&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de setiembre de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para la Creación de empresas de Jóvenes agricultores, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en materia agraria del FOGAIBA, con fecha 4 de octubre&amp;nbsp;de 2021, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.El 15 de septiembre de 2015 se publicó en el Boletín Oficial de las Islas Baleares núm. 136 la Resolución del Presidente del Fon&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de Garant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a Agraria &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesquera de las I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;lles Balears (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores. La Resolución mencionada se modificó en fecha 26 de abril de 2016 (BOIB núm. 54, de 30 de abril de 2016), modificada por la Resolución del Presidente del FOGAIBA de 26 de junio de 2018 (BOIB núm. 80, de 28 de junio de 2018).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. El 23 de diciembre de 2016 (con registro de entrada núm. 22.040), JESÚS BALAGUER BUSQUETS presentó la solicitud de ayuda correspondiente al expediente núm. CEJA2016_2/059. En el Plan Empresarial que adjunta manifiesta que el inicio de la actividad es la instalación como joven agricultor socio/miembro de la entidad jurídica CAS VALLAQUET de una explotación agraria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. El 26 de abril de 2018, el vicepresidente del FOGAIBA dictó la Resolución de concesión de ayudas para la creación de empresas de jóvenes agricultores (R3), publicada en el BOIB núm. 71, de 9 de junio de 2018, en la que se incluye una concesión a favor de JESÚS BALAGUER BUSQUETS, con NIF***1048**, con un importe de ayuda de 40.000,00€, con núm. de expediente CEJA2016_2/059.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. El expediente mencionado ha sido objeto de una revisión sistemática por parte de un superior, de acuerdo con lo establecido en el artículo 3.2 de la Circular de Coordinación 18/2019, para la campaña 2016_2, se ha detectado que en la concesión se produjeron los siguientes errores:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;a) Se concedieron 40.000,00€ cuando sólo corresponden 25.000,00€ en concepto prima base, ya que se han concedido 15.000,00€ por incorporación conjunta de dos o más jóvenes, en el mismo periodo de convocatoria, a una explotación agraria prioritaria integrada exclusivamente por estos.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.El 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. En fecha 23 de agosto de 2021 se notifica al interesado, mediante la publicación en la web del FOGAIBA, el Informe/Propuesta provisional de resolución de modificación de concesión y de revocación parcial de 11 de agosto de 2021, por un importe de ayuda de 25.000,00€, y llevar a cabo una revocación parcial de 15.000,00€, dado que no solicita la instalación en una explotación agraria prioritaria. Transcurridos este periodo el interesado no presentó ninguna alegación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Modificar la Resolución del vicepresidente en materia agraria de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;26&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;abril&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;18&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de concesión (R&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;), por el importe y los datos detallados en el anexo 1 de esta resolución, que es un total de 1 expediente y comienza con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;JESÚS BALAGUER BUSQUETS&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y termina con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;JESÚS BALAGUER BUSQUETS&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;, que suma un importe total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;25.000,00€, relativa a la línea de ayuda «Creación de empresas de jóvenes agricultores», a consecuencia de la revisión sistemática.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Revocar parcialmente la Resolución de ayuda concedida antes mencionada concedida al beneficiario por el importe y con los datos detallados en el anexo 2 de esta resolución, que es un total de 1 expediente y que comienza con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;JESÚS BALAGUER BUSQUETS&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y termina con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;JESÚS BALAGUER BUSQUETS&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, que suma un importe total de 15.000,00€, relativa a la línea de ayuda «Creación de empresas de jóvenes agricultores», ya que no solicit&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a la instalación en una explotación agraria prioritária.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Notificar esta resolución al interesado, mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
