    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la cual se convocan subvenciones para Inversiones a las explotaciones agrícolas, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el&amp;nbsp;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha de 27&amp;nbsp;de agosto&amp;nbsp;de 2021, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“Resolución de Revocación parcial&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del Presidente del Fons&amp;nbsp;de Garant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a Agr&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;à&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ria &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesquera de l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;es Balears (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias. La Resolución mencionada se modificó en fecha 17 de diciembre de 2015 (BOIB núm. 185), con fecha 22 de junio de 2016, (BOIB núm. 81) y 26 de junio de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de BINIME·LA SRM entre otros, que figuran en el anexo de la Resolución de concesión, R50 de fecha 7 de noviembre de 2019 (BOIB núm. 159 de 23 de noviembre de 2019 ) con los datos y los importes correspondientes&amp;nbsp;(con &amp;nbsp;un importe concedido de 40.293,00€).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Considerando la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo establecido en el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otras, a realizar las actuaciones auxiliadas dentro del plazo establecido y en justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en el modo y los plazos determinados en la convocatoria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago, así como la documentación exigida, pero, una vez revisada la misma, se comprueba que el tractor adquirido es NEW HOLLAND modelo T5. 115 DC 1.5 por un importe de 73.000,00 euros; un modelo diferente al modelo del tractor concedido SAME FORTIS 150 con un coste elegible de 73.260 euros, dado este cambio se emitió el informe de moderación de costes con fecha 2 de julio de 2021, que determina que el importe del tractor NEW HOLLAND modelo T5.115 DC 1.5 es de 63.916,96 euros, el valor de mercado del producto es inferior al importe que se ha justificado.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. Por todo ello, se propone hacer la revocación parcial ya que la actuación subvencionable no se ajusta a lo establecido en el punto 2.b del apartado cuarto de la Resolución del Presidente del Fons&amp;nbsp;de Garanti&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a Agr&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;à&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ria &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesquera de l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;lles Balears (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. Con fecha 12 de julio de 2021 se notifica a la persona interesada, mediante la publicación en la web, el Informe/Propuesta provisional de R&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;esolución de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;R&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;evocación parcial de 7 de julio de 2021 ya que la actuación subvencionable no se ajusta a lo establece el punto 2.b del apartado cuarto de la Resolución del presidente del Fon&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de Garant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a Agr&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;à&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ria &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesquera de l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;es Balears (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para Inversiones en las explotaciones agrarias, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones. Transcurrido los 10 días hábiles, el interesado no ha presentando ninguna alegación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. Se ha considerado el Informe/Propuesta provisional de Resolución de 7 de julio de 2021, de Revocación parcial de la ayuda concedida a BINIMEL·LA SRM, con NIF E07710916.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. En el Informe/Propuesta provisional de Resolución antes mencionado se ha detectado un error de cálculo, en el que se establecía un importe de ayuda concedida erróneo de 73.260,00 €, que debe ser 40.293,00 €; un importe de ayuda auxiliable erróneo de 63.916,96 €, que debe ser 35.154,33 € y un importe erróneo de revocación de 9.343,04 €, que debe ser 5.138,67 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Orden del Conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014 a 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, dicto la siguiente&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Resolución &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.&lt;/em&gt;&amp;nbsp;&lt;em&gt;Revocar parcialmente la resolución de ayuda concedida al beneficiario por el importe y con los datos detallados en el anexo de esta resolución, que es un total de 1 expediente y que comienza con BINIMEL·LA SRM&amp;nbsp;y termina con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;BINIMEL·LA SRM&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, que suma un importe total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;5&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;138,67&amp;nbsp;euros, relativa a la línea de ayuda "Inversiones en las explotaciones agrarias", ya que la justificación &amp;nbsp;del gasto es inferior a la aprobada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. &amp;nbsp;Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
