40 ![CDATA[<p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">La Comisión Insular de Ordenación del Territorio y Urbanismo, en sesión de día 30 de julio de 2021, ha tomado el acuerdo siguiente:</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">«Visto el expediente relativo a la modificación puntual nº. 4 de las Normas Subsidiarias del término municipal de Artà, relativa a la admisión del uso funerario en el polígono industrial, en el trámite previsto en el artículo 55.7 de la Ley 12/2017, de 29 de diciembre, de urbanismo de las Illes Balears, y en el artículo 164 del Reglamento general de la Ley 2/2014, de 25 de marzo, de ordenación y uso del suelo para la isla de Mallorca, y de acuerdo con el dictamen de la Ponencia Técnica de Ordenación del Territorio y Urbanismo, esta Comisión Insular acuerda aprobar definitivamente la modificación puntual mencionada, sujetándola a las siguientes prescripciones:</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. No se podrá ocupar, ni siquiera temporalmente, el espacio delimitado como yacimiento arqueológico.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Los establecimientos de servicio funerario que se establezcan en el área AR-IND-1F serán sólo los indicados en la modificación puntual número 4 de las Normas Subsidiarias de Artà: tanatorios y crematorios. Estarán obligados a cumplir el Decreto 11/2018, de 27 de abril, por el que se regula el ejercicio de la sanidad mortuoria de las Illes Balears. </span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Asimismo, se recomienda:</span></p> <ul> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Adoptar medidas correctoras de la implantación del uso funerario para garantizar las condiciones de aislamiento o privacidad adecuadas.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Seguir los criterios de ubicación establecidos en la “Guía del Consenso sobre Sanidad Mortuoria” del Ministerio de Sanidad, Consumo y Bienestar Social.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Obtener informe favorable del Departamento de Cultura, Patrimonio y Política Lingüística de cualquier proyecto (y no tan sólo de los que son objeto de la presente modificación) que se ubique en la zona AR-IND-1 que se superpone con el BIC Es Pujols Grans.</span></p> </li> </ul> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Por otra parte, se acuerda que:</span></p> <ul> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con la Ley 34/2007, de 15 de noviembre, de calidad del aire y protección de la atmósfera, los crematorios constituyen una actividad potencialmente contaminando de la atmósfera (APCA) de tipo B y con el código 09 09 01 00. Estas actividades del tipo B requieren una autorización administrativa de la Dirección General de Energía y Cambio Climático y, entre otras cosas, tienen que respetar los valores límite de emisión establecidos, disponer de registro en continuo de temperatura en el interior de la cámara de combustión, realizar controles de sus emisiones, aplicar las mejores técnicas disponibles y cumplir los requisitos técnicos que le sean de aplicación conforme establece la normativa.</span></p> </li> </ul> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Los proyectos de crematorios que se deriven de esta modificación ubicados en el perímetro de restricciones máximas (10-250 mm) de los pozos de abastecimiento urbano necesitan el informe favorable de la Administración Hidráulica.»</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Asimismo se hacen públicas las normas urbanísticas:</span></p> <p><strong>Normativa</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><strong>Artículo77</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black"><strong>Usos de equipamiento comunitario</strong></span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">1. Socio cultural: comprende las actividades culturales, recreativas y de relación social, las que tienen relación con la creación personal y la artística, y las de carácter religioso. Se incluyen por tanto, casas de cultura, centros sociales, bibliotecas, salas de arte y de exposición, etc., así como también las iglesias, templos, capillas, centros parroquiales, conventos y similares.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">2. Docente: las actividades que forman este uso son las que se destinan a la formación humana y intelectual de las personas en los diferentes niveles. Se incluyen, por ejemplo, los centros de educación infantil, de primaria y de secundaria, de bachillerato, de formación profesional, de enseñanza universitaria, de educación especial, de educación para adultos, las academias, los talleres ocupacionales, las escuelas de educación musical y conservatorios, las escuelas de artes y oficios, los centros de investigación científica y técnica vinculados a la docencia, etc.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">3. Asistencia social: comprende las actividades destinadas a la cobertura de las necesidades sociales de la población y que en general no están incluidas en otros usos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Incluye también el alojamiento asistido, con todos los servicios complementarios necesarios para hacer estancias largas o permanentes. Se especializan según el colectivo al que van dirigidos: ancianos, estudiantes, etc.</span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">4. Administrativo institucional: comprende los centros o edificios destinados a la administración pública exclusivamente para desarrollar las funciones y servicios de sus competencias. Se incluyen, por ejemplo, las sedes del Ayuntamiento, las delegaciones de la Administración autonómica o estatal, etc.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">5. Deportivo: las actividades que forman parte de este uso son las que se dirigen a la práctica, la enseñanza de especialidades deportivas o de cultura física. Se pueden incluir, por ejemplo, las instalaciones deportivas al aire libre y las cubiertas, gimnasios, polideportivos, etc.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">6. Seguridad: este uso se corresponde a las actividades de servicio público que hacen cuerpos e instituciones de la administración y que se dirigen a la defensa del Estado, a la preservación del orden público, la protección de los individuos o de los bienes y las actividades que se desprenden de las anteriores. Se incluyen, por ejemplo, los cuarteles del ejército o de las fuerzas de seguridad locales, autonómicas y estatales, las comisarías, las instalaciones militares, protección civil, bomberos, etc.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">7. Sanitario: lo forman las actividades de uso público o colectivo que se destinan a la orientación, la prevención, la información, la administración y la prestación de servicios médicos o quirúrgicos y hospitalarios. No se incluyen los servicios médicos que se prestan en despachos profesionales, fuera de los centros sanitarios, los cuales se consideran de la misma manera que el resto de actividades profesionales. Dentro del uso sanitario, se incluirán, por ejemplo, los hospitales, las clínicas, las residencias de personas enfermas, los ambulatorios, los dispensarios, los centros de salud de atención primaria y preventiva, los PAC, los consultorios psiquiátricos, los laboratorios relacionados con la actividad sanitaria y, en general, cualquier tipo de centro de asistencia sanitaria.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">8. Recreativo y espectáculos: este uso se relaciona con las actividades vinculadas con el ocio, la vida de relación, el tiempo libre y el esparcimiento en general, y con las similares que no se incluyen en otros usos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Estas actividades se relacionan en el anexo del Reglamento general de policía y espectáculos públicos y actividades recreativas, como, por ejemplo, las salas de cine, los teatros, los café conciertos, las salas de conciertos, las salas de juegos, los casinos, los parques de atracciones, acuáticos, los jardines botánicos, acuarios, plazas de toros, los circos, las discotecas, las salas de baile, etc.</span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">9. Funerario: comprende los servicios que se llevan a cabo desde que se produce la muerte hasta el destino final, así como los servicios relacionados con la exhumación, esto es cementerios, tanatorios, crematorios y traslados.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Estas actividades se relacionan en el Decreto 11/2018, de 27 de abril, por el que se regula el ejercicio de la sanidad mortuoria de las Islas Baleares.</span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">10. Abastecimiento: comprende aquellas actividades ordenadas o reguladas por una administración pública consistentes en el abastecimiento de alimentos o productos de primera necesidad y destinados a la generalidad de la población. Edificaciones auxiliares</span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Los depósitos elevados, torres de refrigeración o de destilación, chimeneas, silos, ciclones y otras construcciones auxiliares necesarias para el correcto funcionamiento de las industrias tendrán una altura máxima libre en función de las necesidades, debidamente justificadas, de cada industria, instalación o edificación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Se permitirá la construcción de un cuerpo auxiliar destinado a ubicar las basuras en la zona de retranqueo y situado a una distancia inferior de 3,00 m. de la alineación de la fachada. La superficie máxima construida de este cuerpo será de 4,00 m2 y la altura total máxima de 2,40 m.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Toda edificación auxiliar no computará a efectos de ocupación ni edificabilidad. Se autorizará mediante licencia.</span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">La publicación de este acuerdo se hace en reserva de la aprobación del acta.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Contra este acuerdo, que agota la vía administrativa, se puede interponer recurso contencioso administrativo delante de la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Illes Balears, en el plazo de dos meses, contadores a partir del día siguiente a la publicación del presente acuerdo. Todo eso de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.
