El día 17 de abril de 2021 se publicó en el BOIB núm.51 la Resolución del Consejero de Educación y Formación Profesional de 15 de abril de 2021 por la que se convocan ayudas económicas para el curso 2020 hasta 2021 para contribuir el sostenimiento de las escuelas de música y danza públicas de las Illes Balears reconocidas por la Consejería de Educación y Formación Profesional los titulares sean administraciones públicas territoriales, corporaciones locales o patronatos municipales.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La Resolución del Consejero de Educación y Formación Profesional de 30 de abril de 2021 modifica la Resolución del Consejero de Educación y Formación Profesional de 15 de abril de 2021 por la que se convocan ayudas económicas para el curso 2020 a 2.021 para contribuir al sostenimiento de las escuelas de música y danza públicas de las Illes Balears reconocidas por la Consejería de Educación y Formación Profesional los titulares sean administraciones públicas territoriales, corporaciones locales o patronatos municipales, a fin de que la entidad beneficiaría pueda subcontratar, hasta el 100%, la actividad y gestión de la escuela de música y / o danza.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Se han presentado un total de veintidós solicitudes dentro del plazo establecido por la convocatoria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El día 17 de junio de 2021 se constituyó la comisión evaluadora que, tras revisar y evaluar las solicitudes de acuerdo con los criterios y requisitos establecidos en la Resolución de convocatoria, emitió el informe preceptivo en base al que, el director general de Planificación, Ordenación y Centros dictó la propuesta de resolución provisional de concesión de las ayudas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El día 28 de junio de 2021 se publicó en la web de la Dirección General de Planificación, Ordenación y Centros (http://dgplacen.caib.es) la Propuesta de resolución provisional de concesión y denegación de las ayudas de la convocatoria de ayudas económicas para el curso 2020-2021 para contribuir al sostenimiento de las escuelas de música y danza públicas de las Illes Balears reconocidas por la Consejería de Educación y Formación Profesional los titulares sean administraciones públicas territoriales, corporaciones locales o patronatos municipales. Las entidades interesadas han dispuesto de diez días hábiles tal y como establece el punto duodécimo de las Normas generales y particulares de las ayudas económicas para el curso 2020-2021 para contribuir al sostenimiento de las escuelas de música y danza públicas de las Illes Balears reconocidas por la Consejería de Educación y Formación Profesional los titulares sean administraciones públicas territoriales, corporaciones locales o patronatos municipales. Durante este periodo no se ha presentado ninguna alegación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Día 20 de junio de 2021, el director general de Planificación, Ordenación y Centros ha dictado la propuesta de resolución definitiva de concesión y denegación de las ayudas de la convocatoria de ayudas económicas para el curso 2020-2021 para contribuir al sostenimiento de las escuelas de música y danza públicas de las Illes Balears reconocidas por la Consejería de Educación y Formación Profesional los titulares sean administraciones públicas territoriales, corporaciones locales o patronatos municipales.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="line-height:115%">Fundamentos de derecho</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Ley 38/2003, de 17 de noviembre, general de subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Decreto Legislativo 2/2005, de 28 diciembre, por el que se aprueba el texto refundido de subvenciones (BOIB núm. 196, de 31 de diciembre).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La Orden de la Consejera de Educación y Cultura, de 1 de julio de 2009, por la que se establecen las bases reguladoras de las subvenciones en materia de educación y cultura (BOIB núm. 100, de 11 de abril).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Resolución de la Consejera de Hacienda y Relaciones Exteriores de 28 de noviembre de 2019 por la que se modifica el anexo al Plan Estratégico de Subvenciones de la Comunidad Autónoma de las Illes Balears para los ejercicios 2018 a 2020, aprobado mediante la acuerdo del Consejo de Gobierno de 9 de marzo de 2018 (BOIB núm. 166, de 10 de diciembre de 2019).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El Acuerdo del Consejo de Gobierno de 25 de enero de 2021 (BOIB Núm.11 de 26 de enero de 2021) por el que se prorroga la vigencia del Plan Estratégico de Subvenciones de la Comunidad Autónoma de las Illes Balears para los ejercicios 2018 -2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello y de acuerdo con el procedimiento establecido por la legislación vigente en materia de subvenciones, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="line-height:115%">Resolución</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Aprobar la concesión de las ayudas solicitadas, con las cuantías resultantes a todas las entidades que se relacionan en el Anexo 1.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Aprobar la denegación de las ayudas solicitadas, por la causa que se expone, a las entidades que se relacionan en el Anexo 2.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Ordenar la publicación de esta resolución en el Boletín Oficial de las Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Hacer pública esta resolución en la página web (http://dgplacen.caib.es).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="line-height:115%">Interposición de recursos</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Consejero de Educación y Formación Profesional en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El recurso potestativo de reposición se entiende desestimado si no se ha resuelto y no se ha notificado la resolución en el plazo de un mes a contar desde el día siguiente de la interposición. En este caso, queda expedita la vía jurisdiccional contencioso administrativa en los términos establecidos en el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso administrativa.</span></p> <p><span style="font-family:Times New Roman,Times,serif;
