    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Acuerdo del Consejo Ejecutivo del Consejo Insular de Ibiza de aprobación de la convocatoria y las bases que regulan la concesión de ayudas correspondientes en 2021 del Consejo Insular de Ibiza para los titulares de licencias municipales de taxi en la isla de Ibiza, para la adquisición de desfibriladores semiautomáticos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El Consejo Ejecutivo del Consejo Insular de Ibiza, en sesión ordinaria de fecha 2 de julio de 2021, aprobó por unanimidad el acuerdo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;“(...)&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;PRIMERO. &lt;/strong&gt;Aprobar las bases que tienen que regir la concesión de ayudas para los titulares de licencias municipales de taxi en la isla de Ibiza para la adquisición de desfibriladores externos semiautomáticos por sus vehículos auto-taxi que se adjuntan en anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;SEGUNDO. &lt;/strong&gt;Aprobar, simultáneamente, la convocatoria correspondiente a 2021, que se regirá por las bases a que se ha hecho referencia en el punto anterior de acuerdo con las condiciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;a) Aprobación del gasto por el importe global máximo de las ayudas y crédito presupuestario. Las ayudas concedidas serán atendidas con cargo a la partida presupuestaria y con el importe máximo que se indican más abajo, sin perjuicio de que el importe pueda ser ampliado de acuerdo con las disponibilidades presupuestarias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;b) El plazo de presentación de solicitudes será de quince días hábiles contador a partir del día siguiente a aquel en que se publique el extracto de esta convocatoria en el &lt;em&gt;Boletín Oficial de las Islas Baleares &lt;/em&gt;(BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;c) El importe máximo de la subvención por solicitud es de &lt;strong&gt;2.000 euros por dispositivo (2.000,00 €).&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;TERCERO. &lt;/strong&gt;Comunicar esta resolución a la Base de datos Nacional de Subvenciones previamente en la publicación de la convocatoria en el Boletín Oficial de las Islas Baleares (BOIB)."&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;BASES QUE REGULAN LA CONCESIÓN DE AYUDAS DEL CONSEJO INSULAR DE IBIZA PARA LOS TITULARES DE LICENCIAS MUNICIPALES DE TAXI EN LA ISLA DE IBIZA PARA LA ADQUISICIÓN DE DESFIBRILADORES EXTERNOS SEMIAUTOMÁTICOS PARA SUS VEHÍCULOS AUTO-TAXI.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;PRIMERA. OBJETO DE LAS AYUDAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El objetivo de estas ayudas es subvencionar la instalación de &lt;strong&gt;desfibriladores externos semiautomáticos&lt;/strong&gt;, &lt;strong&gt;DESA &lt;/strong&gt;de ahora en adelante, a vehículos de auto-taxi de titulares de licencia municipal que se encuentren en posesión de la correspondiente habilitación para su uso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;SEGUNDA. FINALIDAD DE LAS AYUDAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;La finalidad de estas ayudas es que el transporte público discrecional de viajeros en vehículos de auto-taxi se preste con los medios necesarios para proteger la salud de los usuarios, de los propios taxistas y de la ciudadanía en general con el fin de aumentar las tasas de supervivencia en supuestos de parada cardio-respiratoria de nuestros ciudadanos, de acuerdo con el previsto a la exposición de motivos del Decreto 137/2008 de 12 de diciembre, por el qué se regula el uso de desfibriladores externos semiautomáticos en centros no sanitarios de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;TERCERA. FINANCIACIÓN E IMPORTE MÁXIMO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El importe económico máximo de esta convocatoria es de SETENTA MIL euros (70.000,00 €). Las subvenciones se conceden con cargo en el presupuesto del Consejo Insular de Ibiza para el ejercicio 2021 y, concretamente, con cargo a la partida presupuestaria 4410.77000.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;CUARTA. GASTOS SUBVENCIONABLES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Serán gastos subvencionables las destinadas a la adquisición de desfibriladores semiautomáticos, DESA, con certificación CE y homologados por uso sanitario que se encuentren vinculados a la explotación de una autorización de transporte discrecional de viajeros en vehículos de turismo, VT, con residencia en la isla de Ibiza y en posesión de la correspondiente licencia municipal&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;QUINTA. COMPATIBILIDAD CON OTRAS AYUDAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Las ayudas que se otorguen de conformidad con estas bases son compatibles con la concesión otras ayudas, sin perjuicio de la obligación de las personas beneficiarias de comunicarlo al Consejo Insular de la forma establecida en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El importe de las ayudas que se concedan no puede superar, en ningún caso, de manera aislada o con concurrencia con otras ayudas, el coste de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;SEXTA. REQUISITOS DE LOS BENEFICIARIOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Podrán obtener la condición de beneficiarios de la subvención, los titulares de autorización de transporte público discrecional de viajeros en vehículos de turismo (auto-taxis) de la clase VT en la isla de Ibiza, que tengan el certificado o titulación en DESA y que hayan adquirido desfibriladores externos semiautomáticos desde el 1 de enero de 2021 con las siguientes características:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Certificación CE&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Homologación para uso sanitario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;No pueden ser beneficiarias de las subvenciones las personas, entidades o agrupaciones en que concurran alguna de las prohibiciones establecidas en el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;SÉPTIMA. PRESENTACIÓN DE LAS SOLICITUDES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Las solicitudes y toda la documentación requerida se tiene que presentar por el interesado en el plazo máximo de QUINCE días hábiles a partir del día siguiente de la publicación del extracto de esta convocatoria al BOIB, de manera presencial al Servicio de Atención al Ciudadano (OAC), telemáticamente al registro electrónico del Consejo Insular de Ibiza, o mediante cualquier de las formas previstas en el artículo de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;A la solicitud se tiene que adjuntar la documentación siguiente;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;DNI del beneficiario, titular de la autorización VT&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Acreditación de su residencia en la isla de Ibiza&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Acreditación de ser titular de autorización en vigor de transporte público discrecional de viajeros en vehículos de turismo (auto-taxis) de la clase VT en la isla de Ibiza&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Copia de la licencia municipal del taxi en vigor&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Declaración responsable de estar al corriente de las obligaciones tributarias y de la Seguridad Social, o autorización al Consejo Insular para efectuar las comprobaciones ante los organismos correspondientes. En el caso de no efectuar la mencionada autorización, el solicitante tendrá que presentar los certificados acreditativos antes de la propuesta de resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Certificado de capacitación para la utilización de un equipo DESA de acuerdo con el previsto al Decreto 137/2008, de 12 de diciembre por el cual se regula el uso de desfibriladores externos semiautomáticos en centros no sanitarios de las Islas Baleares, adquiridos a partir de 1 de enero de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Acreditación de la comunicación de la instalación del desfibrilador de acuerdo con el previsto al Decreto 137/2008 de 12 de diciembre, por el cual se regula el uso de desfibriladores externos semiautomáticos en centros no sanitarios de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Factura de compra del equipo DESA con acreditación de su pago y antigüedad no superior a 1 de enero de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Documentación técnica acreditativa de la marca, modelo, número de serie, y certificación del fabricante en relación a la homologación del equipo y su adecuación para un uso sanitario, en el términos recogidos al Decreto 137/2008, de 12 de diciembre, por el cual se regula el uso de desfibriladores externos semiautomáticos en centros no sanitarios de las Islas Baleares, y modificado por el Decreto 77 /2012, de 21 de septiembre, de simplificación administrativa y de modificación de varias disposiciones reglamentarias, para la transposición en las Islas Baleares de la Directiva 2006/123/CE, de 12 de diciembre de 2006, de servicios en el mercado interior&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;De acuerdo con el art. 28.3 y el art. 53c del LPACAP, las personas interesadas no tienen la obligación de presentar documentos originales, salvo que, con carácter excepcional, la normativa reguladora aplicable exija el contrario. En cualquier caso, las personas interesadas son responsables de la veracidad de los documentos que presenten (arte. 28.7 del LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Por el hecho de presentarse a esta convocatoria la persona interesada presta al CIE los consentimientos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

		&lt;li&gt;
		&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Para consultar y comprobar la veracidad de la documentación y de los datos presentados por el interesado que tengan en su poder otros administraciones públicas, principalmente mediante las plataformas de interoperabilidad, las redes corporativas u otros sistemas electrónicos habilitados a tal efecto y a los cuales el CIE tenga acceso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
		&lt;/li&gt;
		&lt;li&gt;
		&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Para consultar la existencia y veracidad de la documentación y de los datos que eventualmente el interesado haya considerado oportuno no presentar acogiéndose al derecho de no hacerlo por el hecho que hayan sido elaboradas por las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
		&lt;/li&gt;
	&lt;/ol&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Los mencionados consentimientos solo se considerarán otorgados cuando no conste en el expediente la oposición exprés a la mencionada consulta o cuando la ley especial que sea aplicable al caso requiera el consentimiento expreso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Si la solicitud o la documentación fueran incorrectas o incompletas, el Consejo Insular de Ibiza requerirá la enmienda. Si en el plazo de diez días hábiles, contados desde el día siguiente del día que se reciba el requerimiento de enmienda de la solicitud, la persona interesada no hace la rectificación reclamada o no presenta la documentación requerida, se entenderá que ceja en su petición en conformidad con el artículo 68 del LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;OCTAVA. DETERMINACIÓN DEL IMPORTE DE LA SUBVENCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Se concederá una cuantía máxima de 2.000,00 € por equipo DESA adscrito a una única licencia municipal. En ningún caso el importe de la subvención podrá superar el valor de compra de la equipación subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;NOVENA. PROCEDIMIENTO Y ÓRGANOS COMPETENTES PARA LA CONCESIÓN DE LAS AYUDAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Las ayudas se concederán de acuerdo con los principios de objetividad, transparencia, igualdad, no discriminación y publicidad, por medio del procedimiento de concurrencia competitiva, y se otorgan por orden de presentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El inicio del expediente se efectuará por medio de la aprobación de la convocatoria correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El texto de la convocatoria y el resto de documentación que se requiera se comunicará a la Base de datos Nacional de Subvenciones (de ahora en adelante BDNS) y se publicará el extracto de la convocatoria en el Boletín Oficial de las Islas Baleares, en cumplimiento del arte. 20.8 de la Ley General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;La instrucción corresponde al técnico jefe de servicio o funcionario en quien delegue del Departamento de Innovación, Transparencia, Participación y Transportes, que tiene que realizar de oficio todas las actuaciones necesarias para la determinación, el conocimiento y la comprobación de los datos en virtud de las cuales se tiene que dictar resolución sobre la concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Todas las solicitudes presentadas dentro del plazo establecido en la convocatoria se someterán al examen del/de la instructor/a de el expediente y se resolverán por orden de entrada de la documentación completa en este Consejo Insular, al Departamento de Innovación,Transparencia, Participación y Transportes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Una vez examinadas las solicitudes por el instructor, y después de que este haya emitido su informe, el consejero ejecutivo del Departamento de Innovación, Transparencia, Participación y Transportes elevará la correspondiente propuesta de resolución al órgano competente, que en este caso es el Consejo Ejecutivo del Consejo Insular de Ibiza, el cual dictará resolución sobre la concesión o denegación de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;La resolución del expediente de otorgamiento de las subvenciones tiene que ser expresa y motivada y tiene que fijar, con carácter definitivo, la cuantía específica de cada una de las subvenciones concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El plazo máximo para dictar y notificar la resolución expresa de concesión de la subvención será de seis meses contados desde el día que acabe el plazo de presentación de solicitudes. No obstante lo anterior, este plazo se podrá reducir si se establece expresamente en la convocatoria de las ayudas. El silencio administrativo tendrá carácter desestimatorio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;5. La resolución motivada del procedimiento se notificará mediante la publicación en la página web y el tablón de edictos de la sede electrónica del Consell Insular d'Eivissa ( https://seu.conselldeivissa.es).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Las ayudas concedidas se publicarán en la Base de datos Nacional de Subvenciones (BDNS) en cumplimiento del que se establece en la Ley 38/2003, de 17 de noviembre, general de subvenciones, con expresión de la convocatoria, del programa y crédito presupuestario al cual se imputan, beneficiaria, cantidad concedida y objetivo o finalidad de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;La resolución del expediente de concesión o denegación de las ayudas se remitirá a la BDNS en cumplimiento del arte. 20.8 del LGS y se publicará por el CIE en el Boletín Oficial de las Islas Baleares a efectos de notificación (arte. 45.1b del LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;DÉCIMA. CRITERIOS DE CONCESIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1. Las ayudas reguladas en esta convocatoria se concederán con sujeción a los principios de publicidad, concurrencia y objetividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;2. La concesión de estas ayudas se realizará en régimen de concurrencia competitiva, y se otorgarán por orden de presentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;UNDÉCIMA. ABONO DE LAS AYUDAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El pago se realizará mediante un pago único por transferencia bancaria y al número de cuenta que conste al impreso presentado junto con la solicitud, una vez sea definitivo el Acuerdo del Consejo Ejecutivo que se adoptará a tal efecto y se publicará en la sede electrónica del Consejo Insular de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;De acuerdo con lo establecido en el artículo 20 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, las subvenciones concedidas serán comunicadas a la Base de datos Nacional de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;En los casos de aquellas facturas que hayan recibido otras subvenciones, se tendrán que identificar en la instancia de solicitud, con indicación del importe de la factura y qué es la parte subvencionada por la entidad que corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Para el pago de la subvención, se podrá solicitar cualquier otra documentación o informes técnicos que los servicios del Consejo Insular de Ibiza consideren adecuadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;DUODECIMA . COMPATIBILIDAD CON OTRAS AYUDAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1. Estas ayudas serán compatibles con cualquier otra que con el mismo objeto pudiera recibir la persona solicitante, sin perjuicio de lo que se establece en el apartado siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;2. El importe conjunto de las ayudas, subvenciones o recursos públicos que con este objeto pudiera recibir la persona solicitante no podrá superar el precio de adquisición del bien objeto de la ayuda. En el supuesto de que así fuera, se procedería a reintegrar la cantidad que exceda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;3. Las personas beneficiarias tendrán que comunicar a esta Administración, en los términos que se reflejen en los modelos de solicitud, la percepción otras subvenciones o ayudas que hayan podido percibir con el mismo objeto, cuando sean conocedoras de su concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;DECIMOTERCERA.CONTROL Y REINTEGRO DE LAS SUBVENCIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1. El Departamento de Innovación, Transparencia, Participación y Transportes velará por el cumplimiento de lo que se establece en esta convocatoria, así como respecto al logro de los objetivos a los cuales se dirige este programa de ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;2. Las personas beneficiarias de la subvención, quedan obligadas a facilitar el control de la subvención durante un plazo de dos años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;3. En el supuesto de que se detectaran incumplimientos en alguno de los aspectos a los cuales se refiere esta convocatoria, se iniciará expediente de reintegro de la subvención, incrementada en los correspondientes intereses legales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;4. El incumplimiento por parte de las personas beneficiarias de los requisitos y obligaciones que se establecen en esta convocatoria y en sus bases reguladoras, se someterá al régimen de infracciones y sanciones fijado en el título IV de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;5. A tal efecto se establecerá un plan de control en el desarrollo del cual se realizarán controles aleatorios, dirigidos al menos al 10% de las ayudas concedidas. Este muestreo se considera suficiente atendida la ausencia de riesgo y fraude por el hecho que la compra objeto de la subvención ya se ha efectuado con carácter previo y se requiere toda la documentación para acreditar la misma. Los controles serán administrativos y sobre el terreno y se comprobará el respecto de todas las condiciones fijadas en estas bases y en la convocatoria de ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;DECIMOCUARTA. OBLIGACIONES DE LOS BENEFICIARIOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Los beneficiarios tienen que cumplir las obligaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;a) El equipo llevará una etiqueta adhesiva con el logo de la campaña del Consejo Insular de Ibiza que los beneficiarios recogerán al Departamento de Transportes del Consejo Insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;b) No transmitir el objeto de la subvención a terceros en un plazo de 2 años. Durante este plazo tendrán que encontrarse sujetos a la plena disposición de la persona beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;c) Comunicar al Consejo Insular la aceptación de la subvención en los términos en que esta se conceda. La subvención se entenderá aceptada tácitamente una vez transcurridos quince días hábiles desde la notificación de la concesión de las ayudas en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;d) Justificar la realización de la actividad, como también el cumplimiento de los requisitos y las condiciones que determinan la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;e) Someterse a las actuaciones de comprobación y de control financiero que lleven a cabo los órganos competentes, y aportar toda la información que le sea requerida en el ejercicio de estas actuaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;f) Comunicar al Consejo Insular la solicitud o la obtención otras subvenciones para la misma finalidad. Esta comunicación se tiene que hacer dentro del plazo de tres días hábiles desde la solicitud o la obtención de la subvención concurrente y, en todo caso, antes de la justificación de la aplicación que se haya dado a los fondos percibidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;g) Acreditar, en la forma que se establezca reglamentariamente y antes de dictar la propuesta de resolución de concesión, que está al corriente de las obligaciones tributarias y de la Seguridad Social ante la Administración del Estado, y al corriente de obligaciones con la tesorería del Consejo Insular de Ibiza. La acreditación no será necesaria en el supuesto de que se haya autorizado expresamente el Consejo Insular a consultarlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;h) Dejar constancia de la percepción y la aplicación de la subvención en los libros de contabilidad o en los libros de registro que, si procede, tenga que llevar el beneficiario de acuerdo con la legislación mercantil o fiscal que le sea aplicable y, si procede, en las bases reguladoras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;y) Conservar los documentos justificativos de la aplicación de los fondos percibidos, incluidos los documentos electrónicos, mientras puedan ser objeto de actuaciones de comprobación y control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;j) Adoptar las medidas de difusión a que se refiere el apartado del artículo 34 del TRLS,. del texto refundido de la Ley de subvenciones (de las Islas Baleares), aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;k) Reintegrar los fondos percibidos en los supuestos previstos en el artículo 37 de la Ley 38/2003, de 17 de noviembre, general de subvenciones y en el artículo 44 del texto refundido de la Ley de subvenciones (de las Islas Baleares), aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;DECIMOQUINTA. REVOCACIÓN DE LAS AYUDAS Y REINTEGRO DE LAS AYUDAS CONCEDIDAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;En el caso de incumplimiento total o parcial de las obligaciones de los beneficiarios de estas ayudas se iniciará el correspondiente expediente de revocación y consiguiente reintegro, si corresponde. En cuanto a la revocación y el reintegro de las ayudas se aplicarán los artículos 24, 43 y 44 del TRLS, y el resto de normativa que sea aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Las cantidades que se tengan que reintegrar tendrán la consideración de ingresos de derecho público y los es aplicable la vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;La obligación de reintegro establecida en este artículo es independiente de las sanciones que por la naturaleza del incumplimiento puedan ser exigibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;DECIMOSEXTA. PUBLICIDAD&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Los vehículos adquiridos al amparo de esta convocatoria tendrán que llevar una pegatina con el logo del Consejo Insular y de esta acción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Esta pegatina será entregada en el Departamento de Innovación, Transparencia, Participación y Transportes del Consejo Insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;DECIMOSÉPTIMA. INFRACCIONES Y SANCIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El régimen de infracciones y sanciones administrativas aplicables es el que establece el título IV de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El órgano competente para imponer las sanciones que se deriven de infracciones del establecido en estas bases y de la normativa aplicable en materia de subvenciones es la Presidencia del Consejo Insular de Ibiza, en conformidad con el que establece el arte. 9 de la Ley 8/2000, de 28 de octubre, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;DECIMOCTAVA. OTRAS DISPOSICIONES Recursos administrativos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Los acuerdos del Consejo Ejecutivo por los cuales se aprueban las bases y las convocatorias y se conceden o deniegan las ayudas no agotan la vía administrativa y contra los mismos cabe presentar recurso de alzada ante la Comisión de Gobierno del Consejo Insular de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Normativa general aplicables&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Por todo lo expuesto,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
