    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 8.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de setiembre de 2015, por la cual se convocan ayudas destinadas a la Creación de empresas de jóvenes agricultores para los años 2015-2019, convocatoria 2017, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el Boletín Oficial de las Islas Baleares, y se hará de acuerdo a los términos que prevé el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#212121"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha 10&amp;nbsp;de agosto de 2021, firmó la siguiente resolución: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores. La Resolución mencionada se modificó &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 26 de abril de 2016 (BOIB núm. 54 de 30 de abril de 2016) y &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con fecha 26 de junio de 2018 (BOIB núm. 80 de 28 de junio de 2018).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA, resolvió favorablemente la concesión de la ayuda a favor de MARIA ROSES LAMBOURNE, entre otros, que figuran en el anexo de la Resolución de concesión, R2 de fecha 27 de abril de 2018, (BOIB núm. 65, de 26 de mayo de 2018) con los datos y los importes correspondientes (con un importe concedido de 57.000,00 euros).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Considerando la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo establecido en el apartado Quinto, punto 2 b) se podrá incrementar la prima base para incorporación a una explotación prioritaria de orientación productiva horticultura / fruticultura ( &amp;gt; 50% de la superficie destinada a horticultura / fruticultura), mínimo 1UTA: 10.000,00 € + 1.000,00 € / UTA entera adicional, hasta un máximo de 15.000,00 euros. También se podrá incrementar por incorporación a una explotación prioritaria dedicada a la agricultura ecológica: 10.000,00 €, tal y como establece el punto f) del Apart Quinto.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. Dentro del plazo legalmente establecido, en fecha 22 de junio de 2018 la interesada presenta solicitud del primer pago así como la documentación exigida la cual fue pagada por Resolución del Director Gerente del FOGAIBA por importe 28.500,00 euros.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. Con fecha 20 de septiembre de 2018 la interesada presentó el desistimiento del incremento de la prima para incorporación a una explotación dedicada a la agricultura ecológica concedida por importe de 10.000,00 euros.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;​​​​​​​&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. Dentro del plazo legalmente establecido, en fecha 15 de abril de 2021 la interesada presenta la solicitud del segundo pago, como la documentación exigida. En fecha 16 de junio de 2021 se comprueba de oficio al RIA que el número de UTAS adicionales es 1,804 y que por lo tanto le corresponden 1.000, 00 € más de prima para incorporación a una explotación prioritaria de orientación productiva horticultura / fruticultura en regadío por la UTA adicional de su explotación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8. &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 28 de junio de 2021 se notifica al interesado, mediante la publicación en la web, el Informe /Propuesta provisional de resolución de la revocación parcial de día 23 de junio de 2021 ya que la actuación subvencionable no se ajusta a lo establecido en el punto 2 b) y&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;f) del Apartado quinto de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones a las explotaciones agrarias, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones. Una vez transcurridos los 10 días hábiles, el interesado no ha presentado ninguna alegación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9. Se ha considerado el Informe/Propuesta provisional de resolución de día 23 de junio de 2021, de revocación parcial de la ayuda concedida a MARIA ROS&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S LAMBOURNE, con NIF&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;6665&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;**. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;En el Informe/Propuesta el importe a revocar es de 11.000,00 euros financiado 100% por la CAIB. Se produjo un error administrativo, el importe a revocar de 11.000,00€ está cofinanciado con los siguientes porcentajes: en un 14,00% por la CAIB, en un 80,00% por el FEADER y en un 6,00% por la AGE. Este error no afecta a la interesada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Revocar &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;parcialmente &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;la ayuda concedida a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l beneficiario, mediante la R&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;esoluci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n del vicepresidente en materia agraria del FOGAIBA de 27 de abril de 2017, por el importe y con los datos detallados en el anexo de esta resoluci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n, que es un total de 1 expediente y que comienza con MARIA ROS&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S LAMBOURNE y acaba con MARIA ROS&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S LAMBOURNE, que suma un importe total de 11.000,00 euros, relativa a la l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Í&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;nea de ayudas &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;“&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Creaci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n de empresas de j&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;venes agricultores&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;”&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, ya que el interesado presenta el desistimiento del incremento de la prima por incorporaci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n a una explotaci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n dedicada a la agricultura ecol&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;gica. Tampoco se tiene en cuenta el incremento de la prima por las dos UTAS adicionales porque seg&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ú&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n consta en el RIA el n&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;úmero de UTAS adicionales para el incremento de la prima es una.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;2.Finalitzar el procedimiento y archivar el expediente CEJA2017_1 / 002.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
