Co</em></em><em><em>n fecha de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 106, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016</em></em><em><em>, &nbsp;26 de junio de 2018.</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>2.De conformidad con el apartado sexto de la Resolución mencionada, el plazo para presentar las solicitudes terminó el día 30</em></em><em><em>&nbsp;de </em></em><em><em>junio</em></em><em><em>&nbsp;de 201</em></em><em><em>8.</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>3.El 10 de septiembre de 2020, el secretario general de la Consejería de Agricultura, Pesca y Alimentación dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Islas Baleares número 161, del 17 de septiembre de 2020, en la que figuraba una concesión, entre otros, a favor de </em></em><em><em>TANQUES&nbsp;DE LLUCAITX SRM, con NIF J57645517, con un importe concedido de 104.493,25 euros para una inversión en bienes inmuebles (reforma y ampliación nave agrícola), inversión elegible de 208.986,50 €, expediente número INEA2018_1/179.</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>4.Co</em></em><em><em>n fecha 24 de febrero de 2021, el Sr. ANTONIO LEON, con NIF ***2697**, en representación de </em></em><em><em>TANQUE</em></em><em><em>S</em></em><em><em>&nbsp;DE &nbsp;LLUCAITX SRM, presentó en el Registro del FOGAIBA, Maó, con número de registro L95E11490, una solicitud de modificación de la inversión prevista para una nueva inversión de maquinaria (Picadora Claas Jaguar automotriz), con un presupuesto de 272.564,00€, por causas técnico-económicas de la explotación agrícola y debido a las demandas del mercado actual.</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>5.Según el punto séptimo del apartado noveno de la convocatoria «Con carácter excepcional, y respetando la cuantía de la ayuda concedida, así como la forma y los plazos de ejecución y justificación de los gastos correspondientes, los beneficiarios pueden solicitar la modificación del contenido de las actuaciones subvencionadas cuando se den circunstancias que alteren o dificulten el desarrollo de las actividades que no sean imputables a los solicitantes. Las solicitudes de modificación deberán estar suficientemente motivadas y deben formularse con carácter inmediato a la aparición de las circunstancias que la justifican y, en cualquier caso, en un máximo de seis meses para las inversiones inmuebles y de tres meses para las inversiones muebles y siempre con anterioridad al momento en que termine el plazo de ejecución de las actividades subvencionadas [...] »</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>6.La solicitud de modificación del contenido de las actuaciones no especifica el momento de la aparición de las circunstancias que justifican el cambio de inversión, el cual debe ser de tres meses desde el día de la aparición de estas causas modificativas y con anterioridad al momento en que termine el plazo de ejecución de las actividades subvencionadas. La modificación del contenido de las actuaciones subvencionadas no ha sido suficientemente justificado ya que la entidad no ha demostrado en ningún momento que se hayan dado circunstancias que alteren o dificulten el desarrollo de las inversiones que fueron concedidas. </em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>7.Dado&nbsp;lo anteriormente expuesto, se propone la denegación de la modificación de las inversiones concedidas ya que la entidad, por un lado, no especifica el momento de la aparición de las circunstancias que modifiquen las actuaciones subvencionadas y, por otra parte , no ha justificado la modificación del contenido de las inversiones.</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>8.El beneficiario presentó alegaciones el día 8 de julio de 2021, donde expone que la construcción del almacén no es viable ya que el ayuntamiento de Es Mercadal aún no ha otorgado la licencia de obras, y por ello se ha visto obligado a montar una estructura móvil para poder albergar la maquinaria, le ha costado 18.000 € y tiene unas dimensiones de 470 m2.</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>9.La inversión propuesta es la compra de una picadora, por un importe superior a la ayuda concedida, siendo la inversión auxiliable 208.986,50 euros, y la ayuda condedida&nbsp;de 104.493,25 euros, este importe no se pueden aumentar.</em></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>10.Las inversiones propuestas son bienes&nbsp;muebles y por lo tanto tienen un plazo de 6 meses desde la publicación de la resolución de aceptación de modificación.</em></em></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>Fundamentos de derecho</em></em></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%"><em><em>1.
