&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 14 de septiembre de 2019 se publicó en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; (BOIB núm. 126) la Resolución del director general de Pesca y Medio Marino de 12 de septiembre de 2019 por la cual se establece el censo de embarcaciones de pesca profesional de artes menores de la Reserva Marina de la Illa del Toro.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El 4 de agosto de 2021, el Servicio de Recursos Marinos comunicó a la Federación Balear de Cofradías de Pescadores (FBCP) que han transcurrido dos años desde la publicación del censo y les solicitó colaboración para actualizarlo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El 12 de agosto de 2021, la FBCP comunicó al Servicio la propuesta de modificación del censo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El 25 de agosto de 2021 se emitió el informe del Servicio de Recursos Marinos con relación a la propuesta de embarcaciones que se han de incluir en el censo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El artículo 3.1 del Decreto 41/2015, de 22 de mayo, por el cual se regulan las actividades de extracción de flora o fauna marina y las actividades subacuáticas en las reservas marinas de las aguas interiores del litoral de las Islas Baleares, establece que para estar incluido en el censo de embarcaciones de pesca profesional autorizadas, previsto en el artículo 8.5 de la Ley 6/2013, de 7 de noviembre, es necesario pertenecer a las cofradías del ámbito territorial de la reserva o tener el puerto base en el ámbito territorial de la cofradía a pesar de no ser miembro, o tener el puerto base a menos de 24 millas de la reserva y demostrar&amp;nbsp;habitualidad&amp;nbsp;mediante la acreditación de actividad en la zona en el periodo de cinco años inmediatamente anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El artículo 2.10.b) del Decreto 11/2021, de 15 de febrero, de la presidenta de las Islas Baleares, por el cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares, dispone que la Consejería de Agricultura, Pesca y Alimentación ejerce, entre otros, la competencia en materia de recursos marinos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Por todo esto,&amp;nbsp;dicto&amp;nbsp;la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Publicar el censo de embarcaciones de pesca profesional de artes menores de la Reserva Marina de la Isla del Toro por un periodo de dos años, que estará formado por las embarcaciones que figuran al anexo de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Contra esta Resolución, que no agota la vía administrativa, se puede interponer un recurso de alzada ante la consejera de Agricultura, Pesca y Alimentación en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con el artículo 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 58 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
