b) Ejecución de la prueba</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El juez dirá, dejando un intervalo de dos segundos: «P<span style="color:black">reparados ..., listos ... ", y tocará el silbato. En este instante, el aspirante ha de lanzar al agua de cabeza e iniciar la carrera de natación cronometrada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Los 50 metros del recorrido son con libre elección de estilo, aunque el cuerpo del aspirante debe mantenerse en posición ventral en el agua.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">La prueba termina cuando el aspirante toque la pared de la piscina con la mano en el momento de llegar y de manera visible para el juez.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Existe la posibilidad de una salida nula para cada participante;<span style="color:black"> si se produce una segunda salida nula, el aspirante será descalificado y su puntuación será la de no apto.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Todos los aspirantes deben llevar obligatoriamente gorra de baño. Se permite usar gafas de natación. Se prohíbe cualquier otro complemento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">No se permite en ningún momento de la ejecución de la prueba agarrarse a las cuerdas o aros de separación de las calles ni tampoco cambiar de calle.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>QUINTO.</strong> Vista la comunicación de la Dirección General de Emergencias e Interior y del ISPIB, designar los miembros del Tribunal que deben juzgar las correspondientes pruebas, notificarles la resolución de designación, para su conocimiento, y publicar la composición del Tribunal. </span></p> <p><span style="font-family:Times New Roman,Times,serif;
