    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 13 de noviembre de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para las Inversiones no productivas vinculadas a la realización de los compromisos agroambientales y clima, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia agraria del FOGAIBA, con fecha 23&amp;nbsp;de junio&amp;nbsp;de 2021, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 17 de noviembre de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 169, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan subvenciones para las inversiones no productivas vinculadas a la realización de compromisos de agroambient y clima, correspondientes al año 2015 2019.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.De conformidad con el apartado sexto de la Resolución mencionada, el plazo para presentar las solicitudes terminó el día 31 de diciembre de 2016.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Con las fechas que figuran en el anexo I se notificaron las Resoluciones de concesión a los distintos beneficiarios que figuran en dicho anexo. Con el importe concedido y con las obligaciones y compromisos que debían cumplir.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. El apartado duodécimo de la Resolución de la convocatoria establece las obligaciones del beneficiario.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. A fecha de hoy, los beneficiarios que figuran en el anexo I no han justificado las inversiones objeto de la subvención por el motivo que se refleja en el mencionado anexo, por lo que la inversión no puede ser objeto de subvención .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas establece la obligación de la Administración a dictar resolución expresa y a notificarla. En su párrafo segundo especifica que "En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con la indicación de los hechos producidos y las normas aplicables ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago, y una vez realizada la inspección final, se comprueba, que el cierre con malla ganadera llevado a cabo, no es auxiliable, de acuerdo con l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;os&amp;nbsp;apartados 4.1 y 4.2 donde especifican los requisitos de las inversiones auxiliables (no están permitidas las varillas de hierro).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9.Por todo ello, se propone hacer la revocación total a causa del incumplimiento de la obligación de realizar y justificar las inversiones concedidas en el plazo establecido.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10. En relación a las fechas del Anexo I se notifica, mediante publicación en la página web http://www.caib.es, dicha propuesta a los interesados, concediéndoles un plazo de 10 días para presentar las alegaciones oportunas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;11. A día de hoy, y una vez finalizado el plazo, los interesados relacionados en el anexo I adjunto o bien no han presentado alegaciones, o bien no han acreditado que las actuaciones se realizaron dentro de plazo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la Comunidad Autónoma de las Islas Baleares, publicado en el BOIB núm. 82 de 31 de mayo; en virtud de la Orden de la Consejera de Agricultura y Pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;16. Ley 30/1992, de 26 de noviembre de régimen jurídico de las administraciones públicas y del procedimiento administrativo común y la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;17. Ley 39/2015 de 1 de octubre del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;· Dado el apartado 4&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y 4.2, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;establece los requisitos que deben cumplirse para ser inversiones subvencionables&lt;/em&gt;&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Conclusión&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo lo expuesto anteriormente,&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;el incumplimiento de los apartados &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;4&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.1, y &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;4&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2, implica la posibilidad de revocar la ayuda otorgada a los interesados mediante las resoluciones de concesión detalladas en el Anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Informe - Propuesta de revocación&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Se informa desfavorablemente y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Procedir a revocar totalmente las resoluciones de ayuda concedidas a los beneficiarios por los importes y con los plazos al anexo siguiente:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;a) Anexo I (anualidad 2021), que son un total de 1 expediente, que corresponde a TOMÁS &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ANTONI&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;O GARCIAS MANRESA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, que suma un importe total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;763&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;20&amp;nbsp;€ y con la siguiente distribución:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Dejar sin efecto dichas resoluciones de concesión y proceder a archivar los expedientes que figuran en el anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Notificar esta resolución a los interesados.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Contra esta Resolución se podrá interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con lo que se establece en el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y en los artículos 121 y 122 de la Ley 39/2015 , de 1 de octubre, de régimen jurídico de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
