    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 10 de julio de 2015 por la que se convocan, subvenciones para inversiones en las explotaciones agrarias, correspondientes a los años 2015 a 2019, especifica que la resolución expresa se notificará a los interesados mediante su publicación en el Boletín Oficial de las Islas Baleares de acuerdo con los términos previstos en el artículo 60.2 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 59 de la Ley 30/1992, de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común .&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia agraria del FOGAIBA, con&amp;nbsp;fecha 30&amp;nbsp;de agosto&amp;nbsp;de 2021, firma la siguiente resolución,&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;" INFORME PROPUESTA DE RESOLUCIÓN DE DENEGACIÓN&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 8 de mayo de 2018 con número de registro de entrada L3E2349, el Sr. FRANCISCO BUFI TORRES con NIF *** 5868 ** presentó en el Registro del FOGAIBA una solicitud de ayuda para poder acogerse a la línea de ayudas para inversiones en las explotaciones agrarias al amparo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, publicada en el BOIB número 106 de 16 de julio de 2015.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Con fecha 10 de junio de 2020 el Sr. FRANCISCO BUFI TORRES con DNI***5868** presentó en el Registro del FOGAIBA escrito de alegaciones contra la Propuesta Provisional de Resolución de Concesión publicada el día 3 de junio de 2020 en la página web del FOGAIBA. La parte interesada insta a la incorporación al expediente la solicitud de alta en el Registro Insular Agrario de Ibiza de su actividad agraria, así como que se tenga en cuenta la condición de joven agricultor ya que, según afirma el interesado, en el momento de la presentación de la solicitud de ayuda se produjo un error y esta condición no se indicó.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Una vez analizada toda la documentación, y teniendo en cuenta que el crédito existente no cubría la totalidad de las peticiones, la selección de los beneficiarios de las ayudas debía hacerse mediante el procedimiento de concurrencia competitiva, según los criterios de prioridad y la puntuación obtenida aplicando el apartado séptimo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 16 de julio de 2015.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Con fecha 14 de agosto de 2020 el Sr. FRANCISCO BUFI TORRES con DNI***5868** presentó en el Registro del FOGAIBA escrito de alegaciones contra la Propuesta Provisional de Resolución de la ayuda que se publicó en la web del FOGAIBA día 11 de agosto de 2020. la parte interesada aportó certificado de la Agencia Estatal de la Administración Tributaria, según el cual, en fecha 11 de agosto de 2020, el Sr. FRANCISCO BUFI TORRES se encuentra al corriente de las obligaciones tributarias. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Con fecha 14 de septiembre de 2020 el Director Gerente del FOGAIBA dictó Resolución de concesión parciales de los beneficiarios de las ayudas, R1 de fecha 10 de septiembre de 2020, al amparo de a Resolución del Presidente del Fondo de Garantía Agraria y pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015, por la que se convocan subvenciones para inversiones en las explotaciones agrarias, para el años 2015 a 2019.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.De acuerdo con el orden de prevalencia según la aplicación de los criterios de priorización (concurrencia), el director gerente del FOGAIBA no resolvió a favor del Sr. FRANCISCO BUFI TORRES (con 37 puntos) y por tanto, no se concedió la ayuda solicitada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8.Con fecha 28 de septiembre de 2020 el Sr. FRANCISCO BUFI TORRES con DNI Núm.***5868** interpuso recurso de alzada contra la Resolución de concesión parciales de los beneficiarios de las ayudas R1 de fecha 10 de septiembre de 2020, argumentando lo siguiente:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;em&gt;- que no se tuvo en cuenta el escrito de alegaciones presentado en el registro de FOGAIBA día 10 de junio de 2020 contra la Propuesta Provisional de Resolución de Concesión publicada en la página web del FOGAIBA día 3 de junio de 2020.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;em&gt;- que se tenga por presentada la documentación aportada aquel día que en consecuencia aumente la puntuación a 42 puntos. La parte interesada no aportó documentación adjunta al recurso.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;em&gt;El recurso de alzada se estimó y se retrotrae el procedimiento a la fase de resolución.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. Con 42 puntos y registro de entrada de día 8 de mayo de 2018, le corresponde la posición 310 de acuerdo con el orden de prevalencia según la aplicación de los criterios de priorización (concurrencia). Por lo tanto no tiene derecho a ayuda y se propone la denegación del expediente.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Orden del Conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020 .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;em&gt;Propuesta de Resolución&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa desfavorablemente y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Denegar la ayuda solicitada por e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l interesado que figura en el Anexo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, que &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;es&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;un total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expediente y que comienza y termina con FRANCISCO BUFI TORRES, relativa a la línea de ayudas "Inversiones en las explotaciones agrarias ", no se puede estimar ya que la ayuda solicitada excede la cuantía máxima del crédito fijado en la convocatoria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Declarar concluido el procedimiento y proceder al archivo de los expedientes detallados en el Anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Notificar esta resolución al interesado mediante la publicación en el Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la&amp;nbsp;conse&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ll&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;er&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de Agricultura&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Pesca&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y Alimentación&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;C&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;omunidad autónoma de las I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balears, y l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;os&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;artículo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;121 y 122 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
