    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de setiembre de 2015 por la cual se convocan subvenciones para la Creación de empresas de Jóvenes agricultores, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;&lt;em&gt;Boletín Oficial de las I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balears&lt;/em&gt;&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevee el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantia Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en materia agraria del FOGAIBA, con fecha de 8&amp;nbsp;de setiembre&amp;nbsp;de 2021, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“ RESOLUCIÓN DE REVOCACIÓN PARCIAL&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.El 15 de septiembre de 2015 se publicó en el Boletín Oficial de las Ill&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balears núm. 136 la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;es Balears (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores . La Resolución mencionada se modificó en fecha 26 de abril de 2016 (BOIB núm. 54) de 30 de abril de 2016, modificada por la Resolución del Presidente del FOGAIBA de 26 de&lt;/em&gt;&amp;nbsp;&lt;em&gt;junio de 2018 (BOIB núm. 80, de 28 de junio de 2018).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA, resolvió favorablemente la concesión de la ayuda a favor de GUILLERMO BENNASSAR &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BAUZÀ&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;em&gt;y MIGUEL SUÑER MESQUIDA, entre otros, que figuran en el anexo de la Resolución de concesión, R3 de fecha 26 de abril de 2018, por la creación de empresas de jóvenes agricultores, para los años 2015 a 2019 (BOIB núm. 71, de 9 de junio de 2018) con los datos y los importes correspondientes (con un importe concedido de 45.000,00 euros respectivamente).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Considerando la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo establecido en el apartado Quinto, punto 2 b) se podrá incrementar la prima base para incorporación a una explotación prioritaria de orientación productiva ganadera (mínimo 25 UBMs): 5.000,00 euros + 100,00 €/UGM adicional, hasta un máximo de 10.000,00 euros.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Dentro del plazo legalmente establecido, en fecha 10 de agosto de 2018 GUILLERMO BENNASSAR &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BAUZÀ&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;em&gt;y MIGUEL SUÑER MESQUIDA presentan solicitud del primer pago, como la documentación exigida la cual fue pagada por Resolución del Director Gerente del FOGAIBA por un importe de 22.500,00 euros.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. Dentro del plazo legalmente establecido, en fecha 7 de julio de 2020 GUILLERMO BENNASSAR&lt;/em&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BAUZÀ&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;&amp;nbsp;y MIGUEL SUÑER MESQUIDA presentan la solicitud del segundo pago, como la documentación exigida. En fecha 14 de junio de 2021 se comprueba de oficio al RIA que el número de UBMs es 44,14 y por lo tanto corresponde 6.900,00 euros de incremento de la prima para incorporación en una explotación prioritaria de orientación productiva ganadera por cada beneficiario.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. Con fecha 5 de julio de 2021 se notifica a los interesados, mediante la publicación en la web, el Informe/Propuesta provisional de resolución de revocación parcial de día 30 de junio de 2021 ya que la actuación subvencionable no se ajusta a lo establecido en el punto 2 b) del Apartado quinto de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones a las explotaciones agrarias, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. Con fecha 19 de julio de 2021 GUILLERMO BENNASSAR &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BAUZÀ&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;em&gt;y MIGUEL SUÑER MESQUIDA presentan alegaciones al Informe/Propuesta de resolución de revocación parcial de 30 de junio de 2021, aportan documentación. No se admiten la documentación presentada ya que no acredita el incremento de la prima para incorporación en una explotación prioritaria de orientación productiva ganadera.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. Se ha considerado el Informe/Propuesta provisional de resolución de día 30 de junio de 2021, de revocación parcial de la ayuda concedida a GUILLERMO BENNASSAR &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BAUZÀ&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;em&gt;con NIF &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1674&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;**&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y MIGUEL SUÑER MESQUIDA con NIF &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;***3781**.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014-2020.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Resolución &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Revocar parcialmente la resolución de ayuda concedida a los beneficiarios, mediante la Resolución del vicepresidente en materia agraria del FOGAIBA de 27 de abril de 2017, por el importe y con los datos detallados en el anexo de esta resolución, que es un total de dos expedientes y que comienza con GUILLERMO BENNASSAR BAUZA y termina con MIGUEL SUÑER MESQUIDA, que suma un importe total de 6.200,00 euros, relativa a la línea de ayudas «Creación de empresas de jóvenes agricultores», ya que según consta el RIA el número de UBMS es de 44,14 y por tanto el incremento de la prima por explotación prioritaria de orientación productiva ganadera es de 6.900,00 euros para cada beneficiario.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Finalitzar los procedimientos y archivar los expedientes CEJA2016_2/039 y CEJA2016_2/041.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el consellera de &amp;nbsp;Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución , de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
