font-size:12px">En no haberse presentado reclamaciones durante el plazo de exposición al público, queda automáticamente elevado a definitivo el Acuerdo provisional de la Junta de Gobierno de fecha 10/08/2021 de este Ayuntamiento de sa Pobla sobre el establecimiento y el Acuerdo regulador de precios públicos, el texto íntegro de los cuales se hace público, en cumplimiento del artículo 70.2 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local.</span></span></p> <p style="text-align:center"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“ORDENANZA REGULADORA DEL PRECIO PÚBLICOS PARA LA REALIZACIÓN DE CURSOS PARA PERSONAS ADULTAS</span></span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 1. </span></span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cimiento y naturaleza</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En uso de las facultades concedidas por el artículo 41 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, este Ayuntamiento establece el precio público por la prestación de los servicios de cursos para personas adultas organizados por el propio Ayuntamiento en colaboración con el Centro de Educación de Personas Adultas (CEPA)</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La contraprestación económica por la prestación de estos servicios tienen la naturaleza de precio público para ser una prestación de servicio y realización de actividades objeto de la competencia de esta Entidad y no concurrir ninguno de las circunstancias especificadas en la letra B) del artículo 20.1 del Texto Refundido de la Ley Reguladora de las Haciendas Locales.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 2.</span></span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Obligados al pago.</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Están obligados al pago del precio público regulado en esta ordenanza, los que disfrutan de los que disfruten de los cursos a actividades de formación organizados, prestados o realizados por este Ayuntamiento junto con el Centro de Educación de Personas Adultas (CEPA)</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 3. </span></span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Obligación al pago.</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La obligación de pagar el precio público nacerá con la inscripción en el curso organizado, prestado o realizado por el Ayuntamiento de sa Pobla.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A todos los efectos los precios públicos se harán efectivos mediante autoliquidación en el momento de la inscripción, sin perjuicio que por razones de interés o necesidad se pueda acordar la exacción por liquidación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los precios públicos se exigirán de acuerdo con el procedimiento previsto para hacer efectivos el deudas de carácter tributario, incluyendo el procedimiento de constreñimiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La inscripción mujer derecho a reserva de plaza en los cursos y no dará derecho a devolución del precio pagado cuando, por causas no imputables al Ayuntamiento, el obligado tributario no pueda asistir o no lo haya comunicado con una antelación de 48 horas del inicio del curso.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cuando por causas no imputables al obligado al pago del precio público, el curso no se lleve a cabo, se procederá a la devolución de oficio del importe correspondiente.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Disposición final.</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. En todo aquello que no es previsto en este acuerdo se aplicará lo establecido en la vigente ley de régimen local y otras disposiciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Este acuerdo de regulación de precio público entrará en vigor el día siguiente de su publicación en el boletín oficial de la comunidad autónoma de las Islas Baleares (BOIB).
