    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 10 de julio de 2015 por la cual se convocan subvenciones para Inversiones a las explotaciones agrícolas, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el&amp;nbsp;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha de 31&amp;nbsp;de agosto&amp;nbsp;de 2021, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“Informe/ propuesta de Resolución Revocación parcial&amp;nbsp;de la ayuda concddida&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 27 de junio de 2017 el Sr. MATIAS RAMIS CIFRE con DNI *** 6104 ** presentó en el Registro del FOGAIBA una solicitud para poder acogerse a la línea de ayudas para inversiones en las explotaciones agrarias al amparo de la Resolución del Presidente del fondo de Garantía Agraria y Pesquera de las Ille&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balears (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, publicada en el BOIB núm. 106 de 16 de julio de 2015, modificada &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;fecha 17 de diciembre de 2015 (BOIB núm. 185), &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 22 de junio de 2016 (BOIB núm. 81) y &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 26 de junio (BOIB núm. 80). Según el plan empresarial aportado por el interesado, entre las inversiones programadas consta, un cultivador Chisel de 15 brazos hidráulico por un importe de 21.900,00 €, Ra&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;strillo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;hilerador Nadal&amp;nbsp;RH-90-S2 por un importe de 17.500,00 €, y finalmente, una Pala El León 430 por un importe de 16.000,00 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Con fecha 30 de agosto de 2019 el interesado aporta la siguiente documentación al expediente: la certificación de que el Sr. MATÍAS RAMIS CIFRE es socio de CAMP MALLORQUÍ FRUITS, S.COOP, así como el informe de los trabajadores de alta en fecha 24 de agosto de 2017.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 22 de julio se realiza un informe de moderación de costes en relación con el cultivador Chisel de 15 brazos hidráulico, el Rastrillo&amp;nbsp;hilerador Nadal&amp;nbsp;RH-90-S2 y la Pala El León 430. En este informe de moderación de costes se concluye que el expediente si cumple con este requisito. Según consta en el Registro Oficial de maquinaria agrícola, el coste elegible del Rastrillo&amp;nbsp;hilerador y de la Pala El León es de 11.000,00 € y 9.386,30 € respectivamente. Para calcular el coste del cultivador se tienen en cuenta dos presupuestos de Agrometal Marquez y otro de Talleres Nicolás y se concluye que el coste elegible del cultivador es de 4.899,77 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Con fecha 31 de julio de 2019 el gestor de la línea de inversiones en explotaciones agrarias constó que en la moderación de costes del cultivador Chisel se&amp;nbsp;detecta una sobrevaloración de casi el 350% y que se procede a hacer la moderación de costes de toda la maquinaria, aunque el valor se encuentre bajo los 18.000,00 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Con fecha 30 de septiembre de 2019 se publicó en la web del FOGAIBA la propuesta provisional de concesión de la ayuda solicitada (INEA2017_1_9_PRO) una vez evaluadas las solicitudes y de acuerdo con los criterios de elegibilidad de la convocatoria. Al beneficiario le correspondió una ayuda de 15.171,64 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.Con fecha 4 de octubre de 2019, el interesado presentó alegaciones solicitando que se tuviera en cuenta la nueva documentación aportada de cambio de modelo del Rastrillo&amp;nbsp;hilerador. También presentó la factura detallada de la Pala Extremo 430 para que se tuvieran en cuenta los extras,&amp;nbsp;que sumaban un total de 6.400,00 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.Una vez evaluadas las alegaciones presentadas, y tras aceptar el cambio de modelo del Rastrillo&amp;nbsp;hilerador por un importe de 15.370,00 € así como, los extras de la Pala modelo 430 por un total de 15.786,30 €, con fecha 11 de octubre de 2019 el vicepresidente del FOGAIBA dictó Resolución de concesión de la ayuda, R42 de fecha 11 de octubre de 2019 al amparo de la Resolución del presidente del FOGAIBA, de 10 de julio de 2015 por la que se convocan subvenciones para inversiones en las explotaciones agrarias para los años 2015-2019 que fue publicada en el BOIB núm. 150 día 5 de noviembre de 2019 por un importe de 21.633,64 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8.Con fecha 6 de noviembre de 2019 el Sr. MATIAS RAMIS CIFRE interpone recurso alzada contra la resolución de concesión de las ayudas, R42 de fecha 11 de octubre de 2019, al amparo de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA), de 10 de julio de 2015, por la que se convocan subvenciones para inversiones en las explotaciones agrarias para los años 2015 a 2019, argumentando: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Que la inversión concedida no es la misma que solicitó.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Que en la resolución de concesión no se comunica los importes no elegibles de las inversiones y que esto provoca indefensión.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Que el cultivador que se ha solicitado ha sido fabricado exclusivamente para atender las necesidades de la explotación del interesado.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Que se modifique la resolución de concesión y que el importe de las inversiones elegibles sea de 53.270,00 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9.Con fecha 19 de diciembre de 2019 el Sr. MATIAS RAMIS CIFRE solicitó el pago parcial de la ayuda concedida en este expediente la cual fue pagada día 9 de julio de 2020 por un importe de 18.693,78 € que correspondiente al Rastrillo&amp;nbsp;hilerador (15.370,00 €) y&lt;/em&gt;&amp;nbsp;&lt;em&gt;a la pala solicitada,&amp;nbsp;incluyendo los extras solicitados (15.786,30 €).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;10. Con fecha de 7 de mayo de 2021 se notificó la desestimación del recurso de alzada presentado.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;11. Con fecha de 4 de junio de 2021 se requirió al solicitante para que presentara la solicitud de pago de la inversión pendiente de justificar.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;12. Transcurridos quince días hábiles, el beneficiario no ha presentado la solicitud de pago.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;13. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del prdel procedimiento administrativo común de las administraciones públicas, establece la obligación de la Administración a dictar resolución expresa y a notificarla. En su párrafo segundo especifica que «En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con la indicación de los hechos producidos y las normas aplicables ».&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;14. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente». Por todo ello, se propone declarar revocada parcialmente la ayuda concedida y no justificada al beneficiario que se indica en el anexo de esta resolución y ello conlleva hacer la revocación parcial de la ayuda.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;strong&gt;Propuestas de Resolución&lt;/strong&gt; &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente sobre revocación parcial y se propone al vicepresidente en materia agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Revocar parcialmente la ayuda concedida en la resolución del vicepresidente del FOGAIBA de 5 de noviembre de 2019, correspondiente al expediente INEA2017_1/334 y por el importe indicado en el anexo de esta resolución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Declarar concluido el procedimiento y archivar el expediente INEA2017_1 / 334.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Publicar esta resolución en el Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
