text/html ![CDATA[<p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px">.</span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>RESOLUCIÓN DE ALCALDÍA</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">A la vista de los antecedentes siguientes:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Real Decreto Legislativo 6/2015 de 30 de octubre, por el que se aprueba el texto refundido de la Ley sobre Tráfico, Circulación de Vehículos a motor y Seguridad Vial, donde se atribuye a los municipios la competencia de regulación, gestión, vigilancia y disciplina del tráfico en las vías urbanas de titularidad municipal.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Ordenanza Municipal de la tasa para la autorización administrativa del estacionamiento de vehículos de tracción mecánica en los espacios públicos municipales (ORA), publicada en el BOIB n.º 122, el 9 de septiembre de 2014, donde se establece, en su artículo:</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>"Art. 2.3.- Las zonas de estacionamiento regulado podrán ser:</em></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>- ORA: Cuando se sujete al estacionamiento al previo pago del precio público establecido.</em></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>- ZAR: En los términos definidos por el artículo 16 de la presente Ordenanza, cuando se reserve el estacionamiento exclusivamente para los residentes, independientemente de que dicho régimen coexista, o no, con otros tipos de regulación de aparcamiento. </em>"</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Dado que la Entidad Pública Empresarial Sóller 2010 gestiona el servicio público de la ORA mediante encomienda de gestión aprobada por el Pleno del Ayuntamiento de Sóller en fecha 26 de noviembre de 2004.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Dado que todo el personal específico destinado a controladores ORA ha recibido la formación adecuada según la ordenanza municipal reguladora de la tasa para la autorización administrativa del estacionamiento de vehículos de tracción mecánica en los espacios públicos municipales (ORA).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">-Dado que el estacionamiento en zona regulada no implica el desconocimiento de las normas de circulación, ni el abono del precio público da derecho a no cumplir el resto de la normativa.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">De conformidad con la potestad reguladora de la administración municipal, de acuerdo a la Ley 7/1985, de 2 de abril, Reguladora de las bases de Régimen Local.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En consecuencia, <strong>RESUELVO</strong>:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>PRIMERO</strong>.- El control del estacionamiento en las zonas de estacionamiento regulado será llevado a cabo de manera directa por el personal de Sóller 2010, adscrito al servicio de controladores ORA.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>SEGUNDO</strong>.- Que en las zonas de estacionamiento regulado, que marca la Ordenanza ORA, puedan denunciar las infracciones incluidas en el artículo 13 de la misma Ordenanza, correspondientes a:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>1.- Estacionar sin exhibir el ticket.</em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>2.- Estacionar superando el tiempo autorizado según el ticket.</em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>3.- Estacionar colocando defectuosamente el ticket, de forma que no se permita su lectura desde el exterior del vehículo.</em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>4.- Estacionar colocando nuevo ticket, ocupando un estacionamiento situado a menos de 150 metros en el que se ha utilizado anteriormente, durante el periodo de los 30 minutos siguientes a la hora de finalización del tiempo máximo autorizado.</em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>5.- Estacionar exhibiendo comprobante horario o distintivo falsificados, manipulados o correspondientes a zonas o sectores distintos.</em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>6.- Estacionar exhibiendo distintivo en los siguientes supuestos:</em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>- Una vez transferida la propiedad del vehículo para el que se otorgó.</em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>- En vehículo distinto al autorizado</em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>- Con posterioridad al cambio de domicilio del titular del mismo.</em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>7.- Obtener el distintivo mediante el empadronamiento o transferencia del vehículo ficticios.</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>TERCERO</strong>.- El personal controlador del estacionamiento regulado irá vestido con uniformidad proporcionada por Sóller 2010 y con identificación, así como con piezas de alta visibilidad.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>CUARTO</strong>.- Los controladores del estacionamiento regulado tendrán asignado un distintivo identificativo que será el que figurará en el boletín de denuncias. Este distintivo se corresponde con la siguiente grafía: C000, donde C es invariable, 000 se corresponde al número de controlador, que se asigna de manera correlativa natural.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>QUINTO.-</strong> La relación actualizada, con detalle de la identificación del servicio de vigilancia del estacionamiento regulado, que no sean agentes de la autoridad, con expresión del nombre, apellidos, dirección, las tres últimas cifras de su NIF y letra, así como el número de identificación es la que figura en el punto sexto. En las notificaciones que se tramitan, en su caso, se hará constar el número de controlador y la referencia del presente BOIB.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
