    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se hace constar que la Alcaldesa del Ayuntamiento de Algaida ha acordado aprobar las bases que tienen que regir la convocatoria para la concesión de subvenciones destinadas a preservar la actividad económica del municipio de Algaida de los efectos adversos del COVID-19.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Lo cual se hace pública a los efectos del artículo 131 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;BASES REGULADORAS DEL PROCEDIMIENTO DE CONCESIÓN POR CONCURRENCIA COMPETITIVA DE SUBVENCIONES DESTINADAS A EMPRESAS DEL MUNICIPIO De ALGAIDA PARA PROTEGER La ACTIVIDAD ECONÓMICA LOCAL DEL IMPACTO DE LA COVID-19&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.- Objeto y finalidad&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.1 El objeto de la presente convocatoria es otorgar ayudas destinadas a preservar la actividad económica del municipio de Algaida de los efectos adversos que haya podido originar la situación derivada de las medidas adoptadas para contener la difusión de la COVID-19.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En concreto, establece el procedimiento para la concesión de ayudas con destino a sufragar gastos en qué hayan incurrido los sujetos que puedan adquirir la condición de personas beneficiarias, siempre que los mismos estén orientados a promover la estabilidad y perdurabilidad de la empresa, así como la continuidad de los productos y servicios que preste (o la mejora de los mismos), o su posible diversificación por canales alternativos a los tradicionales.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.2 La finalidad de estas subvenciones es ayudar a los empresarios del municipio de Algaida a afrontar los efectos económicos adversos derivados de la COVID-19 que hayan podido sufrir. La crisis sanitaria provocada por el brote de COVID-19 se está transmitiendo a la economía y a la sociedad, afectando tanto a la actividad productiva como la demanda y al bienestar de los ciudadanos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es por eso que este Ayuntamiento, en este contexto, tiene como prioridad absoluta en materia económica proteger, preservar y apoyar al tejido productivo y social para minimizar el impacto y conseguir que se produzca lo antes posible una normalización en la actividad económica local. Por eso se ha dotado un fondo para la prestación de estas subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.3 De acuerdo con lo previsto en el artículo 29.2.t) de la Ley 20/2006 Municipal y de Régimen Local de las Islas Baleares, en relación con el artículo 25.1. y 5 de la Ley 7/1985 de Bases de Régimen Local y el artículo 32 del Decreto Ley 8/2020, el Ayuntamiento puede otorgar las presentes subvenciones como medida de fomento que coadyuve a la recuperación económica. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.- Personas beneficiarias, requisitos de las personas solicitantes, líneas y supuestos&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.1 Podrán ser beneficiarias de la subvención las agrupaciones de personas físicas o jurídicas privadas, las comunidades de bienes o cualquier otro tipo de unidad económica o patrimonio separado, que sean titulares de cualquier negocio la actividad del cual se haya visto afectada por las medidas adoptadas para contener la difusión de la COVID-19.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.2 Las personas o entidades interesadas en esta subvención tendrán que cumplir los requisitos siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-&amp;nbsp;Tendrán que tener su domicilio fiscal y su actividad en el municipio de Algaida. Se entenderá por domicilio fiscal el último que figure como tal en el Impuesto de actividades Económicas.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-&amp;nbsp;&amp;nbsp;Contar con el correspondiente título habilitante municipal para ejercer la actividad.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-&amp;nbsp;Estar de alta en el Impuesto sobre Actividades Económicas y en el Régimen Especial de la Seguridad Social de los Trabajadores por Cuenta Propia. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-&amp;nbsp;Haber justificado cualquier subvención que le haya sido concedida con anterioridad por el Ayuntamiento de Algaida, siempre que haya finalizado el correspondiente plazo de justificación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.1 Las personas beneficiarias podrán optar a esta ayuda, que subvencionará los gastos siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Gastos en concepto de arrendamiento del local comercial. Tendrá que ser un establecimiento fijo de titularidad privada, con acceso directo e independiente desde la calle. El contrato de arrendamiento tendrá que estar a nombre del solicitante de la subvención, y ser anterior a la declaración del estado de alarma.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Gastos corrientes destinados al desarrollo, mejora o mantenimiento de la actividad:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;•&amp;nbsp;Gastos de seguros vinculados a la actividad empresarial (responsabilidad civil, accidente de vehículo, etc.)&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Gastos por licencias de uso de herramientas y/o aplicaciones informáticas para el impulso y desarrollo del teletrabajo o el comercio electrónico por Internet vinculados a la actividad empresarial.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Gastos por el diseño Web de página destinada a la promoción comercial y/o venta de productos, gastos de dominio, actualización, mantenimiento y revisión de dicho Web, así como actualización de la presencia de la empresa en redes sociales y plataformas de comercio electrónico.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Combustible y gastos de mantenimiento de vehículos: gastos ocasionados por la compra de combustibles para la realización de la actividad económica dada de alta en el Epígrafe 721.2. Los servicios de mantenimiento de vehículos tienen que estar realizados por talleres autorizados.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;•&amp;nbsp;Gastos suministras de energía eléctrica, agua y comunicaciones (Internet, teléfono, etc.) vinculados al local comercial donde se desarrolle la actividad.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Gastos de préstamos hipotecarios de inmuebles vinculados a la actividad empresarial: importes pagados a entidades bancarias para la adquisición de un local donde se ejerza la actividad principal.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;•&amp;nbsp;Renting de maquinaria o vehículos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.2 Los gastos anteriores habrán, de manera indudable, de responder a la naturaleza y objeto de la actividad subvencionada, y haberse abonado efectivamente previamente a la solicitud de subvención hecha por el beneficiario.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;​​​​​​​&lt;/span&gt;&lt;/strong&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.- Periodo subvencionable, crédito presupuestario e importes máximos por línea&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.1 El periodo subvencionable será lo comprendido entre el 14 de marzo de 2020 (declaración del estado de alarma) y el día anterior a la publicación de la presente *convocatoria al Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.2 El Crédito presupuestario total máximo por la subvención es de 71.000,00 euros, que figura consignado en la partida presupuestaria 2021/01/433/47900. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de que el total de ayudas supere la consignación presupuestaria, se reducirán proporcionalmente las cantidades concedidas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presente subvención se encuentra financiada por el Ayuntamiento de Algaida, por la Comunidad Autónoma de las Islas Baleares y por el Consejo Insular de Mallorca.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;​​​​​​​5.- Plazo y forma de presentación de las solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.1 El plazo para la presentación de solicitudes será de 10 días hábiles, a contar desde el día siguiente de la publicación de las presentes bases y convocatoria en el Boletín Oficial de las Islas Baleares y a la página web municipal. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los modelos normalizados, así como las bases y el resto de documentación asociada al expediente, estarán disponibles en la página web del Ayuntamiento de Algaida.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.2 Solo se atenderá una solicitud por empresa (persona física o jurídica) y actividad económica afectada, independientemente de que realicen más de una actividad económica.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.3 Las solicitudes se formalizarán por escrito en modelo normalizado de solicitud que se acompaña como Anexo 1, dirigidas a la Alcaldía- Presidencia e irán acompañadas de la documentación indicada en la base siguiente.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las solicitudes podrán ser presentadas de forma presencial en el Registro General de las Oficinas Municipales o bien utilizando cualquiera de los medios establecidos en el artículo 16.4 de la Ley del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6.- Documentación a acompañar a la solicitud&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con el que establece el artículo 4 del Decreto 6/2013, de 8 de febrero, de medidas de simplificación documental de los procedimientos administrativos, no es necesario adjuntar documentación en caso de que ya esté en poder del Ayuntamiento de Algaida, por haberla aportado en convocatorias anteriores. En este caso, los solicitantes que se hayan presentado en una o en las dos convocatorias anteriores (BOIB n.º 18, de 11 de febrero de 2021 y *BOIB n.º 63, de 15 de mayo de 2021, y la modificación publicada en el BOIB n.º 72, de 3 de junio de 2021) y se los haya concedido la ayuda, lo tendrán que hacer constar en la solicitud, indicando en qué convocatoria se los concedió la ayuda y el número de registro de entrada de la solicitud pertinente. Y solo en este caso tendrán que presentar únicamente el Anexo I.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;​​​​​​​​​​​​​​7.- Procedimiento, resolución y pago de la subvención&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.1 El procedimiento de concesión se tramitará en régimen de concurrencia competitiva, según el establecido en el artículo 22.1 de la Ley 38/2003, de 17 de noviembre.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La gestión de las ayudas contempladas en la presente convocatoria se sujetará a los principios de publicidad, transparencia, objetividad, igualdad y no discriminación, así como la eficacia en lo agasajo de objetivos y eficiencia en la asignación y utilización de los recursos públicos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.2 El órgano competente para resolver el procedimiento es la Alcaldesa del Ayuntamiento de Algaida, que tendrá que dictar y notificar a los interesados la resolución del procedimiento en el plazo máximo de tres meses contadores desde la publicación de la presente convocatoria al Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los actos de trámite del presente procedimiento, así como la resolución de este, se publicarán en la sede electrónica del Ayuntamiento de Algaida (http://ajalgaida.sedelectronica.es).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de ser necesario, se requerirá a los solicitantes porque aporten cuánta documentación e información complementaria se estime oportuna para fundamentar su derecho, así como porque se proceda a la enmienda de los defectos apreciados en la solicitud, en el plazo de diez días hábiles. También podrá realizar de oficio cuántas actuaciones estime necesarias y convenientes para la determinación, conocimiento y comprobación de los datos que figuren en las solicitudes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.3 El pago de estas subvenciones se realizará en un pago único a cada beneficiario por la totalidad del importe concedido, mediante transferencia bancaria, a partir de la fecha de la resolución de concesión.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.- Tratamiento de datos de carácter personal&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En conformidad con lo previsto en la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales el responsable del tratamiento de sus datos será Ayuntamiento de Algaida (CIF: P0700400E, C/ del Rey, 6 – 07210 Algaida, Islas Baleares), único destinatario de la información aportada voluntariamente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los interesados podrán ejercer sus derechos por correo postal, adjuntando una fotocopia del DNI o documento equivalente, dirigido al Ayuntamiento de Algaida, Calle del Rey, 6, 07210 Algaida, Islas Baleares; presencialmente, mediante escrito presentado en el Registro General del Ayuntamiento de Algaida, o a través de cualquier de los medios establecidos en el arte. 16.4 de la Ley 39/2015.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;9.- Legislación supletoria e interpretación de las bases&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En todo aquello no previsto en las presentes bases regirá lo dispuesto en el Reglamento de la Ley General de Subvenciones (Real Decreto 887/2006, de 21 de julio).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Igualmente, le serán aplicables los preceptos básicos de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público, así como el resto de disposiciones legales y reglamentarias que sean de aplicación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.- Que es titular de una actividad económica ubicada y con actividad en el municipio de Algaida, y que esta actividad se ha visto afectada por las medidas adoptadas para contener la propagación de la COVID-19.&lt;/span&gt;&lt;/p&gt;
