El 23 de marzo de 2021 (NRE GOIBE68454 / 2021), la Sra Katerine Verónica Schutz, como representante de la entidad Happy Faces Kinder Balear, SL solicitó la modificación de la configuración del CDE Happy Faces Kinder Balear SL con Código de centro 07015252, con la siguiente solicitud: 1 unidad de 3 a 4 años, 1 unidad de 4 a 5 años y 1 unidad de 5 a 6 años. Justificó su petición para tener el ciclo completo de educación infantil. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El día 7 de julio de 2021, la representante del centro presentó el certificado que acredita el British Council. Este certificado autoriza el centro para impartir desde Nursery (de 3 a 4 años) hasta Year 2 (de 6 a 7 años).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. El 15 de julio de 2021, la jefa del Departamento de Planificación y Centros emitió un informe favorable de la modificación de la configuración del centro docente extranjero Happy Faces Kinder, con una unidad de 3 a 4 años, una unidad de 4 a 5 años y una unidad de 5 a 6 años. No se ha solicitado ningún informe técnico porque el centro no ha solicitado ningún aumento del número de unidades y fue autorizado dentro de los 10 últimos años&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. El 16 de julio de 2021, el director general de Planificación, Ordenación y Centros propuso la autorización de la modificación de la configuración del centro docente extranjero de educación infantil de segundo ciclo Happy Faces Kinder, con la transformación de una unidad de 3 a 4 años en una unidad de 5 a 6 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Ley Orgánica 8/1985, de 3 de julio, reguladora del Derecho a la Educación (BOE núm. 159, de 4 de julio).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Ley Orgánica 2/2006, de 3 de mayo, de Educación (BOE núm. 106, de 4 de mayo), modificada por la Ley Orgánica 3/2020, de 29 de diciembre (BOE núm. 340, de 30 de diciembre).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 44, de 3 de abril). &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Real Decreto 332/1992, de 3 de abril, sobre autorizaciones de centros docentes privados para impartir enseñanzas de régimen general no universitarias (BOE núm. 86, de 9 de abril), modificado por el Real Decreto 131/2010 , de 12 de febrero (BOE núm. 62, de 12 de marzo). &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El Real Decreto 806/1993, de 28 de mayo, sobre régimen de centros docentes extranjeros en España (BOE núm. 149, de 23 de junio), modificado por el Real Decreto 131/2010, de 12 de febrero.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El Estatuto de autonomía de las Islas Baleares, reformado por la Ley Orgánica 1/2007, de 28 de febrero (BOE núm. 52, de 1 de marzo), el cual establece, en el artículo 36.2, que , en materia de enseñanza, corresponde a la Comunidad Autónoma de las Islas Baleares la competencia de desarrollo legislativo y de ejecución de la enseñanza en toda su extensión, niveles y grados, modalidades y especialidades.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El Decreto 25/2021, de 8 de marzo, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares ( BOIB núm. 33, de 9 de marzo). &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, y de acuerdo con la propuesta formulada por la Dirección General de Planificación, Ordenación y Centros en fecha 16 de julio de 2021, dicto la siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Autorizar, con efectos desde el inicio del curso escolar 2021-2022, la modificación de la configuración del centro docente extranjero de segundo ciclo Happy Faces Kinder del sistema educativo británico, con la transformación de una unidad de 3- 4 años en una unidad de 5-6 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Determinar que, como consecuencia de esta autorización, el centro queda configurado de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Educación y Formación Profesional en el plazo de un mes contador desde el día siguiente de su publicación en el BOIB, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También se puede interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contadores desde el día siguiente de su publicación en el BOIB, de acuerdo con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa.&lt;/span&gt;&lt;/p&gt;
