    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Junta de Gobierno Local del Ayuntamiento de Son Servera, en la sesión ordinaria de 14 de julio de 2021, adoptó el acuerdo que sigue:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;"Expediente núm. .: 2448/2021&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Procedimiento: Propuesta de aprobación de la concesión directa y a fondo perdido de ayudas para paliar los efectos del &amp;nbsp;Covid-19 en los sectores económicos del término municipal de Son Servera&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el acuerdo de 10 marzo de 2021 del Consejo Ejecutivo del Consell de Mallorca referente a la concesión de subvenciones de la convocatoria 2021 dirigida a los ayuntamientos de Mallorca para paliar las consecuencias de las restricciones motivadas por la crisis sanitaria del Covid-19 en los sectores económicos con RGE 2021-E-RC-1949 de 25 de marzo de 2021, el cual fue publicado en el BOIB núm. 36, de 16 de marzo de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el Convenio de colaboración entre la Administración de la Comunidad Autónoma de las Islas Baleares y el Ayuntamiento de Son Servera para conceder ayudas dirigidas a paliar las consecuencias de las restricciones motivadas por la crisis sanitaria del Covid-19 en los sectores económicos, formalizado en fecha 18 de marzo de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el informe jurídico sobre la legislación aplicable y procedimiento a seguir emitido por la secretaría accidental el 26 de abril de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el acuerdo de Pleno, en sesión ordinaria y urgente de 28 de abril de 2021, mediante el que se aprueban las bases reguladoras y la convocatoria del procedimiento de concesión directa y a fondo perdido de ayudas para paliar los efectos del Covid-19 en los sectores económicos del término municipal de Son Servera, y se publicaron en el BOIB núm. 58 de 4 de mayo de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista la propuesta del órgano competente para ordenar e instruir el procedimiento de 14 de julio de 2021, donde se propone a la Junta de Gobierno Local aprobó la concesión directa y a fondo perdido de ayudas para paliar los efectos del Covid-19 en los sectores económicos del término municipal de Son Servera, con relación a 11 solicitudes y desestimar 2 solicitud de concesión de la ayuda por incumplimiento de los requisitos necesarios para acceder a la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el informe favorable emitido por la interventora de fecha 14 de julio de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En virtud del artículo 24.4 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, y de acuerdo con el artículo 8.4 de las bases reguladoras y la convocatoria del procedimiento de concesión directa y a fondo perdido de ayudas para paliar los efectos del Covid-19 en los sectores económicos del término municipal de Son Servera,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Junta de Gobierno Local, de acuerdo con el Decreto 2019-0907 de atribución de competencias, acuerda por unanimidad: &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMERO.&lt;/strong&gt; Aprobar la concesión directa y a fondo perdido de ayudas para paliar los efectos del Covid-19 en los sectores económicos del término municipal de Son Servera, con relación a las solicitudes que figuran a continuación, por el importe que se indica:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGUNDO&lt;/strong&gt;. Reconocer el gasto y pago de la cuantía de 24.000 euros con cargo a la aplicación presupuestaria 2021/4310/47902.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERCER. &lt;/strong&gt;De acuerdo con el artículo 10 de las bases reguladoras y la convocatoria del procedimiento de concesión directa y a fondo perdido de ayudas para paliar los efectos del Covid-19 en los sectores económicos del término municipal de Son Servera, las personas beneficiarias estarán sujetos a las obligaciones siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Someterse a las actuaciones de comprobación a efectuar por el órgano que concede la ayuda y cualquier otra comprobación o control financiero que pueden llevar a cabo los órganos de control competentes, tanto nacionales como comunitarios, aportando toda la documentación que le requieran en el ejercicio de las actuaciones anteriores.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Mantener de alta en el censo de empresarios de la Agencia Estatal de la Administración Tributaria, durante un mínimo de 3 meses en el ejercicio 2021 en contar desde la concesión de la ayuda.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Estar al corriente de obligaciones tributarias con la Agencia Estatal de la Administración Tributaria y con el Ayuntamiento de Son Servera, y también al corriente de obligaciones económicas con la Seguridad Social o Mutua profesional correspondiente.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Conservar los documentos que demuestran que cumple los requisitos para ser beneficiaria de la ayuda durante un periodo de cuatro años desde que se ha concedido la ayuda.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) Proceder al reintegro en los casos previstos en esta convocatoria y la normativa aplicable.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f) Disponer de los libros contables, registros diligenciados y demás documentos debidamente auditados en los términos exigidos por la legislación mercantil y sectorial aplicable al beneficiario en cada caso, con el fin de garantizar el adecuado ejercicio de las facultades de comprobación y control.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CUARTO&lt;/strong&gt;. Desestimar las solicitudes de concesión de la ayuda formulada por los solicitantes que figuran a continuación:&lt;/span&gt;&lt;/p&gt;

Todo ello, de conformidad con lo dispuesto en el artículo 52.1 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local; los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y los artículos 8.1, 25.1 y 46.1 de la Ley 29/1988, de 13 de julio, reguladora de la jurisdicción contencioso administrativa, sin perjuicio que se pueda interponer cualquier otro recurso que se considere pertinente. &lt;/span&gt;&lt;/p&gt;
