En fecha 3 de diciembre de 2020 se publicó en el <em>BOIB</em> núm. 203 la Resolución del consejero de Transición Energética y Sectores Productivos por la que se convocan las pruebas para ser instalador/mantenedor/operador en diferentes especialitades en materia de industria correspondientes al año 2021.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En el apartado número 10.2 de las bases de la convocatoria se indica que, de manera adicional a la publicación en la página web de la Dirección General de Política Industrial, <span style="color:black">la lista definitiva de persones que han obtenido el resultado de apto en este turno se hará pública mediante una resolución del consejero de Transición Energética y Sectores Productivos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">1. El artículo 13 del Decreto 4/2006, de 27 de enero, por el que se regulan los requisitos y el procedimiento para la obtención de determinadas acreditaciones profesionales, y la autorización y acreditación de entidades de formación para impartir cursos de instaladores y mantenedores (<em>BOIB</em> núm. 15, de 2 de febrero).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">2. Decreto 60/2007, de 18 de mayo, por el que se regula la obtención y renovación del carnet profesional de operador de maquinaria minera móvil -OMMM- (<em>BOIB</em> núm. 77, de 24 de mayo).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">3. Real Decreto 249/2010, de 5 de marzo, por el que se adaptan determinadas disposiciones en materia de energía y minas a la Ley 17/2009, de 23 de noviembre, sobre el libre acceso a las actividades de servicios y su ejercicio, y a la Ley 25/2009, de 22 de diciembre, de modificación de diversas leyes para su adaptación a la Ley sobre libre acceso a las actividades de servicios y su ejercicio.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">4. Real decreto 560/2010, de 7 de mayo, por el que se modifican diversas normas reglamentarias en materia de seguridad industrial para adecuarlas a la Ley 17/2009 y la Ley 25/2009, en diversas familias profesionales que regulan, establecen la superación de un examen ante el órgano competente de la comunidad autónoma como una de les vías para acreditar la condición de instalador.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">5. El artículo 2.1.<em>c)</em> del Decreto 11/2021, de 15 de febrero, de la presidenta de les Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de les Illes Balears.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">6. El apartado 2.<em>f)</em> de la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 2 de marzo de 2021 de delegación de competencias y de suplencia de los órganos directivos de la Consejería.</span></span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Propuesta de resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propongo al director general de Política Industrial que dicte una resolución en los términos siguientes:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Publicar en el&nbsp; Boletín Oficial de les Illes Balears las listas de aptos <span style="background-color:white">en las pruebas correspondientes al segundo turno de la convocatoria del año 2021 para obtener la competencia profesional como instalador/mantenedor/operador en diferentes especialidades en materia de industria</span>, las cuales constan en el anexo de la resolución.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo lo anterior, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Contra esta resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes contador desde el día siguiente de la notificación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
