&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el&lt;em&gt;&lt;em&gt;&amp;nbsp;Fon&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de Garant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a Agr&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;à&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ria &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesquera de l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balear&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&amp;nbsp;(FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias. La Resolución mencionada se modificó con fecha 17 de diciembre de 2015 (BOIB núm. 185), &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con fecha 22 de junio de 2016 (BOIB núm. 81) y con fecha 26 de junio de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de BARTOLOME BIBILONI DEYÀ, entre otros, que figuran en el anexo de la Resolución de concesión, R1 de fecha 10 de septiembre de 2020, (BOIB núm. 161, de 17 de septiembre de 2020) con los datos y los importes correspondientes (con un importe concedido de 86&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.7&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;94,50&amp;nbsp;€).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Considerando la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo establecido en el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otras, a realizar las actuaciones auxiliadas dentro del plazo establecido y en justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en el modo y los plazos determinados en la convocatoria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago, así como la documentación exigida, pero, una vez revisada la misma, se comprueba que:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- El cultivador adquirido es CHISEL DE 15 BRAZOS CON RODILLO&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Y PLEGADO HIDRÁULICO, por un importe de 11.548,00 euros (sin IVA), un modelo y marca diferente al cultivador GIL CHM HIDRÁULICO 6,5 MTS, por un importe de 12.710,00 euros, dado este cambio se emitió el Informe de moderación de costes con fecha 3 de junio de 2021, que determina que el importe del cultivador CHISEL D&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;15 BRAZOS &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;CON RODILLO&amp;nbsp;Y PLEGADO HIDRÁULICO es de 11.110,00 euros, el valor de mercado del producto es inferior al importe que se ha justificado.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- El tractor adquirido es CLAAS AXION 850 CMATIC, por un importe de 127.107,00 euros (sin IVA), un modelo y marca diferente al tractor DEUTZ FAHR 6205TTV, por un importe de 128.316,00 euros, dado este cambio se emitió Informe de moderación de costes con fecha 3 de junio de 2021, que determina que el importe del tractor CLAAS AXION 850 CMATIC es de 124.740,00 euros, el valor de mercado del producto es inferior al importe que se ha justificado.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;- No realizar la inversión de la plataforma.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Por todo ello, se propone hacer la revocación parcial ya que la actuación subvencionable no se ajusta a lo establecido en el punto 1 del apartado décimo de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears ( FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. Con fecha 19 de julio de 2021 se notifica al interesado, mediante la publicación en la web, el Informe/Propuesta provisional de resolución de revocación parcial de 16 de julio de 2021 no se ajusta a lo establecido en el punto 1 de el apartado décimo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8.El 26 de julio de 2021, en tiempo y en forma, la persona interesada presentó alegaciones, donde expone que desistió del contador de la parcela 3 y 4 del polígono 14 pero no del contador de la parcela 108 del polígono 8 del que presenta factura y justificante del pago y que la factura 3179/2018 la fecha 15 de enero de 2018 es incorrecta, presenta la factura con fecha 15 de abril de 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. Por todo ello, se aceptan las alegaciones presentadas, una vez comprobado que la comunicación de desistimiento presentado por el interesado de fecha 25 de febrero de 2020 no desiste del contador de la parcela 108 del polígono 8 y que la&lt;/em&gt;&amp;nbsp;&lt;em&gt;factura 3179/2018 tiene una proforma 1/2018 de fecha 7 de marzo de 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
