    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;CONCESIÓN DE SUBVENCIÓN NOMINATIVA DEL CONSELL INSULAR DE FORMENTERA A LA SOCIEDAD DEPORTIVA FORMENTERA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Comisión de Govern del Consell Insular de Formentera, en sesión ordinaria de 9 de julio de 2021, &lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;celebrada de forma presencial y telemática,&lt;/span&gt;&lt;/span&gt; &lt;span style="background-color:white"&gt;&lt;span style="color:#333333"&gt;adoptó&lt;/span&gt;&lt;/span&gt;, entre otros, el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;(...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;PRIMERO. - APROBAR&lt;/strong&gt; el otorgamiento de subvención nominativa directa por el importe de 18.000€, a la S.D. Formentera con CIF G-&lt;span style="background-color:white"&gt;07447717,&lt;/span&gt; para la conmemoración del 50 aniversario &lt;sup&gt;&amp;nbsp;&lt;/sup&gt;&amp;nbsp;de la entidad deportiva y la organización de diferentes actos y eventos, que se adjunta como Anexo I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;segundo. &lt;/strong&gt;&lt;strong&gt;-&lt;/strong&gt; La gestión de la subvención se llevará a cabo de acuerdo con la firma del convenio anexo a la propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;TERCERO. -&lt;/strong&gt;&lt;strong&gt; AUTORIZAR Y DISPONER EL GASTO &lt;/strong&gt;con cargo a la partida presupuestaria 2021.1.341.48000 de los presupuestos para el año 2021.Se cumple el Plan Estratégico de Subvenciones para 2020-2021, según acuerdo del Pleno del Consell, de fecha 30 de abril de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;CUARTO. -&lt;/strong&gt;&lt;strong&gt; RECONOCER&lt;/strong&gt; la obligación del importe concedido del 50%, ordenar el pago del 50% de la subvención por valor de 9.000€ y registrar la operación como pendiente de justificar hasta que el beneficiario no proceda a la justificación de la misma de acuerdo con las normas de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;QUINTO. &lt;/strong&gt;&lt;strong&gt;-FACULTAR &lt;/strong&gt;a la señora Presidenta del Consell Insular de Formentera, para que una vez aprobada esta subvención de concesión nominativa directa, pueda firmar el convenio anexo, tal y como establece el artículo 9.2.&lt;em&gt;q&lt;/em&gt; de la Ley 8/2000, de 27 de octubre, de consell insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;SEXTO. -&lt;/strong&gt;&lt;strong&gt; GUARDAR&lt;/strong&gt; copia del presente convenio en el Registro de Convenios que se encuentra en la Secretaría de la Corporación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;SÉPTIMA. -&lt;/strong&gt;&lt;strong&gt; NOTIFICAR&lt;/strong&gt; este acuerdo a la S.D. Formentera&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;OCTAVA. -&lt;/strong&gt;&lt;strong&gt; PUBLICAR&lt;/strong&gt; el Convenio en BOIB y en la página web del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ANEXO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Convenio de colaboración entre el Consell Insular de Formentera y la Sociedad Deportiva Formentera para la realización de diversos actos y eventos deportivos y sociales para conmemorar el 50 aniversario de la SD Formentera&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Reunidos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por un lado, la señora Alejandra Ferrer Kirschbaum, mayor de edad, vecina de Formentera, domiciliada en la Plaza de la Constitución núm. 1 en Formentera, con Documento Nacional de Identidad núm. ***5625**. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Sr. Antoni Roig Torres, mayor de edad, con Documento Nacional de Identidad núm. ***5675**, vecino de Formentera y domicilio a efectos de comunicación a Venda des Pi des Català, 2777, Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Intervienen&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Sra. Alejandra Ferrer Kirschbaum, como presidenta del Consell Insular de Formentera, actuando en nombre y representación de esta Corporación, con CIF P0702400C y domiciliada en La Plaza de la Constitución núm. 1, de Sant Francesc Xavier (Formentera), en virtud del Acto del Pleno del Consell Insular de Formentera de fecha 15 de junio de 2019, de acuerdo con el artículo 136 del Reglamento Orgánico del Consell Insular de Formentera (ROC) y en virtud del artículo 21.1.b) de la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local, de la Ley Orgánica 5/1985, de 19 de junio, de régimen electoral general y del artículo 9 de la Ley 8/2000, de 27 de octubre, de consells insulares, , asistido por el secretario accidental de la Corporación, el Sr. Joan Ferrer Yern&lt;span style="color:red"&gt;, &lt;/span&gt;de conformidad con el artículo 161 de la ROC. El presente convenio fue autorizado por acuerdo de la Comisión de Govern de 9 de julio de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Sr. Antoni Roig Torres, presidente de la S.D. Formentera, que actúa en nombre y representación de esta última, con NIF G-07447717, y con domicilio a efectos de notificación a la Venta de Pi des Català, 2777 Formentera, en virtud del Acta de la Asamblea General Extraordinaria de socios de la Sociedad Deportiva Formentera, núm. 2020/01 celebrada en fecha 12 de julio del 2020.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Ambas partes actúan en representación de sus respectivas entidades, se reconocen mutuamente plena capacidad jurídica para obrar, y,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Manifiestan&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1) Que el próximo 7 de septiembre de 2021 se cumplirán 50 años de la fundación de SD Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2) Que la Junta Directiva del Club, en sesión ordinaria, el pasado 21 de julio de 2020, decidió encargar al área social de nuestra entidad la creación de una Comisión del 50 Aniversario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3) Que el pasado 17 de septiembre de 2020 se llevó a cabo el acta de constitución de esta Comisión que acordó que, entre otras, trabajaría para:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Organizar un programa de actos para conmemorar el 50 aniversario del Club.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Promover la recuperación y el archivo de documentación de la historia de SD Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Dignificar y reconocer a las personas y entidades que han jugado un papel decisivo en la promoción del fútbol en Formentera&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Y colaborar y promover acuerdos con instituciones y otras entidades que faciliten el logro de estos objetivos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4) Que desde el Consejo se ha manifestado a prestar apoyo logístico, material y económico para que se puedan llevar a cabo los eventos para la conmemoración del 50 aniversario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En virtud de lo expuesto anteriormente, ambas partes acuerdan formalizar el presente convenio, de acuerdo con las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Cláusulas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;1. Objeto del convenio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El objeto de este convenio es regular una subvención por procedimiento de concesión directa, estableciendo los términos y las condiciones de la colaboración entre el CIF y la Sociedad Deportiva Formentera (SD Formentera) para la conmemoración del 50 aniversario de la entidad deportiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;2. Actuaciones subvencionables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La organización de los actos para la conmemoración del 50 aniversario será responsabilidad de la SD Formentera, a través de los mecanismos adecuados, con la colaboración del CIF, mediante la firma del presente Convenio de colaboración, y sin perjuicio de otras instituciones y/o asociaciones que puedan colaborar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La propuesta de los actos deportivos y sociales aprobados por la junta directiva de SD Formentera, y que serían objeto de ser subvencionables, se detallan a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Homenajes a los presidentes de la entidad, a antiguos jugadores y a trabajadores del club&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Partido amistoso del primer equipo como uno de los actos centrales de la celebración&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Realización de un documental sobre la historia de la entidad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Ciclo de charlas y mesas redondas divulgativas de la historia del fútbol en Formentera&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Exposición sobre la historia del fútbol en Formentera&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Actividades para niños y niñas&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Acto de fútbol femenino&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Fiesta conmemorativa como uno de los actos centrales de la celebración.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los actos están previstos desde septiembre de 2021 hasta las fiestas navideñas de 2021, siempre en función de la evolución de la crisis sanitaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La SD Formentera se compromete a realizar las actividades objeto del presente convenio, haciendo constancia la colaboración del CIF con la imagen corporativa correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;3. Obligaciones del Consell Insular de Formentera&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Teniendo en cuenta el coste económico que supone a la SD Formentera la realización de las actividades descritas, y teniendo en cuenta su interés deportivo y social de las mismas para la isla de Formentera, el CIF colaborará económicamente en las actividades detalladas en la cláusula 2 de este Convenio con la aportación máxima de 18.000 euros, con cargo a la partida presupuestaria 2021.1.341.48000 de los presupuestos generales del Consell Insular de Formentera, para el año 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El pago de la cantidad fijada se abonará en dos partes. El 50% en el momento de la firma del convenio, y el 50% pendiente se pagará en septiembre, previo un informe desde el área de Deportes sobre el correcto desarrollo de las acciones objeto del convenio. La justificación del 100% de la subvención concedida se realizará antes del 31 de diciembre de 2021 y será un requisito ineludible.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Asimismo, el Consell Insular de Formentera colaborará desde el Archivo de imagen y sonido con soporte logístico y material para el archivo, conservación y divulgación de documentos gráficos (vídeos, fotografías, etc.) que tengan interés histórico y desde las diferentes áreas de la institución se colaborará con el soporte logístico para el resto de los actos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;4. Obligaciones de SD Formentera&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En cumplimiento de lo dispuesto en el artículo 11 del Decreto Legislativo 2/2005, de 28 de diciembre, texto refundido de la Ley de Subvenciones de las Illes Balears, la SD Formentera queda sometida, entre otras, a las siguientes obligaciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Llevar a cabo la actividad o la inversión o adoptar el comportamiento que fomente la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Presentar, antes del 31 de diciembre de 2021, los documentos que acrediten la justificación de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Someterse a las actuaciones de comprobación que llevan a cabo los órganos competentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Notificar al Consell cualquier modificación que se pretenda realizar en el proyecto inicialmente presentado, en relación con las actuaciones subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Hacer constar de forma clara en los carteles, convocatorias de actividades y en toda la información gráfica, escrita y sonora que se realice con motivo de las actividades subvencionables, que la actividad está subvencionada o patrocinada por el Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Dejar constancia de la percepción y la aplicación de la subvención en los libros de contabilidad o en los libros de registro que el beneficiario debe llevar de acuerdo con la legislación mercantil o fiscal que sea aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Conservar los documentos justificativos de aplicación de los fondos recibidos mientras puedan ser objeto de actuaciones de comprobación y control.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Reintegrar los fondos percibidos en los supuestos previstos en el artículo 44 de esta ley.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;5. Concordancia con otras subvenciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La SD Formentera deberá informar al Consell Insular de Formentera, a través del órgano competente en la materia, la subvención o subvenciones que reciba para la misma finalidad. En esta comunicación hará constar el dinero obtenido, así como todas las condiciones aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En ningún caso el importe total de las subvenciones podrá superar el coste total de la actividad, ya que, de ser así, la subvención concedida por esta Corporación se reducirá proporcionalmente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;6. Justificación de la subvención&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La fecha máxima de justificación por parte de SD Formentera será el 31 de diciembre de 2021. Los fondos percibidos deben destinarse a actuaciones y programas que se lleven a cabo de acuerdo con la cláusula 2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La documentación que deberá aportar es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Acreditación de estar al corriente de pago de todas las obligaciones tributarias y delante de la seguridad social, o autorización a favor del CIF, para que pueda solicitar los certificados necesarios delante del Ministerio de Economía y Hacienda y el Departamento de Economía y Hacienda de la Comunidad Autónoma Balear.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Presupuesto de ingresos y gastos realizados, en el que deberá incluir la cuenta justificativa de gastos que de conformidad con lo establecido en el artículo 72 del Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, General de Subvenciones, contendrá la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Una relación clasificada de los gastos, con identificación del acreedor y del documento que acredite el gasto, su fecha de emisión, su importe y su fecha de pago.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Las facturas o documentos de valor probatorio equivalente en el tráfico jurídico mercantil o con eficacia administrativa incorporados en la relación a que se refiere el párrafo anterior y la documentación acreditativa del pago.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Una relación detallada de otros ingresos o subvenciones que hayan financiado actuaciones del programa, indicando su importe y su procedencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Una memoria justificativa simplificada y una relación de las actividades realizadas incluidas que acrediten que efectivamente se ha realizado la actividad subvencionable. Se adjuntará un ejemplar de las publicaciones, los folletos o la propaganda que se haya realizado para difundir la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;strong&gt;7. Reintegro de la subvención&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Se establece la obligación por parte de SD Formentera de reintegrar los fondos en el supuesto de incumplimiento de los requisitos y obligaciones establecidos para la concesión y, en todo caso, en los supuestos regulados en el artículo 44 del Decreto Legislativo 2/2005, de 28 de diciembre, texto refundido de la ley de subvenciones de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Además, el CIF se reserva el derecho de disminuir proporcionalmente su aportación, en caso de incumplimiento parcial del Convenio, o en el caso de que los gastos justificados no alcancen el total de gastos presupuestados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;8. Vigencia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Este convenio está en vigor desde el día de su firma hasta el 31 de diciembre de 2021, teniendo efectos retroactivos respecto de las actividades objeto de este acuerdo, a partir del 1 de enero de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Este convenio podrá resolverse, con audiencia previa de las partes, entre otras, por las causas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. El mutuo acuerdo entre las partes, que deberá formalizarse por escrito.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. El incumplimiento de las normativas de aplicación y/o pactos establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. No llevar a cabo la prestación de las actividades objeto del presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En el caso de que la resolución del acuerdo sea por incumplimiento por parte de SD Formentera, deberá devolver todas las cantidades económicas percibidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;9. Fuerza Mayor&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;No se considerará incumplimiento de lo establecido en el presente convenio, la suspensión de actividades objeto de subvención, con motivo de fuerza mayor, y/o en cumplimiento de las medidas adoptadas por la autoridad competente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Se entiende fuerza mayor, a los efectos del presente convenio, cualquier circunstancia imprevisible e inevitable que afecte al cumplimiento de las obligaciones asumidas por parte de la SD Formentera; como, por ejemplo: eventos naturales extraordinarios como inundaciones, terremotos, situaciones epidémicas y pandemias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;10. Procedimiento de otorgamiento de la subvención y naturaleza del presente convenio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El presente convenio tiene naturaleza administrativa y constituye el instrumento a través del cual se canaliza una subvención por el procedimiento de concesión directa previsto en el artículo 7.1 c) del Decreto Legislativo 2/2005, de 28 de diciembre, texto refundido de la ley de subvenciones de las Illes Balears, y en el artículo 22.2 c) de la Ley 38/2003, de 17 de noviembre, general de subvenciones, porque se acreditan razones de interés público, social, económica o humanitaria que dificultan su convocatoria pública, de acuerdo con los informes que consten en el área de Deportes del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;11. Normativa aplicable&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En lo no previsto en el presente convenio, será necesario ajustarse a lo dispuesto en las bases de ejecución del presupuesto general del Consell Insular de Formentera para 2020, al Decreto legislativo 2/2005, de 28 de diciembre, texto refundido de la Ley de Subvenciones de las Illes Balears, a la Ley 38/2003, de 17 de noviembre, General de Subvenciones y al Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones y al Presupuesto vigente del Consell Insular de Formentera para el año 2020 (BOIB núm. 14, de 1 de febrero de 2020), de acuerdo con lo establecido en el artículo 8 de la Ley 38/2003 , de 17 de noviembre, general de subvenciones , y los artículos 10 y siguientes de su Reglamento, así como, habida cuenta de lo dispuesto en el artículo 6 y concordantes del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto Refundido de la Ley de Subvenciones, aplicable a las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Está recogido en el acuerdo del Pleno del Consell Insular de 30 de abril de 2021 por el cual se modificó el Plan estratégico de subvenciones para los años 2020-2021 del Consell Insular de Formentera, a propósito de incluir una línea de soporte a la celebración del 50 aniversario de la Sociedad Deportiva Formentera (en siglas, SD Formentera), mediante concesión directa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Y en prueba de conformidad, ambas partes firman este convenio de colaboración por duplicado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
